Call to Order The meeting was called to order at 5:30 pm. 11. Roll Call All Commissioners were present with the exception of Commissioner Karow. 111. Additions and Amendments to the Agenda There are no additions or amendments to the agenda. IV. Conflicts of Interest Commissioner Evans voiced conflict with Item VII. Master Sign Program - American National Bank, Property Location: Lot 70, Block 2, Benchmark at Beaver Creek St ib/71 Beaver Creek Place. V. Consent Agenda Commissioner 1 rueblood motioned for the approval of the Meeting Minutes from the October 5th, 2004, Planning and Zoning Commission Meeting; Commissioner Savage seconded the motion and the motion passed unanimously with Commissioner Didier abstaining due to his absence. VI. Sketch Design - Duplex Residence Property Location: Lot 19, Block 1, Wildridge Subdivision/2145 Saddle Ridge Loop Applicant Larry Benway Owner: Jim Meehan Description: Larry Benway is proposing a duplex on the uphill side of Saddle Ridge Loop. The building is approximately 6,865 square feet in size and would include two (2) 4-bedroom units. Proposed materials would include: cedar board siding, stucco, and asphalt shingles. Eric Heidemann presented the Staff Report to the Commission. Commissioner Evans questioned the need for a new survey, as the applicant had provided a 1998 survey. Mr. Heidemann responded that there could be fill placed upon the lot during the transition of time to date. Larry Benway, architect for Mr. Jim Meehan, approached the podium to answer Commissioner questions. He addressed the issue of the parking within the setback. Commissioner Didier asked about a missing handrail and Mr. Benway F:\Planning & Zoning Commission\Minutes\2004\101904.DOC Page 1 of 4 noted the error on his plans and will correct. Commissioner Struve questioned the two different garages and Mr. Benway commented that Design Guidelines specifically state not to mirror image the duplexes. It was suggested to the applicant to break up the massing perhaps by introduction of a bellyband around the project. Commissioner Trueblood discussed the landscaping and how it could enhance the visual of the project. The landscaping plan will be provided at Final Design Review. Commissioner Savage and Commissioner Didier suggested that a shed roof might be attractive for the other entry. Commissioner Struve and Commissioner Smith were concerned with the West Elevation. VII. Master Sign Program - American National Bank Property Location: Lot 70, Block 2, Benchmark at Beaver Creek Sub/71 Beaver Creek Place Applicant: Kit Magley, Gardner Signs, Inc., Owner: American National Bank Description: Kit Magley is proposing a new Master Sign Program (MSP) for American National Bank in their new Avon location. The program includes four signs total including: one monument sign, one building mounted sign near the main entrance, and two freestanding directional signs. Matt Pielsticker presented the Staff Report. Two more signs were presented at the work session. Commissioner Trueblood was concerned with the two front signs one being on the building and the other as a monument sign. He continued that the sign proy- ram was created to eliminate have a builcting reflecting excessive signage. Kit Magley, Gardner Signs, approached the podium to answer Commissioner F concerns. Ms. Magley mentioned that the bank anticipates opening in mid December and the signs will require five weeks to produce. Ms. Magley requested review of the original sign application and their locations with the commissioners. Ms. Magley had presented two additional signs for this location during Commission Work Session. It was Commissioner consensus that the two additional signs be submitted at another time so that production of original application signs can begin. Commissioner Trueblood motioned for approval of the original application for Item VII, Master Sign Program - American National Bank, Property Location: Lot 70, Block 2, Benchmark at Beaver Creek Sub/71 Beaver Creek Place Commissioner Struve seconded and the motion passed 4 to 1 with Commissioner Didier opposing. VI11. Other Business A. Minor Project - Modifications to Final Design Approval Property Location: Lot 45C, Block 2, Wildridge Subdivision/2520 Old Trail Applicant/Owner. Bob Mach F:\Planning & Zoning Commission\Minutes\2004\101904.DOC Page 2 of4 Description: All changes to a final design must be approved through a 'Minor Project' application. Bob Mach is proposing modifications to his approved landscaping and building design. The project is a single-family home on Old Trail Road and is currently under construction. Matt Pielsticker presented the Staff Report. Bob Mach, applicant, approached the podium and addressed the 9 issues, presented in the Staff Report, individually. Mr. Mach maintained that the split rail fence is not visible from anywhere but on the property and should be acceptable to the Commission. He would still like to have a 6-foot fence for privacy and could change it to a 4-foot high 10ft X 10ft fence. The window is larger than originally proposed and has been centered under the gable. The bellyband would be as demonstrated on the plans. Staff requested the elimination of a deck and Mr. Mach requested that it be addressed at another date. He removed the bellyband, due to changes in window size, however it was a condition of the original Final Design Approval. Commissioner Didier commented that the berms are at neighbor's discretion and the bellyband issue is difficult to envision. Commissioner Trueblood was concerned with the elevation and the bellyband, and to landscape appropriately instead of erecting a fence for hot tub privacy. Commissioner Savage voice disapproval for the construction of this borne as it is being construction ver, differently from the approved Final Design. Commissioner Didier moved to approve Minor Project - Modifications to Final Design Approval, Property Location: Lot 45C, Block 2, Wildridge Subdivision/ 2520 Old Trail, ApplicanVOwner: Bob Mach, as follows: Item 1. Two berms on easterly property line - Approved with the condition that the neighboring property owner must provide written approval of the berms on their property to staff prior to issuance of a Temporary Certificate of Occupancy. Item 2. Install 40' of 3' high split rail fence - Approved. Item 3. Install 20' length of 6' cedar privacy fence near hot tub - Denied. Item 4. New window location on north elevation - Approved. Item 5. Omit bellyband detail from all elevations except for gable bumpout on north elevation - Denied. Bellyband is approved for north elevation only, but must terminate to inside corners, not outside corners. Item 6. Omit Deck - Denied. Item 7. Two new firebox bumpouts. - Approved. Item 8. The proposed amendments to the PUD includes the removal of the 6 deed restricted housing units as required by Ordinance 98-6 to be replaced by 3 fractional ownership units. Furthermore, the applicant agrees to enter into a development agreement with the Town which will include: (1) payment of an in-lieu fee (impact fee) of $100,000 to the Town of Avon's Affordable Housing Program; (2) establishment of a time share amenity fee; and (3) an agreement that should a certificate of occupancy not be issued by the second anniversary of the effective date (2006), the Town will retain a $60,000 cash deposit, the building permit shall be cancelled and no further development shall be permitted under existing approvals (i.e. all approvals will be null and void, including the PUD and the Design Review approvals). These amendment items will be effectuated by a development agreement entered into by the property owner and the Town of Avon. The development agreement is currently being reviewed by the Town Attorney and should be finalized prior to the Council's public hearing. This submittal is also being reviewed in conjunction with a minor modification application for some of the previously approved design features. Background & Discussion The PUD was originally approved September 1996 and later amended in June, 1998. The PUD currently consists of 31 fractional-fee units, 6 employee housing units, 17 whole ownership units, and a total of 4,127 sq. ft. GLFA of commercial space. The applicant is requesting removal of the 6 deed restricted housing units to be replaced by 3 fractional ownership units. The PUD currently contains a condition which states " Deed restricted affordable housing or employee units shall be included in the development in an amount equal to ten percent of the hotel, residential, or timeshare units." The deed restricted units are located on the west end of the first floor. If approved, the total number of units would be reduced from 54 to 49 units. The payment of an in-lieu fee of $100,000 to the Town of Avon Affordable Housing Program is expected to offset the proposed reduction of 6 deed restricted housing units. In addition, the applicant agrees to the establishment of a timeshare amenity fee. The amount of the fee and the fee schedule will be outlined in the development agreement Included in the proposed development agreement is a requirement that should a certificate of occupancy not be issued by the second anniversary of the effective date (2006), the Town will retain the $60,000 cash deposit, the building permit shall be cancelled and no further development shall be permitted under existing approvals (i.e. all approvals will be null and void, including the PUD and the Design Review approvals). Following is a detailed timeline for the activity that has taken place on the Chateau property: Februarv 1996 - Chateau St. Claire LLC petitioned to the Town for annexation and PUD zoning and development plan approval. The proposed project was a 4-story building with 72,000 sq. ft. devoted to office, retail and restaurant. No residential use was included. September 24, 1996 - Council approved the Annexation (Ordinance 96-16) and PUD zoning and Development Plan (Ordinance 96-17) with the condition that the parcel be subdivided into two lots: a 2.42-acre development lot ("Lot 1 ") and a 3.38-acre Public Open Space lot ("lot 2"). Lot 2 is to be dedicated to the Town. July 1997 - Applicants received a building permit, This permit eventually lapsed due to a lack of progress. August 5, 1998 - Council approved a PUD Amendment (Ordinance 1998-6) allowing for 150 hotel rooms or 110 timeshare units with office, retail, restaurant and service commercial land- uses. The permitted uses were altered with this amendment, not the design of building. September 5, 2000 - Revised Final Design plan was submitted and approved for a 6-story, 118,000 sq. ft. building including 52 condominium units and a restaurant. The condominium units were proposed as a mix of interval ownership, fee simple ownership and employee housing. This revised design submittal is similar in height and massing to the original design approved in 1996. September 26,2000 - Town issues a grading permit (X-EG2000-2) to clear debris and topsoil from the site. All work pertaining to this permit was completed October 12,2000. August 2001 - Town issues a foundation, excavation, and retaining wall permit (X-EG2000-3) and retained a surety to ensure restoration of the site pending issuance of a complete building permit. June 2002 - Building permit (C-BP2001-4) is issued. • Town expires building permit due to lack of construction activity on the site. The owner/developer is required by the Town to pay half of the building permit fee again to extend the building permit (allowed under the 1997 UBC). December 10, 2002 - The Town issues a new building permit (C-BP2002-17) with specific conditions for construction and development. • Based on this revised permit, owner/developer was required to commence construction no later than May 10, 2003 and pay a recreational amenity fee in the amount of $58,808 Town of Avon Community Development (970) 748-4030 Fax (970) 949-5749 Lot 1, Chiteau St. Claire Subdivision, "Gates on Beaver Creek" PUD Amendment November 16,2004 Planning & Zoning Commission meeting Page 3 0 f 5 and a school impact fee in the amount of $11,415.81 for a total of $70,223.81. The Town collected all fees. • Renewal #1 (January 27, 2004): 180 days pending satisfactory funding in place. • August 2004: Town Attorney determines funding in place • August 11, 2004 :Inspection performed on shared and partial footing. Permit will expire in 180 days (February 7th, 2005) with no substantial resumption of activity. PUD Design Criteria According to the Town of Avon Zoning Code, Section 17.20.110, the following shall be used as the principal criteria in evaluating a PUD. It shall be the burden of the applicant to demonstrate that submittal material and the proposed development plan comply with each of the following design criteria, or demonstrate that one or more of them is not applicable, or that a particular development solution is consistent with the public interest. 1. Conformance with the Town of Avon Comprehensive Plan's Goals and Objectives. The fundamental reason for having a Comprehensive Plan is to generally communicate where and how land uses may and will occur in the Town. The land use plan is based upon these goals and polices. Implementation is through annexation, subdivision and zoning regulations. This proposed PUD Amendment appears to comply with the following goals and polices of the Town Comprehensive Plan based upon the following: Policy Al.1 Development and redevelopment will be of a scale and intensity appropriate for the neighborhood in which it is located. The proposed Chateau St. Claire PUD amendment will not increase the land use intensity or overall density. In fact, the proposed amendment to the PUD represents a reduction in residential density from 52 units to 49 units. The proposed amendment has no bearing on the scale of the project, based on the prior approvals. Additionally, the net anticipated change in average daily trips (ADD generated from the site is negligible, and may create a reduction in ADT. Policy C2.1 New development, annexations, and major redevelopment shall include or otherwise provide for affordable housing. The application proposes the removal of 6 deed restricted housing units to be replaced by 3 fractional ownership units. Although this amendment would eliminate all deed-restricted units, the owner has agreed to contribute $100,000 towards the Town's Affordable Housing Program. Policy C2.4 The Town will encourage and, to the extent practical, participate in development of affordable housing. Conformity and compliance with the overall design theme of the town, the sub-area design recommendations and design guidelines of the Town. The proposed amendment application has previously been evaluated for conformity to the design guidelines of the Town with the original adoption of the PUD. The proposed changes are internal to the project and will not affect the exterior design. 3. Design compatibility with the immediate environment, neighborhood, and adjacent properties relative to architectural design, scale, bulk, building height, buffer zones, character, and orientation. The proposal appears compatible with the immediate environment, neighborhood, and adjacent properties including the proposed conditions of approval. 4. Uses, activity, and density provide a compatible, efficient, and workable relationship with surrounding uses and activity. The proposed uses appear to provide a compatible and efficient relationship with the surrounding uses and existing residences. 5. Identification and mitigation or avoidance of natural and/or geologic hazards that affect the property upon which the PUD is proposed. The application does not appear to negatively affect a known geologic hazard. 6. Site plan, building design and location and open space provisions designed to produce a functional development responsive and sensitive to natural features, vegetation and overall aesthetic quality of the community. The site plan and location of buildings and open space are responsive to natural features of the existing PUD. 7. A circulation system designed for both vehicles and pedestrians addressing on and off site traffic circulation that is compatible with the Town Transportation Plan. The proposed amendment will not affect the anticipated circulation system, creating no change to the access. 8. Functional and aesthetic landscaping and open space in order to optimize and preserve natural features, recreation, views and function. The landscaping has been reviewed through the design process when the PUD was originally adopted. 9. Phasing plan or subdivision plan that will maintain a workable, functional, and efficient relationship throughout the development of the PUD. The phasing plan shall clearly demonstrate that each phase can be workable, functional and efficient without relying upon completion of future project phases. The phasing plan submitted has been reviewed through the design process when the PUD was originally adopted. 10. That the existing streets and roads are suitable and adequate to carry anticipated traffic within the proposed PUD and in the vicinity of the proposed PUD. The original approval consists of 31 fractional-fee units, 6 employee housing units, 17 whole ownership units, 135 parking spaces and a total of 4,127 sq. ft. GLFA of commercial space. In July of 2003 the applicant received conceptual approval for a 'theme' change to the exterior of the structure- from French Chateau to a Swiss Chateau. Some of the conditions from that approval have been incorporated into this design submittal. Prior to construction of an on-site riockup, the applicant is seeking approval of auditional exterior changes. Some of the exterior site design changes evident on Sheet Al.1 include the following: o Reconfiguration of stair access to an enlarged patio area on north (Highway 6) side of the project. New patio design to include two gas-log fireplaces and concrete pavers of a variety of colors. o New 'air handling' unit on the west side of the property to be screened with a site wall enclosure. o Size of transformer near garage entrance has been reduced and new enclosure design provided. o Relocation of outdoor hot tub from western property line to indoor pool area. o New decorative steel fence added for security (visible on Sheet A4.1). Various building design changes are proposed including: o Removal of all window planter boxes. o Window heads and sills changed from stained wood to built up cement stucco detailing. o Canvas awning removed from north outdoor patio. o Baroque turret above main entrance has been modified. It is important to note that some of the proposed design modifications are limited to architectural elements, and details can only be approved with review of an on-site mockup (as required by final design approval). The massing, building location, density, and height remain unchanged with this application. Design Review Considerations According to the Town of Avon Residential, Commercial, and Industrial Design Review Guidelines, Section 7, the Commission shall consider the following items in reviewing the design of this project: 1. The conformance with setbacks, massing, access, land use and other provisions of the Town of Avon Zoning Code. • Allowed use: Fractional, timeshare, whole ownership, and commercial are all permitted uses in this PUD. • Density. The density approved was for a total of 54 units, which included 6 employee housing units. As part of a separate application, the 6 required employee units would be eliminated and the final project density reduced to a total of 49 fractional ownership units. • Lot Coverage: Building lot coverage proposed is. at approximately 22%, and remains unchanged from the full final design appro,al. • Setbacks: The project complies with all setbacks. • Easements: A new shared access design to benefit the neighboring property to the east (Folson) is provided with this application. Several easements must be executed by the Owner and the adjacent property owner to allow for this new shared entrance and access configuration. • Building Height. The building height is restricted to 74 feet. The plans show compliance with this height limitation. • Grading: The grading plans submitted by the civil engineer comply with Town requirements. • Parking: Parking demand would be reduced with a separate PUD amendment application by removal of the 'future restaurant' and 6 employee housing units. Adequate parking is provided on-site. • Snow Storage: A large portion of the entrance and main driveway is snow- melted. A significant portion of the remaining snow will be hauled from the site. Whether adequate development rights exist for the proposed improvements. The project complies with existing development rights as approved in the PUD. 4. The final design plan is in compliance with all sketch plan approval criteria and with all final design plan submittal requirements. • Site Development o Site Design: Site design is unaffected by the proposed architectural changes. Slight modifications to the site plan (Sheet Al.1) are bubbled in on the reduced copy of the design plans. Please refer to the bullet items above for specific changes to the site design. o Site Access: Access from Highway 6 & 24 is being provided in accordance with CDOT access requirements. Shared access to the neighboring property is provided with this application. o Parking and Loading: Surface parking is slightly modified to accommodate an improved retaining wall scheme, a new front patio layout, and ADA accessibility requirements. All parking is in compliance with the approved PUD and Town standards. o Easements: As stated, several easements must be executed with the owner and property owner to the east in order to successfully complete the project and design as proposed. At this time no easements have been executed. o Site Grading: The grading plan appears consistent with the building permit approval. o Drainage: Drainage appears functional. Some of the proposed drainage occurs on the neighboring property to the east. o Snow Removal and Storage: Snow removal is accomplished by a combination of snowmelt and off site storage. o Water, Sewer, and Trash Storage: Trash is being screened inside the parking structure. o Sidewalks: Sidewalks are provided in compliance with Highway 6 CDOT and Town requirements. • Building Design: o Design Character: The design of the project now consists of a Swiss architectural theme rather than French. Some material changes include: corner quoining from cast stone to built- up cement stucco quoins, and window head and sill details from stained wood to built up cement stucco detailing. o Exterior Walls, Roofs, and Architectural Interest The texture of the exterior stucco walls has been modified with this application. This will be reviewed in detail with an on-site mockup. o Outdoor Lighting: New lighting cut sheets are provided with this application for site and building mounted light fixtures. • Landscaping. o Design Character: The landscaping plan provides adequate screening and consists of appropriate materials that compliment the architectural style. However, a revised landscape plan must be submitted which includes the required irrigation calculations. o Retaining Walls: The facing material finish for the retaining walls must be provided with the on-site mock-up. • Miscei aneous: o Signs: No signage is included with this application. A separate master sign program application must be submitted and approved by the Commission prior to issuance of a Temporary Certificate of Occupancy. 5. The compatibility of proposed improvements with site topography, to minimize site disturbance, orient with slope, step building with slope, and minimize benching or other significant alteration of existing topography. The project is compatible with site topography and complies with the site plan previously approved. 6. The appearance of proposed improvements as viewed from adjacent and neighboring properties and public ways, with respect to architectural style, massing, height, orientation to street, quality of materials, and colors. The modifications to final design of theme comply with the guidelines with respect to massing, style, height, and quality of materials. 7. The objective that no improvement be so similar or dissimilar to others in the vicinity that monetary or aesthetic values will be impaired. The close proximity to the entrance of Beaver Creek and the Swiss/Alpine Chateau theme of the revised elevations will not impair aesthetic values and should be appropriate for the area. Box 975 Avon, CO 81620 RE: Minor Modification Application- L'Auberge on Beaver Creek (formerly Geneva Crown Club) Brief History: A Final Design Application for Lots 1 and 2 of the ChAteau St. Claire subdivision received approval from the Town of Avon Planning Commission on September 5,2000. This approval and any subsequent approvals are still contingent upon a final review of an on-site building materials mock-up by the Town. Based on the PUD approval and Ordinance, CSC Land and a design team generated Construction Documents that were submitted to the Town of Avon Building Department under the name "L'Auberge on Beaver Creek" dated September 07,2003. This set of Construction Documents received building department approval and a building permit (with conditions) numbered C-BP-2002-17 in late September of 2001. On June 24,2003 Parkhill-lvins, P.C. submitted a Final Design Modification package under the altered project name, Geneva Crown Club, to the Town of Avon Planning and Zoning Commission in order to update the site plan and building elevations previously approved within the PUD for the project. The Planning and Zoning Commission approved the alterations with conditions in a letter dated July 16, 2003. Minor Modification: During the summer of 2004, the ownership of the property and thus the approvals that were granted for the parcel changed hands. The design team has once again created Minor Modifications to the site plan and building elevations. Concurrent to implementing the design alterations, the design team has incorporated the changes into the Construction Documents and has submitted these changes to the Town Building Department for approval. With this submittal, the Owner is requesting a Minor Modification approval for the again altered project name, L'Auberge on Beaver Creek, for the further altered site plan and building elevations. In addition, the owner is requesting an alteration to the PUD Ordinance for the parcel in order to remove the requirement to include six deed restricted residential units within the project. The owner is currently working with the Town attorney to generate the required Development Agreement detailing the conditions associated with the exemption of this requirement. Listed below, are brief descriptions of the latest changes depicted in this submittal. Site Plan Alterations (Al.1): Please refer to the site plan submitted for this review. • Vehicular entry to the site now affords shared access between the subject parcel and the parcel directly to the east. This alteration addresses the need for vehicle management associated with the future developments potential impact to highway 6&24. Several easements have been executed by the Owner and the adjacent property owner to allow for this reconfiguration. • The removal of six deed restricted units and the previous area designated to be "future restaurant" has altered the number of parking spaces required by the Town Ordinance Title 17. We believe that this change will favorably affect the appearance of the structure and enliven its sense within the community. • The reconfiguration of the stair access to the patio has increased the amount of outdoor area. Hydronic snow melt has been included for all of the additional patio area. • The residential units are for-sale and not "hotel" in nature, therefore all visitors will be familiar with the destination. Therefore, we have removed the lighted monument sign from the location along the entry drive. • The inclusion of additional residential units and an expanded owner club area have required additional mechanical units. We have included a site mounted air handling unit on the western edge of the property. This unit will be completely screened with a site wall that includes additional acoustic baffles to limit the amount of sound transmission to adjacent properties and the creek. This site wall enclosure design can be seen on the site plan drawing. The addition of this element required a slight reconfiguration of the parking layout adjacent to this area as well. • We have been able to reduce the size of the transformer enclosure near the garage entry on the north east corner of the building. The site wall enclosure design can also be seen on the site plan drawing. • The outdoor hot tub has been relocated from the western property line to the northern edge of the indoor pool area. A decorative steel site fence suspended between cement stucco pilasters has been added for security. House Side Shield (HSS) is an option. which will block up to 120° of light in any one direction. 5-Light (5L) candelabra set is an option for incandescent application. QUARTZ RE-STRIKE The 6130 fixtures can be supplied with an optional quartz re-strike system to retain constant fixture light ifthe H.I.D. lamp fails. The fixture will be equipped with a 100 watt quartz lamp and a con- troller to run on a 120 volt circuit and must be used in conjunction wilh a 120 volt or multi-tap ballast. PHOTOCELLS Photocells shall be either the thermo bi-metal button type or the electronic button type. On single post top fixtures the photocell shall be mounted in the fitter. On multiple head fixture assemblies photocells shall be mounted in the pole shaft on an access plate. The thermo bi-metal photocell shall be designed to turn on at 1.0 footcandle and turn off at not more than 5 footcandles. The electronic button type photocell is instant on and a 5-10 second turn off and shall turn on at 1.5 footcandles with a tum-off at of 2-3 footcandles. Photocells are either 120 volt or 208 thru 277 volt. Photocells are pre-wired as ballast housing assemblies and fitters for ease of wiring to source. ARMS All arms are made of cast aluminum and/or extruded aluminum. Anns with decorative filigree have meticulously detailed scroll work and gracefully curved brackets. All 6130 fixtures will have its fitter welded or inechanicily attached to the arm at the factory to ensure arms will be plumb, secure and level over the life of the installation. Each arm shall be bolted to a post mount adapter, which is welded to the pole to ensure proper alignment to the base. TA and 579 arms will be altached to a decorative center hub which will slip-fit the center tenon of the pole. Arms are pre- wired for ease of installation. FINISH Prior to coating, each assembly will be ground etched or sandblasted to create a uniform surface texture and to ensure superior bonding of primer and finish coat. Two coats of wash primer shall be applied to increase bonding strength followed by two coats of Sherwin Williams semi-gloss industrial enamel. Powder coating is available, consult factory. The proposed building measures approximately 8,543 square feet with a maximum building height of 31'8". The proposed materials include a stucco finish with a combination of stone veneer and wood siding. The subject property, along with the two adjacent lots (42B and 42C) were granted a P.U.D. amendment on May 21St, 2002 for three duplex lots from the originally approved two 4-plex lots. This amendment represented an overall reduction of 2 development rights and is subject to conditions of approval, which are discussed below. The applicant was subsequently granted final design approval for a duplex dwelling on the subject property May 20,2003. The final design was approved for a duplex building measuring approximately 7,635 square feet, in the same location on the lot with a similar orientation and use of material. Staff Comments This design of the duplex appears to be in conformance with the residential design guidelines and the associated conditions of approval from the prior P.U.D. amendment. The proposed building materials include a stucco finish, wood clad doors, bellyband and skirt boards, asphalt shingles, and cedar accent features. The architectural design features include walkouts on the middle levels, two car garage(s), and roof ridgelines and wall planes that appear to be mirror images of each unit. Although the connection of the units is relatively narrow, the connection is made sharing a common wall with opposing living areas. The roof ridgelines and wall planes on each elevation of this project appear to be broken up by the use of different materials and interrupted architectural features. However, the residential design guidelines recommend that the units of a duplex not be "mirror image", but include a variety of architectural interest to distinguish a duplex form a single family residence. It appears that the proposed duplex units are mirror images with little or no difference. The proposed building height and massing of the structure appears to be consistent with the residential design guidelines. The maximum lot coverage of 50% (including impervious surface) has been adhered to, and the minimum building setbacks from both Longsun Lane and Wildridge Road East is 25', which is a condition of the P.U.D. amendment. The proposed access to lot 42A is by way of a shared access easement through lot 42B that was established as part of the P.U.D. amendment. The driveway depicted varies in grade, but appears not to exceed 4% at any point. The residential guidelines state that a minimum of 3 parking spaces shall be provided for structures in excess of 2,500 square feet. According to the site plan, a total of 4 garage spaces and 4 outdoor spaces have been provided. However, it appears that there may not be adequate area for the 4 proposed outdoor parking space. Staff would ask that the applicant address whether there is sufficient area for the proposed outdoor parking. The minimum required snow storage area is 20% of the impervious surface. Although the proposed site plan adheres to the minimum area requirement (21%), the location of the snow storage area may conflict in some areas with landscaping also proposed in the same location. Staff would ask that the applicant to address this point. The sketch plan as presented generally conforms to the Town's residential design guidelines. However, staff has identified several issues that need further clarification prior to submittal of the final design plan. These issues include the mirror design of the duplex units, the minimum required parking spaces, and the area for snow storage and landscaping. Design Review Considerations The Commission and Staff shall evaluate the design of the sketch plan utilizing the specific Design Standards, and by using the following general criteria: A. The conformance with setbacks, massing, access, land use and other provisions of the Zoning Code. B. General conformance with Residential Development Sections A through D of the Town of Avon Residential, Commercial, and Industrial Design Review Guidelines. The Commission will take no formal action on the sketch plan application. Rather, direction on the design will be given to the applicant from Staff and the Commission to incorporate in the final design application. The program incorporates four signs including: one monument sign (31 sq. ft.), one building mounted > ign (43 sq. ft.), and two freestanding directional signs (6 sq. ft. each). The application under review is to amend the MSP by adding two building mounted signs. One sign would face the Avon Annex building to the south and the other sign would face the parking lot and the entrance to the drive through windows on the northeast side of the building. The signs in this application utilize aluminum cabinets with beveled returns and acrylic (interior lit) push thru lettering and logo, similar to the previously approved signage for the property. Attached to this report are the sign details (with elevations) for the two new signs. Additionally, a complete version of the approved MSP is attached for your review. Design Review Considerations According to the Town of Avon Sign Code, Section 15.28.070, the Planning & Zoning Commission shall consider the following items when reviewing proposed sign designs: 1. The suitability of the improvement, including materials with which the sign is to be constructed and the site upon it is to be located. The predominant material of the signs is aluminum, which appears appropriate for the site and consistent with the existing sign program. This application would add signage to two of the building elevations. 2. The quality of the materials to be utilized in any proposed improvement. The acrylic lettering for the two signs would be 'push thru' and three-dimensional in appearance. Materials would be consistent with the already approved signs. 3. The visual impact of any proposed improvement, as viewed from any adjacent or neighboring property. The additional signs would be visible from the roads or sidewalks and may have a visual impact as viewed from adjacent properties. 4. The objective that no improvement will be so similar or dissimilar to other signs in the vicinity that values, monetary or aesthetic, will be impaired. Monetary values should not be impaired. Aesthetic values could be impaired. 5. Whether the type, height, size, and/or quality of signs generally complies with the sign code, and are appropriate for the project. The type and quality of the two additional signs appear to be in general compliance with the Sign Code. However, the proposed signs appear to exceed the Sign Code allowance for a single business property. An excerpt from the Sign Code is attached for your review. Pursuant to the Sign Allowance criteria from the Sign Code (15.28.080), "individual business sign or signs shall not exceed one (1) square foot of sign area per lineal foot of building front." The 'building front' includes frontage on Beaver Creek Boulevard and Beaver Creek place, totaling 144 lineal feet (or 144 square feet of sign area). The existing program provides 86 square feet of sign area. The Sign Code states that sign allowance can be increased through a Sign Program, and "generally, the increased total sign allowance shall not exceed one (1) square foot of sign area per lineal foot of the portion of building front that is contiguous to the interior space occupied by the individual business." It is staffs interpretation that this allowance increase provision is intended for sign programs that include multiple businesses on a lot which fronts the same street (ex. Chapel Square). If taken literally, this would allow for an increase of 76 square feet o f sign area (on top of the already allowed 144 square feet) for a total of 220 square feet of signage. The proposed MSP amendment would bring the total sign area for the property to 199 square feet. 6. Whether the sign is primarily oriented to vehicular or pedestrian traffic, and whether the sign is appropriate for the determined orientation. The signs are orientated primarily to vehicular traffic. The proposed sign that faces the parking lot appears redundant, since there will already be visible signs from the road directing customers onto the property. Staff Recommendation Staff recommends denial of the Master Sign Program amendment for American National Bank on Lot 70, Block 2, Benchmark at Beaver Creek Subdivision due to conflicts with Avon's Sign Code allowance requirements.
