PZC Minutes 121989044 RECORD OF PROCEEDINGS MINUTES OF PLANNING AND ZONING MEETING DECEMBER 19, 1989 The regular meeting of the Planning and Zoning Commission was held on December 19, 1989, at 7:30 PM in the Town Council Chambers of the Town of Avon Municipal Complex, 400 Benchmark Road, Avon, Colorado. The meeting was called to order by Chairman Frank Doll. Members Present: Frank Doll, John Perkins, Buz Reynolds, Clayton McRory, Denise Hill, Terri Jeppson Staff Present: Rick Pylman, Director of Community Development, Charlette Pascuzzi, Recording Secretary Chairman Doll introduced Eric Vogglman, who has been building houses in Berry Creek and desiras to build in Wildridge. At this time Mr. Vogelman wishes to show the Commission the style that he wishes to build in Wildridge. Mr. Vogelman provided photos of the styles used in Berry Creek and stated that he felt that these styles would be appropriate in the Wildridge area. They are basically a southwestern style architecture and he feels they would blend well with the topography and vegetation in Wildridge. The Commission agreed that this style would be appropriate for the Wildridge area and encouraged Mr. Vogelman to follow through with the project he has in mind. 7irk Pylman stated that at the last meeting Sonnen Halde came in to show their chosen shingle color. The project had originally had wood shakes, then received approval to change to asphalt shingles, subject to coming back and showing a color, and through that discussion they decided to go back to the wood shakes. Sonnen Halde Condominiums Roof Material Change, Design Review (contj Clayton McRory stated that at the last meeting the asphalt shingles, rather than the color, became the issue. John Dunham and Franz Elsigan provided samples of the color and the type of shingle they desire to use. Discussion followed on the style to be used. Jeppson complimented Mr Dunham and Mr. Elsigan on the project. Mr. Dunham stated that they shingle is quite superior and The color is a rustic cedar. for the owners in the long run be allowed to do this. have found that the asphalt gives a thirty year warranty. They think it will save money and strongly request that they Jeppson stated that even though she likes the building, she feels that this project should stay with the cedar shakes. In looking at the entire area, which can be seen from I-70, every property around it has cedar shakes. Mr Elsigan responded stating that they are trying to do something different and that the colors of the asphalt shingles will last much longer than cedar shakes. Considerable discussion followed regarding the preferences of the Commission of cedar shake shingles for this project. Chairman Doll pointed out that the design review for this building has been completed and at one point the asphalt shingles were approved and in design review asphalt shingles are not prohibited. Hill stated that she feels that the neighborhood is fairly developed out and she feels that they need to stay in conformance with the neighborhood and a project of this magnitude should blend with the neighborhood and she feels that this is what the Commission is all about. Mr. Dunham stated that he concurs, but suggests careful thought on what Mr. Doll said, it was an approved roof. McRory moved to deny the request for the color change and the asphalt roof shingles on Lot 8, Block 1, Benchmark at Beaver Creek at the Sonnen Halde Condominiums. Jeppson seconded. Planning and Zoning Commission Meeting Minutes December 19, 1989 Page 3 of 7 Rick Pylman stated that some findings should be included in the motion. McRory amended his motion to include the finding regarding the suitability of the improvement, including type and quality of materials of which it is to be constructed and the site upon which it is to be located and the finding regarding the compatibility of the design to minimize site impacts to adjacent properties. Jeppson seconded the amendment. Reynolds stated that he would like to leave it up to the applicant whether he uses shakes or shingles. The motiton carried, with Reynolds voting nay. Lot 4. Filing 1, Eaglebend Subd_ivision,_ South_ Harbor Rick Pylman provided sets of plans for this project. He stated that since the report was written, he and Tony Seibert have had some conversations and basically what is they are looking for tonight is a conceptual review of the architecture. They will come back with an amended site plan because of some the concerns regarding this site plan. Pylman stated that it is a single family house. Lot 4 is 16,700 square feet and the building footprint is a little under 2,000 square feet. The building area ratio is at 11%. The building is sited on the extreme western edge of the lot and assuming that the roof over hang is not greater than 18", it does meet all of the setbacks. The building height is 32 feet at its highest point, so there is no problem there. Usable open space and snow storage is not indicated, but there is adequate space for this. The architecture is similar to what is being done in the Eaglebend area. The problem with the proposal as presented is that the elevations do not match the site plan, specifically the south elevation along the river. Pylman stated that it does meet the zoning code. The type and quality of materials is fine. All of the setback requirements are being met, but there are some problems with the siting in relation to the river bank. The visual appearance is fine except for some concerns from the river and across the river with the appearance of the deck that extends out and the supports that will be required to go down Planning and December 19, Page 4 of 7 Zoning commission Meeting Minutes 1989 to grade on the deck. This proposal is very similar to existing improvements in the vicinity, and there is no problems with that, and the proposal is in general conformance with the adopted Goals, Policies and Programs of the Town of Avon. Pylman stated that the comments relate to the site plan in the elevations. Part of the problem is the house is set on the front setback and extends over the river bank in back. The floor plan is being set on a site that doesn't quite fit. The site isn't quite long enough given the front setback and the location of the river bank. He stated that he feels there should be a new site plan and that the commission should look at the architecture conceptually at this time. Tony Seibert, South Harbor Development, stated that this house is a presale, based upon one of the duplex units. The buyer wanted an exact duplicate of the floor plan, but as a single family residence. He agrees with Staff that the house needs to be moved back towards the road. He would like to proceed with the aesthetics of the building, subject to a new site plan being provided to staff, so that, staff could approve that. He feels that the only wzy this sill work on the site is to come back and ask for a setback variance, similar to what John Railton got. They would probably be asking for a ten foot setback or at least 8 feet. Rick Pylman -stated that he didn't feel comfortable with the Staff approviny the site plan. He felt that the commission should see the new site plan, but if there is a variance request they will see it again anyway. Seibert stated that what they are trying to do is buy Lot 3 and rather than build two duplexes on the lots is break them up and build three smaller single family residences and that is why they put this first single family to the extreme west end of the lot. Discussion followed on the architecture of the project. Seibert stated that the roof overhang will definitely be 18" or less. Discussion followed on the bland look of the north elevation, especially in connection with the west elevation which is rather bland also. It was suggested that some windows be added on the north elevation. Discussion followed on dressing up the chimney and possibly using stucco. It was recommended that the west elevation and north elevation be Planning and Zoning Commission Meeting Minutes December 19, 1989 Page 5 of 7 Lot 4 Filing 1 Eaglebend Subdivision_ South Harbor given some of the interest that the other two have, possibly some plane changes, to develop some shadow patterns. It was suggested that maybe lattice work could be used under the deck to disguise the supports for the deck. Since a revised site plan is required, and this discussion was basically conceptual, no action was taken regarding this application at this time. Reading and Approval of P 8 Z Minutes of 11/21/89 Regular Meeting Denise Hill moved to approve the minutes of the November 21, 1989 regular meeting. Clayton McRory seconded. The motion carried unanimously. Other Business Discussion followed on the steel frame that has been erected for the Christie Lodge pool. Buz Reynolds stated that, at 5 AM the other morning one of the semi trucks at the moving company pulled out in front of him and forced him into the ditch. Denise Hill stated that she also had a problem yesterday with a truck blocking the road. Discussion followed on this problem and also on the problem of outside storage. Rick Pylman stated he would check into this further. He stated that Paul Wolff, the owner, would also like to get the matter settled. Chairman Doll stated that one of the matters that the Commission is going to have to address is the roof husiness. He stated that the Town of Avon is trying to encourage people to come here and build. Today, every applicant is talking about costs. That is one of the things that slows down building. He stated that he had checked , at the two lumber companies that service this area, the costs on roofing material. Wood shingle roofing, sawed shingles, is $115.00; Shake shingle roof is $90.00; Fireproof shakes, $147.00. Metal roof is $85.00 with all of the attachments it takes to put it up. Asphalt, fireproof shingles, with a 30 year guarantee is $78.00. Other asphalt shingles, not fireproof and depending on the guarantee run from $25.00 to $60.00. Fiberglass is about $80.00. Other options are tile or tarred gravel, both far more expensive. Doll stated that he feels I,, Planning and Zoning 3ommission Meeting Minutes December 19, 1989 Page 6 of 7 Other Business (cont) that one of these days some of the applicants will take exception to this wood shingle roof business and go to the Council. Hill stated that the Commission has to look at the neighborhood consideration. She stated that she has no problems in other areas, just this particular project. Considerable discussion followed on the matter. Doll stated that the Commission could not say that every house that comes through here has to have shake shiigle roof, or they will disapprove it. If they do, then the Commission is in deep trouble. Hill stated that it is not the Commission's job to consider costs. Doll stated that it is not their job to disco.rage people from coming in because the Commission insists on the most expensive material. Discussion followed on the importance of roofscape. Doll stated that the Commission can not say that shake shingle roof is the only thing that is acceptable. Each project should be considered on its own individual merits and location. Discussion followed on the justifications of the denial on Lot 8, Block 1, Benchmark at Beaver Creek, Sonnen Halide, citing the location as a primary reason. John Perkins moved to adjourn.
