PLANNING AND ZONING COMMISSION MEETING MINUTES
DECEMBER 17, 1991
The regular meeting of the Planning and Zoning Commission was
held on December 17, 1991, at 7:30 PM in the Town Council
Chambers of the Town of Avon Municipal Complex, 400 Benchmark
Road, -kvon, Colorado. The meeting was called to order by
Chairman John Perkins.

Chairman Perkins stated all members were present, except for
Buz Reynolds. Mr. Reynolds arrived at 7:40 PM.

Final Design Review
Jim Curnutte stated that the applicant is proposing a 21 unit
residential complex that could be condominiums, however he
may retain some of them for rental purposes. The lot is
about one acre in size. The lot is zoned Residential High
Density. The development consists of three six-plexes and
one tri-plex. All of the buildings are about 42' in height
and three stories in size. The units in the three six-plexes
are about 800 square feet in size. Each of the six-plexes
has two units on each level. The three in the tri-plex
building could be upwards of 2000 square feet. All units
will have gas fireplaces. There are 32 parking spaces
provided along with 26 covered parking spaces. At two per
unit plus six, the minimum number of guest spaces, the
applicant is exceeding the minimum number of parking spaces
required by ten.
Curnutte stated that exterior building materials include 8'
cedar lap siding, stucco chimneys and stair towers, aluminum
clad windows, metal doors and composition shingles. The
applicant has some samples of what the composition shingles
will look like. The site plan shows that the access aisles
and parking spaces will be paved, but does not specify

previously approved project.
He stated that it has always been their intent to sell off
fifty to sixty percent as condominiums and retain the balance
as rental units.
He stated that they have not addressed what the tri-Mex will
look like. Obviously they will want to keep it looking
similar to the others, by keeping the roof line, siting,
painting etc. the same. They will bring the modifications
back to the Commission.
He stated that they will remove the two spaces out of the 10'
front setback, however, due to the problem of plowing snow
and as a potential rental project, they will need all the
spaces they can get and they feel that they need to keep the
three spaces in the landscape island.
Curnutte staled that one of the garages shown on the plans is
actually the trash enclosure.
Seibert stated that the garages are important as a sound
barrier and one additional item he would like to have
approved, which is not on the plan, is the addition of a
cedar fence along the railroad track at either end of the
garage, maybe as high as 12' as you get to the west end.
This is in order to create a continuing sound baffle along
the entire northern p-operty line. He described the slope of
the site at these locations as the reasoning for the fence.
Regarding the vacating of the utility easements, Mr. Seibert
stated that he has re:eived several quit claim deeds from
some of the utility companies and so has Inter-Mountain
Engineering, and tha'i is the method by which they are
vacating tKat particular utility easement.
He stated that the archictect is showiig one garage light
every sixty feet, but they will probably triple that, in
addition to the lighting along the walkways.
Relative to the question as to how often the garage detail
repeats itself, it is every six garage doors. Since three
more garages have been added, this will probably be changed
so that it will repeat every four doors.
He stated that they will try sod in place of the gravel
between the buildings. He stated that he would like to get

approval on another change and that is on an alternative for
the 8" channel lap siding. It is a 14" channel lap masonite
siding. He then provided the colors as a light blue/grey for
the main body, the trim being a dark blue grey and the roof
would be a 20 year class A fiber -glass composition shingle in
a dark grey.
Discussion followed on the type of roofing material. It was
decided that Staff could approve the proposed material to be
used.
Discussion followed on the raquest for the fence. The
Commission felt 12 feet would be too much. They suggested
maybe some mounding and then installing the fence.
Considerable discussion followed on this matter. It was
suggested that some landscaping also be added to the fence.
Mr. Seibert asked for approval of a minimum of six feet and
if needed come back with any deviation.
Seibert stated that the parking area would be asphalt.
Discussion followed on the landscaping and using more for
shielding the straight on shots of the garages. Also
discussed was the matter of leaving the chimney chases.
Discussion followed on the placements of the decks into the
setback. Seibert stated that the footprint will be c:•anged
to remove the decks out of the setback. It was s.aggested
that some of the trim be another color, and teal was
suggested. Also suggested was to deviate shades of color for
the garages doors. Mr. Seibert stated he world not object to
that. Discussion followed on the matter of snow loading in
the front of the garages and how to alleviate the problem.
Discussion followed on the parking situation. It was the
general consensus of the Commission that the three parking be
left as is.
Also discussed was the matter of sod in the proposed gravel
areas. It was decided that if the sod does not work in those
areas, then gravel would be alright.
After considerably more discussion, Patti Dixon moved to
grant final design approval to Lot 8, Block 3, Benchmark at
Beaver Creek, with the following conditions:
1. Final staff review of the grading/drainage plan prior to

the issuance of a building permit. These plans should be
redrawn to match the architectural site plan.
2. Final fire department review of hydrant locations prior
to the issuance of a building permit.
3. Written permission from the owns of Tract L authorizing
the improvements on the property be provided prior to
construction of any improvements.
4. Extension of the path on Tract L to the public
right-of-way.
5. Determination of proposed project sign location and
method of illumination.
B. Elimination of the two parking spaces from the 10'
setback. Elimination of the three parking spaces in the
landscape island not required.
7. The landscape plan be amended to match the architectural
site plan and to remove the gravel currently shown between
the buildings. A better definition of the term shrubbery
needs to be made. Additional trees and shrubs should be
provided along the north east corner of the site and behind
the garages. Also, additional trees or shrubbery be added to
the landscape plan in front of any long fences and that
berming islands where appropriate in the front will be
constructed.
8. Written review and approval by all utility companies must
be provided authorizing the encroachment of the garage
building into the utility easements prior to issuance or a
building permit.
9. At such time that the applicant wishes to proceed wit.ir
the tri-plex building, he will return to the Planning and
Zoning Commission for review and approval.
10. Add a fourth trim or accent color. A teal has been
suggested and this could be a Staff approval.
11. A Staff approval of the specific roofing manufacturer
and product proposed. Recommendation is 300 lb per square
roofing product.

12. Any excess of a fence height of six feet, Staff approval
required.

acceptable.

Lot 65/66 Block 2. Benchmark at Beaver Creek_, The Annex

Jim Curnutte stated that the new owner of the space
previously occupied by Powder Hound Sports requested a permit
for a temporary banner for his new business. However, the
sign code only allows a temporary banner to be 35 square feet
in size, and can only be left up for a week, for any one
event during a thirty day period. This would not help this
particular applicant since he needs an identification sign
for his business until his permanent sign is made. In order
to accomplish this, Pat Barron of the Otis Company, the owner
of the Annex, is requesting an amendment to the sign program
for the Annex to allow for temporary identification signs on
their building for new businesses. The applicant is
requesting that temporary banners be allowed for a period of
up to thirty days, while the permanent sign is being
fabricated. The temporary signs will not exceed 20 square
feet for each 20 lineal feet of store frontage and they will
be required to have blue lettering on a white background.
Curnutte stated that the Commission needs to consider the
materials to be used and the location the sign will be
placed.
Curnutte reviewed the criteria for approving an approval of a
sign program.
Staff recomndation is for approval of the proposed sign
program amendment with the following conditions:
1. It should be made clear that the temporary banners are
for the purpose of identifying the new business only and are
not for sales. The banners should include the name of the
business only and no other messages.
2. The banners should be limited to one per business, eycept
for corner businesses which can have more than one on each

3. Discussion and approval of proposed method of attaching
the banners to the building and materials and color.
After considerable discussion regarding the size of the
temporary banner to be allowed, the method of attachement and
possible materials to be used, Patti Dixon moved to approve
the sign program amendment for the Annex building with the
following conditions:
1. It should be made clear that the temporary banners are
for the purpose of identifying the new business only and are
not for sales. The banners should include the name of the
business only and -io other messages.
2. The banners should be limited to one per business, except
that corner businesses can have one on each side of the
building.
3. The material is to be a vinyl banner type, white
background and blue lettering, and secured to the building in
a forthright manner.
4. The size of the banner shall not exceed 35 square feel:.
5. The electric power on any existing sign shall be
disconnected as long as the banner is installed.

With no other business to be presented, Railton moved to
adjourn, McRory seconded and the meeting was adjourned at
9:00 PM.
