PZC Minutes 091592RECORD OF PROCEEDINGS PLANNING AND ZONING COMMISSION MEETING MINUTES September 15, 1992 The regular meeting of the Planning and Zoning Commission was held on Septembe- 15, 1992, at 7:35 PM in the Town Council Chambers, Avon Town Municipal Building, 400 Benchmark Rd., Avon, Colorado. The meeting was called to order by Chairman John Perkins. Members Present: John Perkins, Patti Dixon Sue Railton, Jack Hunn Rhoda Schneiderman, Henry Vest Buz Reynolds Staff Present: Rick Pylman, Director of Community Development, Charlette Pascuzzi, Recording Secretary Lot 18 Filing 1. EagIebend Subdivisions__Railton Duplexy F final Design Review Sue Railton stepped down as a voting member of the Commission, due to a confli,:t of interest. Rick Pylman stated that. the Railtons brought this duplex in several months ago for a front setback variance. The variance was granted, and the design presented at this time does tollow the variance. There is a 1650 square foot unit and a 2900 square foot unit on a duplex lot. Metal panel roof, 1 x 8 cedar siding, stucco and moss rock shown as accent elements, metal clad windows, and cedar trim are the materials to be used. The applicant will provide a color board. A complete landscape and irrigation plan has been provided. Pylman stated that the only problem that staff saw during the review is that Unit B shows a deck encroaching into the Metcalf Ditch easement. Staff recommendation is to get approval from the easement holder for the encroachment, or remove the encroaching deck. Pylman stated that, other than the encroachment into the easement, the projec,+• is in total conformance with the zoning code. He stated that the materials and design are compatible with the neighborhood, the design is compatible with adjacent properties, and the improvements work well with site topography. Eaglebend, Subdivsion,_ Rai ItonDuplex_, ._Final Design Review (cont) John Railton stated the encroachment consists of some landscape ties laid at grade on the ground level with some 2 x 6 redwood decking sitting on top of it. He stated that he spoke to Norm Wood about this and he suggested that he send him a copy of the site plar along with a request for that encroachment. He stated he would commit to either seeking the approval or removing the deck. D;scussion followed on the colors (roof - felt green, siding - cinnamon, windows painted same as roof, stone walls - moss rock). Discussion tollowed on the siding, the metal roof, the turrets, the carport and its lighting, and the balance of site lighting. "he chimney caps will be painted to match the roof. Discussion followed on the landscaping. Jack Hunn moved to grant final design approval to Lot 18, Filing 1, Eaglebend Suhdivision, as submitted. Rhoda Schneiderman seconded. After discussion, Jack Hunn amended his motion to include a recommendation that the easement holder grant approval for the encroachment into the easement. Rhoda Schneiderman seconded the amendment and the motion carried unanimously. Sie Railton returned as a voting member of the Commission. Zone ChangelConceptual_ Design Rewiew, Rick Pylman stated that this application was tabled at the August 18, 1992 meeting. The request was to take the two duplex lots and subdivide into two single families and one duplex lot. He stated that instead of building the typical duplexes, the applicant has come up with the idea to take the units on either side as single families and take the unit in the middle, with a carriage house and zone that as a duplex. Staff had a problem calling this a duplex and the Commission agreed with it, although the Commission generally did like the concept. This proposal is basically just doing away with the lot line between the two duplex lots and making it a multi -family lot zoned for four units, building four single family homes and doing a type of subdivision similar to what Mark Harrison did in Wildridge. Staff is still not comfortable with this proposal. They are really the same building that has been built in Eaglebend on PLANNING AND ZONING COMMISSION MEETING MINUTES September 15, 1992 Page 3 of 6 16,000 square foot lots. There are two 16,000 square foot lots that the applicant is trying to put four single family houses on and Staff does not think it fits. Generally, in this concept, units have been lost. Pylman stated that he thinks this is pushing the fit of the typical type of development on that side of the street. Staff probably wouldn't have a problem if it was being rezoned to three single families. Staff would rather see two duplexes, than this proposal. Pylman stated that there is a public hearing required, and some criteria that is required when making a decision. He reviewed the criteria. Staff recommends denial of this application. Dave Prater, of Design and Construction Services, stated that they had changed roof pitches, done away with mirror images, and tried to add different features on the outside of the buildings and the elimination of the center lot line allowed increased space between the sides of the units and the property lines and decreased the space between the units. He stated that they feel that they will be providing a better product to the community. Chairman Perkins then opened the public hearing. Chris Ekrem, owner of Lot 15, stated that she feels very strongly that this is the best approach that could be taken for that land. The three large homes would have a wonderful river front opportunity. Also, the parking of this plan is so mucri beter. t. She approved of the carriage house, but would be happy if were only three units. She stated that she felt that this is a more desirable project for that site. john Railton stated that he also felt that he finds himself having more support for the idea of individual buildings, rather than two more duplexes. It will add more variety to the street. It also is probably more marketable. He is more sympathetic to the concept than the architecture. This is where the program needs some work_ He suggested moving the carriage house closer to the street and maximizing the river frontage. With no further public input, Chairman Perkins closed the public hearing. Discussion followed on the square footage of the four units. especially the square footage of the carriage house, which the Commission felt should be smaller than the other three units. The general consensus of the Commission was that the applicant needs to consider realignment of the units, and consider building a design that is completely different than what has been built in the past. The Commission was in agreement that they would like to have a site visit, and asked the applicant to pin the locations of each unit, so that they could better determine where each unit would be located and how they would work with the site. It was suggested that this application be tabled to allow the applicant to take the Commission's comments and concerns and try to work out, a better solution for this project. The applicant agreed that; he would rather have the application tabled at this time. He requested that it be tabled until the October 20, 1992 meeting. Jack Hunn moved to table the zone change request until the October 20, 1992 meeting. Henry Vest seconded and the motion carried unanimously. ission Meeting Patti Dixon moved to approve the minutes of the September 1, 1992 meeting as submitted. Rhoda Schneiderman seconded and the motion carried unanimously. Other Business The Commission, at the September 1, 1992 meeting, approved a Home Occupation, Special Review Use for Hector Montero, Lot 8, Block 1, Wildridge Subdivision. The Staff prepared Resolution 92-14, granting approval of the Special Review Use, for Commission approval. Rhoda Schneiderman moved to approve Resolution 92-14, Henry Vest seconded, and the motion carried unanimously. Lot 17 Block 1. Wildridqe _Subdivision Cliffrose Townhomes_, Landscape Design Review Rick Pylman stated the' the applicant submitted this application after the agenda was set and posted, therefore it is being presented at this time. Pylman stated he now has a revised plan. He described the concerns that the Commission had at the previous meeting and what the applicant has provided to meet the Commission's concerns. Considerable discussion followed on the proposed landscaping, and the fact that there will be no sod, it is all natural vegetation. Due to several conversations being conducted at the same time, transcription is difficult, however, the sizes of the trees was being discussed. Discussion followed on relocating some of the landscaping down the hill somewhat. The Commission questioned the amount of landscaping, and the applicant replied that there are 47 trees propo.ed for the site. Henry Vest moved to approve the landscaping plan for Lot 17, Block 1, Wildridge Subdivision with the following conditions: 1. Add 6 dogwood bushes to the southwest section. 2. A minimum of 6' for the spruce trees. 3. A minimum of 2" caliper for the aspens. 4. A Wildflower/Hydro Seed mix be used. 5. Diversify the plan by moving some of the clumps away from the building. 6. Narrow leaf, 2" minimum caliper cottonwoods. Patti Dixon seconded. The motion was amended to applicant consider varying maintaining the minimums. Patti Dixon seconded the: unanimously. include the suggestion that the the sizes of all plant materials, amendment and the motion carried Discussion followed on the observation deck on Lot 60, that was poured by way of helicopter. Rick Pylman stated that he would check into this matter. Jack Hunn asked Staff how many unrelated people can live 'in one unit. He stated that a developer is planning on renting a bedroom at a time, this winter in any of the units that they don't sell. They are selling them and then they rent them for the owners. The bedrooms have sepaarate phone and cable lines, etc., and each has their own bathroom. These units were planned to be rentals. The Town has no regulations to control this type of rentals. Rhoda Schneiderman moved to adjourn, and the meeting was adjourned at 9:20 PM. Respectfully submitted.
