PZC Minutes 081688RECORD OF PROCEEDINGS MINUTES OF PLANNING AND ZONING MEETING AUGUST 16, 1988 The regular meeting of the Planning and Zoning Commission was held on August 16, 1988, at 7:35 PM in the Town Council Chambers of the Town of Avon Municipal Complex, 400 Benchmark Road, Avon, Colorado. The meeting was called to order by Chairwoman Pat Cuny. Members Present: Tom Landauer, Frank Doll, Buz Reynolds, John Perkins, Denise Hill, Clayton McRory, Pat Cuny Staff Present: Lynn Fritzlen, Director of Community Development; Charlette Pascuzzi, Recording Secretary Lots 26/27 Block 1. Benchmark at Beaver Creek Special Review Use to Allow Automotive Repair, Public Hearing Lynn Fritzlen stated that Jerry Vekre of Jerry's Auto Repair is seeking a Special Review Use that would allow automotive repair in one of the 12 condominiumized spaces of the commercial complex presently owned by Les Shapiro, known as Mountain Center. The complex is located in the IC Zone District. Fritzlen stated the allowed uses in the IC Zone District are: warehouse, labratories, electrical substation, light manufacturing plants, wholesale outlets, showrooms, industrial, construction and wholesale offices, accessory building. The Special Review Uses consist of: residential unit when used in conjunction with business operation, automotive or other vehicular sales and repair shops, retail sales and personal service outlets, restaurants, public uses, outside storage areas, general commercial offices. The space to be used by Vekre is approximately 2100 square feet, has a pedestrian entry at streetside and a vehicular entry at the rear. Five spaces at the front of the building and six spaces at the back of the building are to be assigned to Jerry's Auto Repair, per Mr. Vekre. Additionally there will be unpaved parking for 15 vehicles an the west end of the building for the storage of cars under repair. Vekre has stated that there is an agreement with Shapiro to maintain the lot for Jerry's Auto Repair's use, but eventually that area is scheduled for a future building addition. There will be no hazardous materials stored on site. Waste oil will be taken off site to be disposed of. It is assumed that used parts will be recycled. Fritzlen stated that the Staff recommends that the Planning and Zoning Commission approve Resolution No. 88-8, recommending approval to the Town Council of the Special Review Use to allow automotive repair for Jerry's Auto Repair, located in the Mountain Center Building, Lots 26/27, Block 1, Benchmark at Beaver Creek, subject to: 1. Adequate parking being provided for the proposed use in conjunction with Chapter 17.24 of the Avon Municipal Code; 2 The provisions that the visible accumulation of personal property on the site, including but not limited to, automobile parts, tires, disabled vehicles, etc., shall be screened from the view of passing motorists and residential uses in the area, by being contained within the building or other structure as may be approved by the Planning and Zoning Commission; 3. Commission review and approval of all modifications for the building exterior; 4. Commission review and approval of plans for individual business signage or a comprehensive sign program for the entire project; 5. The provision that the Special Review Use shall expirEr with the loss of any required parking. Cuny asked if there had been any complaints or nonconformance to the current Special Review Use that this applicant is now working under. Staff replied that there were none that they were aware of. Jerry Vekre stated that the reason for this move is that they have problems with parking at their current location and they are looking for more room to be able to keep more cars inside. Cuny then opened the public hearing. She then read the letter received from Gallegos Masonry regarding this matter into the record. She then asked if there had been any other comments received. The Secretary stated that there had been no others received. Cuny asked if Vekre would be using this as a tow yard. Vekre stated that it would not be a tow yard. Cuny asked if cars would he left outside to be used for parts. Vekre stated that the cars would be only the ones that are being worked on. Reynolds asked Les Shapiro to clarify the parking situation. Shapiro provided a plan showing the parking and described the area that would be used by Jerry's Auto Repair. Discussion followed on the plans for parking in the future when Phase II is constructed. Discussion followed on screening. Shapiro stated that there is no proposed screening as there will be no wrecked cars parked in the area. Discussion followed on the amount of cars normally handled by Jerry's Auto Repair at one time. Vekre stated that any cars that are repaired and not picked up in a week to ten days are taken to his place in Gypsum to hold. Perkins asked about a sign program. Shapiro replied that a sign program for the entire building has been approved. Doll commended Mr. Vekre on what he has done at his current place of business and feels that his business is an asset to the Town of Avon. Doll moved to approve Resolution 88-8 as written except in paragraph 2. the statement "shall be screened from the view of passing motorists and residential uses in the area" should be deleted, and a further provision that this Special Review use be re-evaluated at the time that Mr. Shapiro starts Phase I1 or not later than June 1, 1989, should be added. McRory seconded. The motion carried unanimously. Reading and Approval of the Planning and Zoning Minutes of 8/2/88 Regular Meetino Doll moved to approve the minutes of the last meeting as submitted. Reynolds seconded. The motion carried unanimously. Other Business Doll stated he had a concern regarding safety in the area where North American Van Lines is located. The trucks are blocking the road and is a dangerous situation - C WO Planning and Zoning Commission Meeting Minutes August 16, 1988 Page 4 of 4 40 Cuny stated that she was also concerned about all the storage pallets etc. stacked around and asked Staff to try to correct the problems being created. The truck parked at Vail Imports and the Now Hiring sign at Pizza Hut were discussed, and also the advertising signs at Coastal Mart. Fritzlen stated she would advise the Building - Official of these items. Cuny asked if the Christie Lodge had indicated that they would be starting with the painting and instructed Fritzlen to find out if they are in fact going to paint this summer.
