1. CALL TO ORDER AND ROLL CALL
The meeting was hosted in a hybrid format, in -person at Avon Town Hall and virtually via Zoom.us. Mayor
Tamra N. Underwood called the October 14, 2025, Council Regular Meeting to order at 5:16 p.m. A roll call
was taken, and Councilors present in person were Ruth Stanley, Gary Brooks, Kevin Hyatt, Mayor Pro Tern
Richard Carroll, and Mayor Tamra N. Underwood. Councilors Chico Thuon and Lindsay Hardy were absent.
They were joined by Town Manager Eric Heil, Deputy Town Manager Patty McKenny, Town Attorney Nina
P. Williams, Chief Administrative Officer Ineke de Jong, Town Clerk Miguel Jauregui Casanueva, Finance
Director Paul Redmond, Recreation Director Michael Labagh, Community Development Director Matt
Pielsticker, IT Carlos Molina, and Avon Police Chief Greg Daly.
2. APPROVAL OF AGENDA

Mayor Underwood provided information regarding the scheduling of 4th Quarter Council Meetings for public
awareness. Mayor Underwood initiated the meeting with the Agenda approval process. Mayor Pro Tern
Carroll motioned to approve the Agenda, as presented. Councilor Hyatt seconded the motion. The motion
carried unanimously with a 5-0 vote of those present,
3. DISCLOSURE OF ANY CONFLICTS OF INTEREST RELATED TO AGENDA ITEMS

Mayor Underwood asked if there were any conflicts of interest related to the agenda, and none were
disclosed.
4. PUBLIC COMMENT

Mayor Underwood explained that public comment may be provided in person, via Zoom (video/audio), by
telephone, or by email. She clarified that this portion of the meeting is reserved for items not listed on the
agenda. Comments are limited to three minutes, with an additional minute granted at Council's discretion,
Members of the public are asked to address Council directly and should not expect a response, as this
time is intended solely for public input. Mayor Underwood invited comments from those present in the room
or participating virtually and requested that, upon stepping up to the podium, speakers state their name
and, optionally, their neighborhood or Town of residence.
Mayor Underwood opened the floor to public comment, and Guy Erickson, resident of Eagle Bend Drive,
took the podium in person and spoke of his concerns regarding the lack of communication related to Eagle
Bend Pocket Park improvement and noted that other neighbors were present to share similar concerns.
Betty Todd, resident of Eagle Bend Drive, took the podium in person to speak about the park at Eagle Bend
and expressed concerns regarding the placement of a porta potty at the end of the cul-de-sac. She stated
the site at Eagle Bend Park is not suitable for a porta potty, describing the park as primarily a playground
with limited grassy area. She emphasized that the porta potty is unsafe for the park and may attract
individuals who do not belong in the neighborhood. Additionally, she noted the process was flawed and
that the two public meetings held were insufficient.
Thomas Walsh, lifelong resident of Eagle Bend Drive, spoke in person to express opposition to two

elements: the permanent porta potty and the dedicated bike lane. He stated that the porta potty seems
unnecessary, as the park is not sufficiently active and could pose a health risk. Regarding the bike lane,
he noted that the street is already calm, safe, and residential, and a dedicated lane would only add more
traffic. He urged the Council to listen to the concerns of residents living nearest to the park.
Randy 'Buzz' Didier, resident of Eagle Bend Drive, spoke about the GOCO Grant, stating that he believes
it is poorly worded. He noted that Eagle Bend Apartments already have their own parks and that the grant
considers the Hispanic community there but does not mention the residents of Eagle Bend who live on the
street. He attended the public meeting but said it was unclear that a porta potty would be included. He
objects to the porta potty, stating it would provide amenities that could attract homeless individuals, and
therefore does not want it installed.
Kathleen Walsh, resident of Eagle Bend Drive, spoke in person about her review of the GOCO application,
which she had not seen prior and noted it does not mention residents of the street or how it would support
them. She stated that she originally brought the land to the Town's attention to become a pocket park. She
attempted to attend the public meeting and reviewed the survey, which at that time did not disclose plans
for a bike lane or porta potty. She opposes the porta potty, stating it turns the park into a rest stop rather
than a pocket park. She also opposes the bike lane, citing concerns about excessive traffic racing through
the area. She asked the Council to keep the street safe for the small residential neighborhood.
Mathew Tonn, resident of Lakeview Benchmark Condos, spoke in person to raise awareness and concerns
about Lakeview and Benchmark allowing short-term rentals. He stated that the properties were designed
for long-term rentals, but in recent years there has been a sharp increase in STIRS for as little as 1-2 nights,
resulting in a change in clientele who do not appear to be here on vacation. He expressed that this impacts
their quality of life, citing frequent disturbances by guests who are not being good neighbors, which he
believes is making the neighborhood unsafe and dangerous.
Sarah Taylor, resident of Eagle Bend Drive, and originally from Texas, took the podium in person and
stated she believes the porta potty will expose the Town of Avon to lawsuits. She expressed concern that
someone young could be assaulted inside the porta potty. She stated it takes away from her community
and makes the area unsafe. She added that she knows of a homeowner who is now selling their home
because of the porta potty being added to the park.
Chris Morrison, resident of Eagle Bend Drive, spoke in person about her quiet residential street and
expressed opposition to the porta potty. She noted that no other pocket parks have porta potty and agreed
with her neighbors that the porta potty should be removed, as it serves people who are not part of that
park.
Amy Phillips, resident of Eagle Bend Drive, spoke in person to address a different issue, noting that she
appreciates her neighbors mobilizing. She emphasized the importance of reports included in the back of
the packet, especially financial reports, and expressed satisfaction that the Town met its budget. She added
that staff reports reference MiCasa limits, which she believes need to be adjusted and increased to align
better with the dual one. She also mentioned five recent conversations regarding the Wildwood South
lottery selection, stating that the process feels lacking in transparency and that applicants are owed greater

clarity.
No other public comment was made in person or virtually.
Mayor Pro Tern Carroll and Mayor Underwood requested Town Manager Eric Heil to provide a list of
recognitions for Avon Police staff who received awards at the 2025 Night of Excellence Public Safety
Awards. They stated they were impressed by all the accolades received by Avon staff.
5. CONSENT AGENDA

Mayor Underwood introduced the approval of the Consent Agenda to include the following:

Mayor Pro Tern Carroll motioned to approve the Consent Agenda, as presented. Councilor Brooks
seconded the motion. The motion carried unanimously with a 5-0 vote of those present.
6. BUSINESS ITEMS
6.1. PRESENTATION: Avon's Ballot Box Location and Election Updates (Town Clerk Miguel Jauregui
Casanueva and Eagle County Clerk and Recorder Becky Close)

Town Clerk Miguel Jauregui Casanueva and Eagle County Clerk and Recorder Becky Close
presented on Avon's Ballot Box Location and Election Updates. Rich Carroll asked if the voting center
moving to Edwards is the closest option to Avon, and it was noted that Vail will remain open. Mayor
Underwood added that concerns were raised about construction at the ballot box and provided
context on timelines that impacted the situation, which are now resolved. Mayor Underwood opened
the floor to public comment, and no public comment was made in person or virtually.
6.2. ACTION: Proclamation Honoring High Five Access Media Day (Chief Administrative Officer Ineke
de Jong and High Five Access Media Director JK Perry)

High Five Access Media Executive Director JK Perry took the podium in person to speak about High
Five Access Media Day in October. He noted that 2025 is an important year as it marks the 40th
anniversary of the organization. He was joined by board members Harry Green, Russell
Frederickson, Mike Griffin, Gusty Kanakis, and former board member Amy Phillips. He thanked his
staff members Brett Ferraro and Jonathon Czarny and expressed appreciation to all volunteers for
sharing their stories over the last 40 years. With unanimous support from Council, Mayor Underwood
read the proclamation into the record, and the group captured photos to memorialize the event.
6.3. WORK SESSION: Regional Housing Solutions - Introduction (Town Manager Eric Heil and GPS

Town Manager Eric Heil and Government Performance Solutions, Inc. Consultant Brian Pool
delivered a presentation related to Regional Housing Solutions. Pool presented the Regional
Housing Solutions information included in the packet and indicated he was present to listen, thanking
Council for their input and feedback. Amy Phillips, resident of Avon, took the podium in person and
made a public comment, agreeing that the presentation and conversation should be tailored based
on each group's familiarity with the topic of housing. She suggested that Government Performance
Solutions, Inc. should consider reaching out to the 1,300 individuals on the Valley Home Store waitlist
to gather their stories and help build trust. There were no other public comments. Mayor Underwood
noted she believes the Town of Vail doesn't need to be involved in this first round given that they
have far more experience than the group steering the regional housing solutions for this group. Staff
received unanimous support from Council to continue their work on regional housing solutions.
6.4. PUBLIC HEARING, Resolution 25-24: Finding State Land Board Property Eligible for Annexation

Community Development Director Matt Pielsticker introduced Resolution 25-24 and was joined by
Eliot Hoyt from the State Land Board and Pedro Campos with Zehren. He explained the proposal is
to annex a small part of the project. Kathleen Walsh, resident of Avon, took the podium in person
and made a public comment asking who will control this property. The Mayor confirmed this would
be annexation into the Town of Avon, not into the PUD of Traer Creek. There were no other public
comments. Mayor Pro Tern Caroll motioned to approve Resolution 25-24, as presented on second
reading. Councilor Hyatt seconded the motion. The motion carried unanimously with a 5-0 vote of
those present.
6.5. PUBLIC HEARING: ORDINANCE 25-17, Second Reading: Update to Chapter 5.08 Liquor Licenses
(Town Clerk Miguel Jauregui Casanueva)

Town Clerk Miguel Jauregui Casanueva introduced the second reading of Ordinance 25-17. There
were no public comments and no Council discussion. Mayor Underwood expressed pride in raising
this concern last year, securing City Market's agreement to limit two floating end caps, and now
codifying that limit. Councilor Stanley motioned to approve Ordinance 25-17, as presented on second
reading. Councilor Brooks seconded the motion. The motion carried unanimously with a 5-0 vote of
those present.
6.6. PRESENTATION: Parks Improvements and Summer Recap (Recreation Director Michael Labagh)

Recreation Director Michael Labagh took Council through the presentation in the packet. Kathleen
Walsh, resident of Avon, took the podium in person and made a public comment about the
landscaping at Eaglebend Pocket Park and said a lot of green and trees were taken out with the new
townhomes going in and she hopes the neighbors can have input on the landscaping. There were

8. MAYOR AND COUNCIL COMMENTS & MEETING UPDATES

Mayor Pro Tern Carroll spoke about the CORE Transit Meeting held on October 8, 2025, which is viewable
on the High Five Access Media website. He noted that the fare -free youth passes have been extended
through the end of the ski season.
Councilor Gary Brooks indicated he attended the Mountain Towns 2030 two-day Climate Action
Conference in Breckenridge last week. He described it as an interesting and valuable event, noting the
great format with presentations in the mornings and breakout sessions in the afternoons. He found the
conference very engaging and invited the public to attend the next one, which will be held in Idaho next
year.
Mayor Underwood stated that last week Avon hosted the 2025 Sustaining Colorado Watersheds
Conference at the Westin, which was attended by staff. The Town invited clean drinking water scientist
Leah Krebbary to participate, marking a strong week for environmental efforts. Mayor Underwood also
noted that she attended the CAST meeting in Keystone last week along with Gary Brooks and Ruth Stanley.
She reminded everyone that tomorrow at 5:00 p.m. the Town will host the ribbon -cutting ceremony for the
all -electric Public Works Garage.

There being no further business before Council, Mayor Underwood moved to adjourn the regular
