MINUTES OF PLANNING AND ZONING MEE"PING
AUGUST 6, 1991
The regular meeting of the Planning and Zoning Commission was
held on August 6, 1991, at 7:30 PM in the Town Council
Chambers of the Town of Avon Municipal Complex, 400 Benchmark
Road, Avon, Colorado. The meeting was called to order by
Chairman John Perkins.

Chairman Perkins stated all members were present except
Clayton McRory.

Chairman Perkins stated that the applicant had requested this
application be tabled to the August 20, 1991 meeting. Buz
Reynolds moved to table this item to the next meeting. Henry
Vest seconded and the motion carried unanimously.

Association, Review of StairwgY—
Jim Curnutte stated that a proposed hot tub addition had
received final design approval at the last meeting with the
condition that the applicant return with more detail on the
egress stairway, incorporating some of the suggestions made
by the Commission.
Michael hazard, representing the Avon Center Homeowners
Association, stated that they had changed stairway enclosure
to stucco to match the buildins, per the recommendation of
the Commission. They are creating a fascia wall in front of
the stairs. The stairs will not be visible. They are
retaining the gate, at the client's request. He stated that

Center_Homeowners
Dave Tyrr�ll's office doesn't want the door that is there and
are in the process of substituting it with a window. Mr.
Hazard stated that they still have not received the letter
from the commercial owners allowing this project, but it is
being processed.
Patti Dixon moved to approve the egress stairway as submitted
with the condition that the owners use agreement be provided
prior to the issuance of a building permit.
Sue Railton seconded and the motion carried unanimously.
Lot 23, Block 1,_Wild_ridge Subdivision,___Todd Miller Revised
Landscape Plan.
Jim Curnutte stated that on April 16th Todd and Linda Miller
received final approval for a single family residence. The
conditions of that approval were: 1. A new drainage plan be
provided prior to issuance of a building permit; 2.
Driveway centerline match up with West Beaver Creek Point
centerline; 3. A more complete landscape plan be provided
for approval. In compliance with this last condition the
applicant has provided a new landscape plan.
After study and discussion, Sue Railton moved to approve the
landscape plan as presented. Buz Reynolds seconded and the
motion carried unanimously.
Lot 5 Filing 1. Eaglebend Subdivision, Commission Re_cuired
Revisions
Sue Railton stepped down as a voting member of the Commission
due to a conflict of interest.
Jim Curnutte stated that the applicants received final
approval for a duplex at the June 4th meeting with the
conditions that a drainage plan and a landscape plan be
provided for review; A minimum weight of 300 lbs per square
be put on the asphalt shingles approval; and the trees that
were shown in the public right-of-way be moved out of the
right-of-way. Curnutte stated that the applicant has
provided the landscape/drainage plan for review. Curnutte
stated that the plan has been reviewed by Staff. Norm has
some comments, but very minor in nature and he feels that he
can sign off on a building application. The landscape plan
has been amended. No automatic irrigation has been proposed.
Buz Didier, owner stated that they will probably install it
at a future date. The applicant stated that the bid he

received included the 300 lb per square asphalt shingles.
After further discussion Henry Vest moved to approve the
revisions as presented. Buz Reynolds second and the motion
carried unanimously.
Sue Railton resumed her seat as a voting member of the
Commission
Lot 50. Block_1,__wildridge1,._5chaub Duplex_,___Flnai Design
Review
Jim Curnutte stated that the sizes of the units and the
proposed materials are provided in the staff report. He
stated that a grading/drainage plan and a landscape plan has
been provided. The grading plan shows a considerable amount
of boulder and timber retaining walls on the property.
Landscape timbers will be pressure treated. The landscape
plan was professionally prepared. The entire site will be
irrigated with an automatic sprinkler system. All disturbed
areas will be reseeded. Planting beds will be covered with 2
to 3 inches of mulch and formal edging will be provided
around landscape areas. The driveway grade does appear to be
nearing 12%, so the Commission may want to keep that in mind.
This is a fairly steep lot. He stated that he feels that
this is the best that the applicant could do with this drive.
Curnutte stated that the applicant has made a number of
changes in response to the Commission's comments from
previous meetings, which had to do with the mirror image. He
has moved the garage entrance of one side around to the side
of the building. Staff recommends approval with the
condition that the applicant consider additional width
between the retaining wall and the driveway, and when
submitting for a building permit the applicant needs to show
the water service lines on the plans.
Wally Schaub provided colored samples stating that there wiII
be a clear coat on the logs and trim. Discussion followed on
the landscaping plan.
The applicant stated that there would be no problem in
widening the space between the retaining walls and the drive.
Derek Pysher moved to approve the final design review for
this application.
Sue Railton seconded.
The motion was amended to include that the applicant include

Sue Railton seconded the amendment.
The motion carried unanimously.

Curnutte described the lot size and slope of the lot. He
stated that 81% of the lot will remain as open space. He
stated that driveway enters the site at the extreme east end
and moves southwest to a two car garage. The garage apron
area should be enlarged to allow vehicles an adequate turn
around area.
He described the residence size and materials, stating that
this would be a log home with an attached garige. It will be
stained a light oak color with dark brown windows. A woodruf
roof will be used, and all exposed concrete wi'I1 be stucco in
an off white color. A landscape plan has been provided.
Curnutte then reviewed the criteria for reviewing a final
design . Staff recommends that the driveway apron be enlarged
to allow for adequate turn around area.
Discussion followed on the placement of the driveway, the
matter of a log home being allowed in this area, and the
landscaping and lack of an irrigation system. The applicant
stated that all watering would be done by hand sprinkling.
The applicant stated that the driveway turn around is being
redone to allow for more turn around area. She then provided
the colors to be used and discussion followed.
Sue Railton moved to approve the final design on Lot 38-B,
Block 2, Wildridge, with the condition that the apron be
widened.

Lot 38-A, Block 2, WildridgeSubd_ivision, MaroneY-_Sin_gle
Family Residence, Conceptu1_DesignReview.
Rick Pylman stated that the Maroney residence is the other
half of what used to be the duplex lot, Lot 38, Block 2. It
is now two singrle family lots. He stated that this is also
a log home, made by the same company as the house just
previously approved, but different architectural style. It
si.s on the lot a little. bit differently, but uses the same

Materials. He stated that there is quite a bit of exposed
foundation that needs to have some sort of treatment applied.
He described and showed a sample of, the stone to be used on
the exposed concrete portion of the garage wall. He
described the materials to be used, the location of the lot
and the drive location. He stated that a landscape plan has
also been submitted. Pylman stated that as a conceptual
review, no formal recommendation will be presented.
Mr. Garrett, Ms. Maroney's brother was present to answer any
questions the Commission might have. Discussion followed on
the vertical supports. It was suggested either using a log
or an 8 x 8 post for these supports. It was felt that the
round logs would be the best solution. Also discussed was
the exposed concrete, the landscaping, the railings, and the
radius of the drive curves.
Chairman Perkins reiterated the concerns of the Commission
as follows: The exposed foundation walls;
The vertical supports for the exterior balcony
with log support recommended;
Increased detail on the landscape plan,
comparable to the neighbor's plan;
Railings should be of a log detail;
Increased radius on the driveway curves.
As this was a conceptual design review, no formal action was
taken at this time.
Lot 4_ wildridge Acres Subdivision. Corwin -Brown_ Residence, -
Final Design Review
Jim Curnutte explained that this application had been tabled
at the July 16, 1991 meeting to allow the applicant time to
re-evaluate the driveway location. He stated that the
applicant has raised the garage floor elevation in order to
have the driveway come in striaght off of Sheperd Ridge.
Curnutte stated that Staff does not have any additiona;
comments or problems with the solution. He stated that .t
looks like some work needs to be done for the grading for the
driveway. He feels this needs to be resolved by building
permit time.
After some discussion on the grade, Henry Vest moved to
approve final design review with the condition that the grade

question be resolved and approved by Staff prior to building
permit issuance. Derek Pysher seconded and the motion
carried unanimously.
Lot 2, Wildridge Acres Subdivision, Barron Residence. Final
Design Review
Jim Curnutte reviewed the size, and location of the lot. He
stated that the proposal is in conformance with the Town's
zoning code, with the exception of the possible encroachment
of a deck/patio. The applicant stated that that is a slab
patio on grade. Curnutte stated that this is allowed so it
will not be a problem. He then reviewed the criteria for
considering a final design review. He stated that the garage
door shown on the east side of the building would be more
functional on the west side of the garage. If the door is
moved, the applicant may want to consider a window on the
east side of the garage or in the bedroom. Staff recommends
approval.
After considerable discussion, Sue Railton moved to approve
the final design for Lot 2, Wildridge Acres with the
condition that a window be added to the east elevation
bedroom. Derek Pysher seconded and the motion carried
unanimously.
Lot 6, Wildridge Acres Subdivision Long Residence1__Fir,al_
Design Review
Jim Curnutte stated that this is the final residence to
receive design review for the Wildridge Acres project. He
stated that the proposal is in conformance with the zoning
code, with the exception that the entryway overhang
encroachment into the front yarJ setback area. Curnutte
reviewed the criteria for considering a final design review.
This proposal shows a woodburning fireplace. The newly
adopted ordinance requires an applicant to pay $1500 at time
of building permit for a woodburning fireplace. Staff
recommends approval with the conditions that the entryway is
removed from the front yard setback, and payment of $1500 for
the woodburning fireplace at time of building permit
application.
After discussion on the entryway encroachment, Sue Railton
moved to grant final design approval, with the conditions
that the entryway overhang is removed from the front yard
setback; and payment of $1500 for the woodburning fireplace

to keep it as a woodburning fireplace. Henry Vest seconded
and the motion carried unanimously.
Lot 83, Block 1, Wildridge Subdivi_sion,_WahljDeg_en Fou_rplex�
Conceptual Desj_gn_Review
Jim Curnutte stated that the applicants have named the
project Mountain View Townhouses. This is the second
conceptual review and the first plan has essentially been
scrapped. They have made changes directly related to the
Commission's comments of the last meeting. He stated that
the lot is nearly an acre, but about a third of the lot is
restricted by a overhead power line easement.
He stated that this is a fourplex building with a maximum
building height of 23 feet. Each unit includes a two car
garage and gas fireplaces in each of the units. Exterior
building materials are eight inch cedar rustic channel
siding, woodruf shingles, aluminum clad wood windows,
insulated steel doors, concrete walkways and steps, and
asphalt parking and driveway. The applicant has contracted
with BFI for individual unit trash pickup and a letter is in
the file.
A grading/drainage plan and a landscape plan has been
provided. The grading plan shows that a treated timber
retaining wall will be provided on the west side of the
driveway. The maximum height will be six feet. The
landscape plan shows a good mixture of plant sizes and
species. Formal lawn areas will be provided in front of the
unit as well as the sides of the building. Although not
indicated on the plan, an automatic irrigation will be
provided to all sod areas and a drip irrigation system to
those trees outside of the system area. A project sign is
indicated on the plans, but no elevations have been provided.
The most substantial changes are that the repetitious gable
roof form has been more creatively designed and the east and
west entryways have been moved to the sides of the building.
Since this is a conceptual review, no formal recommendation
will be presented at this time. Staff suggests that the
applicant take another look at the entrance way and possibly
providing adequate back up space.
Richard Wahl stated that they have tried to meet all the
Commission's requirements. Discussion followed on the

entrances of the two middle units. It was felt that the
roofing above the two middle units did not fit with the rest
of the design. Considerable discussion followed on this
matter. Also discussed was the project sign, and the
retaining wall and the landscaping.
As this was a conceptual design review, no formal action was
taken at this time. The Commission commended the applicants
for their response to the Commission's concerns.
Chairman Perkins reviewed the concerns voiced at this time as
follows:
Project sign will need to be presented at time of
final design review.
Look at the entryway canopies and make them a
stronger statement with the shed roof repeated twice.
Retaining wall be stepped if it becomes too high in
elevation, and landscaping be added.
Make sure that the driveway works and that Staff is
satisfied with it.

Sue Railton moved to approve the minutes of the July 16, 1991
minutes as submitted.
Henry Vest seconded and the motion carried unanimously.
Other Business
Buz Reynolds stated he would like to comment on the aesthetic
value of some of the roofing materials that have been
required for use in Wildridge and also he is concerned about
the safety of these products as demonstrated by the comments
from Fire Chief Moore at the last meeting.
Considerable discussion followed on the various types of
roofing materials and the possible hazards. The masonite
product was of considerable concern with Mr. Reynolds. It
was suggested that Mr. Reynolds attend the next tour and
point out some of the concerns he has on some of the
projects. It was the general consensus that more study

needed to be done on this matter.
