PZC Minutes 060689N RECORD OF PROCEEDINGS MINUTES OF PLANNING AND ZONING MEETING JUNE 6, 1989 The regular meeting of the Planning and Zoning Commission was held on June 6, 1989, at 7:30 PM in the Town Council Chambers of the Town of Avon Municipal Complex, 400 Benchmark Road, Avon, Colorado. The meeting was called to order by Chairman Frank Doll. Members Present: Frank Doll, Clayton McRory, John Perkins, Buz Reynolds, Terri Jeppson, Jack Hunn Staff Present: Lynn Fritzlen, Department of Community Development; Charlette Pascuzzi, Recording Secretary Center Building Unit B_2, Je_r_ry's._Automot _v_e.Repai_r.,____Special Review Use Jerry Vekre, Owner, Publio_Hearing_C.ontinuance Lynn Fritzlen stated that Jerry Vekre is seeking continuance of the Special Review Use. She stated that at the last meeting a number of conditions were discussed, but the discussion centered around the improvements of the car storage area on the west side of the building. The recommendation to the applicant was that they provide specific information in regards to the site improvements for the car storage area. She stated that Mr. Vekre did come in last week with a sketch, but it did not include the detail that is needed to evaluate it, therefore, he has requested that the hearing be continued for another two weeks. Reynolds mentioned the ventillating system problem, also. McRory asked if anything had been received regarding the new system as requested. Fritzlen stated that this information had been received yet. Doll opened the public hearing for comments. With no comments forthcoming, the Chairman asked the Recording Secretary if any letters or calls had been received. The Secretary stated that there had been none. Benchmark at_Beaver Creek,__ Mountain Center Building Unit B-2 Jerry's Automotive Reoair�ecial_ Review Use Jerry Vekre, Owner Public Hearing__Conti.nuance cont._J Perkins moved to continue the public hearing on Jerry's Auto Repair until June 20, 1989. McRory seconded. The motion was amended to state that the hearing will be continued until June 20. and if the applicant does not appear and provide the reques..ed information then the Commission would revoke the application. McRory seconded the amendment. The motion carried unanimously. Lot 54. Block 3, Wildridcae,__ Ptach___S,ingl_e Fami_ly.Res_idence, Final Design Reviev, Chairman Doll stated that Buz Reynolds has provided a letter of conflict of interest and is stepping down as a voting member. Jack Hunn stated that he also has a conflict of interest and provided a letter stating this. He also stepped down as a voting member. Fritzlen stated that this project was in for preliminary design review at the last meeting. She described where the lot is located and described the site plan. She stated that Steven Richards, on behalf of Tom and Cindy Ptach, 11 requesting final design review. She stated that at the May 16th meeting the discussion centered on the access and associated retainage. The applicant requested approval of an unpaved driveway at the last meeting. She stated that the applicant is now proposing asphalt from the right-of-way up to the property line and then gravel from there on. The Town Engineer has reviewed the plans with the applicant and is satisfied with this .,)lution. Fritzlen stated that the exterior materials are cedar shakes, wood siding, stucco and river rock and it is compatible with other development in the area. Fritzlen then reviewed the proposed retainage in the public right-of-way. She stated that it is recommended that Planning and June 6, 1989 Page 3 of 8 Zoning Commission Meeting Minutes Lot 54. Block 3 Wi1dridge. Ptach Si_n-2le Family Residence_,_ Final Design Review cont. drainage be directed back onto the lot and the retainage be moved out of the public right-of-way. She stated that the site is large but steeply sloped. There are two access to the lot, but both are steeply sloped. The proposed access is from the lower road. She stated that the retainage is about 30 feet high. She stated that other siting alternatives were discussed at the previous meeting, but it was determined that the location was acceptable as proposed if the retainage were properly designed. In regards to the visual appearance, the retainage and driveway will have a significant impact on the visual appearance. Revegetation of cut and fill areas are proposed to be native grasses and sage. New landscaping consists of 21 dicidous trees, aspen and birch, no low landscaping elements are proposed. Fritzlen stated that it is suggested that plant material such as tall shrubs and native ground cover more sutied to this microclimate be considered in 'light of the difficulties that will be encountered with irrigation. Irrigation is not addressed in this application. ^ritzlen stated that this proposal is unique to the vicinity. Fritzlen stated that the staff recommendation is that if the Commission has adequate findings, approval is recommended with the following conditions: A more thoroughly developed landscape plan, subject to Commission review, be submitted prior to issuance of building permit. Approval of exterior material samples as presented at the meeting. Approval of exterior lighting specifications as presented at the meeting. Engineered drawings for the retainage be submitted with the building permit application. Steven Richards provided color samples and also the exterior lighting information. He stated that Intermountain Engineering is working on drawings for the retainage, to be submitted with the building permit application. Ptach_Sin_gile_Family_ Residence_ Final Design Review (cont.) accomplish is a bank with rough, large boulders, like an outcropping that will look natural, with grasses and natural vegetation. He stated they are not trying to do too much landscaping in that area. He stated, as far as the driveway drainage itself, the intention was to have the drainage down the driveway. They hope that by using the gravel it will minimize the runoff off the lot. He stated that they will work with the staff to meet the requirements for the driveway. Discussion followed on the colors to be used. Discussion followed on the length of the driveway and the retainage. Perkins moved to grant final design review approval for the Ptach residence, Lot 54, Block 3, subject to condition 1. A more thoroughly developed landscape plan be submitted for the staff to review and approve, prior to issuance of building permit; and 4. Engineered drawings for the retainage be submitted with the building permit application. Jeppson seconded. The motion carried unanimously. Lot 2 Filing I. Eaglebend. $cuth_Harbor DeveIopment,__Pup _Iex Residence Final Design Review Fritzlen stated that this residence is located on Lot 2, which is at the eastern end of the Eaglebend Subdivision, adjacent to the Eagle River. The access to it is Eaglebend Drive. She stated that Tony Seibert, South Harbor Development is requesting final design review for a duplex. residence. She stated that this proposal is identical to the proposal approved February 7, 1989 for Lot 7, Filing No. 1. She stated that it is the intent of the owner to construct a single family residence on Lot 7 and abandon the previous approval. Fritzlen stated that the back decks encroach into the required thirty foot setback from the mean annual high water mark, and it is suggested that the decks be redesigned to comply with the requirements. She stated that the applicant has agreed to do so. Regarding the suitability of the Planning and June 6, 1989 Page 5 of 8 Zoning Commission Meeting Minutes Lot 2 Filing 1 Eaglebend, South Harbor Developments Duplex Residence Final Design Review (cont. improvement, this proposal is similar, but not identical to the duplex approved and now under construction on Lot 12, Filing 1. She stated that approval of exterior colors should be based on dist;nguishing this duplex from its Similar neighbor as well as other applicable design criteria. Previously approved colors were blue and grey and off white stucco. Fritzlen stated that there does not appear to be any unusual or significant impacts to adjacent properties. She stated that the site is gently sloped and easily accomodates the proposed improvements. Landscape plan is well developed and serves to screen parking areas and side elevations from adjacent properties. She stated that if the approval for Lot 7, Filing 1, remains in place there is a potential that there would be two identical buildings within sight of each other. Staff recommendation is approval conditioned by the following: 1. Approval of material samples as presented; 2. Prior to issuance of the building permit, revised plans indicating rear decks outside of the applicable setback be submitted. Ton; Seibert stated that they are prepared to totally abandon the use of this plan on Lot 7. The difference between Lot 7 and Lot 2 is that Lot 7 has a significant slope all the way down to the river, whereas Lot 2 is virtually flat until it gets to the top of the bank and then drops at a very steep angle to the river. The proposed house is all on the flat portion of the lot. He stated that they have made several changes since the plans were submitted. They have changed the site plan slightly to rotate the house and drop back about a foot and a half so that neither deck is encroaching. They have also totally eliminated the basement. The differences and similarities between Lot 12 and Lot 2 were discussed. Discussion followed on the landscaping plan. Hunn questioned the parking and manuevering space. Fritzlen stated that the area is sufficient. McRory asked if there is adequate snow storage. Fritzlen stated that the setbacks could be used. Perkins voiced concerns regarding mirror image projects. The Commission members agreed with these concerns. Considerable discussion fcllowed. Reynolds moved to approve final design for Lot 2, Filing 1, Eaglebend, duplex residences as submitted. McRory seconded. The motion carried with Perkins and Hunn voting nay. Fritzlen stated that John Rosolak, on behalf of William Loughridge, is requesting final design review for a single family residence , located on Lot 18, Filing 3, Eaglebend. She described the location of this application. She stated that this was recently replatted so that they would be suitable for single family residences. She stated that this was done with the permission of the Condominium Association. She described where Lots 17 and 18 were and stated that they would be served by a common driveway. She stated that Lot 17, the Appleby residence received final design review approval on April 4, 1989. Hunn asked if the plans for Lot 17 could be provided so that they could compare it with this application. Discussion followed on the colors and materials to be used. There will be cedar siding with a light stain and stucco. Discussion followed on various aspects of the design. The fact that this is a contemporary design and the design approved for Lot 17 was victorian was discussed. Perkins moved to grant final design review for the Loughridge residence on Lot 18, Filing No. 3, as submitted. Hunn seconded. The motion carried with McRory voting nay. Planning and June 6, 1989 Page 7 of 8 Zoning Commission Meeting Minutes Reading and Approval of the Minutes of the Mav 1 6_1989 Regular Meeting Reynolds moved to approve the minutes of the May 16, 1989 meeting. Jeppson seconded. The motion carried unanimously. Other Business The Recording Secretary informed the Commission that included in their packets were copies of the REVISED Design Review Procedures, Rules and Regulations. She stated the revisions consisted of the adopted fractionalization amendments. She asked that the Commission review them and be prepared to approve or disapprove at the next meeting. The Secretary also brought to the attention of the Commission the copy of a Public Service Announcement included in the packets. She stated that the Commission needs to make a motion accordingly before the meeting can be officially cancelled. Perkins moved to cancel the meeting on the Fourth of July. Hunn seconded. The motion carried unanimously. Reynolds stated that he would like to, very soon, meet with the Town Council regarding the Master Plan. The Commission members agreed. MCRory voiced concern that the Planning and Zoning Commission members cannot use the medallions for golf. He stated that he was told that, because of the stringent regulations at the country clubs, the only people that could use them are the Town Council members. Perkins moved to adjourn. McRory seconded.
