MINUTES OF PLANNING AND
MAY 21, 1991
ZONING MEETING
The regular meeting of the Planning and Zoning Commission was
held on May 21, 1991, at 7:30 PM in the Town Council Chambers
of the Town of Avon Municipal Complex, 400 Benchmark Road,
Avon, Colorado. The meeting was called to order by Chairman
John Perkins.
Members Present: Sue Railton, John Perkins, Henry Vest,
Pat Dixon, Clayton McRory, Derek Pysher

Chairman Perkins stated that all members were present except
Buz Reynolds.
Lot 8 Filing 1 Eaglebend Subdivision Building_ Color=
Review
The applicant was not present at this time, therefore,
Clayton McRory moved to table this item until the June 4th
meeting. Sue Railton seconded and the motion carried
unanimously.
Lot 3 Filing 1. Eaa_lebend Subdivision.,__ Bu_ lding__ Colors
Review
Chairman Perkins stated he had a conflict of interest with
this item and stepped down as a voting member. Vice Chairman
Clayton McRory presided.
Jim Curnutte presented the proposed colors for this project.
The exterior siding and trim is to be stained heritage blue
(Olympic), window sash and soffits will be stained
stonehedge, the clad windows will be sand taupe, the building
stucco will be an off white color and the deck railings will
be black.

Review
Patti Dixon moved to approve the exterior colors for Lot 3,
Filing 1, Eaglebend, the Ben Kreuger duplex. Derek Pysher
seconded, the motion carried unanimously.
Lot 8,._F lin9_1. Eag1ebend� Buildin�g_Colors _Rev_iew
During the last review Mr. Tony Seibert arrived with the
colors for this project. He stated that the cream color will
be the main body of the unit, the trim will be the green, the
stucco will be the white. After discussion on the colors
and how they will fit into the neighborhood, Clayton McRory
moved to approve the colors for Lot 8, Filing 1, Eaglebend.
Henry Vest seconded and the motion carried unanimously.
Lot 58, Block 3, Wildridge,_,Jones_Residences__ Final Design
Review
Jim Curnutte reviewed the request for final design review,
stating that this lot has slightly more than one-half of the
lot that is nondevelopable. He described the slopes or the
property. He stated that the landscape plan is somewhat
conceptual in nature. He stated that the building is two
stories with basement and gable roofs, is approximately 3000
feet in size, has a two car garage, and maximum building
height is approximately 30 feet. Exterior building materials
include channel rustic wood siding and board and batten
siding, cedar shingles and any exposed concrete foundation
will be painted. The applicant stated that any thing that is
board and batten and any exposed concrete, including the
fireplace will be stucco. Curnutte stated that there is a
railroad tie retaining wall shown on the south side of the
building, but is not reflected on the site plan. The
applicant has provided a color rendering and driveway grade
is approximately 10%.
Curnutte then reviewed the criteria for considering final
design review.
Staff recommendation is for approval with the following
conditions:
1. Driveway entrance must conform with Town
standards.
2. A revised grading plan be provided prior to
issuance of a building permit.

Bill Jones discussed the color rendering, stating that the
actual colors are as shown in the magazine provided. He then
discussed the drainage and how it would be worked around the
railroad ties.
The Commissioners then commented on the project. discussing
the grading, the driveway and the possible need for
retainage, the landscaping, the octagon window, colors, ano
drainage.
Sue Railton moved to grant final design approval with the
following conditions:
Driveway entrance must conform with Town
standards.
2. A revised grading plan be provided prior to
issuance of a building permit.
3. Applicant provide a detailed landscape plan.
4. Color samples and numbers be supplied for the
record.
Patti Dixon second and the motion carried unanimously.
Lot 51. Block 3 Wildridge,Ray Residence� _Ad_dition _Design
Review
The applicant stated that in the last couple days he has made
some revisions to the plans he had submitted. He made some
roof line changes, and added two feet to the size, from 13 x
26 to 15 x 26.
Jim Curnutte reviewed the original submittal, and included
the proposed changes. He stated that the siding, roofing and
windows will be the same as the existing building. The only
concern that the staff has is that to date no evidence has
been provided to indicate that the east side property owner
has agreed to this encroachment. Also, the site/grading plan
shows work within the public right-of-way. Also, the
applicant must replat the property in order to extend the
parcel B property line around the building addition. All
disturbed areas must be reseeded and landscaped.
After discussion, Clayton McRory moved to grant final design
approval with all four staff conditions to be included.
Henry Vest seconded. During further discussion it was
decided that the replatting should be done prior to a TCO
being issued.

Lot._ Block 2. Wildridge Subdivision, _.__Harrison,__Final
Design Review
Rick Pylman stated that this project was tabled at the May
7th meeting because of the following six concerns.
1. Overall driveway grade was excessive.
2. Driveway grade to the southeast unit was very
steep.
3. Amount of overlot grading.
4. Quality of landscaping.
5. Color of one of the buildings
6. Metal roof forms at entry.
Mr. Pylman stated that the applicant has responded to these
concerns, with the exception of the overlot grading. A new
landscape plan has been submitted. The plan includes a
formal sod area around each unit, defines tree planting
areas, includes species number and size and includes
underground sprinkling system for the sod area.
The unit previously s'iown as a blue color has been changed to
a muted green. The roof forms over the entry will be cedar
shake.
Pylman stated that the changes are positive and the only
concern is the overlot grading and the density.
Mark Harrison stated that he feels they have addressed the
concerns. After considerable discussion on the landscaping
and colors and grading, Sue Railton moved to grant approval
with the condition that the driveway be built to Town
standards. Patti Dixon seconded and the motion carried
unanimously.
Lot 9, Wildrid_ ee Acreuntoon Residence Buildinq Design
Changes
Jim Curnutte stated that this residence received final design
approval on December 18, 1990 and a building permit was
issued. He stated that at the time of the issuance of the
building permit the plans did match the design review
approval drawings. Approximately two weeks ago, an
inspection was requested and it was discovered that numerous

siding and fenestration changes had been made without
receiving the necessary approvals.
Curnutte stated that changes have been made to every occupied
unit in the subuivision. He stated that he has included in
the packet a copy of the letter sent 1.o Mr. Kedrowski in
February regarding some of the previous changes. He then
read a portion of the letter making t clear that no further -
field revisions would be tolerated and directing staff to
provide the information clarifying the procedure for making
design changes to previously approved plans. The letter went
further to describe what the process was. Curnutte described
the changes that could be approved by staff and what changes
would have to be approved by the Commission.
Curnutte stated that the changes are in conformance with the
design guidelines, and staff is recommending approval.
Bob Kedrowski stated that he had talked to Jim Curnutte
previously about the window changes on this residence.
Considerable discussion followed on the practice of Mr.
Kedrowski making changes without receiving prior approval.
The Commission seriously considered denying approval of these
changes being discussed. The Commission admonished Mr.
Kedrowski for his total disregard of the Commission and for
continuing with this practice of making changes without
approvals, especially since he was previously informed of the
proper procedure.
Mr. Huntoon addressed the Commission,
requesting that
the

not
make the contractor redo
the house as it
is
the way he
had
requested it be done.
He stated that he
did
not think
he
should have to be
punished because
the
contractor
did
not follow procedure.
Rick Pylman reminded the Commission that the changes have to
be considered according to the design guidelines and should
be approved or disapproved in accordance with these
guidelines. The matter of the disregard for procedure is a
matter for staff to handle.
The Commission informed Mr. Kedrowski that if any other
unapproved :hange is found in any of the future projects,
that a stop work order will be placed on the project and
consideration will be given to cancelling his contractors
li-ense.

Sue Railton moved to approve the minutes of the May 1, 1991
minutes as submitted.
Clayton McRory seconded.
The motion carried unanimously.
Other Business
The Commission then discussed the matter of problems such as
the previous agenda item.
