PLANNING AND ZONING COMMISSION MEETING MINUTES
September 1, 1992
The regular meeting of the Planning and Zoning Commission was held
on September 1, 1992, at 7:30 PM in the Town Council Chambers,
Avon Town Municipal Building, 400 Benchmark Rd., Avon, Colorado.
The meeting was called to order by Chairman John Perkins.

All members were present except Buz Reynolds. Mr. Reynolds
arrived at 7:37 PM.

Lot 8, Block 2, WildridgeSubdivision. Jorck Residence Material_
Change Request
Jim Curnutte stated that in August 1987, Connie Behmlander
received final design review approval for a single family home on
Lot 8, Block 2, Wildridge Subdivision. The approval included a
concrete block foundation with river rock face. The applicant
would like to eliminate the river rock facing on the concrete
block foundation wall. He did install it in the front on either'
side of the garage. The applicant would like to leave the rest of
the foundation the way it is or possibly paint it.
Curnutte stated that another change is the stairs. They were
supposed to go right up the front, right off the driveway,

directly up to the deck. Due to the topography, it did lend
itself to a natural stone stepping stairs going ap and around to
the side, so the front stairs have been eliminated.
Curnutte reviewed the history of this house, stating that it has
not yet received a CO, although it has been occupied for five
years. Mr. Jorck called for a final inspection, and that was when
it was noticed that the siding on the concrete block isn't done,
the stairs are not as approved and the driveway is not paved. The
applicant would like approval on the change for the foundation
wall and the st4irs, and will provide a letter of credit for the
driveway paving.
Rhoda Schneiderman moved to approve the applicants request to
eliminate the river rock with the condition that the concrete
block be parged and painted ar Arizona Clay color, and that the
removal of the stairway be approved, and that a letter of credit
be provide to assure that the driveway will be paved by June 30,
1993.
Henry Vest seconded, and the motion carried with John Perkins and
Jack Hunn voting nay.
Jim Curnutte stated that Hector Montero is requesting permission
to run a business out of his home. The buisness involves computer
repairs, programming and upgrades, software sales, and
troubleshooting. The sales would not happen in the home. All
packages related to the business are received at mail boxes, no
customers come to the home, and there are no employees. Work at
the home is limited to a few comp iters, and a small workbench.
The owner of the property, Damon Pap, signed the application for
this request, therefore giving his consent.
Curnutte then reviewed the criteria for reviewing a home
occupation special review use. Staff recommends approval of the
home occupation special review use with the condition that the
applicant not install any business signs.
Chairman Perkins then opened the public hearing. With no public
input forthcoming and no letters or phone calls received, the
Chairman then closed the public hearing.
After some discussion, Patti Dixon moved to approve the special
review use request for a home occupation at Lot 8, Block 1,
Wildridge Subcivision, with the condition that this special review

use applys only as long as the applicant resides in this
particular home, and based on criteria A, B,and C., and also with
the condition that the applicant not install an; business signing
on the property or the building.
Sue Railton seconded and the motion carried unanimously.
Lot 6 Block 1. Wildridge Subdivision Sunflower Townhonies Final
Design Review
Jim Curnutte stated that this application is for two tri-plexes.
The driveway is 18' wide. There are 24 parking spaces. Each of
the units are 4 bedroom units with about 1600 sq. ft. of habitable
area, 7 car garages, and gas fireplaces. Building height is about
35' above finished grade. Exterior building materials are
similar to the o`.her two projects that this applicant has done
(Lots 46 and 17). A landscape plan has been provided, and a
grading plan. An automatic sprinkler system is proposed on this
lot.
Curnutte then reviewed the comments made by t;ie Commission at
conceptual design review. He then reviewed the criteria for
considering a final design review. Staff recommendation is for
approval with the following conditions:
1. The landscape legend must be amended to include the minimum
material sizes specified by the Planning and Zoning Commission at
conceptual design review.
2. Spot elevations must be added to each of the units highest
ridgelines in order to more accuretly assess maximum building
height above existing or finished grade.
Dan Karzen stated that there would be no problem in complying with
the staff conditions.
Discussion on the colors followed. They will be a heritage blue
for the siding and a navajo white. The roof will be the weathered
wood asphalt shingle. Discussion followed on the types and
amounts and sizes of the landscaping. Discussion followed on the
placements of the utility meters. Discussion followed on the
driveway grade and possible need for a retaining wall.
Sue Railton moved to grant final design approval with the
following conditions:
1. The landscape legend be amended to include the minimum
material sizes of 2" caliper for decidious trees, 6' evergreen

trees and 5 gallon shrubs.
2. Spot elevations must be. added to each of the units highest
ridgelines in order to more accurately assess maximum building
height abDve existing or finished grade.
3. Fin, -,l approval by Town Engineer of the grading and drainage
plan.
4. The garage doors be painted to match the siding color.
5. The gas meters be ganged between the buildings and the
electrical meters be covered.
6. The roof projections be painted to match the color of the
roof.
Patti Dixon seconded and the motion carried unanimously.
Jim Curnutte stated that the applicant will be back at a later
date regarding the color change. At this time, only the
landscaping will be discussed. He stated that this proposal
received conceptual design review on May E,, 1992, and on May 19,
1992, was denied final design approval by the Planning and Zoning
Commission. That decision was overturned by the Town Council on
May 26, 1992, with the condition that the applicant return to the
Planning and Zoning Commission for a final review and approval of
a landscape plan for the project. The applicant has provided a
new landscape plan for the Commission's review.
Dan Karzen stated that the soils report recommended against an
automatic irrigation system. Discussion followed on the need for
more landscaping than what is proposed, due to the site being so
visible and the types of plants to be used. Discussion on where
mowable sod should be placed followed. Discussion followed on the
topography as shown, and the fact that the placement of the
building on the site/landscape plan doesn't reflect the actual
siting of the building.
Buz Reynolds moved to table this application. Jack Hunn seconded

Jim Curnutte stated that this is a very conceptual design review.
At the time of writing the staff report, no plans had been
submitted. Curnutte reviewed the sizes of the two lots and the
zoning which is Industrial/Commercial. He stated that the first
two levels of each of the buildings is comprised of warehouse and
office space and the third level will be mini storage. There
will be two three story building, each about 22,000 sq. ft., 41
foot building height. The building is similar to the Mountain
Center building in terms of having first lave] access at grade on
the front side of the building and access to the second story on
the back side. There are 60 parking spaces on the site, in two
parking areas. There is an access aisle between the two buildings
that is at 12% grade that will be heated. The purpose of this
review is to get a feeling from the Commission regarding the
proposed project, before closing on the property.
Mark Donaldson stated that there is approximately 46,000 square
feet of gross enclosed building area. Also, there are about 72
parking spaces on site. He stated that they are not trying to
attract any retail. They are looking at shops, warehousing
storage, subcontractor type spaces, etc. Mr. Connor is going to
offer about. 60-70% of these spaces for sale on a condominium
basis.
Mr. Donaldson proceeded to describe the concept of the project.
He described how they calculated the parking.
T. J. Connor stated that they believe that they can build this
building and office/warehouse condominimize it and sell it, to the
user so that he can be put on s monthly payment plan that will
allow him to own his space in ten years. They feel it will be
good for the economy of Avon. So far he has strong interest from
several people. He feels that there is a demand for this type of
project.
Considerable discussion followed on the types of businesses to ue
allowed; parking for large trucks; the possibility of berming to
hide some of the parking; possible signage; the roofline; snow
shed; snow storage; the possibility of covering between the
buildings; and the access, etc. Due to many conversations being
conducted at the same time, transcription is difficult.
Discussion followed on the turning radius for trucks; the
retaining walla; and site lighting.

Jim Curn!!tte stated that this application was reviewed at the last
meeting. At that tine, the Commission had some concerns and
therefore tabled this item and asked the applicant to consider the
following:
1. Look for ways to break up the massing of the large south wall;
2. The east wall is very plain, consider adding windows and/or
landscaping;
3. Consider stepping the building down the hill to provide more
relief
The Commission felt that it is an acceptable idea to fill in the
arches, but not a: shown at the last meeting. Also the Commission
would strongly urge the west half neighbor to consider doring the
same.
Curnutte stated that in response to the above, additional
landscaping has been added to the east and south sides of the
building in the following sizes, 10 - 3" caliper aspens, 2 -
6'-8' Spruce, 20 - 5 gallon shrubs, and an automatic irrigation
system Vas been added. Also, two additional windows have beer
added to the east facing wall, the stairs have been partially
enclosed and a roof has been added over the stairwell to help
break up the massing of the south wall, and the deck railings have
been changed from being enclosed with siding to horizontal metal
rail.
Due to the discussions being conducted awa; from the microphones
and with several discussions going on at the same time, it is
impossible to transcribe clear information.
Jack Hunn stated he would like to see the applicant work with the
neighbor to do the same to get rid of the archr.s. Mark Donaldson
stated that the applicant has been tryin; to work with the
neighhor since June, and the neighbor is refusing to do anything.
They have given the applicant permission to do what they want to
do, but they will not participate. It was suggested that some

trees be planted along the other side to cover the arches, but as
that is private property this idea is not feasible. Considerable
discussion followed on how they would get equipment down to do the
work, and how much natural vegetation will be distu,-bed.
Discussion followed on the changes on the south wall. Some
concern was voiced about remodeling o,ie side of a duplex and not
the other.
Sue Railton moved to approve the remodel request, with the
conditions:
1. If existing grades are being substantially altered as a result
of the construction of this addition, the applicant provide a
grading plan for Staff review when a building permit application
is made.
2. A minimum of on and off site disturbance and revegetation.
Rhoda Schneiderman seconded.
Discussion followed on what will be done with the soil to be
removed and the Commission felt it would be alright to put it
around the sides.
3. The underside of the deck be stained.
4. The irrigation system to cover existing and new landscaping.
Rhoda Schneiderman seconded the amendments to the motion. The
motion carried with Henry Vest voting nay.
Reading and Approval of the Planning and Zoning Commission Meeting
Minutes of August 18, 1992
Patti Dixon moved to approve the minutes of the August 18, 1992
meeting as submitted. Buz Reynolds seconded and the motion
carried unanimously.
Other Business
Jim Curnutte stated that the owners of the Benchmark Mobile Home
Park is proposing to install a new fence arou!id the park. He
provided a photo of the type of fence it would be and stated that
it would be painted grey. The Commission agreed that this would
be a considerable improvement. Discussion followed on it being
stained and treated so that it doesn't rot out.

Curnutte then stated that the residents of Gosshawk have requested
that a fence be installed to block the view of the Wildwood
Townhomes from their complex. The cost of the fence will be
shared with the Town. Curnutte stated the fence will be 4 x 4
posts, with 3- 2 x 4 horizontal rails and 1 x 6 cedar uprights.
The fence will be on the Gosshawk property, with the good side
facing the back of the Wildwood Townhomes. The Commission had no
problems with this project.
Buz Reynolds moved to adjourn, Rhoda Schneiderman seconded and the
meeting was adjourned at 9:40 PM.
