I. Call to Order (5:OOpm)
The meeting was called to order at 5:15 pm.
II. Swearing in and Appointment of Commissioners
Patty McKenny, Town Clerk, swore in the new, Guy Patterson, and reappointed the existing
Planning and Zoning Commissioners, W. Todd Goulding, Scott Prince, Phil Struve.
Commissioner Goulding was nominated for Chairperson.
Commissioner Green was nominated for Vice Chairperson.
Commissioner Struve was nominated for Secretary.
Commissioner Prince was nominated to be the Traer Creek DRB Representative.
The appointments passed with a vote of 5-0.
III. Roll Call
All Commissioners were present with the exception of Commissioner Roubos and Green.
IV. Additions and Amendments to the Agenda
There were no additions or amendments to the agenda.
V. Conflicts of Interest
Commissioner Anderson stated he had a conflict with Item VII. Work Residence and Item IX,
HA Park Pavilion proposal, as his company is the civil engineer on both proposals.
Commissioner Prince discussed a conflict by stating that his father is working with an applicant
of Item VIII. Gandorf PUD on a separate potential project. He stated that he is actually
working on financing for the project therefore he has a conflict of interest on that Item.
VI. Consent Agenda
• Approval of the April 20, 2010 Meeting Minutes
Action: Commissioner Anderson moved to approve the revised consent agenda.
Commissioner Prince seconded the motion and it passed 3-0 with two abstentions.
DESIGN REVIEW
VII. Final Design
Work Single -Family Residence
Property Location: Lot 35, Block 4, Wildridge Subdivision / 5075 Wildridge Road
Applicant: Jeff Manley, Martin -Manley Architects / Owner: Brian and Jackie Work
Description: Single-family residence on a duplex property on Wildridge Road East in the
Wildridge Subdivision.
Discussion: Matt Gannett presented staff's report. Applicant provided material and color board
as required for final design. Matt Gannett highlighted some of the changes made since sketch
design.
Jeff Manley presented the changes to the plans since sketch, specifically the retaining walls,
textures, color and material board.
Commissioner Prince asked if the representation presented was the true colors. Jeff Manley
pointed out the material and color board for specifics on the colors.
Commissioner Goulding asked for confirmation Sheet A1.1. He commented that the drawing
appears to be two walls below the residence each at 6' tall. Jeff Manley responded that these
changes were in response to Commissioner Roubos' comment that there were two extremely
long walls and so they reduced the width of the walls
Commissioner Prince questioned the applicant if they had any problems with the engineering
analysis. The applicant was in agreement with the engineering comments.
Commissioner Goulding was trying to understand the full elevation perspective. He explained
that from the bottom most wall, to the top of the tallest roof form was a great expanse,
resulting in an approximate 80' tall area of improvements as viewed from the downhill side of
the lot. Jeff Manley described how they pushed the home as far up the hill as possible.
Mike Dantas felt that the comments resulted in the inability to build a large house. It is difficult
to compare Wildridge to Bachelor's Gulch since they are two completely different areas.
Commissioner Struve questioned how this structure would be viewed from the next lot to the
east. Jeff Manley showed the different studies for the neighboring property and how this
would be viewed. The neighboring structure would likely be pushed beyond this structure for
the better views.
Action: Commissioner Prince move to approve the design, with the five engineering comments
written into the approval.
Commissioner Struve seconded the motion. The motion for approval passed 3-1, with
Commissioner Goulding objecting.
VIII. Final Design
Gandorf Tract B
Property Location: Tract B, Block 1, Wildridge Subdivision / 2101 Saddle Ridge Loop
Applicant: Phil Matsen /Owner: Gandorf Tract B LLC
Description: A final design review of two duplexes. The duplexes will be designed in modern
mountain architecture. One duplex will measure approximately 31 feet tall and each unit will
be approximately 2200 square feet, while the other duplex will be approximately 25 feet tall
and 1700 square feet.
Discussion: Jared Barnes presented the staff report to the Commission, highlighting the history
of the property and the PUD approval. The PUD approved slightly different development
standards for each duplex, including height.
Commissioner Anderson questioned if the 25% site coverage includes impervious and building
coverage. Staff explained that the calculation only includes the building coverage.
Commissioner Anderson asked if the 4:12 roof pitch was a "guideline" or a "requirement".
Jared Barnes explained that generally the "guidelines' require a 4:12 pitch, except for some
secondary roof exceptions.
Commissioner Anderson questioned if there was a civil site plan prepared. Jared Barnes
mentioned that engineering reviewed the drawings and it was determined that a civil plan was
not warranted for this design submittal.
Commissioner Anderson asked if there was parking in front of the garages. Jared Barnes
responded that the parking requirement was two spaces per unit. Some units have a two car
garage in which case all of the required parking is covered, and the other units have a one car
garage with surface parking in addition which meets the parking requirement. Commissioner
Anderson explained that once a truck parks in front of the garage you will not be able to get to
the side parking spots. He continued to discuss parking and felt that there will be difficulty
pulling out of the spaces since there is no hammerhead to turnaround.
Commissioner Anderson questioned if there was a swale in the back of westerly units. Phil
Matsen responded that they are planning to sheet drain in a general direction away from the
structures. Commissioner Anderson responded that the grades shown are heading towards
the westerly unit in the back. Commissioner Anderson said that it looks like there is room for a
swale in the back of this unit and he would suggest one.
Commissioner Anderson felt that the `similar but different' looks, was achieved with this
submittal.
Commissioner Struve would like to see the colors reconciled, and asked if the colors are
similar to the project on Highway 6. His impression was that the colors seem dark.
Additionally, the east building's south elevation has small windows towards center of the
building that do not compliment the design. He commented that he likes the proposed light
fixtures, but the glass needs to be addressed to ensure compliance. He suggested that the
glass may be coated so that light does not show through.
Commissioner Goulding commented on the proposed colors specifically the cement boards.
He stated while they are individually earth tone colors, when the colors are put together it may
be too much, especially for the confined lot size they are dealing with. Michael Pukas,
Architect, decided to use the same cedar trim for all of the units, but wanted each unit to have
some individuality to identify the units therefore the proposed colors. Michael Pukas agreed
that this was a bold move, but they are comfortable with how this played out.
Commissioner Struve asked if the four proposed cement board colors could be acceptable
after an on-site mockup.
Commissioner Patterson was trying to understand what the implications would be if the whole
area started to turn to this type of color scheme. Michael Puckas stated that he was inspired
by an area in Eagle Ranch where there is a cul-de-sac and there are four single family homes
with varied color schemes and it worked very well. Phil Matsen explained that they are
utilizing either masonry or concrete for the colored areas and in this way it will be a sharp
appearance when painted.
The Commissioners discussed whether or not if they stuck with two of the brighter colors that
would be approvable and if they desired four colors then this should be reviewed on site.
Commissioner Goulding commented on the landscape plan. He felt that the caliper should be
varied, and that the taller 8' trees should possibly be scattered for a more established
appearance.
Commissioner Goulding asked Staff how irrigation and SFEs worked, and what the correlation
was to landscaping. Justin Hildreth, Town Engineer, explained that irrigation assumptions
were built into the water allocation.
Commissioner Patterson asked if the landscaping might interfere with the site distance of the
fire district vehicles. Justin Hildreth stated this was reviewed for potential interference and it
was determined that the design was adequate for site distance.
Action: Commissioner Anderson moved to approve with all the conditions from staff's report,
with the exception of Condition #3. He also moved to add a condition that the grading is away
from all sides of each building. This motion was discussed.
Commissioner Struve added a condition that there will be a review by PZC via an on-site
mockup of the proposed colors for the cement board area. Commissioner Goulding clarified
that this approval would be for the use of two stucco colors, and the final cement board colors
would be determined later. Phil Matsen suggested samples on-site.
The motion was seconded by Commissioner Struve. Commissioner Goulding made an
additional clarification that the calipers would be 2-4" instead of 3-5".
The motion was approved 4-0.
IX. Final Design
H.A. Nottingham Park Pavilion
Property Location: Tract G, Block 2, Benchmark at Beaver Creek Subdivision / One Lake St
Applicant: Stephanie Lord -Johnson, VAg / Owner: Town of Avon
Description: Final review of a performing arts pavilion, to be located on the north side of the
municipal building.
Discussion: Matt Pielsticker briefly overviewed the application.
Stephanie Lord Johnson discussed the materials and colors proposed with the application.
She discussed how the color palette mimicked the existing building's colors.
Commissioner Patterson asked why the location has been moved from the previous Fourth of
July concerts. Justin Hildreth responded that it was based on the sightlines. Commissioner
Struve added that the community surrey also desired fewer buildings in the park.
Commissioner Goulding questioned the painted copper material. Stephanie Lord Johnson
stated that it was platenaed copper.
Commissioner Patterson stated that the parking management plan should be dealt with prior
to issuance of a building permit. Justin Hildreth stated that the special events permit requires
a parking management plan.
Commissioner Prince questioned if the stucco material would be the first choice if money
wasn't an issue. Stephanie Lord Johnson responded that it wouldn't be her first choice.
Commissioner Struve would like to see a stage access plan.
Commissioner Goulding questioned how the lights would be controlled. Stephanie Lord
Johnson responded that there would be a series of panels on the rear that would control
lighting, sound, and other necessary equipment.
Commissioner Goulding stated that a landscaping plan should be required prior to a building
permit and it can be reviewed by staff.
Action: Commissioner Struve moved to approve the application with the conditions listed in
Staff's Report and with a condition that a Landscape Plan be reviewed by staff prior to a
building permit. Commissioner Prince seconded the motion and it passed 4-0.
WORK SESSION (6:30pm)
X. Unified Land Use Code
Description: Review of the Development and Design Standards portion of the Unified Land
Use Code.
Discussion: Sally Vecchio presented a PowerPoint that outlined the Development Standards of
the Avon Development Code (ADC) Update.
Sally Vecchio presented each of the major design standards proposed.
Commissioner Prince questioned the comment that buildings need to relate to the street. Sally
Vecchio stated that the buildings need to have a pedestrian component at the street. She also
stated that a courtyard could be a viable solution as it would create a pedestrian space.
Sally Vecchio continued to discuss the proposed design standards. She also discussed the
proposed sustainability table. She stated that the Zoning Advisory Committee (ZAC)
requested that this be removed from the ADC.
Commissioner Patterson questioned if there are other communities that have a sustainability
table in their municipal codes. Sally Vecchio stated that we would be the first community to
adopt a table like this. Commissioner Goulding elaborated by stated that a majority of the
table items would be either required during site planning, but a majority of the items were
building permit issues. He gave an example of waterless urinals.
Sally Vecchio discussed the Alternative Equivalent Compliance (AEC) process. She stressed
that the alternative method would be required to be equivalent or better than the standard, but
certainly not worse.
She questioned if the design standards were heading in the right direction, but did stated that
the Town Council liked the standards and thought that they could go further in standardizing.
Commissioner Goulding asked for more information on what the Town Council desired at their
work session. Sally Vecchio stated that duplex design standards, garage design standards,
and Council review in the Town Core were some of the biggest. She elaborated on the
Council review by stating that a PUD will not be necessary in the Town Core therefore the
council would be removed from the review process. The change in the process will still ensure
that the Town Council will be able to review those projects.
Commissioner Prince questioned how AEC worked. Eric Heil stated that the process intended
to add flexibility to the hard fast standards that may limit innovative designs. He brought forth
an example of street frontage and how a specific design could allow for a portion to not front
the street due to the design ability to vitality to the street.
Commissioner Prince stated that this process is very subjective and ambiguous and he feels
that too many applicants will come forth requesting this process.
Commissioner Struve stated that this wasn't a process that was for those who couldn't meet
the standard, but those that had a design that provided a public benefit.
Commissioner Goulding stated that the intent statements will be imperative here since those
will be the measuring tools.
Commissioner Patterson stated that this will be a process to allow developers to value design
their projects.
Sally Vecchio discussed an example that she was involved with in the metro Denver area.
Commissioner Anderson questioned if the town was vulnerable on the parking requirements if
developers choose to pursue an AEC. Eric Heil stated that parking was not one of the items
that was allowed to move through the AEC process.
Commissioner Goulding stated that an AEC process should be as difficult to get approval for
as a variance. He stated that an expensive application fee would help be a deterrent.
Commissioner Patterson stated that he loves the idea and concept, but has reservations.
Commissioner Anderson commented that this appears like another PUD process and that it
will be cumbersome for a developer.
Commissioner Struve had to leave the meeting at this point.
Commissioner Goulding questioned why the natural resources section was left off the AEC
process. Eric Heil stated that the areas this would be in play is very limited and therefore was
left off since it could be addressed by staff.
Larry Brooks asked how articulation is defined.
Commissioner Anderson suggested that parking spaces sizes as outlined in the Eagle County
code should be used in the ADC.
Commissioner Goulding suggested that we had a floor -to -ceiling minimum for parking
structures.
Commissioner Anderson stated that drive aisle width should be included as well as turning
radius.
Commissioner Goulding stated that a maximum surface parking should be added. He stated
that we should also have a maximum height on parking lot lighting. He also questioned if
there was parking access standards, specifically gates and/or garage doors and associated
stacking.
Commissioner Anderson questioned snow storage requirements. He would prefer 30% over
20%. He suggested if heated areas were provided the snow storage could be reduced to
10%.
Commissioner Prince questioned if the parking standards take into effect the seasonal aspects
of the area we live in. He questioned if the parking should be reduced to take that into
account.
Commissioner Anderson questioned if 10' landscaping aisles were excessive and 6' would
better reflect land values here. He suggested that openings in curbs should be every 30'
instead of 10' due to the size of parking spaces.
Commissioner Goulding stated that the large landscaping aisles could help deter the
abundance of surface parking.
Commissioner Goulding wanted the standards to reflect compatibility requirements for all
retaining walls, especially where the materials change.
Commissioner Goulding also questioned screening for mechanical equipment. He stated that
the screening should be year round and that it be natural versus fencing.
Commissioner Goulding wanted the landscaping to be layered and be organic. He wants the
landscaping to be sophisticated and natural.
Commissioner Prince stated that materials on retaining walls should be reviewed.
Commissioner Anderson questioned if the entire structure included the reinforcement of
retaining walls, will the entire design be included in the design plans. Justin Hildreth stated
that the building permits will require the necessary engineering.
Commissioner Anderson questioned if an engineered site plan is required. Commissioner
Goulding stated that he would prefer if an engineered site plan should be required on any
application that requires significant grading or retaining walls.
Commissioner Anderson suggested that a maximum retaining wall height should be pursued.
Design Standards
Commissioner Prince suggested that the ADC remove pueblo or southwest style homes from
acceptable designs. Commissioner Goulding questioned if that would be solely applicable to
Wildridge. Sally Vecchio stated that the authenticity of a traditional adobe/pueblo style
architecture could be argued for AEC.
Commissioner Anderson questioned the necessary stone requirements on residential
structures.
Commissioner Goulding suggested that the duplex standards should apply to single -families
as well.
Commissioner Prince questioned if two single families could be placed on a duplex lot. Sally
Vecchio responded that staff is working on standards to address this issue.
Commissioner Goulding stated that curb appeal should be addressed in this code as well as
repetition. He also commented that pedestrian entries should supersede automobile entries in
the design of a structure.
Commissioner Goulding commented that he appreciated the four sided design standard. He
also commented on articulation and how the intent of the term could be developed first then
standards could be developed.
The Commissioners stressed the need for intent statements.
Processes
Commissioner Goulding questioned the reason for council to review town core projects. Eric
Heil responded that it was due to the associated processes that would be accompanying these
applications such as development bonus and public financing.
Commissioner Goulding stated that one of the major purposes of the PZC is to take design
review off of Town Council's workload.
Commissioner Prince commented that the Town Council already has a full plate and this is a
down economy, but when activity picks up their workload will be extremely busy.
