To complete the above annexation, the following
things must be done:
1. One copy of the map of the area annexed
must be filed with the Town Clerk.
2. Two certified copies of the Ordinance
annexing the property, together with a copy of the map,
must be filed with the Clerk and Recorder of Eagle County.
3. A certified copy of the Ordinance annexing
the property, together with a copy of the ��, must be
filed with the Division of Local Government, Department of
Local Affairs, 1550 Lincoln, Denver, Colorado 80202.

Dear Mr. Mayor and Council Members:
This office represents Venture -20. As you are aware, on June 23, 1981, the
above referenced ordinance was passed on final reading. Zoning of the subject
property shall be required as a matter of law within ninety days after the
effective date of the annexation ordinance.
As you may recall, upon the request and advise of the Town Attorney, Mr. Dunn,
and with the concurrence of the Town Council, the owner of the subject real
property, Venture -20, was directed to initiate the zoning process for the
subject property. Though this is contrary procedurally to the statute my
client has no objection. However, as this is a somewhat unique situation the
precise procedure as set forth in the Town Zoning Ordinance cannot be followed.
We assume the Town has no objection.

S1 /2 NE1/4 NE1 /4 of Section 12, T.5S9
R.82W, of the 6th Principal Meridian Colorado,
containing approximately 19.67 acres.)
TO THE HONORABLE TOWN COUNCIL OF THE TOWN OF AVON:
The Undersigned, as the sole landowner of the area, in accordance with
the Colorado Municipal Annexation Act of 1965, as amended, hereby petitions,
the Town Council of the Town of Avon, Colorado, to commence proceedings to annex
to the T¢{wn of Avon certain unincorporated territory located in the County of

Eagle, State of Colorado, legally described in Exhibit "A ", attached to this
petition, and by this reference incorporated herein. In support of said
petition, the petitioners allege that:
(1) Venture -20, a Colorado Partnership, is the sole landowner of the
area proposed to be annexed, excluding streets and alleys;
(2) A. J. Wells is a managing agent of Venture -20, a Colorado
Partnership;
(3) It is desirable and necessary that the above described territory
be annexed to the Town of Avon;
(4) Not less than one -sixth of the perimeter of the area proposed to
be annexed is contiguous with the Town of Avon;
(5) A community of interest exists between the territory proposed
to be annexed and the Town of Avon;
(6) The territory proposed to be annexed is urban or will be
urbanized in the near future;
(7) The territory proposed to be annexed is integrated with or is
capable of being integrated with the Town of Avon;
(8) No land held in identical ownership has been divided into
separate parts or parcels without the written consent of the landowner;
(9) No land held in identical ownership comprising twenty acres or
more, with a valuation for assessment in excess of $200,000 for ad valorem tax
purposes, has been included without written consent of the landowner;
(10) No annexation resolution pursuant to Section 31 -12 -106, C.R.S.
1973, as amended, and no annexation petition or petition for an annexation
election pursuant to Section 31 -12 -107, C.R.S. 1973, as amended, has been
commenced for the annexation of part or all of such territory to another
existing municipality;
(11) This proposed annexation will not result in the detachment of
area from any school district;
(12) The mailing address of the signer of this petition and the date
of signing are affixed to the petition;
(13) Attached to this petition is the affidavit that the signature
hereon is the signature of the person whose name it purports to be;
(14) Accompanying this petition are four prints of an annexation map
also included in Exhibit "A", attached to this petition, and by this reference
incorporated herein, containing the following information:
(a) A written legal description of the boundaries of the area
proposed to be annexed;
(b) A map showing the boundary of the area proposed to be
annexed;
(c) Next to the boundary of the area proposed to be annexed is
drawn the contiguous boundary of the Town of Avon;
(d) The dimensions of the contiguous boundaries are shown on
the map;
(e) The map bears the certificate and seal of a registered
engineer or land surveyor and shows the dimensions by scale of the
boundaries and the bearings of the boundaries of said area.

the Town of Avon, Colorado, make a finding of substantial compliance for this
petition and commence proceedings for and approve the annexation of the subject
