All commissioners were present with the exception of Commissioner Struve.
III. Additions & Amendments to the Agenda
Sally Vecchio recommended that Items VI and VII be switched. The commission agreed.
IV. Conflicts of Interest
There were no conflicts of interest to disclose.
V. Consent Agenda
• Approval of the October 5, 2010 Meeting Minutes
Action: Commissioner Green moved to approve the minutes. Commissioner Patterson
seconded the motion and it passed 5-0, with Commissioner Prince abstaining.
VI. Planned Unit Development Amendment
Gates at Beaver Creek
Property Location: Lot 1, Chateau St. Claire Subdivision / 38390 Highways 6 & 24
Applicant: Brian Wilson, CCS -Land, LLC / Owner- Timothy Barton, CSC Land, LLC
Description: The Applicant is requesting that the PUD requirement prohibiting dogs on the
property be removed. The prohibition was a condition of approval related to the 1998 PUD
Amendment.
Discussion: Upon a brief presentation by staff outlining the rationale and adherence to the
criteria achieved by the application, the Commission agreed to the applicant's request.
Action: Commissioner Green moved to approve the PUD amendment for Lot 1, Chateau St
Claire Subdivision, with the findings of fact outlined in the staff report for this agenda item.
Commissioner Patterson seconded the motion and it passed with a 6-0 vote.
VII. Other Business
Right -of -Way Access Requirements
Description: Presentation and discussion with the Director of Public Works, Jennifer
Strehler, regarding the existing and proposed driveway access requirements.
Discussion: Jenny Strehler addressed the Commission and explained the history of Title 12
and the governing authority of improvements in the Right -of -Way by the Public Works
Director. The Planning Commission reviewed photographs of various examples in the Town
where the Right-of-way was compromised for some private improvements. Some of the
examples included:
Eric Heil, Town Attorney, spoke to the Commission on the subject and explained that there
could be some language drafted to address the situations where snow storage might happen
to be impeded and would become an encumbrance to a property.
