TOWN OF AVON
PLANNING & ZONING COMMISSION
RESOLUTION NO. 99-5
SERIES OF 1999
A RESOLUTION RECOMMENDING TO THE TOWN COUNCIL OF THE TOWN OF
AVON APPROVAL OF A ZONE CHANGE FROM TOWN CENTER (TC) TO PLANNED
UNIT DEVELOPMENT (PUD) AND ESTABLISHING DEVELOPMENT STANDARDS,
LOT 61, BLOCK 2, BENCHMARK AT BEAVER CREEK SUBDIVISION, TOWN OF
AVON, EAGLE COUNTY, COLORADO.
HEREAS, IDG3, LLC, owner of Lot 61, Block 2, Benchmark at Beaver Creek Subdivision, has
applied for a zone change from TC to PUD, and approval of Development Standards, as
stipulated in Title 17 of the Avon Municipal Code; and
HEREAS, a public hearing has been held by the Planning & Zoning Commission of the Town of
Town of Avon, pursuant to notices required by law, at which time the applicant and the public
public were given an opportunity to express their opinions and present certain information and
reports regarding the proposed PUD Zoning and Development Standards; and
HEREAS, the Planning & Zoning Commission has reviewed and evaluated the Development
Standards and Preliminary Development Plan according to the criteria in Section 17.20.110,
17.20.110, subsections H and I, of the Avon Municipal Code; and
HEREAS, based upon the above, the Planning & Zoning Commission finds that:
1. Due to its location within the Town Center, proximity to the Avon Transportation Center
annd
2. Absent a development plan, there is not sufficient basis to evaluate whether the proposed density,
building setbacks, and building height conform to the Avon Comprehensive Plan goals and
objectives.
3. The PUD Zoning and Development Standards conform to the overall design theme of the town, the
Subarea design recommendations and design guidelines;
4. The PUD Zoning and Development Standards are compatible with the immediate environment,
neighborhood, and adjacent properties relative to architectural design, scale, bulk, building height,
buffer zones, character, and orientation;
5. The PUD Zoning and Development Standards propose a mix of uses, activity, and density which
provide a compatible, efficient, and workable relationship with surrounding uses and activity;
6. The PUD Development Plan will identify and propose any necessary mitigation and/or avoidance
of natural and/or geologic hazards that affect the property;

7. The general pattern of development as represented by the PUD Zoning, Development Standards,
and Preliminary PUD Development Plan appear to be designed to produce a functional
development responsive and sensitive to natural features, vegetation and overall aesthetic quality of
the community;
8. The project will incorporate a circulation system designed for both vehicles and pedestrians
addressing on and off-site traffic circulation that is compatible with the town transportation plan
and proposed downtown plan;
9. The PUD zoning and Development Standards propose functional and aesthetic landscaping and
open space, and the PUD Development Plan will optimize and preserve natural features, recreation,
views and function;
10. Phasing plans will be reviewed and approved as part of the PUD Development Plan review and
approval process; and will maintain a workable, functional and efficient relationship throughout
the development of the PUD. The phasing plan will clearly demonstrate that each phase can be
workable, functional and efficient without relying upon completion of future project phases;
11. There are, or will be as needed, adequate public services including sewer, water, schools,
transportation systems, roads, parks, and police and fire protection.
OW, THEREFORE, BE IT RESOLVED, that the Planning & Zoning Commission hereby
recommends to the Town Council of the Town of Avon, Colorado, to approve the PUD Zoning and
Zoning and associated Development Standards, attached hereto as Exhibit A, and amendment to
the Zoning District Map to reflect the PUD zoning of Lot B, Avon Center at Beaver Creek
Subdivision, and its designation as Planned Unit Development (PUD), subject to the following
condition:
1. Development may occur on this site only in conformance with a final PUD Development Plan,
reviewed and approved by the Town through a separate application and review process pursuant to
Section 17.20.110 of the Avon Municipal Code.
