A MSP acts as a sign code for a project and allows the sign administrator to approve specific signs that are in compliance with the MSP without going before the Planning and Zoning Commission. The current Sign Code for the Town of Avon permits one square foot o f sign area per lineal foot of building front. With 85 feet ofbuilding frontage, the Town Sign Code would allow a total of 85 square feet of signage for this building. The proposed MSP includes signage criteria for two monument signs (Conoco, Professional Building), a corporate logo sign (On the Go), four building identification signs (Option 1 and Option 2), and two canopy signs (Conoco). As submitted, this MSP proposes a total of 195 square feet of signage. Following is a summary of the program: Monument Signs: The Conoco monument sign is located on the Southeastern corner of the property on Nottingham Road. This sign is 44.64 square feet in size. Materials include a stone base with internally lit fluorescent components illuminated through acrylic faces. This sign includes three sections: a stone base, interchanging gas pricing, and a 2'7"x 8' corporate logo for Conoco. As proposed, the sign would encroach the ten- foot structure setback. The Professional Building monument directory sign is located at the second entrance to the property on Swift Gulch Road. This sign is 7'x 5'4" with the tenant panel portion as 40"x 4'. Materials include: acrylic faces on an aluminum panel, a concrete base, and stucco. As proposed, the sign encroaches on the Town drainage easement and the setback. This sign will be a backlit fluorescent cabinet box measuring 28"x101" (19.6 sqft). Building Identification Signs: There are two building identity logos with the initials "SG." These logos will be located on the building pop-outs over the entries of the south and east elevations. Both logos are 2.7 square feet and are composed o f a cutout metal brand and stud mounted bronze. The application proposes two options for the professional building signage. Option 1 proposes two tenant panels on the south elevation comprising 40 square feet in total. Option 2 proposes one tenant panel on the south elevation comprising 30 square feet, and a separate tenant panel on the east elevation comprising of 20 square feet. Staff supports Option 1, and does not support a separate sign on the east elevation. Canopy Signs: There are two "Conoco" logos located on the canopy over the gas pumps; one faces south and the other faces east. Both signs measure 20.6 square feet and are internally lit (fluorescent) through a single sided acrylic face. Design Review Considerations According to the Town of Avon Sign Code, Section 15.28.070, the Planning & Zoning Commission shall consider the following items in reviewing proposed designs: 1. The suitability of the improvement, including materials with which the sign is to be constructed and the site upon it is to be located. The proposed materials (acrylic faces, aluminum panels, and stone) are encouraged by the sign code. Interior-lit signs are also encouraged by the si~ code. The proposed signs are well sited, with the exception ofthe Conoco and Professional Building monument signs which conflict with the Town ofAvon Zoning Code. 2. The nature of adjacent and neighboring improvements. The immediate area consists ofresidential and neighborhood commercial uses, and open space. 3. The quality of the materials to be utilized in any proposed improvement. The aluminum, acrylic, and stone materials are consistent with Town standards. 4. The visual impact of any proposed improvement, as viewed from any adjacent or neighboring property. The project proposes over twice the amount of signage than the Town sign code would normally allow. Additionally, there are several issues with the placement of each monument sign that have been identified in this report. 5. The objective that no improvement will be so similar or dissimilar to other signs in the vicinity that values, monetary or aesthetic, will be impaired. The proposed signs will have significant impact to other signs in the vicinity, if approved as proposed. However, the elimination or reduction of the two monument signs would lessen the overall aesthetic impact o f the sign program. Whether the type, height, size, and/or quality of signs generally complies with the sign code, and are appropriate for the project. The proposed signs comply with the sign code and are appropriate for the locations with the exception of the two monument signs that encroach on building setbacks and in the drainage easement as submitted. 7. Whether the sign is primarily oriented to vehicular or pedestrian traffic, and whether the sign is appropriate for the determined orientation. All signs are orientated to vehicular traffic. This orientation is appropriate considering the proximity to the I-70 interchange with Avon Road. Staff Recommendation Staff recommends approval of the Master Sign Program for the Swift Gulch Professional Building located on lots 67/68, Block 1, Benchmark at Beaver Creek Subdivision with the following conditions: 1. The monument signs are not approved. 2. Option 1 for the Professional Building is hereby approved. This option, along with the elimation ofthe two monument signs, will reduce the square footage of the MSP to a total of 117 square feet. 3. The total square feet of the master sign program may not exceed 117 square feet. 4. A revised master program specifying these requirements must be submitted and approved by staff prior to issuance of a sign permit; 5. Except as otherwise modified by this permit approval, all material representations made by the applicant or applicant representative(s) in this application and in public hearing(s) shall be adhered to and considered binding conditions of approval. Community Development Swift Gulch Professional building will have a mixed use of retail and commercial tenants. The intent of this program is to provide an aesthetic sign program fitting the buildings architecture and to insure consistent quality representation for any and all tenant signage. GENERAL REQUIREMENTS: 1. Approval Process/Permits All signage shall be in accordance with Swift Gulch Professional Building sign program. All tenants must submit drawings and specifications for proposed signage and must be pre-approved by Condominium Association prior to submission to the Town of Avon for permitting. All building signage shall be approved and permitted by Town of Avon prior to installation. Incurred costs for submitted art work and permit fee shall be at tenant's expense. 2. Installation All installation expenses are to be the responsibility of the tenant. A licensed electrician is required for any lighting installation, All workmanship and specifications will comply with Swift Gulch Professional Building sign program and all applicable government regulations. 3. Maintenance Tenant Signs are to be kept well-maintained and to building standard, Lighting must kept in good repair. Physical condition of tenant sign should be maintained, no missing letters or characters, paint kept fresh and not faded etc. Landlord holds rights to require tenant improvement or repair to any sign that falls below building standard. Any repair requirements will be presented in written form to tenant by the Condominium Association. Failure to meet maintenance needs required by written notification with-in 60 days constitutes a violation of a tenant's lease. 4. Removal of tenant signs shall be the responsibility of and at the expense of tenant. Base substrates and lighting components for upper floor tenant signs become a fixed building asset and may not be removed once installed. (See below for descriptions) Landlord reserves the right to withhold the expense of removing any tenant signage from deposits held on tenant space or lien the tenant for all costs incurred in said removal. 5. Requirements & Options Tenants are not required too, but have the option of applying for, building mounted and/or monument directory signs. Tenant signage allocations are outlined as Ground floor (street level Nottingham) or upper levels. a.) Tenant Sign locations & approval The Condominium Association reserves the right to assign exterior building, and monument, sizes and locations for tenant signage. These allocations must fit into the required guidelines of the total square footage allowed for the building as approved by the Town of Avon. The Association reserves the right to approve or decline tenant requests for exterior building signage. b.) Location & allocations Signage shall be placed per designated building locations only. (See attached) Upper floor tenants may apply for one exterior and one monument directory space only. Tenant spaces may require sharing of a base substrate but shall have their own Tenant Panel (see below) 6. Temporary Signage a tenant may place a temporary sign in allocated tenant space while permanent sign is under construction. Temporary sign shall not exceed allocated permanent sign square footage and shall consist of the same layout and colors as permanent sign. No other temporary signage, sales banners posters etc. are allowed. No interior signs, notices posters etc. are allowed in common areas unless approved by Condominium Association. SIGN SPECIFICATIONS: 1. Building Identification There shall be one primary building identification sign located on the South side of the building (see attachment 1) Building materials shall consist of dimensional formed acrylic letters individually mounted to building exterior matching Mathews paint color Dark Bronze. (See attachment) A building logo identity will be utilized to represent the building and will be located on building pop-outs over exterior entries. (See attached) The owners of the building reserve the right to change the building identity name at their discretion. 2. Ground Floor Tenant Signs as designated for: On the Go / Conoco station Current main floor tenant requires set identity representation according to their contract requirements in order to represent and sell CONOCO products. a.) Monument sign includes interchanging gas pricing. Stone base on a concrete footer with internally lit fluorescent components illuminated through acrylic single sided face. Located at Southeast ground level to Nottingham. Rd. (See attached sizing and landscaping lay-outs) b.) Canopy (2) Internally lit fluorescent components illuminated through acrylic single sided face. Locations: Southeastern corner of canopy & South face of canopy. (See attached) c.) Store Identity A station Identity sign for "On The Go" incorporating their logo will be represented on the building itself. Cabinet will be backlit fluorescent cabinet box located over entry doorway flush with building facing West. (See attached) d.) Window graphics shall consist of professionally installed vinyl or digital text and graphics. No temporary "poster or banner style" window graphics will be allowed on windows "street side" facing south onto Nottingham Road. All window graphics to be reviewed and approved by Condominium Association prior to installation and must conform to applicable Town of Avon codes. 3. Upper Floor Tenant Signs a.) Building mounted base substrate of >1" thick aluminum to shape (see attachment) primed and painted with polyurethane mounted to building by Hilti stucco anchoring system and mechanical hardware. The base plate will have extruding permanently mounted 1/1" threaded studs for attaching tenant panels with hex head cap nuts. This "base plate" will be considered a fixed asset and is to remain property of the building once installed. Base plate shall match PMS color 554 Forest Green. Tenant panel will stud mount extruding from base plate with W standoffs. Tenant panel shall be fabricated of 14" aluminum or dibond primed and painted with polyurethane to match building beige, Forest Green, and Duronodic Bronze colors. (see attached art files) Text portion of sign may consist of a business name, nature of the business and logo if applicable. Text may be of a font determined by tenant. The business name shall be raised text; minimum 5/8" thick mounted flush to tenant panel. Nature of the business text may be made of dimensional painted aluminum letters or flush vinyl letters. All text shall match building trim paint spec or vinyl Avery high performance opaque beige. Logo's should have a raised shape and can incorporate paint or vinyl to building and sign program colors only. Condominium Association reserves the right to decline requests for logos deemed not aesthetically fit into building sign program. Town of Avon must also approve the use of any logos on tenant panel Allocated sizing is based on total allowable square feet as designated by this Town of Avon approved sign program divided by the number of tenants requesting exterior signs as approved by the Condominium Association. (See attached) Lighting Tenant signs shall be down lit with single bulb fluorescent fixtures to match size of base substrate per building standard. (See attached) Licensed electrician to be used for installation following all applicable government regulations Monument directory sign located on Swift Gulch Rd. Text portion of sign may consist of a business name, nature of the business and logo if applicable. Text may be of a font determined by tenant. The business name shall be raised text, minimum 3/8" thick acrylic mounted flush to tenant panel. Nature of the business text may be made of painted dimensional letters or flush vinyl letters. All text shall match art standards and colors as set by attached art files. Logo's should have a raised shape and can incorporate paint or vinyl to building and sign program colors only. Condominium Association reserves the right to decline requests for logos deemed not aesthetically fit into building sign program. Town of Avon must also approve the use of any logos on tenant panel. Allocated sizes: Monument sign has a total tenant sq. footage area of 48" x 40" Tenant panels are to be allocated as follows: Tenant space allocation (per appx. 1000 sq. ft.) = 9.5" x 22" increments Larger tenant panels will be available for tenants occupying more than 1 of the 7 original spaces. (See attached) Condominium Association reserves the right to designate sign locations and sizes allowed to each tenant. Lighting Monument sign will be externally lit with a garden level halogen light. Licensed electrician to be used for installation following all applicable government regulations Landscaping will follow comparable planting and ground coverage as the lower level monument per original landscaping plans. Landscaping will extend a minimum of 5' around plantable hillside of sign parameter. (See landscape attachment for Conoco monument) c.) Window signage shall consist of professionally installed text and graphics not to exceed 25% of window space. No temporary "poster or banner style" window graphics will be allowed. All window graphics to be reviewed and approved by Condominium Association prior to installation and be in compliance with Town of Avon codes. d.) Interior Directory will be available for tenant use and is the responsibility of, and at the expense of Swift Gulch Tenants. Designated Directory standard of set Font, spacing, and format only, no logos. In order to maintain consistency of directories all tenants are required to use Condominium Association specified sign shop only. Suite Signs Assigned suite numbers are provided for each tenant location. Each suite Number will have an allocated attachment to suite number sign for business description. Designated Suite sign standard of set Font, spacing, and format to be used by tenants. Logo's with-in the standard and capable of fitting into designated space allowable. In order to maintain consistency of suite signs all tenants are required to use specified sign shop only. Interior Identity signs require an art submittal and approval by Condominium Association. Meeting was opened for public comment. One member of the public came to the podium with comments of the Skate Park's positive recreational use. Seeing as there was no public comment, the public hearing portion of the meeting was closed.. The Skate Park came to Staffs attention by an inquiry and Code Enforcement reviewed the situation. Staff was concerned with its compliance with codes of Land Use Approval and Fire Safety Codes as the skate ramp was constructed and in use. Commissioner Didier questioned the use of the parking space and its availability. Applicant responded that the park is used in the evening and the adjacent business are daytime parking users. Chairman Evans commented that Special Review Use focused on concerns of life safety issues, impact on parking and on neighboring properties. This application meets the three criteria for Special Review Use; 1- use does comply with all requirements imposed by the Zoning Code, 2- the proposed use is in conformance with the Town's Comprehensive Plan; and 3- proposed use is compatible with adjacent uses. Commissioner Karow moves to approve Resolution 03-03 granting a Special Use Permit to operate an indoor skate park in Unit 211, Lot 18/19, Block 1, Benchmark at Beaver Creek, 281 Metcalf Road (Metcalf Commercial Park), with conditions 1-4 as stated in the Staff Report dated January 15, 2003. Students identified communities as tourist, residential or year round. They were to find locations to place stations for a monorail. They selected the Confluence site as an optimum location for a station. Station to include housing and an ice rink and significant parking. Paper to be presented in the United Kingdom. C. On January 14, 2003, the owner of the subject business, Mr. Larry Kilstrup, submitted an appeal of this decision to Town Council. During review and preparation for the appeal, staff recoinmended that Mr. Kilstrup withdraw his requested appeal and that the sign permit be approved. There was a discrepancy found by staff after the appeal was filed between several elevations in the master sign program, the original master sign program application, and the language of the most recent master sign program. It was my determination that the Yld sign at the rear of the building in question was in fact approved in the Chapel Square Master Sign Program (MSP). I have informed Mr. Kilstrup of my action permitting the second sign, and will have Planning and Zoning Commission formally remove their variance denial from the public record at their next scheduled meeting. Mr. Kilstrup recently inquired as to whether or not his original 'logo' cabinet sign may be reinstalled on one of the archways in front of his business. This obsolete sign would require you to submit a formal amendment as the current property owner to the MSP in order to accommodate this request for Mr. Kilstrup.
