Additions and Amendments to the Agenda There was one amendment to the Agenda to move Item VI, Sketch Design Plan, Property Location: Lot 8, Block 5, Wildridge Subdivision/1031 West Wildwood Road, to the Consent Agenda. Chairman Evans requested moving the discussion of the Comprehensive Plan to the last item on the Agenda. IV. Conflicts of Interest Commissioner Savage recused himself from Item VI. Consent Agenda Commissioner Smith motioned for the approval of the Meeting Minutes from the July 6th, 2004, Planning and Zoning Commission Meeting; and Item VI, Sketch Design Plan, Property Location: Lot 8, Block 5, Wildridge Subdivision/1031 West Wildwood Road, Applicant: Stephen Richards, Owner: Steven McDonald, be approved on the Consent Agenda. Commissioner Savage seconded the motion and the motion passed unanimously. VI. Sketch Design Plan Property Location: Lot 8, Block 5, Wildridge Subdivision/1031 West Wildwood Road, Applicant: Stephen Richards, Owner: Steven McDonald Description: Stephen Richards is proposing a sketch design for two triplex units on West Wildwood Road. This lot is zoned for six units. Proposed materials include: wood siding and stucco. Each unit will be approximately 2,500 sq. ft., including garage space. Moved to Consent Agenda. VII. Sketch Design Plan Property Location: Lot 30, Block 2, Wildridge Subdivision/2631 Bear Trap Road Applicant VMDA, Mark Donaldson, Owner: Shane Bohart, Description: Victor Mark Donaldson is proposing a sketch design to add an additional dwelling unit F:\Planning & Zoning Commission\Minutes\2004\072004.doc Page 1 of 5 to an existing single-family home on Bear Trap Road. The property is zoned duplex and this dwelling unit is the second unit. The concept for this application was presented to the Commission during the Work Session of the May 18th,2004 meeting, and the application was tabled to this meeting from the July 20, 2004 meeting. Ken Kovalchik presented the Staff Report. Mark Donaldson and Chris Juergens, applicant representatives, discussed the application, as complying with all Design Guidelines, designed to grade for building height, and the plan was a "site responsive driven design". OPEN PUBLIC HEARING Greta Blamire, neighbor, advised the commissioners of the impact the plan would have on her home with the obstruction of the view corridor. CLOSE PUBLIC HEARING Commissioner review began with Commissioner Struve commenting on the design, to attach the new duplex portion to the existing structure, did not look connected or cohesive but resembles a breezeway. Commissioner Smith concurred with Commissioner Struve's comments. Commissioner Karow agreed that the design responds well to the site and technical issues could be resolved, however, the integrated design is difficult with an existing single-family house and it fell short of the Design guidelines, as it resembled a breezeway. Commissioner Didier and Chairman Evans agreed with Commissioner Karow's comments. Commissioner Trueblood suggested a PUD to create two single- family lots, as the design is too dissimilar however close to meeting the guidelines. Mr. Donaldson and Mr. Juergens questioned the criteria to be used for connected and unified. They were looking for guidance, as there were no definitions and believed they had complied with the guidelines. Chairman Evans responded that the design guidelines provided guidance to the "bridging" of duplexes. Commssioner Karow moved for denial of Item VII. Sketch Design Plan, Property Location: Lot 30, Block 2, Wildridge Subdivision/2631 Bear Trap Road Applicant VMDA, Mark Donaldson, Owner: Shane Bohart, with Commissioner Struve seconding the motion. The motion for denial passed 5 -1 with Commissioner Trueblood opposing denial of the application. VI11. Comprehensive Plan Public Input - Public Hearing Topic: Comprehensive Plan Update Applicant: Town of Avon Description: The public is invited to this special neighborhood meeting to provide input and feedback on the proposed update to the Town Comprehensive Plan. Commissioner Evans gave a quick overview of the Comp Plan to the attendees and introduced Commissioner Smith and Brian Sipes, Town Councilman, along with Tambi Katieb, staff member, as members of the Comp Plan Steering Committee. Dialogue regarding the fire station location, traffic, parking convenience, and commercial drawing ability resulted. IX. Special Review Use - Public Hearing Property: Lot 61 PUD, Block 2, Benchmark at Beaver Creek Subdivision/75 Benchmark Road. Applicant: Skyhawk Rugs, Owner: IDG3 LLC, Description: Skyhawk Rugs is proposing to operate a temporary retail rug sales business on this lot from August 5th - 15th. The hours of operation will be from 9:00am to 7:30pm daily. The applicant will have a cargo trailer and display racks on-site and parking will be provided within the lot. Ken Kovalchik presented the Staff Report. . OPEN PUBLIC HEARING No public comment. CLOSE PUBLIC HEARING Commissioner Karow moved to approve the application with Commissioner Smith seconding the motion. The motion passed with all commissioners in favor. X. Minor Project - Fence Property: Lot 1078, Block 1, Wildridge Subdivision/3063B Wildridge Road, Applicant: Michael & Sandy Horning, Owner: Michael & Sandy Horning, Description: The applicant is proposing to construct two new decks and install a split rail fence for dogs. Staff approved the deck portion of this application and the fence requires approval by the Planning Commission. The applicant is proposing to install a split rail fence 4 feet in height on the north side of their property for their two dogs. The length of the fence appears to be greater than 1/4 of the length of the perimeter of the property by approximately 10 feet. Ken Kovalchik presented the Staff Report. Sandy Horning, applicant, stated this was a resubmission from her original plans and the fence would be less than 4 feet in height and would be used to contain her dogs. She presented two options for the commissioners to review. Commissioner review focused primarily on the premise that "fencing was discouraged" in the Design Guidelines. Rick Walter, Wildridge resident, stated that trees surrounded the fence location. F:\Planning & Zoning Commission\MinutesU004\072004.doc Page 3 of 5 Commissioner Savage motioned to approve Option #2 and approval was contingent that no chicken wire or chain link be used and staff must approve the materials to be used. Commissioner Didier seconded the motion and the motion passed 6 to 1 with Commissioner Karow opposing approval. XI. Design Modification Property: Lot 22, Block 4, Wildridge Subdivision/5588 Coyote Ridge, Applicant: Ruth Miller, Ownec Ruth Miller, Description: The applicant is proposing to add an additional dwelling unit to this duplex-zoned lot. On June 14th, 2004 the applicant submitted a minor project application proposing to - construct a detached two-car garage with an apartment below. On June 18th, 2004 Staff notified the applicant that the application was denied because the application does not meet the definition of a duplex per section 17.08.240 of the Avon Municipal Code. The applicant is appealing the Staff decision. Tambi Katieb presented the Staff Report. Ruth Miller, applicant, stated that her desired plan was not presented and the addition was an extra bedroom and a second garage, and not a dwelling unit and without a kitchen. Commissioner review revolved on the issues of lock off unit, definition of a dwelling unit and the impact of a kitchen install at a later date. Chairman Evans questioned the for-sale sign on her property and Ms. Miller responded that the house would have greater sales dollars with the addition planned. Commissioner Trueblood motioned for approval of this Design Modification for a second bedroom, second garage and no kitchen installation. Commissioner Savage seconded the motion and all commissioners were in favor. XII. Amendments to Zoning Code & Design Guidelines - Public Hearing Property Location: Town of Avon, Applicant: Town Staff Description: In response to comments and feedback received from the building community during Public Hearings with the Town Council, staff was directed to clarify and improve the design review and building permit processes. Changes proposed include clarifications to the building height definition, PUD process, and public notice when reviewing Preliminary Subdivision plans in conjunction with PUD applications. Various amendments to the Design Guidelines are proposed and include: new sketch design plan requirements, appeals process revision, consolidated final design checklist, building height clarification to match Zoning Code, retaining wall definition, and a revised scheduling section. The amendments were reviewed at the July 6,2004 meeting and continued to this hearing. F:\Planning & Zoning Commission\Minutes\2004\072004.doc Page 4 of 5 Tambi Katieb discussed the revisions to the Zoning Code and Design Guidelines. Approval was sought to move the Amendments to Town Council for final approval. Commissioner review questioned the compliance of existing submitted applications and Mr. Katieb voiced that it shouldn't be an issue as the new guidelines are less restrictive. Commissioner Smith asked if there is a limit to the number of rows of retaining walls permitted and Staff stated that if there were over three rows of walls it would become a structural wall. Commissioner Savage complimented Staff on a job well done. OPEN PUBLIC HEARING Greta Blamire commented she would like to see the height requirement prevent excessive heights. CLOSE PUBLIC HEARING Commissioner Karow motioned to approve Resolution No. 04-20 and Resolution No. 04-21 for the Amendments to the Zoning Code and the Design Guidelines as presented by Staff. Commissioner Smith seconded the motion and all were in favor. IX. Other Business (Other business as may come before the Commission) Commissioner Trueblood brought up concerns for a Maintenance Ordinance for the Town of Avon to encourage ongoing preservation. X. Adjourn Commissioner Didier made the motion to adjourn. Commissioner Struve seconded and the motion was unanimously approved. The meeting adjourned at 7:45 pm. The building is approximately 5,800 square feet in size and would include two (2) 4-bedroom units. Some proposed materials include cedar board on board siding, stucco, and asphalt shingles. The lot has a consistent 25% grade from the road to the back lot line. Currently, the property is covered with sagebrush and is surrounded by vacant lots on either side. The proposed design stretches fi--im one side of the lot to the other, with decks to border toth side (10') building setback linos. Retaining walls are proposed behind the building in rider to allow for decks and a flat area behind each unit. Design Review Considerations According to the Town of Avon Residential, Commercial, and Industrial Design Review Guidelines, Section 7, the Commission shall consider the following items in reviewing the design of this project: 1. The conformance with setbacks, massing, access, land use and other provisions of the Town of Avon Zoning Code. • Allowed use: A duplex is an allowed use for this lot. • Density: The lot is zoned for 2 units per the Wildridge PUD. • Lot Coverage: Maximum site coverage allowed for this PUD is 50%. This project appears to comply with this requirement and will need to be confirmed at Final Design. • Setbacks: All setbacks are labeled on the site plan. Each unit of the duplex proposes a deck that would come within inches of the side (10') setback lines. According to the Architectural Foundation Plan (Plan Sheet AS1) it appears that one of the deck support columns for the south unit encroaches into the side setback. This must be removed from the setback by Final Design submittal. • Easements: All easement remain unobstructed with this design submittal. No portion of any roof exceeds 34' as proposed. • Grading: Grading on the property appears to be done only as necessary for building improvements. Both existing and proposed grades are indicated on the Site Plan. The finished grading does not demonstrate that water will move around the structure. It appears that a drainage swale may be necessary in order to direct water away from and around the building. • Parking: 6 parking spaces are required for this project, and it appears that 6 functional spaces are provided on site. • Snow Storage: h appears that sufficient on-site snow storage will be available for the proposed site design. This design requirement will be reviewed at Final Design for compliance with Town standards. The placement of landscaping near the driveway should not inhibit snow storage operations. • Landscaping: A Landscaping Plan will be reviewed at Final Design. No more than 20% ofthe total landscaped area may be irrigated. Compliance with this requirement must be demonstrated with an irrigation table on the Final Design submittal. 2. The general conformance with Goals and Policies of the Town of Avon Comprehensive Plan, and any sub-area plan which pertains. The project generally complies with the Town of Avon Comprehensive Plan. 3. Whether adequate development rights exist for the proposed improvements. Adequate developi ient rights exist in the Wildridge PUD for the proposal. A single-family or duplex may be 1 uilt on the property. 4. The sketch plan i in general compliance with all design requirements. • Site Development: o Site Design: The building appears to blend in well with the natural settings. Slope retention is limited to the rear ofthe property in order to allow for a small flat back yard area. o Site Access: Entrance to the site is provided with a 12' wide driveway. Access grades appear to exceed the 4% maximum requirement for the first 20'. This should be clarified with a spot elevation 20' from the driveway entrance. o Parking and Loading: The guidelines state "parking and loading location and design is significant in avoiding conflict in multi-family projects." There are areas on each side of the project that appear to be hammerhead turnaround areas. Additionally, spot elevations should be provided 20' out from the garage doors to ensure compliance with Town of Avon driveway grade requirements. It appears that driveway grades exceed 4% (over 7% for the north unit) leaving the garage doors. o Easements: All easements are labeled correctly and would remain unobstructed with this project. Landscaping improvements shall avoid placement in easements whenever possible. Drainage swales may be necessary to carry water around the structure. This must be addressed by Final Design. There is an 8" culvert shown on the site plan. The driveway culvert must be per the Town of Avon Standard Driveway Culvert Detail by Final Design. o Snow Removal and Trash Storage: h appears that snow storage can be accommodated on-site. This will be reviewed at Final Design. • Building Design: o Design Character: The guidelines state that buildings should be orientated to take advantage of solar gain and view corridors. This design is taking advantage of view corridors. The building design should not impact the solar or view corridors of the neighboring properties. o Building Height: As stated, the building appears to be in compliance with the 35' limitation. The ridgeline elevations should be called out on the Site Plan. o Building Materials and Colors: Materials and colors will be reviewed at Final Design. Indigenous natural or earth tones are required in residential neighborhoods. According to the application form and provided building elevations, proposed materials include: asphalt shingles, a stucco body, and cedar wood decking, fascia, and board on board siding. o Exterior Walls, Roofs, and Architectural Interest: Architectural interest is provided on each elevation ofthe structure. All primary roof pitches equal 6:12, with some ·4:12 pitches above the garage doors. The proposed roofig material is asphalt shi.igles, which must carry a weight of 300 pounds per squa.'e foot. o Outdoor L,ghting: Lighting will be reviewed at the time of Final Design submittal. o Duplex Developments: The development appears to be designed in a manner that creates an integrated structure on the site. Compatible building materials, architectural style, scale and massing are proposed for each side ofthe duplex. • Landscaping: Landscaping will be reviewed in detail with a Final Design submittal. An irrigation table will be required on the site plan on the Final Design submittal. o Retaining Walls: The plans show two separate retaining walls behind the structure that would run from one side lot of the lot to the other. The Guidelines encourage landscaping between retaining walls and this should be included in the Landscape Plan at Final Design. Although difficult to determine without additional spot elevations (Top of Wall and Bottom of Wall) on the Site Plan, some of the proposed boulder walls do not appear to meet the criteria for non-structural retaining walls. All walls over 4' in height must be designed and stamped by a Colorado Registered Professional Engineer. Proposed grading must demonstrate positive drainage away from and around the structure. Drainage swales are necessary. 2. A current (less than 3 years old) survey must be provided. 3. All portions of the proposed decks (including support columns) must be removed from the building setbacks. 4. The driveway culvert must be per the Town of Avon Standard Driveway Culvert Detail. This includes indicating an 18" culvert and providing a minimum of 12" of cover over the top of pipe. Grading may be necessary around the culvert and should be indicated on the site plan. 5. Except as otherwise modified by this permit approval, all material representations made by the applicant or applicant representative(s) in this application and in public hearing(s) shall be adhered to and considered binding conditions of approval. The application under review would amend the MSP to require all first floor tenants to utilize aluminum cabinet box type signs with acrylic faces and vinyl lettering. The revised tenant signs would fit inside the white mesh framing that exists currently on the building and each sign would measure 20" x 108." The Association for the building recommends forest green and white colors for the tenant signy. Also part ofthe application is an a nendment to the design of the Monument Sign that exist:; on the comer of the property. The sign would increase in height by 4 feet and would allow for four (4) tenant panels. Currently the Monument Sign only has the "Westgate" name routed in a metal face. Background The original MSP for Westgate was approved in 1994, which approved signage for all of the first floor tenants. The approval stated all signage for the tenants would be in the form of Pan Channel lettering in green and tan colors consistent with those of the Westgate Building. On December 6, 1994, a MSP amendment was approved for Unit #105 (currently Agave) to allow for two signs on the top of the round parapet wall. At the February 19, 2002 Planning and Zoning Commission meeting another MSP amendment was approved to change the material of the two signs for unit #105 from Pan Channel lettering to backlit black iron letters. Design Review Considerations According to the Town of Avon Sign Code, Section 15.28.070, the Planning & Zoning Commission shall consider the following items when reviewing proposed designs: 1. The suitability of the improvement, including materials with which the sign is to be constructed and the site upon it is to be located. Both options (A1 and A2) propose to retain the existing stone base of the current monument sign. raise the Westgate name panel, and add four tenant name panels. Each tenant panel would measure l'x 6." Both monument options would raise the height of the sign from 5' to 9'. Option A1 would include white acrylic faces with translucent copy. The typestyles, logos, and colors would be subject to condominium association approval, and the association recommends forest green and white colors. Option A2 would consist of routed forest green metal faces with white translucent acrylic message to allow light through the copy (similar to the current monument sign design). Tenant Signs: The current sign program requires first floor tenants to use illuminated pan channel lettering for their individual signs. The proposed amendment would require tenants to use aluminum cabinet (backlit) boxes with acrylic faces, and the location ofthese signs would be the same as the current tenant spaces on the building. The material (aluminum cabinets) is encouraged by the Sign Code. 2. The quality of the materials to be utilized in any proposed improvement. Monument Sign: In order to remain consistent with the "Westgate" sign design that exists today, staff recommends that the proposed tenant panels be constructed with routed green metal faces and white translucent acrylic messages (Option 2). Tenant Signs: The proposed aluminum cabinet box type signs may appear to be ofa lesser quality than the signs currently used for first floor tenants. Aluminum cabinet box type signs may diminish the appearal ce of the building and staff is recommending the same design as the proposed Option 2 for the monument sign (similar to the MSP recently approved for the Avon Center). 3. The visual impact of any proposed improvement, as viewed from any adjacent or neighboring property. Monument Sign: The visual impact of adding 4 feet in height to the existing monument sign should not detract the appearance of the property. The Sign Code requires 5 lineal feet of landscaping out from, and around the perimeter of all freestanding signs. Additional landscaping should be installed around the sign in order to diminish the visual impact of the sign. Tenant Signs: As stated, the visual impression of the Westgate building may be diminished with the proposed aluminum cabinet box signs. 4. The objective that no improvement will be so similar or dissimilar to other signs in the vicinity that values, monetary or aesthetic, will be impaired. Monument Sign: Monetary or aesthetic values should not be impaired with each option (Option 1 and Option 2) for the revised monument sign design. Staff recommends Option 2 in order to stay consistent with the existing sign materials on the Monument Sign. Option 1 (acrylic faces with vinyl lettering) could impair the aesthetic values of the property. Tenant Silms: Monetary and aesthetic values should not be impaired with this MSP amendment for tenant signs. However, the application does not establish a sunset clause for compliance. Whether the type, height, size, and/or quality of signs generally complies with the sign code, and are appropriate for the project. Monument Sign: The Sign Code states that "in general. sites shall be limited to one (1) freestanding sign with an area of forty (40) square feet and a height of eight (8) feet." Furthermore, "the Planning and Zoning Commission shall also have discretionary powers to approve a freestanding sign with a maximum total area of sixty-four (64) square feet and a maximum height of twenty (20) feet." The proposed sign would be 814' tall and approximately 38 square feet in size. The size of this sign appears to be appropriate for the site and the quality ofthe Option 2 design may be more appropriate for the building since the "Westgate" logo that exists would be the same construction quality. Tenant Signs: The current MSP allows requires 2' x 8' (or 16 sq. ft.) sign faces for the Unit 101-104 tenant signs. The proposed amendment would require 1.6' x 9'(or 14.4 sq. ft.) cabinet signs. The Sign Code states "sign programs shall be compatible with the site and building, and should provide for a similarity oftypes, sizes, styles and materials for signs within a project." The size and location of the proposed box signs is appropriate for the project. All tenants should comply with the revised sign design within one year. 6. Whether the sign is primarily oriented to vehicular or pedestrian traffic, and whether the sign is appropriate for the determined orientation. The signs are oriented to vehicular traffic. This orientation is appropriate given the location near Highway 6 & 24. Staff Recommendation Staff recommends the following approvals ofthe Master Sign Program for the Westgate Building on Lot 3, Block 3, Benchmark at Beaver Creek Subdivision: 1. Option 2 is approved for the Monument Sign. Vacant tenant sign panels will be metal panels painted to match the existing green color. 2. All 1St floor tenants (with exception of 2 metal parapet Agave signs) shall comply with this revised design within one year of approval. New tenant's signs shall be the same construction (routed green metal) as the Monument Sign. 3. Additional landscaping will be added around the Monument Sign at least 5' in each direction. Community Development shall approve a revised landscape plan for this area. 4. No colored bulbs (luminaries) are permitted. 5. Except as otherwise modified by this permit approval, all material representations made by the applicant or applicant representative(s) in this application and in public hearing(s) shall be adhered to and considered binding conditions of approval. A tenant that occupies more than one space may have a maximum oftwo 2' x 8' signs over their space. Each tenant is required to have a conforming sign. See 2-D for unit details. The copy portion of the signfaces may utilize a maximum of 16 square feet, see exhibit 3-A. Logos, which will be an illuminated cabiR@f-siin, may constitute a maximum of40% of the sign square footage allowed. Typestyles shall be at the tenant's discretion, subject to the condominium association approval and limited stroke to permit UL label signs. The main portion of the signage- which includes the tenant business name will be illuminated pan channel letters. Up to 40% of the allowed square footage may be dedicated to the nature of the business. This copy may be illuminated as pan channel letters (colors to match main text), or be an illuminated cabinet sign, text, trim and return to be matching green, and the face to be ivory plex. All illuminated signfaces shall have forest green sides and trim to match the building trim, with translucent ivory acrylic faces, similar to translucent plex #2146. All electrical signage shall be UL labeled. 2 Subdivided or shared space: A maximum of two signfaces shall be used by the two or more business. Limits as to materials, logos, and nature of the business shall be the same as above. Two or more spaces for one tenant: A maximum of two signfaces may be used by a tenant occupying more then one space (101-104). A maximum of 50% ofthe total square footage allowed Of the two signfaces are used), may be used for the nature of the business. (Exhibit 2-13). Unit 105: The occupant of space 105 will have pan channel letters and logo box cabinet signs, similar to above in color and percentage limitations as above, but with a total square footage limitation of 30 square feet, see exhibit 3-A. Placement will be centered left/right and up down, to utilize the 30 square feet, as shown in exhibit 3-B. Window signate: First floor tenants shall be permitted window signage in accordance with the then current Town of Avon sign code (subject to condominium association approval). Rear door signage: First floor tenants may place the suite number and business name on the rear entry door. The signs shall be a maximum of2 square feet in size, and may be vinyl graphics or other non-illuminated materials at the tenants choice, subject to condominium association approval. Temoorary signage: First floor tenants may utilize temporary signage of tan vinyl banners with green copy, similar to the permanent illuminated signage, to be placed over the permanent sign area during the period of construction of approved signage. This may be in place a maximum of 60 days. All sale and special event signs, and other temporary signage require approval of the condominium association, and must be in conformity of the Town of Avon sign code. 3 SECOND FLOOR TENANTS No signage is permitted for second floor tenant. This prohibition includes building signs and window signs. DIRECTORY An illurninated tenant directory shall be placed at the location shown in exhibit 4-B. The directory shall be fabricated from green painted aluminum, with slide-in panels. The copy - -- - -- - - shall be translucent green in an ivory field. The owners of Units A, B, and C (applicant) are proposing to make improvements to the West, South, and East sides of the three units. The applicant is proposing to remove all existing siding and trim boards; repair or replace wall insulation and sheathing; and apply a synthetic or real stucco material and fiber cement siding to the areas indicated on the drawings. All stucco work will receive the same 'skip trowel' finish. Windows will be repaired or replaced as needed. A belly band will be installed as indicated on the drawings. A cultured stone base will be applied as indicated on the drawings. Existing deck structures will be repaired or replaced as needed. The decks will be reconstructed to comply with the current building code. The existing stairs will be replaced with pre- fabricated steel stair units consisting of grate style treads. Decking materials will consist of composite or wood. Design Review Considerations According to the Commission's Procedures, Rules & Regulations, Section 4.10, the Commission shall consider the following items in reviewing the design of this project: 1. The type and quality of materials of which the structure is to be constructed. A variety of quality, durable building materials is proposed which include: synthetic/real stucco, fiber cement siding, cultured stone, composite/wood decking material. 2. The appearance of proposed improvements as viewed from adjacent and neighboring properties and public ways, with respect to architectural style, massing, height, orientation to street, quality of materials, and colors. No negative impacts should be experienced as viewed from adjacent properties. 3. The objective that no improvement be so similar or dissimilar to others in the vicinity that monetary or aesthetic values will be impaired. As proposed, the townhome improvements should not impair monetary values or aesthetic values in the vicinity. The general conformance of the proposed improvements with the adopted Goals, Policies and Programs for the Town of Avon. As proposed, the townhome improvements appear to conform to the adopted Goals, Policies and Programs o f the Town and appears consistent with the Design Guidelines. Staff Recommendation Staff recommends approval of the townhome improvements to Units A, B, C for Lot 43, Block 1, Benchmark at Beaver Creek Subdivision with the following conditions: 1. The owners of each individual unit shall obtain the necessary building permits from the Town o f Avon Building Department prior to construction. 2. Except as otherwise modified by this permit approval, all material representations made by the applicant or applicant representative(s) in this application and in public hearing(s) shall be adhered to and considered binding conditions of approval.
