CASE Committee Packet Materials 2025.05.09 970-748-4065 ddempsey@avon.org TO: CASE Committee FROM: Danita Dempsey, Chief Cultural Officer RE: Staff Update DATE: May 9, 2025 SUMMARY: This report provides updates and activity related to the (1) 2025 Adopted Budget (2) the Seasons Mural project (3) 2025-2027 Art Around Avon program and (4) Special Events Calendar and policies. The June meeting will encompass a review of the Colorado Creative Summit, our recent tour of the Breck Create cultural and arts venues, and potential presentation by a third-party producer for a new bluegrass festival in June and/or October. The Town received two event awards from the Colorado Event Alliance for the ICON Awards and Salute to the USA won (1) Best Overall Event and (2) Best Public, Fair, Event or Festival. Put your hands together for Team Avon! STAFF UPDATE: 1. 2025 ADOPTED BUDGET: Since the last CASE Committee budget update was in November 2024, I wanted to provide a brief update on the 2025 Adopted Budget. The update includes the addition of the new Bravo! Orchestral performance on June 26th, which results in a net decrease of $16,696 in the 2025 Adopted Budget, representing a 1.8% net decrease. A detailed 2024 Adopted Budget vs 2025 Adopted Budget Comparison is provided as ATTACHMENT A. The numbers provided in ATTACHMENT A do not include personnel costs, general operations (cell phones, meeting expenses, dues, and memberships, etc.) and capital outlay (computers, furniture, etc.). Additionally, on the April 8, 2025, the Council approved Resolution 25-09 Supplemental 2025 Budget Amendment which included the following: a. A budget increase for the addition of $6,116.72 in cash support for Cars in the Park. The funding will be spent directly by the Town to support (1) creative design (2) advertising and promotions (3) resource recovery (4) event poster printing (5) event photographer and (6) Eagle River Fire Protection District permit fee. b. A budget increase for the addition of $1,000 to purchase a table at the Colorado Event Alliance ICON Awards for Staff to attend the awards ceremony. 2. LARGE FORMAT SEASONS MURAL: Artist is Graham Carraway was selected for this project. Staff and the Jury Panel are about to finalize the design concept. Once approved, Staff will advance the Independent Contract Agreement and finalize installation logistics. ART AROUND AVON: The fourth biennial Art Around Avon is well underway with two pieces recently installed. All artists have been contracted, and the full temporary collection will be installed by June 3rd. The final selections and locations are provided in ATTACHMENT B. Please note location #5 on Avon Road (near First Bank) is no longer viable and the piece will be relocated, possibly on Avon Road. CURRENT ACTIVITY & PLANNING: As we start our event season with four new CASE Committee members and approach our weekly event series and our signature event, Salute to the USA, it is timely to update this group on our (1) dog policy at events (2) new low-chair policy and (3) optional liquor license. These policies are outlined in our Frequently Asked Questions, available on each event landing page on Avon.org and Discoveravon.org. 1. Dog Policy at Special Events: Staff expanded the Dog Friendly area at AvonLIVE! last year to provide additional dog friendly space and the “No Dog Signs” posted at entrances were removed. Since that time, the Council approved Ordinance No 24-13 amending Avon Municipal Code Chapter 9.40.050 (7) authorizing the Town Manager to adopt rules, regulations, prohibitions and designation of appropriate times and location for dogs on Town properties and dogs at special events. a. The new Ordinance simplifies Staff efforts with operations, logistics and communications. Moreover, dogs must be leashed at all times inside the venue footprint. This is supported by pre-event communication, on-site signage, volunteers, and private security to assist in enforcement of seating guest with leashed dogs in the dog friendly area. Furthermore, per the ADA (“Americans with a Disability Act”), in situations where it is not obvious that the dog is a service animal, Staff and/or volunteers can ask two questions: a. Is the dog required because of your disability? b. What work or task has the dog been trained to perform? Staff are not allowed to request any documentation for the dog, require that the dog demonstrate its task, or inquire about the nature of the person’s disability. Under the ADA, the definition of a service animal is defined as “a dog that has been individually trained to do work or perform tasks for an individual with a disability. The task(s) performed by the dog must be directly related to the person’s disability.” And, regarding the question “Are emotional support, therapy, comfort or companion animals considered service animals under the ADA?” Per the ADA website, the answer is, “No. These terms are used to describe animals that provide comfort just be being with a person. Because they have not been trained to perform a specific job or task, they do not qualify as a service animal under the ADA…” 970-748-4065 ddempsey@avon.org 2. Low-Back Chairs: Staff was asked to reassess our chair policy at special events, particularly those with stage performances. After researching other venues such as Dillon and Ford Amphitheater, low back chairs no more than 5” off the ground will be allowed at AvonLIVE!, and Salute to the USA however, there is not a need for this policy at Lakeside Cinema. Further internal conversations are needed regarding this policy at SunsetLIVE! a. The FAQs (“Frequently Asked Questions”) provided on our website for the general public have been updated to include these policies and new signage is being printed. The entire FAQs is provided and attached as ATTACHMENT C. 3. Optional Premises Liquor License: In 2020, the Avon Town Council approved Ordinance No. 20- 03 and Resolutions No. 20-03 and No. 20-04 to support the Town’s application for an Optional Premise License with the State of Colorado. In 2021, the Town of Avon was issued an Optional Premises Licenses which allows the Town to store and sell malt, vinous and spirituous liquor at Town produced special events. The issuance of a license comes with requirements that must be met in order to be compliant and retain a license. Such as (1) defining the liquor boundary, (2) shrinking the boundary when a Special Event Permit Liquor License is issued in our premises, (3) having conspicuous signage stating, “No Alcohol Beyond This Point”, and “No Outside Alcohol”, and (4) ensuring the alcohol being sold by the Town does not leave the boundary, or alcohol outside the boundary does not enter the boundary. In correlation with the items mentioned prior, Staff hires private security to monitor and restrict alcohol entering and exiting the venue. Our ability to ensure compliance with outside alcohol not entering the premise or alcohol sold not leaving the premise, is critical to the Town retaining a license. The scope of work for private security includes (1) monitoring for prohibited items during ingress (such as outside alcohol, pets, marijuana, firearms, fireworks, drones, etc.); and (2) ensuring alcohol does not leave the venue upon egress and (3) assisting attendees to the “dog friendly” area. 4. Special Event Calendar & Synopsis: The Egg Hunt event was a success despite the cold weather. The event was held on Saturday, April 22 between 10:00 a.m. and 12:00 p.m. and attracted approximately 1,500 guests. The total event budget was $18, 683 and total expenditure was approximately $15,907.00. The Post Event Brief is provided as ATTACHMENT D. Beginning next week, we have event every week until the end of August beginning with the Town Clean Up & Sustainability Fair on Wednesday, May 21st. Therefore, we wanted to review the 2025 Event Synopsis provided as ATTACHMENT E. Please note it only includes upcoming events and not those that have already taken place this calendar year. Fostering a culture of environmentalism, waste mitigation and energy conservation which minimizes the negative impacts to our collective environment and community for the long term is of utmost importance to the Town. All vendors participating in events held on Town properties shall support the Town’s environmental sustainability initiatives and Eagle County’s waste diversion goal of 30% reduction and 80% organics diverted by 2030 (zero waste events utilizing leave no trace practices). In addition, the Town has a new recycling ordinance that is effective November 1, 2023. The Recycling Ordinance requires all Town residents, businesses, and visitors to recycle. Listed below are requirements and prohibited items: 1.There will not be beverages available for purchase in single-use plastic bottles. 2.There will be water filling stations and canned beverages available for purchase. May I bring my own alcohol? Even though Nottingham Park is designated as “open container” during summer months, during special events where alcohol is being sold, alcohol is not allowed within the liquor boundary. We love all four-legged furry family members! In general, well-behaved leashed pets with owners present at all times are allowed at special events such as AvonLIVE!, SunsetLIVE!, Lakeside Cinema, and Dancing in the Park although they may be restricted to specific “dog-friendly” areas of the venue. Pets are not allowed at ticketed events, culinary events, or events with potentially larger audiences such as Salute to the USA, and Fireworks in Avon. Under no circumstances shall pets be tied to perimeter fencing and/or at event entrances and/or exits. Is smoking allowed? Avon is a smoke-free community (tobacco, marijuana, etc.). The smoking of marijuana in any outdoor area, public or private, in Avon is illegal. What does “gates or doors open at” mean? Isn’t the park always open? This indicates when food and beverage sales begin, family activities and/or live entertainment start, etc. and when the event is ready to receive guests. There may be times when certain areas of the park, recreational pathways around the park, or the lake are closed to facilitate event set up, event tear down, racecourses, etc. such as at the Fireworks in Avon, Salute to the USA, and Triple Bypass. ATTACHMENT C 2 Are events accessible to people with disabilities? Yes, our event venues all have hard surface paths and locations which will accommodate access. May I bring a chair or blanket to the event? At AvonLIVE!, SunsetLIVE!, Lakeside Cinema, Dancing in the Park, Salute to the USA and other free events, low-back chairs, blankets and small tables are allowed if they do not impede the view corridor of others. Ticketed events are handled on an event-by-event basis. Low back chairs should not be higher than 5 inches off the ground. Please see examples of acceptable low back chairs below: What happens during inclement weather? All Avon free events will happen rain or shine (or snow!) unless live performances and/or safety of our staff or guests would be impeded by weather. In severe weather scenarios events may have a change of location or be canceled due to lightning, dangerous winds, wildland fires or outlook, etc. If an event is canceled or guests are required to shelter, there will be notifications through multiple channels such as Town of Avon / Discover Avon Facebook, Instagram accounts, press release and website. Attending an event in a high-alpine environment means you should always be prepared with appropriate clothing and protective gear. You may bring your own food and non-alcoholic beverages – no single use plastic vessels – however, there will be plenty of delicious food and beverage options at most events and we encourage supporting our local vendors/restaurants. Residents and guests will be required to pay $1 per hour beyond the initial three free hours. Areas for Improvement/Adjustment: • Petting Zoo was unable to make it due to the inclement weather; we should consider striking this activation from future events. • Consider adding one to support the bi-lingual emcee who fields lots of questions. • Addition of a volunteer at Rec Center parking lots. (Not able to provide one this year due however, there were no complaints according to Rec Center staff.) Operations & Logistics: • Pub Ops swept the field to remove snow, which while helpful, resulted in large piles of dirt around the egg hunt perimeter. • All activation / vendor tents to the south side of the field and inflatable features on the north side worked well. • Combining the “TOA Info/Lost Kids” tent with the Jellybean and Coloring Contest worked well. • Volunteer number, shifts and roles are appropriate. Production & Talent: • Kaleidoscope provided 4 speakers, an audio engineer and mic for the emcee. • Sound production was seamless and coverage excellent. WM took the minimal amount of compost off-site as the event compost dumpster doesn’t arrive until the end of May. Transportation & Parking: • The use of public transportation is encouraged as well as walking or riding a bike to the park at all events. • Town Hall parking lot was utilized for staff and vendor parking and had plenty of space. • Placed “No Event Parking” signage at the entrances of the Rec Center north lot. Avon Turkey Trot Date: Thursday, November 28th Time: 8:30am – 11:00am The annual YouthPower365 Turkey Trot is back, and the Town of Avon is excited to host this fun and healthy community event in Harry A. Nottingham Park on Thanksgiving! Choose between a 2K or 5K Run/Walk, with costumes highly encouraged to add to the festive spirit! The 2k race will cost $10 per person and the 5k race will cost $20 per person. Children 5 years old and under race for free! Prices will increase by $5 for day of registration. All participants will be required to sign a liability waiver which can be completed prior to race day. A percentage of the proceeds benefit YouthPower365.
