March 18, 2003 , TOWN OF AVON PLANNING & ZONING COMMISSION RESOLUTION NO. 03-04 SERIES OF 2003 A RESOLUTION AMENDING THE AVON TOWN CENTER IMPLEMENTATION PLAN AND THE EAST AVON ACCESS AND CIRCULATION PLAN TO AFFIRM THE NEED TO ENABLE A VIBRANT AND UNIQUE COMMERCIAL REGION WITHIN EAST AVON, TOWN OF AVON, EAGLE COUNTY COLORADO HEREAS, the Town of Avon recognized the potential for new development and redevelopment of an area of town known as the "Town Center"and developed basic concepts to guide development of this area in a phased approach, adopting the Town Center Plan in 2001; and HEREAS, the Town of Avon recognizes that the East Avon Commercial area is ripe for redevelopment and there exists a unique and compelling opportunity to better define the character and relationship of this area to the benefit o f both the property owners and community; and HEREAS, the Town of Avon recognized the necessity to develop a multimodal plan for access and circulation within the East Avon commercial area and surrounding, including the connectivity to the Town Center Mall on the west side o f Avon Road, adopting the East Avon Access and Circulation Plan in 1999; and HEREAS, the Town is moving forward with the initial implementation o f the Town Center Plan improvements, which includes the realignment of Benchmark Road and the acquisition of a regional transit center on Lot 61 and the conversion of the pedestrian mall to both pedestrian and local traffic, as well as the following goals: . Begin creating a unique and vibrant shopping, entertainment, commercial and residential experience for the community that is easily visible and accessible from Avon Road. . Connect all commercial areas and improve mobility within the Town, in particular between the Town Center and East Avon Commercial Area; . Recognize the importance ofpedestrian and vehicular movement across Avon Road; . Encourage these concepts to be implemented through to the Village (at Avon); . Explore, develop, and implement opportunities for shared parking between the East Avon commercial area and the Town Center area. ~A~ HEREAS, the Town recognizes the importance of agreeing upon a vision, and seizing V V opportunities to achieve our goals as opportunities present themselves through the redevelopment requests of private sector proposals. ~OW, THEREFORE, BE IT RESOLVED, that the Planning and Zoning Commission hereby recommends to the Town Council that both the Avon Town Center Implementation Plan and the East Avon Access and Circulation Plan be formally amended to recognize the necessity for improvements to include the area of East Avon to maintain, reinforce, and create the community character and philosophy as set forth herein. Conflicts of Interest Commissioner Greg Macik disclosed a conflict with Master Sign Program, Lot 67/68, Block 1, Benchmark at Beaver Creek Subdivision, 1111 Swift Gulch Road. V. Consent Agenda Chairman Smith motioned for the approval of the Meeting Minutes from the January 21, 2003 Planning & Zoning Commission meeting. Commissioner McCIinton seconded the motion and it passed unanimously. VI. Master Sign Program Lot 67/68, Block 1, Benchmark at Beaver Creek Subdivision 1111 Swift Gulch Road Applicant: Sign on Design Matt Pielsticker gave the presentation for staff on the Master Sign Program. Tom Banner represented Petro Hut and did not have a formal presentation for the Commission. Staff briefly reviewed the sign program, and noted that height requirements were exceeded and staff's recommendation is to limit the signage square footage as outlined in the Staff Report. Commissioner Didier and Commissioner Smith suggested to Mr. Banner to reprioritize to get the sign program to meet the sign code requirements more closely, even though the purpose of a master sign program purpose is to allow for more flexibility and creativity for a project. For the record, Commissioner Hirn arrived at 6:20 pm. Recommendations to the applicant from the Commission consisted of lowering the signs, relocating the monument sign, and to get closer to the sign code i C. Staff has divided this project into two distinct areas: 1) The drafting of a Water Conservation Resolution, and 2) Implementation of revised landscaping design guidelines for residential, commercial, and jndustrial development in the Town of Avon. A draft Water Conservation Resolution is attached, and to be discussed at Council during the March 25,2003 meeting. A draft of the revised landscaping guidelines will be discussed in detail at your next meeting on April 1,2003. The Water Conservation Resolution sets basic parameters for water use within the Town of Avon, while the proposed revisions to the Design Guidelines further define landscaping measures that promote efficient water use. Highlights of the recommended Water Conservation Resolution include: • Promotion of Water Conservation Education, in conjunction with the Eagle River Water & Sanitation District. • Implementation and monitoring of regulated watering schedules within the Town. • A rebate incentive program for existing irrigators that promotes the reduction of turf area, and the implementation of a xeriscape program. • Adoption of a fine program to discourage water waste. The proposed revisions to the Landscape Design Guidelines are intended to be practical and easy to implement. Highlights of the recommended revisions include: • One half of the total landscape area for all projects required as xeriscape landscape area only. Not less than 50% of the useable open space area required, shall consist of pervious landscaped areas. The remaining useable open space requirements may be satisfied by impervious patio or mall type areas containing seating, decorative fountains, planters, recreational amenities and similar type facilities. 3. Consideration should be given to use of landscape material for snow fencing, visual screening and wind breaks when applicable. 4. Plant materials should be adaptable to the area and selection and placement should include Consideration of function and color coordination. A list of recommended plant species that are compatible with various climate zones found in the Town is attached in Appendix 1. No noxious weeds, as listed in Appendix 2, shall be permitted for use in the Town. 5. All lots to be covered by grass lawns shall utilize healthy sod material for complete coverage. All grass sod shall extend to the property line or, where adjacent to a roadway, to the bottom of adjacent drainage ditch or back of curb, as applicable. Commercial and Industrial Landscaping Design Character Plant material selection and placement must ensure safe sight lines to traffic and signs. Care should be taken that no hazards are created for pedestrians and vehicles by plant litter. Trees and shrubs with thorns should not be used in or near pedestrian areas. Alllandscape development for commercial projects, including specific landscaping elements such as planters, retaining walls and berms must be specifically approved. Landscaping should accentuate a project design, not hide it from public view. Requirements: 1. Landscaping design should be compatible with other site improvements and with neighboring properties. 2. Trees should be massed or grouped together whenever possible to provide a greater visual impact. Tree plantings may not interfere with utility or drainage easements, and their location should be based on a function such as screening, shade, view enframement or accent. Accent plantings should occur at locations such as building entries, parcel entries, or pedestrian areas. Evergreen locations should consider shading sidewalks in winter to avoid creating hazardous icing conditions, as well as avoiding south facing windows that may be impaired to solar access. 3. Plant materials should be adaptable to the area and selection and placement should include Consideration of function and color coordination. Grasses should be used close to pedestrian areas where visual relief from extensive pavement is desired, or, in large open areas as a soils stabilizing agent for visual effect (primarily viewed from vehicular traffic). All grass sod shall extend to the property line or, where adjacent to a roadway, to the bottom of adjacent drainage ditches or back of curb, as applicable. Fire Resistant landscaping in areas with wildfires are required. 7. In large open areas numerous grass mixes should be considered depending on water requirements and availability, maintenance requirements, potential fire hazard of dry grass, and visual effect desired. In these areas, rough grass mixes should be utilized. Native grasses and wildflower mixes require less water, less mowing and lend themselves well to the perimeter areas of the Town Center blending into the existing vegetation. 8. These changes include the deletion of stucco bumpouts on the canopy and above the main entrance ("On The Go"), the replacement of bitumen roofs with a painted EPDM material to match the roo f (and standing seam metal), and the omission of two sidewalks on the south side o f the building. Design Review Considerations According to the Town o f Avon Residential, Commercial, and Industrial Design Review Guidelines, Section 7, the Commission shall consider the following items in reviewing the design ofthis project: 1. The conformance with setbacks, massing, access, land use and other provisions of the Town of Avon Zoning Code. • Allowed use: The proj ect conforms to the Special Review Use approval. • Density: The density conforms to Town Zoning. • Lot Coverage: The lot coverage conforms to Town Zoning. • Setbacks: Setbacks conform to Town Zoning. • Easements: Easements conform to Town Zoning. • Building Height: Building Height has been verified, and conforms to the approved final design. • Grading: The proposed omission o f two sidewalks on the south side is partly because of grading issues, however, a revised site plan has not been submitted to verify this condition. • Parking: Parking conforms to Town Zoning. • Snow Storage: Snow storage conforms to the final design approval. A surety is being held for the completion of landscaping and retaining walls. 2. The general conformance with Goals and Policies of the Town of Avon Comprehensive Plan, and any sub-area plan which pertains. The project generally conforms to the Comprehensive Plan, as well as the issued Special Review Use. 3. Whether adequate development rights exist for the proposed improvements. Adequate development rights under Town Zoning exist for the project. 4. The final design plan is in compliance with all sketch plan approval cri teria and with all final design plan submittal requirements. • Site Development.- o Site Design: The site has been designed to promote pedestrian access and circulation. The proposed deletion o f two sidewalks will limite pedestrian connections to the project. o Site Access: The proposed deletion of sidewalks will not promote site access. o Site Grading: A revised site plan has not been submitted to verify that the two sidewalks cannot be constructed. o Sidewalks: The project was approved with two short sidewalks on the south side o f the building to promote pedestrian access. Staff does not support the deletion of these sidewalks. • Building Design: o Design Character: The small stucco bumpouts appear to be minor deletions, and would not otherwise impair the overall design o f the building. o Building Materials and Colors: The use of a painted roo f instead o f a tan bitumen roo f should not detract from the proj ect material design. o Exterior Walls, Roofs, and Architectural Interest: The deletion of the bumpouts appears minor, and due to the placement o f the "On the Go" and the "Conoco" signage, the bumpout would not serve the original function. 5. The compatibility of proposed improvements with site topography, to minimize site disturbance, orient with slope, step building with slope, and minimize benching or other significant alteration of existing topography. The project otherwise complies with the site and the approved final design. 6. The appearance of proposed improvements as viewed from adjacent and neighboring properties and public ways, with respect to architectural style, massing, height, orientation to street, quality of materials, and colors. The change in materials for both the canopy roof and the main roof should not detract from the style o f the building. The deletion o f sidewalks and pedestrian access would detract from overall access and circulation. The objective that no improvement be so similar or dissimilar to others in the vicinity that monetary or aesthetic values will be impaired. The project appears to otherwise comply with all final design requirements, and should not detract from aesthetic values in the area. 8. The general conformance of the proposed improvements with the adopted Goals, Policies and Programs for the Town of Avon. The project generally conforms with the goals, policies, and approvals as issued from the Town o f Avon. Staff Recommendation Staffrecommends approval with the following conditions: 1. Approval is for deletion of the two bumpouts, and the change in roofing materials from tan bitumen to painted rubber material on both the canopy and main roof, both as described in the application dated March 6,2003. 2. The deletion of the two sidewalks on the south side of the building is denied. A revised site plan showing sidewalks or stairs shall be submitted for review and approval by staff prior to the issuance of a final Certificate o f Occupancy. 3. Except as otherwise modified by this permit approval, all material representations made by the applicant or applicant representative(s) in this application and in public hearing(s) shall be adhered to and considered binding conditions of approval. This resolution is essentially about doing that, but the language it uses reinforces this division in our minds. I propose to begin thinking about the idea o f downtown rather than the "mall" or "east Avon" or "west Avon" except when literally used as direction indicators. I think we should begin to call all of this the Town Center. To do this may require several steps or resolutions but we can begin with statements like this: The Town recognizes the importance of the idea of a downtown retail mixed use district and that the boundaries of this district should encompass both the areas now known as east and west Avon. The Town recognizes the future importance of connections within the downtown retail district across Avon Road for both Pedestrians and Automobiles. These connections will become vital to the continued success of Avon as a regional commercial center for the Fail valley. I also think it is important to begin to outline desired features for the redevelopment of east Avon as we have done with the existing Town Center Plan. These can be in the form of opportunity statements or definitive design guideline-type directions. Perhaps this resolution should just direct the staff and P&Z to investigate these opportunities as a revision to the comp plan, but why wait? Either way, here are some suggestions: Investigate opportunities for joint venture partnerships with redevelopers to realign east benchmark road to be more direct from roundabout three to the new connection to the Village at Avon at Chapel Square. Identify opportunities for an open space area within the retail area of east Town Center that would be surrounded by retail spaces for use as a location for small special events that would energize the commercial activity while providing an enhanced experience for guests and residents. Investigate opportunities for joint venture partnerships with redevetopers to locate and contribute to the construction of a centrally located shared parking facility that would be fronted with retail/commercial at the ground level Short walking distances from this facility to the maximum number of retail or commercial spaces is important to its use by the majority of customers and for the opportunityfor each person using thefacility to shop or visit as many storefronts per visit to town. Investigate changes to the town shared parking code to encourage this central structure. No reduction in spaces should be allowed for residential, but some may be allowed for o#ice space. Page 1 0 f 2 Strongly encourage (or require) redevelopment to place buildings at the street with a maximum of a 2-story facade. Above this level the building must step back an additional 10-15 feet before rising their additional height. The town should encourage narrow street widths on secondary streets within the retail district. This may or should include alt streets other than Beaver Creek Blvd. Narrow streets naturally slow trajfic andaremorepedestrian friendly. Sidewalks (setbacks) infront of redefined retail areasfronting the street should be wide enough to allow for sidewalk usage by restaurants and retailers (providing interest to pedestrians), but not so wide as to increase significantly the perception of the width of the street. A pedestrian on one side Of the street should be able to view goods and signs in the windows ofshops on the other side Of the street. Investigate opportunities to allow for angled parking on street in front of the retail stores. This parking may be metered to generate money for increased maintenance and to provide incentive for long-term shoppers to use the central structured parking while still allowing for the convenience of quick trips. As we encourage redevelopment we should also understand that there are things about our current town that should be preserved. We should always be aware o f our roll as the portal to Beaver Creek in the minds of our guests. The scale of the buildings along Avon road should not be allowed to increase making this road a canyon. Consent Agenda Chairman Smith motioned for the approval of the Meeting Minutes from the January 21, 2003 Planning & Zoning Commission meeting. Commissioner McCIinton seconded the motion and it passed unanimously. VI. Master Sign Program Lot 67/68, Block 1, Benchmark at Beaver Creek Subdivision 1111 Swift Gulch Road Applicant: Sign on Design Matt Pielsticker gave the presentation for staff on the Master Sign Program. Tom Banner represented Petro Hut and did not have a formal presentation for the Commission. Staff briefly reviewed the sign program, and noted that height requirements were exceeded and staff's recommendation is to limit the signage square footage as outlined in the Staff Report. Commissioner Didier and Commissioner Smith suggested to Mr. Banner to reprioritize to get the sign program to meet the sign code requirements more closely, even though the purpose of a master sign program purpose is to allow for more flexibility and creativity for a project. For the record, Commissioner Hirn arrived at 6:20 pm. Recommendations to the applicant from the Commission consisted of lowering the signs, relocating the monument sign, and to get closer to the sign code A approvable square footage. The Commission also recommended that the pricing signage might not be the best use of total sign square footage. Commissioner Smith motions to approve the two canopy signs and the "On The Go" sign on the building; and that those signs would be the Master Sign Program until such time as it comes back the applicant returns with an amendment or revision to include the other signage. Commissioner Didier seconds and the motion carries unanimously. Commissioner Macik, who had a conflict of interest with this application, returns to the hearing room. VII. Other Business A.
