V. Consent Agenda Commissioner Karow motioned for the approval of the Meeting Minutes from the September 7th, 2004, Planning and Zoning Commission Meeting; Commissioner Smith seconded the motion and the motion passed unanimously with Commissioner Evans abstaining due to absence. VI. Variance - Encroachments into Easements and Setbacks - PUBLIC HEARING Property Location: Lot 70A, Block 1, Benchmark at Beaver Creek Subdivision/580 Nottingham Road Applicant Jerald L. Wuhrman Owner Jux and DW Family Trust Descriptiont jerald Wuhrman is proposing two alpine style side-by-side town homes with a central corridor entry on Nottingham Road. The proposed design would require encroachments into the 7.5' Utility and Drainage Easement on the western lot line and 7.5' Building Setbacks on the western and eastern lot lines. Ken Kovalchik presented the Staff Report to the Commission. Commissioner Karow questioned the lot lines and easement with Staff. Jerald Wuhrman, applicant, approached the podium and discussed the granting in 1984 of a Variance on this property. He never intended to encroach on easements but did state he did have an overhang on the setback. Mr. Wuhrman F:\Planning & Zoning Commission\Minutes\2004\092104.DOC Page 1 of 7 continued with discussing Bristol Pines and their easement thru the lot. He mentioned that property owners on either side of this lot were in agreement with Mr. Wuhrman's project. Commissioner Savage questioned his alternative design in 1984 and Mr. Wuhrman responded that he was not the owner at that time. PUBLIC HEARING OPENED Ron Triblelhorn, adjacent owner of the property, stated that he had no objection to Mr. Wuhrman's application but commented that the drainage was an issue. He did not believe this was a hardship and recommended approval. Steve Smith, Unit B Owner, voiced that he did not have a problem with the application. He did have a problem with the drainage easement and its associated problems. He suggested a redesign of the drainage easement. PUBLIC HEARING CLOSED Commissioner Trueblood stated concern with the overhang and didn't see how approval, as presented, could be granted. Commissioner Evans commented that there are 7.5 side yard setbacks on all lots. Commissioner Didier mentioned that hardship was created when the lot was subdivided and Mr. Wuhrman bought the lot with this issue in place. Commissioner Karow reviewed the criteria, mentioned that every property has setbacks and easement. Commissioner Smith agreed with Commissioner Karow and did r,ot see it as a special privilege. Commissioner Savage mentioned that Staff create· d the Resolution presented for this application and he noted that hardship was :at the time of purchase of the property. He continued that adhering to the code was necessary and that there were designs. Commissioner Evans referred to the 1984 application and that he would not have moved for approval. He continued that the 50 foot drainage easement does not constitute a hardship and that the application does not meet the criteria presented in the Staff Report Items A and C. Commissioner Smith motioned to deny the Variance - Encroachments into Easements and Setbacks, Propedy Location: Lot 70A, Block 1, Benchmark at Beaver Creek Subdivision/580 Nottingham Road, as outlined in Resolution No. 04-24. Commissioner Savage seconded the motion and the motion passed 5 to 2, with Commissioner Trueblood and Commissioner Struve opposing. VII. Sketch Design - Duplex Properly Location: Lot 70A, Block 1, Benchmark at Beaver Creek Subdivision/580 Nottingham Road Applicant Jerald L. Wuhrman Owner Jux and DW Family Trust Description: Jerald Wuhrman is proposing two alpine style side-by-side town homes with a central corridor entry. Each unit is proposed to contain 3 bedrooms and 3% baths. Each unit will have a single car garage and surface parking. Proposed materials include rough sawn natural cedar trim and textured white stucco exterior and cedar shake shingles for the roof. The proposed maximum F:\Planning & Zoning Commission\Minutes\2004\092104.DOC Page 2 of 7 height is 35' and each unit will be approximately 3,000 sq. ft. A Variance is required for the proposed site design. Since the Variance on this property, see above, was denied, Ken Kovalchik mentioned that Mr. Wuhrman could present the Sketch Plan to obtain Commission guidance for Final Design submittal of this project. Mr. Kovalchik continued by presenting the Staff Report. Mr. Wuhrman mentioned that his plans would address all issues and asked that the town review its drainage issue and design. He continued with comments of how he changed the design from southwestern to mountain chalet per Commission preference. Commissioner Savage complimented the design of the project and would like to see the technical issues fixed. Commissioner Struve voiced approval of the structure and the lack of another driveway, Commissioner Smith concurred. Commissioner Karow recommended Mr. Wuhrman to make use of staff comments and that the design was well done. Commissioner Didier commented that the interiors were different and approved of it; he suggested making an integrated plan with the Town for the drainage. Commissioner Karow mentioned that the drainage was a flow issue and the Applicant should design accordingly to the debris flow. Commissioner Trueblood was concerned with the landscaping plan and that the applicant should make sure it is integrated in the Final Design submittal. Vi:l. Special Review Use - Preschool - PUBLIC "IEARING Property Location: Lot 22, Block 1, Benchmark at Beaver Creek Subdivision/77 Metcalf Rd Applicant: Martha Peck Owner: Evans Chaffee Construction Description: Mountain Montessori is proposing a preschool at 77 Metcalf Road that would consist of approximately 20 students. The school would operate Monday - Friday from 8:00am to 4:30pm. In order to facilitate the school use, there would be a fenced playground area outside the building for the students. Ken Kovalchik presented the Staff Report. Commissioner Karow asked about the hours of operation and if there were concerns about expanding the times of operation. The response by staff was based on conversation with the applicant. Commissioner Struve questioned why one year allowed and the response was to review compatibility in the zone district. Commissioner Didier questioned Evans Chaffee's use of the building and the use of trucks on the site. Michelle Evans approached the podium to mention that the church was still on the premises. Martha Peck, applicant, approached the podium and gave her qualifications to direct a Montessori School. She proceeded to describe the school's location, its benefits, intention of ease for the neighborhood, and that 25 children would be enrolled with 20 children on site at a time. Michelle Evans F:\Planning & Zoning Commission\Minutes\2004\092104.DOC Page 3 of 7 proceeded to the podium as landlord for the school. Ms. Evans met with Ms. Peck and walked the site. They believed it was a viable location and its access to Wildridge residents was beneficial for the community. PUBLIC HEARING OPENED Vera Miller, Wildridge resident, approached the podium. She commented that she approved all of the benefits of pre-schools and young children. Chris Evans, Wildridge resident, Avon business owner and parent, approached the podium. He commented that there is no zone district in the Town of Avon for preschools. He continued that the Town of Avon's Comprehensive Plan supported this application. PUBLIC HEARING CLOSED Commissioner Savage questioned the number of 20 children and Ms. Peck responded that there is a formula of 30 square feet per child required by the State of Colorado. He continued with the design of the parking lot and that there should be a one way in and a one way out consideration. Commissioner Struve stated agreement with the concept. Commissioner Smith noted the application was a great use of the land and an improvement to the area. Commissioner Didier was fine with the concept but concerned with the pre-existing traffic issues. Comrlissioner Trueblood voiced concern regarding trati,c. Commissioner Karow state,] that the application met the three criteria as presented in the Staff Report and acknowledged that the hours of operation should be left open, and a five year approval period might be more beneficial for the community than a lesser duration. Michelle Evans commented that the program was a three-year program, and in capacity of landlord and mother, the traffic issue would be addressed and resolved immediately. Commissioner Trueblood motioned for approval of Item Vlll, Special Review Use - Preschool, Property Location: Lot 22, Block 1, Benchmark at Beaver Creek Subdivision/77 Metcalf Rd, Applicant: Martha Peck, Owner: Evans Chaffee Construction, Resolution No. 04-23, with condition number one being eliminated and with a five year use at time of approval. Commissioner Smith seconded the motion and all commissioners were in favor. IX. Minor Project - Windows & Fence Property Location: Lot 22, Block 1, Benchmark at Beaver Creek Subdivision/77 Metcalf Rd ApplicanVOwner: Evans Chaffee Construction Description: Evans Chaffee Construction Company is proposing building modifications and a fence. The proposed fence crosses over the 7.5' Utility and F:\Planning & Zoning Commission\Minutes\2004\092104.DOC Page 4 of 7 Drainage Easement on the southern lot line and will terminate at the building on Lot 23. Ken Kovalchik presented the Staff Report and requested to modify the Staff Report to reflect that the fence in question will only be on Lot 22 due to the disapproval of the adjacent property owner (Lot 23). He continued by amending condition number one to reflect Staff Approval of a fence could be installed on Lot 22 and extend to the property line on the south side of the property adjacent to Lot 23 and that the section of fence along Metcalf Road, instead of saying located on the inside of the large pine tree, could be moved by the pine tree closer to the trunk and delete Staff Recommendation Number Three and Staff would consider a split rail with chicken wire instead of a four foot solid fence. Commissioner Savage asked about the type of fence change, originally the fence would be a 6-foot solid fence and that the State would approve a 4-foot fence with chicken wire. Ms. Michelle Evans appreciated the changes by Staff. Commissioner Trueblood suggested that a vacation of the easement should occur and chicken wire made sense in this environment. Commissioner Didier voiced concern with the chicken wire and felt it wasn't safe for small children. Ms. Peci~ stated that it is not an attraction for children but ti,at tall fences seem to resemble: a climbing option thus posing greater danger. Commissioner Smith had con cerns with the solid fence. Commissioner Struve and Commissioner Savage had no problems with the Application. Commissioner Karow brought to light that complying with the State was okay. Commissioner Smith motioned to approve Item IX, Minor Project - Windows & Fence, Property Location: Lot 22, Block 1, Benchmark at Beaver Creek Subdivision/77 Metcalf Rd, ApplicanVOwner: Evans Chaffee Construction, with omission of Staff recommendation number one, solid fence will be replaced with a split rail fence. Commissioner Trueblood seconded the motion and it passed unanimously. X. Minor Project - Fence Property Location: Lots 40&41, Block 1, Wildridge/ 2133A & 2121 B Long Spur Applicants/Owners: Eddress Ahmad Jr. (Lot 40A) & Helen D. Rudy (Lot 41 B) Description: The applicants have built a fence, connecting both properties, constructed with rounded lodge pole wood. This application is in response to a field visit with Town staff and Ed. Ed was informed that design approval is required from the Commission for any fence located in the Town. There are a number of split rail fences in the vicinity. F:flanning & Zoning Commission\Minutes\2004\092104.DOC Page 5 of 7 Matt Pielsticker presented the Staff Report to the Commission. Peter Rudy, applicant, approached the podium and apologized. for the fence that he erected. He began with the foot traffic and dog residue that he experienced as the public walked through to access the Open Space. He believed that the fence complimented the property and proceeded to show fences in his area. He agreed that fences between yards delineate boundaries but his fence acts more as a berm to deter dog traffic. The issue remains that Planning and Zoning Commission cannot approve a fence to be placed on land not owned by the Applicant. Commissioner Savage mentioned that no one else on the street had a fence of lodge poles. Commissioner Karow mentioned that fencing is discouraged in Wildridge. Commissioner Evans could support the fence if it was moved from the Right of Way onto the property and lodge pole was a good variation of materials. Commissioner Didier motioned for approval of Item X. Minor Project - Fence, Property Location: Lots 40&41, Block 1, Wildridge/ 2133A & 2121B Long Spur Applicants/Owners: Eddress Ahmad Jr. (Lot 40A) & Helen D. Rudy (Lot 41 B), with the condition that the fence be moved back to the property and out of the Right of Way. Commissioner Savage seconded the motion. The motion carried 6 to 1 with Commissioner Karow opposing. XI. Minor Project- Landscaping Progerty Location: Lot 45, Block 1, Wildridge/2400 Saddle Ridge Loop ApplicanUOwner: Vera Miller Description: A minor project was approved in July 2003 for landscaping improvements and a new deck and stairs. All improvements have been completed and 10 aspens trees have been planted along the rear property line in Spring 2004. The trees were not indicated or approved on the original plan. This item was tabled (at the request of applicant) at the last Commission meeting. Matt Pielsticker presented the Staff Report. Vera Miller, applicant, approached the podium. She discussed that the trees were planted over a year ago. She continued that the tree guy dumped 15 aspens and 2 pine trees in her ditch. She called him and he never came to claim them, so she planted and irrigated them. She understood that the trees were planted in a utility easement and would take the responsibility to move them if need arose. Commissioner Savage asked Ms. Miller if she knew approval was necessary for the trees. Ms. Miller responded that she had provided a landscaping plan last year but stated that this situation happened. Commissioner Evans stated that supplemental tree planting did not require approval. The motion passed 5 to 2 with Commissioner Struve and Commissioner Savage opposing. XII. Other Business Tambi Katieb updated the commission regarding the Comprehensive Plan and the Town Council approval of the extension of the completion and adoption date. Mr. Katieb brought to the attention of the commission the electric signs to be placed by the skier parking lots to direct traffic and provide information. One of the signs is in the Town of Avon Right of Way. XIII. Adjourn Commissioner Trueblood made the motion to adjourn. Commissioner Savage seconded and the motion was unanimously approved. The proposed residence measures 5,492 square feet under roof (finished 3,916 sq. ft. and unfinished 1,576 sq. ft.) with a maximum building height of 33'10". The proposed materials include a stucco finish with a combination of stone veneer and wood siding, and asphalt shingles. The topography on the site slopes downward from Wildridge Road with significant slopes, some in excess of 40%. It's also important to note that a prior application for sketch plan review and final plan review for a duplex dwelling unit, in the same location on the lot, utilizing similar style and material was heard by the Commission and tabled at your August 17th, 2004 meeting because the plans submitted did not meet the criteria for duplex connection. Staff Comments This design of the residence appears to be in conformance with the residential design guidelines with respect to material, architectural style, and building height. The proposed building materials include a stucco finish, a combination of stone veneer and wood siding, cedar facia trim, and asphalt shingles. The alpine style architectural design features include cantilevered walkouts on all three levels with wood railings and posts on the deck. The roof ridgelines and wall planes on each elevation of this project appear to be broken up by the use of different materials and interrupted architectural features. The maximum building height of the structure measures 33' 10" feet which is less than the maximum allowable of 35 feet. Building colors will be reviewed at the time of final design review. The floor plan contains three bedrooms, two of which are located on the upper level, a three-car garage and dining area on the middle level, and storage and entertainment on the lower level. There are several windows depicted on the north and east elevation plans that do not match the floor plans. Staff recommends that the applicant reconcile the floor plans to match elevations. It appears that the total area of disturbance has been minimized due to the orientation of the residence and the proposed location of the development envelope. Approximately 75% of the lot contains slopes in excess of 40%, with the most significant slopes along the eastern property line. The finished grade (middle level) of the proposed residence is approximately 20 feet below the elevation of the Wildridge Road right-of-way and setback approximately 50 feet from the front property line. The proposed driveway slopes from 8% at the entrance down to 4% at the entryway to the garages. The location of the access point is consistent with a previously disturbed access point that gradually drops down to the site. The site plan provides for 7 parking spaces including the three-car garage. The sketch plan as presented generally conforms to the Town's residential design guidelines. However, staff has identified several technical issues that should be addressed prior to submittal of the final design plan. Staff's concerns include the design of retaining walls, the drainage pattern along the driveway, and areas of additional parking. The sketch plan depicts a two-tiered retaining wall located adjacent to the site access driveway. According to the east elevation, the design of the retaining wall, specifically the upper retaining wall, is inconsistent with the Town's design guidelines. The bottom of the upper tier must be on the same horizontal plane as the top of the lower tier. The applicant should be prepared to discuss whether lowering the second tier will require the placement of an additional retaining wall to further stabilize the slope. It's also important to note that the height of the retaining wall in some locations exceed 4 feet and therefore will require structural engineered drawings at the time of final design, stamped and certified by a Colorado Registered Professional Engineer. The driveway grade depicted varies in grade from 8% the first 100 feet and drops to 2% at entry grade. It appears that the driveway is crowned in the center and may force the drainage on either side of the drive. Staff's concern is the drainage that follows the tow of the retaining wall may undermine the structural integrity of the wall if significant drainage or pooling of water occurs. Staff would suggest the applicant address drainage scenarios at the final design stage to ensure adequate storm water runoff flows that may occur due to the slope of the driveway. Staff would also ask the applicant to discuss the need or rationale for the 2 additional parking spaces along the southside of the driveway. Especially in light of the lots prominent viewshed location from the valley and the need for an additional 6' high retaining wall to stabilize the slope beneath the parking area. Design Review Considerations The Commission and Staff shall evaluate the design of the sketch plan utilizing the specific Design Standards, and by using the following general criteria: A. The conformance with setbacks, massing, access, land use and other provisions of the Zoning Code. B. General conformance with Residential Development Sections A through D of the Town of Avon Residential, Commercial, and Industrial Design Review Guidelines. Staff will prepare a memo to the Commission highlighting anticipated areas of discussion for the submittal materials. Each sign would be identical in design and size. The two proposed signs would be freestanding (3'6" tall), internally lit, and be composed of a textured aluminum base with acrylic sign faces. The Commission must review all signs that do not belong to a Master Sign Program. Design Review C,~nsiderations According to the Top, n of Avon Sign Code, Section 15.28.070, the Plai ning & Zoning Commission shall consider the following items in reviewing proposed designs: 1. The suitability of the improvement, including materials with which the sign is to be constructed and the site upon it is to be located. The Sign Code encourages "quality sign materials" and is at the discretion of the Commission. Both signs would stand on a textured aluminum base painted to match the stucco on the building. Internally illuminated acrylic sign faces would display the 1St Bank logo and direct customers to the ATM machine. The signs are doubled sided with a sign display area of approximately 4 square feet. Sign 1 would be sited in the same location as an existing sign but would be turned 90 degrees in order to facilitate vehicle traffic movement. The sign would be visible at the West Beaver Creek Boulevard entrance. Sign 2 would be moved closer to Sun Road in order to gain exposure. The current sign is difficult to see due to the mature trees near the round a bout. A site plan is attached showing the existing and proposed locations for Sign 2. 2. The nature of adjacent and neighboring improvements. There are similar signs in the immediate vicinity. 3. The quality of the materials to be utilized in any proposed improvement. The materials would be of high quality and consistent in appearance with the building and surrounding sign materials. The visual impact of any proposed improvement, as viewed from any adjacent or neighboring property. The proposed signs should not have any significant impact to adjacent properties. 5. The objective that no improvement will be so similar or dissimilar to other signs in the vicinity that values, monetary or aesthetic, will be impaired. It is Staff s opinion that there will be no impairment. 6. Whether the type, height, size, and/or quality of signs generally complies with the sign code, and are appropriate for the project. The proposed signs generally comply with the sign code in terms of height, size, and quality. Landscaping is required for all freestanding signs and Sign 2 should incorporate landscaping in it' s new proposed location since it would be standing alone in a grass island where proposed. Both signs appear to be appropriate for the project. 7. Whether the sign is primarily oriented to vehicular or pedestrian traffic, and whether the sign is appropriate for the determined orientation The primary orientation of the proposed signs is to vehicular traffic, which is appropriate given the location at the intersection of Avon Road and West Beaver Creek Boulevard. Both signs would also be visible to foot traffic. Staff Recommendation Staff recommends approvai of the 1St Bank sign design application for Lot 3, Sun Road Subdivision ( 1St Bank) with the following conditions: 1. The applicant shall submit a landscape plan to be reviewed and approved by staff prior to sign installation. Landscaping must be designed to enhance the signage and surrounding building landscaping. 2. Except as otherwise modified by this permit approval, all material representations made by the applicant or applicant representative in this application and in public hearing shall be adhered to and considered binding conditions of approval. At the September 27*, 2004 Town Council meeting, the Council proposed that the future Mountain Star Drive roundabout be selected as an appropriate location for public art. Based on the direction from Council, staff is forwarding on Resolution 04- 25 that would establish Mountain Star Drive roundabout as a future location for public art. In addition, staff is requesting retroactive approval of the art placed in Roundabout 2. The request for retroactive approval is an effort to reconcile all the existing and proposed public art locations. Attached to Resolution 04-25 is Exhibit "A" that identifies the location of existing and proposed public art locations. Staff Recommendations: Staff recommends the Planning & Zoning pass a motion for retroactive approval of the public art improvements located within Roundabout 2 and the proposed location of public art within the future Mountain Star Drive Roundabout. The lot was originally approved as Empire Savings and Loan, and subsequently redeveloped from a bank with a drive through to a medical center. American National Bank is beginning a tenant finish to reestablish a bank at this location. A Minor Project for landscaping was approved at your August 17,2004 meeting. At that meeting the applicant stated that improvements to the structure that affect the exterior shall be separately applied for. This application is proposing exterior modifications to the building and additional landscaping improvements. The proposed building modifications include: 1) new entry feature which would enlarge the Gross Floor Area by 111 square feet; 2) new night depository; 3) repair of existing enclosure for the dumpster - new matching gates and strap hinges and concrete surface to be repaired; 4) new canopy soffit design for the drive-through; 5) new metal facia and soffit colors; and 6) masonry restoration and cleaning. The proposed landscaping improvements include: 1) new brick pavers with concrete border sidewalk to be installed at the entry plaza; and 2) removal of one pine tree. Please see the letter dated September 29,2004 from Mark Donaldson for detail regarding each of the proposed modifications/improvements. Staff will provide full plan sets for this minor project at your October 5,2004 meeting. Design Review Considerations According to the Commission's Procedures, Rules & Regulations, Section 4.10, the Commission shall consider the following items in reviewing the design of this project: 1. The type and quality of materials of which the structure is to be constructed. A variety of quality, durable building materials is proposed which include: wood timbers, stone veneer for the two support columns, and brick pavers with concrete border for the entry sidewalk. The proposed exterior acid wash and sand blasting of the masonry should revive the brick to near original condition. The existing metal clad fascia materials will be painted in Sherwin Williams (6990) 'Caviar'. The existing 'ribbed metal soffit' materials will be painted copper. On the drive-through canopy the proposed soffit material will be painted with Sherwin Williams (7013) 'Ivocy Lace'. 3. The objective that no improvement be so similar or dissimilar to others in the vicinity that monetary or aesthetic values will be impaired. The building modifications and landscaping improvements should not impair monetary values or aesthetic values in the vicinity. 4. The general conformance of the proposed improvements with the adopted Goals, Policies and Programs for the Town of Avon. The project appears to conform to the adopted Goals, Policies and Programs o f the Town and appears consistent with the Design Guidelines. NEW NIGHT DEPOSITORY: The new night depository feature facilitates after business hours deposits for commercial bank customers who "cash out" their daily receipts and remove from their respective premises for nightly deposits. The equipment (see 2 cut sheets) itself will be a through-wall installation as shown on SK-02. 4. REPAIR OF EXISTING DUMPSTER ENCLOSURE GATE: Photographs have been attached to illustrate the existing conditions and the following items describe the Work to be performed in order to restore the original design with a new matching gate and a new color for the gate and cap flashing around the perimeter of the masonry enclosure. Please refer to 2 hand noted color photographs attached. A. The size, configuration and appearance of the pair of gates will remain the same. NEW DRIVE-THROUGH CANOPY SOFFIT DESIGN: Upon removal of a few of the existing unit metal soffit ribs to access the existing light fixtures and the pneumatic cash transfer systems, we found that the materials were not replaceable and have exceeded their useful life. Therefore we are proposing a new soffit design that accommodates future access panels, reinstallation of the existing high- pressure sodium light fixtures in concert with 3 new recessed (150 watt incandescent lamps) can lights over the new Night Deposit area (Item 3 herein).
