INTRODUCTION:
At the meeting of January 5, 1988, the Commission deferred action on this
application until this meeting and directed the Applicant to return with
information regarding screening of the satellite dish antenna or relocation
of the dish. The Staff report from the previous meeting is attached to th;s
report.
At this time, Staff has not received any additional information from the
Applicant. The Commission should be aware that the Planning and Zoning
Commission Rules and Regulations require that the Commission approve, deny,
or continue the design review of the application within forty-five (45) days
of the date of the meeting at which the application is first reviewed by the
Commission.
STAFF RECOMMENDATION:
If the Commission must deny the application, Staff
be continued until Staff can prepare a resolution
outlining the reasons for such denial.

INTRODUCTION:
This item was continued from the regular meeting of 1/5/88, at the applicant's
request.
Commercial Federal, formerly Empire Savings, has applied for Design Review of
a sign program for their building located on Lot 71, Blc-k 2, Benchmark at
Beaver Creek. They are proposing changing the two building mounted signs to
reflect the new name or' the bank, as well as adding a monument sign with the
company name and a time. -temperature readout feature.

The building currently has approximately 110 square feet of signage divided
between two signs. The proposal for replacing the building mounted signs
appears to fall within the 96 square foot sign allowance for individual
business lot signage. A variance will be required for approximately 62 square
feet for the monument sign.
Before acting on a variance request, the Planning and Zoning Commission shall
consider the following factors:
a. The relatianship of the requested variance to existing and potential
uses and structures in the vicinity;
b. The degree to which relief from the strict or literal interpretation
and enforcement of a specified regulation is necessary to achieve
compatibility and uniformity of treatment among sites in the vicinity.
c. Such other factors and criteria as the Commission deems applicable
to the requested variance.

Findings Required: The Planning and Zoning Comm=.sion shall make the following
findings before granting a variance:
a. That the granting of the variance will not constitute a grant of
special privilege inconsistent with the limitations on other properties
in the vicinity;
b. That the variance is warranted for one or more of the following reasons:
i. The strict or literal interpretation and enforcement of the
regulation would result in practical difficulty or unnecessary
physical hardship inconsistent with the objectives of this title,
ii. There are exceptional or extraordinary circumstances or conditions
applicable to the site of the variance that do not apply
generally to other properties in the vicinity.
iii. The strict or literal interpretation and enforcement of the
specified regulation would deprive the applicant of privileges
enjoyed by the owners of other properties in the vicinity.
STAFF RECOMMENDATIONS:
If the Commission approves the sign program as submitted, Staff recommends that
the Applicant work with staff on the location of the monument sign to avoid
any problems with required setbacks for this sign.
RECOMMENDED ACTIONS:

I-70 BUSINESS SIGNS
INTRODUCTION:
On December 1, 1987, the State of Colorado, Division of Highways adopted Rules
and Regulations pertaining to specific information and business signs for the
Interstate Highway system. These signs are placed along the Interstate Highway
to provide directional information for businesses offering services for gas,
food, lodging and camping to the traveling public. As part of the State's
permit system for these signs, the Applicant is required to get local approval
for the sign prior to turning the application over to the State for review.
At this time, Wynfield Inn, Falcon Point, and Beaver Creek West are requesting
approval from the Commission to have their names and logos placed on one of
these Interstate Business signs.
STAFF COMIMENTS:
Since these signs are not specifically addressed in the Town's Sign Code, and
the entire program for these signs is administered by the State of Colorado,
Staff requests that the Commission make some determinations regarding these
signs.
1. Do these signs fall under Section 15.28.030 (E): "?rohibited Signs" as
"Off -Premises Advertising Signs";
2. Do these signs fall under Section 15.28.040 (B): "Exempted Signs" which
exempts - "Official governmental notices, notices posted by governmental
officers in the performance of their duties, governmental signs to control
traffic, to identify streets, to warn of danger, or for other purposes;"
RECOMMENDED ACTIONS:
1. Introduce Application;
2. Presentation by Applicant;
3. Commission review of submitted material;
4. Make determination as to whether these are allowed or prohibited signs.
