Public Comments, Avon Downtown Development Authority Simplified Rules of Order (970) 748-4055 predmond@avon.org TO: Chairperson Tony Emrick and DDA Board Members FROM: Paul Redmond, Town of Avon Finance Director RE: 2024 Proposed Budget for Downtown Development Authority DATE: November 30, 2023 SUMMARY: The 2024 Budget for the Avon Downtown Development Authority (“Avon DDA”) is presented to the Board of Directors for review and adoption. Adoption occurs by approval of the attached budget resolution 23-01. BACKGROUND: The Avon DDA is considered a separate legal entity from the Town authorized by Colorado State Statutes 31-25-801. The Avon DDA is required to adopt a budget each fiscal year (C.R.S. §31-25-816). In addition, the Local Government Budget Law of Colorado requires every local government to adopt a budget each year. FINANCIAL: The proposed 2024 Budget Fund Summary is attached as an exhibit to this memorandum. Note the summary is also included for informational purposes in the Town of Avon’s budget summary as a component unit of the Town. We do not have any decent estimate of revenues that may be generated by the Avon DDA and we do not have any identified or planned expenditures. The proposed revenues of $100,000 and proposed miscellaneous expenditures of $10,000 are purely placeholders for the purpose of adopting a budget for 2024 and complying with Colorado law. We are coordinating with the Eagle County Assessor with regard to implementation of the tax increment financing provisions. It appears that the Avon DDA may capture a significant majority of the increased valuation of new construction from the dual brand hotel and Maverick gas station, so we are optimistic that the actual revenues in 2024 will be excess of $100,000. Local government budget law allows for amendments of the budget after conducting a public hearing. We expect that we will propose budget amendments in 2024, probably in the 3rd quarter, when we have a more accurate idea of the actual revenues. TOWN MANAGER COMMENT: At the next Avon DDA Board of Directors meeting we will bring an agreement to rebate or share back any tax increment captured by the Avon Station, Confluence and Village Metropolitan Districts. This arrangement is consistent with the current arrangement with the Avon Urban Renewal Authority for Avon Station and Confluence Metropolitan Districts. RECOMMENDATION: Staff recommends the Board adopt the Resolution as presented. Board Member Neuswanger seconded the motion. The motion was approved unanimously with an 11-0 vote. 3.DISCLOSURE OF ANY CONFLICTS OF INTEREST RELATED TO AGENDA ITEMS Town Manager Eric Heil explained the definition of conflict of interest to the newly elected Board Members, and no conflicts of interest were disclosed. 4.PUBLIC COMMENT No public comments were made in person nor virtually. 5.BUSINESS ITEMS 5.1 Overview of Avon Downtown Development Authority Town Manager Eric Heil delivered a presentation to the Board Members related to the Avon DDA, including a careful review of the Avon DDA Statute adopted in the Avon Municipal Code. 5.2 Adoption of Simplified Rules of Order Board Member Neuswanger made a motion to approve the simplified rules of order, as presented. Board Member Jimenez seconded the motion. The motion was approved unanimously with an 11-0 vote. 5.3 Appointment of Officers After a nomination process was followed by a vote, Board Member Glaner made a motion to appoint Tony Emrick as Avon DDA Chair and Brandt Marott as Avon DDA Vice-Chair. Board Member Marott seconded the motion. The motion was approved unanimously with an 11-0 vote. After a nomination process was followed by a vote, Board Member Tartre made a motion to appoint Chris Neuswanger as Avon DDA Secretary. Board Member Jimenez seconded the motion. It was unanimously approved with an 11-0 vote. Town Manager Eric Heil was designated Executive Director of the Avon DDA. 5.4 PUBLIC HEARING: Adoption of Avon Downtown Development Authority Plan Town Manager Eric Heil delivered a presentation of the Avon DDA Plan. He noted that it is necessary to add business survey results under Appendix C to the DDA plan, and carve out the Confluence Metro District, Avon Station Metro District, and Village Metro District from the bottom of Page 3 of the Avon DDA Plan. DDA MEETING MINUTES MONDAY, OCTOBER 2, 2023 HYBRID FORMAT IN PERSON AT AVON TOWN HALL AND VIRTUALLY VIA MS TEAMS AVON DDA MEETING MINUTES, OCTOBER 2, 2023 PAGE 2 | 2 Board Member Lindholm asked that for the Village Metro District, there be an amendment to the plan to state that it may be extended beyond the December 31, 2053 deadline with the verbiage “…or such longer period if extended by statute or as otherwise negotiated.” Councilor Carroll noted that Section 6.1 of the Avon DDA Plan should also be amended to state “AT LEAST 50% of funding…”. Avon DDA Chair Emrick opened the floor to the public hearing, and no public comment was made in person nor virtually. At approximately 6:15 p.m., Board Member Tarbet left the meeting virtually. Board Member Jimenez made a motion to approve the Avon DDA Plan, as amended with the changes indicated above. Board Member Marott seconded the motion. The motion was approved unanimously with a 10-0 vote of those present. 5.5 Discussion of the Avon DDA Board Meeting Schedule Proposals from Staff and Councilor Carroll were to set a quarterly meeting schedule, while Secretary Neuswanger and Board Member Hanson suggested monthly meetings. After deliberations, DDA Board Chair Emrick noted consensus from Board Members in support of a quarterly meeting schedule starting 2024, and suggested that the next two meetings be held on December 4, 2023 at 3 p.m. and February 5, 2024 at 3 p.m. 6.ADJOURNMENT DDA Board Chair Emrick adjourned the meeting at 6:51 p.m. Respectfully submitted by: Miguel Jauregui Casanueva Avon Town Clerk These minutes are only a summary of the proceedings of the meeting.
