referenced site (Site). The report has been prepared in general accordance with the ASTM

Based on the data obtained, this ESA has provided no evidence of recognized environmental
conditions existing at the Site.

1.0 INTRODUCTION AND SCOPE OF SERVICE
This report has been written to comply with the American Society of Testing and Materials
(ASTM) Phase I Site Assessment Standard E1527 -97.
This site assessment includes, in the following sections:
• A site description.
• A limited review of the historic use of the site and adjacent properties.
• A review of regulatory agency records and environmental databases.
• Conclusions.
Waste Engineering, Inc. (WEI) observed the site (Site) in the field on November 23, 1999.
2.0 SITE DESCRIPTION
The Site is irregularly shaped and consists of approximately 4 acres. The attached Site map
(Figure 1) depicts only the eastern 3.329 acres of the Site; a map of the remaining acreage was
not yet available at the time of this report. The Site's legal description is included with the
attachments of this report.
At the time of WEI's reconnaissance, the Site was not developed. Site vegetation included
willows, spruce, cottonwood, and native grasses & shrubs.
The Site's irregular northern and western boundaries are formed by the Eagle River and
undeveloped property. The Denver & Rio Grande Western Railroad is located further to the
north, approximately 300 feet from the Site's boundary. A private golf course is located
northwest of the Site, across the Eagle River. Highway 6 & 24 right -of -way forms the Site's
southern boundary. A residential condominium development borders the Site to the east.
Access to the Site is via Highway 6 & 24 and the condominium parking area located east of the
Site. An unimproved jeep trail traverses the eastern portion of the Site. The Site appears to
have been improved with underground utilities including a sewer line.
3.0 RECORDS REVIEW
3.1 Historical Use Information
Historical use information for the Site and adjoining properties was obtained by reviewing
reasonably ascertainable sources such as ownership information, aerial photographs, and
interviews.

F3.1.1 Ownership Information
WEI obtained Site ownership information from the Town of Avon records. A title search was
l J completed by the Town and the Eagle County Real Estate Records information was made
l J available to WEI. Based on the results of the title search, the Site is currently owned by the
Avon Ranch Company. The following is a summary of real estate transaction records involving
a
the Site.
The Avon Ranch Company (affiliated with Kelton, Garton & Associates) first acquired property
including the Site from S.G. Meyer and S.H. Van Gorden in 1981 (Book 332, page 416) and
1979 (Book 292, page 952) transactions, respectively. Meyer and Van Gorden acquired interests
in property including the Site from JoBeth Abrams in a December 1977 transaction (Reception
Fi No. 162226). The Abrams acquired property including the Site from Violet Montgomery in a
July 1969 transaction (Book 215, page 736). Ms. Montgomery purchased the property including
F",the Site from James and Lois McDaniels in May 1961 (Reception No. 94756). Mr. McDaniels'
parents, the Vosburghs, purchased a large tract of land including the Site from the Casto family
in August 1949 as recorded in Real Estate Record Book 135, page 64. The earliest record of
Site ownership included in the title search file is a February 1947 joint tenancy warranty deed
between the Castos and John L. Thomas (Book 133, page 159).
The ownership information did not reveal past owners of the Site whose company titles or
individual names suggest activities typically associated with the use, generation, storage, or
ndisposal of hazardous materials.

Review of available aerial photographs indicate two structures were located on the Site in 1981.

3.1.3 Historical Map Review
WEI requested Sanborn Fire Insurance Map coverage of the Site and adjacent areas from
Environmental Data Resources, Inc. (EDR) of Southport, Connecticut. According to EDR's
map database, there is no Sanborn coverage for the Site or adjacent properties. A copy of the
EDR Sanborn Map Coverage statement is included in the attachments of this report.
3.1.4 Historical Interviews
Interviews with persons familiar with the Site were conducted to obtain information pertinent
to the environmental evaluation of the Site.
! WEI conducted a telephone interview with Ms. Samantha Gale with the Avon Ranch Company,
current Site owner. According to Ms. Gale, the Site was undeveloped at the time of the Avon
Ranch Company's purchase in the late 1970's and no development has occurred on the Site since
their purchase. Ms. Gale was not familiar with the Site structures observed in the 1981 aerial
photograph. Ms. Gale stated there had been no use or storage of petroleum products on the Site
during the Avon Ranch Company's years of ownership. Ms. Gale stated that, to the best of her
knowledge, there were no pending, threatened, or past litigation, administrative proceedings or
governmental violation notices relevant to hazardous substances or petroleum products in, on,
or from the Site.
WEI was unable to locate previous owners of the Site based on area telephone book searches and
an Internet search. Ms. Gale stated she did not have address information available for previous
owners of the Site.
WEI contacted Ms. Janet Kohl with the Eagle County Environmental Health Department. Ms.
Kohl stated she was not aware of reported spill events of petroleum products or potentially
hazardous substances on or in the vicinity of the Site based on her 25 years of service with the
County.
3.1.5 Historical Summary
Review of historical information revealed no recognized environmental conditions associated
with the Site.
3.2 Physical Setting Information
L 3.2.1 Topography
The 1962 USGS Topographic Quadrangle Map (Figure 2) of Edwards, Colorado indicates the
Site ranges in elevation from approximately 7,320 to 7,400 feet. Surface water resulting from
storm events or snowmelt would generally flow to the north towards the Eagle River. The
Lf topographic map indicates a ditch traversing the southern portion of the Site. Highway 6 & 24

F borders the Site to the south and the Eagle River forms the Site's irregular northern, western,
and eastern boundaries. Adjacent properties appear undeveloped with the exception of the
Denver & Rio Grande Western Railroad, which is located to the north of the Site, across the
�! Eagle River.
The 1962 (photo- revised 1987) USGS Topographic Quadrangle Map (Figure 3) of Edwards,
Colorado does not depict development on the Site. Conditions on adjacent properties appear
similar to those noted on the 1962 topographic map.
3.2.2 Soil Conditions
Based on a review of the United States Department of Agriculture (USDA) publication "Soil
F Survey of the Aspen - Gypsum Area, Colorado," the predominant soil type identified at the Site
is the Coulterg loam, 12 -50 percent slopes. This soil unit typically occurs on mountain slopes
or fans and was derived primarily from siltstones, soft shales, and limestones. Permeability is
F moderate and hazard from water erosion is considered moderate to severe on steeper slopes.
The Soil Survey indicates that gypsum is commonly found in this soil unit.
3.2.3 Site Geology
According to the "Geologic Map of the Leadville 1 x 2 Degree Quadrangle, Colorado,"
compiled in 1978 by Tweto, et. al., surficial geology at the Site is dominated by unconsolidated
deposits including stream, terrace, and outwash gravels. Bedrock in the vicinity of the Site is
mapped as the Eagle Valley Evaporite, a thick formation including gypsum, anhydrite, siltstone,
-� and dolomite.
3.2.4 Regional Groundwater Conditions
Groundwater at the Site was not measured during WEI's reconnaissance of the Site. Based on
the proximity of the Eagle River to the Site, groundwater in the central portion of the Site is
expected to be found at elevations close to that of the Eagle river, an average of 20 to 40 feet
below ground surface.
3.3 Regulatory Review
LJ The purpose of the records review is to obtain and review reasonably ascertainable records that
will help identify recognized environmental conditions in connection with the Site. For this
review, records were obtained from Environmental Data Resources, Inc. (EDR) of Southport,
Connecticut. The EDR report is attached at the end of this report.
Our investigation included, but was not limited to, a review of the following lists prepared and
maintained by environmental regulatory agencies for the area around the subject Site. The most
recent list update completed by the respective agency in control is identified in the following
section.

No mapped locations were found in EDR's search of available government records on the Site
or on adjacent properties.
The EDR report indicates a list of orphan sites that were unmappable due to incomplete address
information (page 15). WEI has reviewed this list of orphan sites and the listings appear to be
beyond the required minimum search distance from the Site and are not considered recognized
environmental conditions in regard to the Site.
4.0 SITE INVESTIGATION
4.1 Site Observations
The Site and adjoining properties were visually observed on November 23, 1999 by WEI
personnel. Site photographs are included in this report.
4.1.1 Current Use of the Site
At the time of our reconnaissance, the Site was not developed.
4.1.2 Description of Specific Site Features
The Site was covered with approximately 4 to 6 inches of snow at the time of WEI's
reconnaissance.
�J WEI did not observe the storage or use of potentially hazardous materials on the Site. Chemical
odors, sumps, or pits were not identified around or near the Site suggesting a release event or
recognized environmental conditions.

An irrigation ditch channel parallels the Site's southern boundary. WEI observed an abandoned
sofa bed near the western boundary of the Site. WEI observed sewer line manholes traversing
the Site in a general southeast to northwest orientation. Remnants of camping sites were
observed along the river bank in the central portion of the Site including firewood, beer cans,
soup cans, and champagne bottles. Many of the tree trunks near the river bank were wrapped
in chicken wire. WEI observed scrap chicken wire on the ground near the trees.
4.2 Adjoining Property Observations
Adjoining properties were visually examined from public access right -of -ways to make a cursory
assessment of the current land use and its potential for recognized environmental conditions
which may have an impact on the Site. Reconnaissance of adjoining properties was performed
by viewing land use from legal boundaries or by walking upon the adjoining properties that were
legally accessible.
The Site is bordered to the east by residential condominium development that was partly under
construction at the time of WEI's Site visit.
1 ! Undeveloped land and Denver & Rio Grande Western Railroad right -of -way borders the Site to
the north, across the Eagle River. WEI observed a wooden camping structure and discarded
railroad ties on the undeveloped property.
The Arrowhead Golf Course is located northwest of the Site, across the Eagle River. A ditch
headgate appearing to be associated with the golf course was observed on the north bank of the
Eagle River. Scrap wood and a rusted 55- gallon drum were observed near the ditch headgate.
The Eagle. River and an undeveloped steep hillside forms the Site's irregular western boundary.
Highway 6 & 24 right -of -way forms the Site's southern boundary.
5.0 CONCLUSIONS
FBased on the foregoing assessment and data obtained, this ESA has provided no evidence of
recognized environmental conditions existing at the Site.

6.0 TERMS AND CONDITIONS OF ASSESSMENT
t� This assessment is based on the information available to WEI at the time of the investigation and
provides an indication of the status of the Site at that time. The opinions expressed concerning
the environmental risks or migration of contaminants are based on the data in the report.
Additional data could change the opinions expressed.

(, The goal of the processes established by the ASTM practice is to identify recognized
environmental conditions. The term "recognized environmental conditions" means the presence
or likely presence of any hazardous substances or petroleum products on a property under
conditions that indicate an existing release, a past release, or a material threat of a release of any
hazardous substances or petroleum products into structures on the property or into the ground,
groundwater, or surface water of the property. The term is not intended to include de minimis
conditions that generally do not present a material risk of harm to public health or the
environment and that generally would not be the subject of an enforcement action if brought to
the attention of appropriate governmental agencies. This process is designed such that
completion of the process, as described in this report, should constitute all appropriate inquiry
into the Site and uses of the Site to qualify for the innocent landowner defense to Comprehensive
Environmental Response, Compensation and Liability Act (CERCLA) liability.
A complete definition of the Site conditions would require substantial testing and a more detailed
investigation. Future conditions may change, and further investigation should be completed if
contamination is suspected or if Site conditions substantially change. Because of uncertainties
related to subsurface conditions and the changing nature of Site conditions, it is not possible for
WEI to provide guarantees with this assessment.
This ESA did not include any inquiry with respect to radon, methane, asbestos containing
materials, lead -based paint, lead in drinking water, formaldehyde, endangered species, wetlands,
subsurface investigation activities or other services or potential conditions or features not
specifically identified and discussed herein. In those instances where additional services or
service enhancements are included in the report as requested or authorized by the client, specific
limitations attendant to those services are presented in the text of the report.

As of February 1995, CERCLIS sites designated "No Further Remedial Action Planned" ( NFRAP) have been removed
from CERCLIS. NFRAP sites may be sites where, following an initial investigation, no contamination was found,
contamination was removed quickly without the need for the site to be placed on the NPL, or the contamination
was not serious enough to require Federal Superfund action or NPL consideration. EPA has removed approximately
25,000 NFRAP sites to lift the unintended barriers to the redevelopment of these properties and has archived them
as historical records so EPA does not needlessly repeat the investigations in the future. This policy change is
part of the EPA's Brownfields Redevelopment Program to help cities, states, private investors and affected citizens
to promote economic redevelopment of unproductive urban sites.

Violation and Enforcement data for Public Water Systems from the Safe Drinking Water Information System (SWDIS) after
August 1995. Prior to August 1995, the data came from the Federal Reporting Data System (FRDS).
Area Radon Information: The National Radon Database has been developed by the U.S. Environmental Protection Agency
(USEPA) and is a compilation of the EPA/State Residential Radon Survey and the National Residential Radon Survey. The
study covers the years 1986 - 1992. Where necessary data has been supplemented by information collected at private sources
such as universities and research institutions.
EPA Radon Zones: Sections 307 & 309 of IRAA directed EPA to list and identify areas of U.S. with the potential for
elevated indoor radon levels.
Oil /Gas Pipelines /Electrical Transmission Lines: This data was obtained by EDR from the USGS in 1994. It is referred to by
USGS as GeoData Digital Line Graphs from 1:100,000 -Scale Maps. It was extracted from the transportation category including
some oil, but primarily gas pipelines and electrical transmission lines.
Sensitive Receptors: There are individuals deemed sensitive receptors due to their fragile immune systems and special sensitivity
to environmental discharges. These sensitive receptors typically include the elderly, the sick, and children. While the location of all
sensitive receptors cannot be determined, EDR indicates those buildings and facilities - schools, daycares, hospitals, medical centers,
and nursing homes - where individuals who are sensitive receptors are likely to be located.
USGS Water Wells: In November 1971 the United States Geological Survey (USGS) implemented a national water resource
information tracking system. This database contains descriptive information on sites where the USGS collects or has collected
data on surface water and /or groundwater. The groundwater data includes information on more than 900,000 wells, springs, and
other sources of groundwater.
Flood Zone Data: This data, available in select counties across the country, was obtained by EDR in 1999 from the Federal
Emergency Management Agency (FEMA). Data depicts 100 -year and 500 -year flood zones as defined by FEMA.
NWI: National Wetlands Inventory. This data, available in select counties across the country, was obtained by EDR
in March 1997 from the U.S. Fish and Wildlife Service.

not received, client agrees to pay interest at the rate of 1.5 percent per month on the outstanding
balance. This does not constitute a credit arrangement, and in no case shall the minimum
payment be less than 33 percent of the amount billed. If account is placed with an attorney for
collection, client agrees to pay court costs and reasonable attorney fees. The liability of Waste
Engineering, Inc. for losses or damages arising out of the errors, omissions, or negligence of
Waste Engineering, Inc. while providing professional services shall be limited to the total fee

Waste Engineering, Inc. (WEI) has prepared the following proposal for a Phase I Environmental
Site Assessment for Lot 2, Eaglewood Subdivision in Eagle County, Colorado.
PHASE I ENVIRONMENTAL SITE ASSESSMENT
WEI follows the ASTM standards (E1527 -97) for all of our environmental site assessments.
This assessment will be conducted by inspecting the property in the field and by reviewing
documentation which is relevant to the subject property. The field assessment will include an
inspection and inventory of all potentially hazardous materials identified on the subject property,
as well as any potential hazards from neighboring properties within a one -half mile radius of the
subject property.
A regulatory records review will be completed from the following lists prepared and maintained
by environmental regulatory agencies to determine potential hazards to the site:
• Underground Storage Tank (UST) list as available from the Colorado Department of Labor
and Employment, Oil Inspection Section,
• Leaking Underground Storage Tank (LUST) list, as available from the Colorado
Department of Public Health and Environment (CDPHE),
• Comprehensive Environmental Response Compensation and Liability Information System
(CERCLIS) list as available from the Environmental Protection Agency (EPA),
• Emergency Response Notification System (ERNS) list also from the EPA,
• Resource Conservation and Recovery Act (RCRA) list,
• National Priorities List (NPL) sites in Colorado, from EPA,
• Active /Inactive Colorado Landfill list from the CDPHE.

In addition, aerial photographs will be examined in an attempt to construct the development
history of the area, to identify historic land use, and to identify potential historic environmental
hazards or contaminant sources.

WEI is prepared to initiate the Phase I assessment immediately upon receiving authorization to

discussed, a tentative due date of November 29, 1999 has been established.
