MINUTES OF PLANNING AND ZONING MEETING
JULY 18, 1989
The regular meeting of the Planning and Zoning Commission was
held on July 18, 1989, at 7:30 PM in the Town Council
Chambers of the Town of Avon Municipal Complex, 400 Benchmark
Road, Avon, Colorado. The meeting was called to order by
Chairman Frank Doll.
Members Present: Frank Doll, Clayton McHory. John Perkins,
Buz Reynolds, Denise Hill, Jack Hunn
Terri Jeppsen

Due to the lack of a quoi at the beginning of this meeting,
with John Perkins declaring a conflict of interest on the
first item, the Commission took item two, the Ptach residence
des;.gn revisions, as the first agenda item. Members present
at call to order were Frank Doll, Denise Hill, John Perkins
Pnd Terri Jeppsen. Jack Hunn, Buz Reynolds and Clayton
McRory arrived after the discussion on the Ptach Residence
began, with Buz Reynolds and Jack Nunn declaring a conflict
of interest regarding this item.
Lot 54,__ Block 3. Wildridae,_..Tom Ptach__ Residences_ Design
Review Modifications
Norm Wood stated that at the June 6th meeting of the Planning
and Zoning Commission, design review approval was granted for
a single family residence on Lot 54, Block 3, Wildridge. The
applicant is now requesting design review approval for some
modifications to the design which was approved. In general
the changes consist of:
1. A reduction in building size by approximately 300 sq. ft.
2. The elimination of the deck from the west elevation and
adding a bay window.
3. The garage previously projected beyond the building and
the revised plans call for moving the garage back so that it
is entirely under the building.

4. There are some revisions to windows and window
treatments.
5. A change in the fireplace from stone to stucco is
proposed.
6. A change of the roofing materials from cedar shakes to
asphalt shingles is proposed.
Wood stated someti-ing that does not show or, the revised plans
that has occurred with the construction, i:;, in constructing
the driveway, the previous plans called for a native rock
retaining walls to be built, but wher they began the
excavation they ran into basically solid rock in that area.
Therefore, they have a stable slope without having to go to
the retaining walls. This change has not been reflected on
the drawings, but should be considered as it may have some
effect on the landscaping. The previous approval had two
conditions included:
1. A more thoroughly developed landscape plan be submitted
for staff review and approval, prior to issuance of a
building permit; and
2. igineered drawings for the retainage be submitted with
t ilding permit application.
Wood stated that staff feels that condition number 2 is no
longer applicable, due to the materials encountered on the
site. It may have some impacts with the Commission's
thoughts regarding the landscape plan.
Wood stater] he had provided both sets of drawings :o
comparisons can be made.
Tom P',:ach stated that the changes indicated are results for
financial reasons. The primary :savings result frcm the
red-.jc�tion of the square footage and the moving of the garage
to underneath the building. There is also substantial
savings by removing the deck. He stated that the bay window
was a bay window on the previous dr&wings, however it was
just not as predominate with the deck. He stated they are
proposing the cedar tone shingles, which will look like cedar
shakes at a distance.
Discussion followed on the length and width of the driveway.
The drive is 200 ft. long and is 16 ft wide. It meets with

all requirements for conformance.
Hill asked if he was aware that asphalt shingles are nut
allowed by the Wildridge covenants. He stated that he was,
but that they are allowed in the Town of Avon.
Hill asked for a sample of the shingle. Ptach provided a
brochure on the type of shingle to be used. He stated that
they would be a weathered cedar tone.
McRory and Perkins voiced concerns with the backside of the
cut for the driveway and possible erosion.
Discussion followed on the window treatments.
Perkins moved to approve the revised design to the Ptach
residence. Lot 54, Block 3, Wildridge, with the comment that
he monitor and watch the driveway for erosion and continue to
address this matter, and with the staff recommended condition
that a detailed landscape plan for Planning and Zoning
Commission review and approval be submitted by August 1,
1989.
Jeppsen seconded.
The motion carried unanimously.
Lot 25 Block 2. Benchmark at Beaver Creek,. Christie Lodge
Owners Association, Variance Requests Public Hearing
John Perkins stepped down as a voting member of the
Commission due to a conflict of interest.
Buz Reynolds and Jack Hunn resumed their positions as voting
members.
Wood stated that the Christie Lodge Owners Association has
applied for a variance request from the front yard and side
yard setbacks, for the purpose of adding a swimming pool to
the Christie Lodge project. He stated that the proposed
location is at the northwest corner of the site, basically at
the intersection of Avon Road and I-70 at the east bound on
ramp. He stated it would be an out000r pool that would have
a canvas type enclosure that could be opened. He stated that
the encroachments are 11.25 ft into the front lot setback
along Avon Road, and 6.25 feet into the 7.5 setback along
I-70. Schmatic drawings have been provided to help to
evaluating the variance request. They are also asking for
conceptual review on the proposed design for the enclosure.

Wood suggested a presentation be given by the applicant and
then the public hearing opened.
John Perkins, representing the Christie Lodge, stated that
the Lodge has found that they really need a swimming pool.
They have a lot of requests for a pool. This particular site
is the only site where the pool makes sense. Perkins then
described, on the schematic, where the project would be
located. He stated that the pool would be a 45 by 17 foot
pool. He stated he felt it was important to build a
substantial structure around the pool, so that it reads as
part of the building. He stated that the line of the fence,
being at a different angle, makes a more interesting play on
the angles. The pool enclosure will have a retractable
canvas awning top that will roll up and will be stored, with
a covering, in the summer. The vertical openings around the
pool will have a canvas curtain type system that will have
transparencies in the openings. They will fasten on the
inside o� the frame. The materials will be wood siding on
the framework and the fence may be the same as the building,
an upgraded wood fence.
Considerable discussion followed on the type of fence and
also the location of the fence and the encroachment into the
setbacks.
Discussion followed on the proposed canvas roof. Perkins
stated that he will provide samples at the final design
review.
Doll stated that design matters should be discussed at the
design review, the concern now is for the variance.
Doll then opened the public hearing for any comments.
Jose Boza of the Christie Lodge described why this location
for the pool was chosen and stated that this was a much
needed amenity, and urged the Commission to approve the
variance.
Doll asked if any correspondence or calls had been received,
The Recording Secretary stated that there had been none
received.
Doll then closed the public hearing.

Doll noted that Resolution 89-11 had been provided, which
includes the staff recommended conditions.
Hunn moved to adopt Resolution 89-11 with the conditions,
criteria and findings as stated.
Hill seconded.
The motion carried unanimously.
McRory stated that he feels that the design and construction
of the structure around the pool is very important. Perkins
stated, again, that he will have samples at the design
review. Further discussion followed regarding the design.

Wood stated that a design review application has been
received for an approximately 10,500 sq. ft. masorry building
with a metal roof on Lot 24, Block 1, Benchmark at Beaver
Creek. He stated that lot is near the west end of Nottingham
Road, immediately adjacent to the Wolff Warehouse. There is a
drainage easement along the west side of the property. The
proposed uses include 10,000 sq. ft. of warehouse and 1350 so
ft. of office space. Wood stated it is located in the
Industrial Commercial zone district and the warehouse is an
allowed use. General commercial offices are allowed only as
a special review use, therefore it should be clarified in
this application regarding the use of the office space, so it
will not be interpreted as general office space.
Wood stated that rather than go through the Staff comments at
this time, the applicant should make his presentation and
then the Staff comments should be addressed.
Wood stated that the review was based on a limited amount of
information. The applicant did not provide all the
information needed for final design review.
Mark Donaldson, representing Deep Rock Water Company, stated
that he is asking for final approval tonight, rather than
preliminary approval as suggested by staff in its report.
Drawings have been revised and renderings are provided, and
they feel that they have everything needed for final approval
with the possibility of some grading details being worked out
prior to building permit.

They have selected Beck and Associates as General Contractor
and Armco Steel Building Company to erect the steel portion
of the building, shop drawings are underway and so they would
appreciate the Commissio" considering this as a final design
review.
Donaldson then described the colors to be used as a dark blue
for the accent color, a dark grey for the block and overhead
doors and the other color of the building material is the
antique white. Discussion followed on the areas for each
color.
Donaldson was asked where they would locate snow storage. He
replied that most of it would be hauled off, there is very
little opportunity to stack it on site. He also stated that
trash dumpsters will be kept indoors. He stated that they
are using the manufacturer's heated gutter system over the
loading dock.
Donaldson then described the lighting system.
Donaldson then provided an updated plan.
Discussion followed on the lighting.
Jeppsen asked how many trucks would be going in and out
during the day or spending the night. Donaldson stated that
the trucks will be parked within the warehouse. No trucks
will be parked outside. Considerable discussion followed on
this matter.
Chairman Doll then reviewed the staff conditions as follows:
1. Proposed development may require use of public street for
maneuvering of larger trucks into building and loading dock
areas.
Donaldson reiterated that the semi -trucks will have to
back into the building. He stated there is Just not enough
room on site to turn a semi, even if you would cut the
building in half. He stated, at Norm's request to deal with
the possible tight radius of the drive, they nave now
combined the two driveway cuts into one wider cut. He stated
that there is now room to move there. They still plan on
making the continuous culvert through there.
Discussion followed on this being a low volume area for
traffic.

potential truck access.
Hunn stated that, aesthetically, he prefered the two
drive solution. He asked if 55 ft. was really necessary?
Donaldson stated they could do it any way the :ommission
wants it. Further discussion followed. The Commission
members all seemed to concur that two accesses would be bast.
3. Access to some parking spaces does not appear to meet
minimum requirement of 24 feet.
Hunn stated that the requirements are for 17 parking
spaces and on the revised plan there are only 16.
Donaldson stated that they can accomodate the other
parking space, however, the actual required spaces will
depend on the actual size of the office space. Further
discussion followed. The inclusion of curb and gutter was
discussed.
4. Increased access for both trucks and automobiles may
encroach into setbacks or reduce open space to below minimum.
Donaldson stated that this is not the case, they still
have in excess of 1000 extra feet of -een space with the
wider access.
:ill asked why Staff made this comment, if this was the
case. Wood stated that the Staff Report comment was made on
the previous plans submitted.
5. Trash storage should be addressed on site development
plans.
All trash storage will be required to be stored within
the building. It was asked that this be shown on the
drawings. Trash pickup was discussed. Donaldson explained
how this would be accomplished.
6. Building colors should be specified on development plans.
Donaldson stated the accent color will be 505D -Electric
Blue, for the garage doors and masonry is 5473M, High Society
(dark grey) and the roof and wall metal panels are antique
white from Building Technologies Corp.

Discussion followed on the antique white color being a
matt finish. The windows will be painted wood.
7. Exterior building, parking lot and driveway lighting
should be indicated on development plan.
The lighting will be the pink high pressure sodium
lights. 4 located around the building. Discussion followed
on dome shaped ones and flat shaped ones. The style of
lighting was then discussed. Hunn asked how the two signs
would be iluminated. Donaldson stated that they would be
pan -channel, back -lit, with blue plex-glass lens in
individual letters. If the tenant with a specific logo comes
in then they would come back for approval.
This is basically their sign program.
Donaldson stated that the lighting will be poles,
cut-offs and 100 watt. Further discussion followed on the
lighting location:.
8. Proposed building roof line appears to be less than
recommended 4:12 pitch.
Donaldson stated that if they use a 4:12 pitch the
building gets so out of proportion. Donaldson stated that
the pitch is 1-1/4:12.
Wood stated that this particular recommendation is part
of the Design Guidelines and is basically dust to point it
out and is not a recommendation. Further discusssion
followed.
9. Proposed roof line appears to result in loading dock area
being located in a snow drop area.
Donaldson stated that there will be a heated gutter to
protect the dock. Discussion followed on the design of the
loading dock. Discussion followed on the drainage easement.
Discussion followed on the possible use of the drainage
ditch for snow storage.
Discussion followed on the possibility of a roof for the
loading dock.

exit may be required due to size and configuration of
building.
Donaldson stated that the depth of the lease space is
not beyond the required travel distance to the primary exit
and the occupancy load does not require two exits.
11. Sign Program should include allowed size range, sign
types and materials.
Donaldson stated that the frame of the letters will be
a metal frame, and the letters will be back -lit.
12. Site grading and drainage plan must address flows in
drainage easement along westerly lot line, treatment of
parking lot runoff and drainage along Nottingham Road.
Drainage plans must address both piped storm water and
surface drainage along Nottingham Road.
Doll stated that this comment had already been covered.
Regarding the staff recommendation of considering this as a
preliminary design, the applicant asked that it be considered
as a final design review. Doll stated that if the conditions
listed by the staff has been satisfied, then there should be
no problem condisering this application for final design
review, with conditions.

to the Deep Rock project, with the following conditions.
1. Any future tenant sign conform to the sign program.
2. Any future conversion of the window in the tenant space
to a garage door must come back to the Commission for
approval.
3. A revised site plan showing two curb cuts and 17 parking
spaces, together with curb and gutter.
4. The exterior lighting fixtures be amended to a horizontal
cut-off style fixture, on poles or mounted on the building
and the lighting at the entrance be a soffit fixture, rather
than an exposed fixture. That wattage be 100 watts maximum.
b. The applicant submit a grading and drainage plan as per
Stiff comm9nt 12.
6. If the loading dock is covered with a roof, the applicant
come back to the Commission for approval.
7. Trash storage be shown on drawings.
8. The applicant will look into the possibility of putting a
snow fence on the roof over the loading dock.
McRory seconded.
Wood asked that it be noted that the motion is based upon the
plans as presented at this meeting of July 18, 1989.
Hunn amended his motion to include the reference of the site
plan drawing with the revision date of July 18 and floor plan
drawings dated July 7, 1989.
McRory seconded the amendment.
The motion carried unanimously.

on March 21, 1989. The applicant is requesting one change
from cedar shakes to asphalt shingles.

Franz Elsigan stated that this is a very low priced project
and they would like to keep the price down, but also it is
better regarding insurance premimums. He provided samples of
the propose shingles, stating that they are considering the
charcoal color.
Discussion followed on the colors available and the
possibility of having a weathered grey that would resemble
the wood shake.
Discussion followed on allowing the use of asphalt shingles
within the Town.
McRory moved to grant the final design review revision for
Lot 8, Block 1, Benchmark at Beaver Creek, to go from a wood
shake shingle to an asphalt shingle, for reasons such
mentioned. The color is to be a dark grey or similar to a
weathered shake shingle, and the applicant bring a sample of
the asphalt shingle he intends to apply back to the
Commission prior to installation.
Reynolds seconded.
The motion carried with Hill, Perkins and Hunn voting nay.
Doll stated that there is one more applicant that is not on
the agenda, out needs some input from the Commission
regarding his sign program. This is for Lot 65/66, Block 2,
Benchmark at Beaver Creek, The Annex.
Pat Barron stated that he is here in order to let the tenants
get their signs ordered for a September I, 1989 opening.
He provided color renderings. He stated that the tenant
signs will be no higher than 18 inches and no more than 20
sq. ft. He also described the project sign. He stated that
they would like to have one of these signs ar. each entrance
location. They would be a 4 x 8 foot sign, with the addition
of the peak to match the architectural style of the ouiiding.
Considerable discussion followed on the allowable sizes, and
the style of the monument signs requested.
Tenant signs were then discussed. All signs will be white,
even though they may be in script or box, etc. The materials
of the signs was discussed.

This is a conceptual review and the applicant will come back
with a formal sign program.
McRory suggested that the Commission do a walking tour of
this project prior to the next meeting. He felt this would
be beneficial to all Commission members. The Commission
condurred. Monday, July 24th, at 4:30 PM was set as a date
and time to do this. Commission members are asked to meet at
the construction trailer.

Hill moved to approve the minutes of the June 20, 1989
meeting.
Perkins seconded.
The motion carried unanimously.
Other Business
Doll commented on the procedures for denying any projects. A
discussion on this followed.
Hunn asked about the procedure to revise the design review
guidelines. Doll stated that it would be a process of
worksessions and could take considerable time.
Doll asked the Commission members to please make an effort to
be here on time.
Further discussion followed on the matter of shake shingles
versus asphalt shingles.
Wood reviewed the design guidelines for approval or denia of
a project.
Discussion followed on the possibility of incorporating some
of the Wildridge Covenants into the Town of Avon Design
Review Procedures, Rules and Regulations.
A worksession was set for 6:30 PM on August 1, 1989, to
discuss this matter.
Jeppsen voiced concern that there is not a lot of community
involvement regarding the master plan. It was the general
consensus that it is still too early for this type of
participation.
