To follow up on the discussions in connection with the 2008 budget, there is
included on the consent agenda a new representation agreement. This accomplishes the following
changes in my fee agreement with the Town:
1. The billing will be on the basis of a charge of $175 per hour, an increase from
$165. The increase reflects the increase in the consumer price index since I returned to work for
the Town in 2002 and set an hourly rate of $150.
2. The "pass-through" hourly rate will be raised from $275 to $300. This rate
reflects my rates to new private clients and will be used in circumstances when a third party has
agreed to reimburse the Town for legal fees. This is consistent with the practice in other
municipalities.

We pledge our best professional efforts in all matters which you entrust to us.
Our representation of the Town will be based on the hourly rates shown in the attached
schedule. In addition to our fees, you will be expected to pay all costs incurred by us on your
behalf. Such costs will include long distance telephone calls, photocopying, telecopying,
postage, and, where applicable, docket and filing fees, service of process fees, court reporter's
fees, expert witness fees, and other witness fees.
You will be billed each month for current charges (both fees and costs) and the
bill is due and payable upon receipt.
