LETTER OF AGREEMENT
This Agreement is made on January 5, 2026, between the Town of Avon (“Avon”) and Beaver Creek
Resort Company (“BCRC”) and outlines the terms and conditions of the agreement between parties.
Avon hereby grants permission to BCRC to install banner/s on one light pole located at Avon Road
roundabout (“RAB”) No. 5 in accordance with the following Terms:
TERMS: BCRC agrees to comply with the terms and conditions listed below:
1. This Agreement shall continue until terminated by either party. Either party may terminate this
Agreement at any time without or without cause by providing written notice to the other party.
2. The banners shall be limited to events held in Beaver Creek resort.
3. The light pole that BCRC can use is the one located on the southern exterior edge of Avon Road
RAB No.5 is identified as located on Avon Road roundabout number five on the southern exterior
edge at the intersection of Avon Road and Village Road.
4. Banners may be single or double panel installations.
5. Banners may hang for no more than seven (7) consecutive days unless a long period is approved by
Avon in writing.
6. Avon grants permission to BCRC to hang banners promoting the following special events:
a. Winter Culinary Weekend
b. Talons Challenge
c. Blues, Brews & BBQ
d. Art Festival
e. Oktoberfest
f. Cookie Competition/Winter Opening Week
g. Birds of Prey
h. New Year’s Eve Celebration
7. Avon may grant written permission to BCRC to hang additional banners in Avon’s discretion.
8. BCRC shall provide all labor and equipment to install and remove the banners.
9. BCRC shall complete and submit a Right of Way Permit Application and a Traffic Control Plan to be
approved by the Public Works Operations Division if the installation and/or removal interrupts the flow
of traffic or public rights of way. Avon shall waive the fee for the Right of Way permit.
10. Avon shall not be responsible for damage to banners or light poles.
11. If there is damage to the light pole during the installation and/or removal process by BCRC and/or
contractors, vendors, etc. hired by BCRC to perform the work, BCRC will immediately and fully repair
the damage at no cost to Avon. If damage is not repaired within five days, then Avon may proceed
with the repair and invoice BCRC for related charges.
