Parking Variance Request
INTRODUCTION:
This item wa_ tabled at the meeting of February 2, 1988 to give the Applicant
the opportunity to consider modifications to the design of the existing
parking lot, including covering some of the spaces, or considering a variance
to change the size of some of the parking spaces. At this point, the Applicant
has not submitted any additional plans for review. Staff reminds the Commission
that action must be taken on an application within forty-five days of the date
of the meeting at which the complete application and supporting material is
first reviewed by the Commission. The Commission may approve, conditionally
approve, deny or continue the application. Failure of the Commission to act
within the prescribed time limitations shall be considered as conditional
approval of the application.

The Rio Grande is in receipt of your notice that a public hearing will be
held to consider an application by 182 Avon Corporation for a variance to
allow additional parking places in an area located in Eagle County more
particularly described as situated in Lot 21, Blk 2, Benchmark at
Beavercreek Subdivision, Avon, Colorado, lying adjacent to the D&RGW RR Co.
right of way..
This particular development application, if approved, would be immediately
adjacent to our main line right of way which runs between Denver and Salt
Lake City and carries an average of 12 to 16 trains daily. Because we do
have heavy rail traffic over ;his particular line, our Company is very
apprehensive and concerned at the prospect of having this development
adjoininc, right of way. If the proposal is granted, there would be a
tremenO -rease in auto vehicular traffic in this immediate area. As
the Toh,, Avon is no doubt aware, if there are not sufficient public
crossings to allow adequate access across our tracks to and from the
proposed development area, then we predict that many who would use the
subject area would enter or depart by unauthorized and unsafe methods, such
as using private crossings, which is strictly prohibited by our Railroad,
or by entering or leaving the proposed area by crossing our tracks where no
type of crossing at all exists.
Any Utility crossings will require permits or licenses from the Railroad
and plans must be approved by the D&RGW in advance. -
if the Town. of Avon's Planning and Zoning Commission grants the requested
approval of the variance, we would like to insist that the following three
(3) conditions, which our Company feels should be met to preserve the
public safety, be made a condition to the granting of the application
sought by the above referenced applicant. They are:

INTRODUCTION:
This request was considered at the Regular Meeting of February 2, 1988. At
that time the required Public Hearing was conducted., and the Commission
reviewed plans and heard a presentation from the Applicant. After reviewing
the criteria and findings for approval of variances, the Commission directed
Staff to prepare a resolution approving the variance, for adoption at this
meeting. A copy of the resolution is attached to this report and the
appropriate action would be to adopt Resolution 88- 1 as submitted, or
with modifications.

Design Review
INTRODUCTION:
John and Suzanne Railton have applied for Design Review of a residence they
plan to construct on the east half of Lot 19, Eaglebend Filing No. 1. The
property is zoned duplex and there is currently one residence on the lot.
The proposed structure is planned to match the existing residence as far as
color and materials go. Parking is being provided under carports between the
buildings and the street. A site plan, elevations, and floor plans have been
submitted for review.
STAFF COMMENTS:
This application appears to conform with the requirements of the Zoning Code.
Open space is not a problem due to the fact that the Eagle River and the
Metcalf Ditch take about half of the lot. Parking is being provided between
the buildings and right-of-way line by grant of a variance by the Commission.
The total building height is approximately 31 feet, where 35 feet is allowed.
Staff would lite to have the Applicant clarify the building and roofing
materials and colors as they do not appear on the drawings.
STAFF RECOMMENDATIONS:
Staff recommends that the Commission review this application in conjunction
with the following Design Review Guidelines:
1. The conformance with the Zoning Code and other applicable rules and
regulations of the Town of Avon.
2. The suitability of the improvement, including type and quality of materials
of which it is to be constructed and the site upon which it is to be constructed
and the site upon which it is to be located.
3. The compatibility of the design to minimize site impacts to adjacent properties.
4. The compatibility of proposed improvements with site topography.
5. The visual appearance of any proposed improvement as viewed from adjacent
and neighboring properties and public ways.

Sign Design Review
INTRODUCTION:
Eagle Summit Moving & Storage has requested approval for two business signs
that they would like to 'place on the Wolff Warehouse. This business is
located in the space formerly occupied by Beaver Track and Trail. One of
the signs is planned for the east face of the building and identifies the
business. The other sign is planned for the south side of the buil.ling
and indicates the business' association with North American Van Lines.
The total square footage proposed is approximately 42 square feet. Pictures
of the actual signs and sketches of the building showing sign locations
have been submitted for review.
STAFF COMMENTS:
The Commission previously approved sign program guidelines for the Wolff
Warehouse which allocated a total of 44 square feet of signage for the
space occupied by Eagle Summit Moving and Storage. One condition of that
program was that all signs for the Wolff Warehouse be reviewed by the
Commission.

Sign Program Modification
Design Review
INTRODUCTION:
Palmer Development, developer of the Community Shopping Center, has requested
a modification to the sign program for the project as it relates to project
identification signage. They originally requested a single -sided project
identification sign of 32 square feet. Plans submitted for a sign permit
show a double -sided, interior lit sign approximately 36 square feet per
side. When the sign manufacturer was contacted about the discrepency, the
manufacturer and developer requested review and approval of the new sign.
STAFF COMMENTS:
This sign closely conforms to the previously approved sign,
that it now has two faces instead of one. The Commission is
reviewing changes to the sign code, one of which counts the
side of double -sided signs toward the sign allowance for the

We are requesting a modification to the proposed project sign for
Avon Market Center.
The sign which ivas approved is slightly different from what Pouw &
Associates Architects had submitted on their final drawings and
site plan.
To date, the sign has already been completed, including block base,
electrical, and the frame face portion, but has not yet been installed.
The sign is now a double -face sign perpendicular to the street,
instead of a single -face parallel to the street. It is also 4 square
feet larger than originally shown.
Our company was told the sign had already gone through the approval
process, and that it had been approved. We assumed the approval
was according to the same plans and specifications we received. Our
company found out they were not the same plans and specifications on
2/9/88 when Ray Wright contacted me.
We are, therefore, requesting an approval of the sign as shown in the
enclosed drawing.
We certainly would appreciate your cooperation in this matter, as the

INTRODUCTION:
Vail Associates, Inc. has applied for approval to extend the previous approval
for temporary parking on Lot 1, Lodge at Avon Subdivision. This use was
previously approved by the Planning and Zoning Commission for the 1984-85 ski
season. In addition, the Applicant has requested a similar approval for Lots
1 and 2, Sunroad Subdivision. Previous approvals were limited to ski season
uses. This request is for year round approval so that the parking would be
available for the Town's special events during summer months.
STAFF COMMENTS:
The present Zoning Code does not address the use of vacant lots as temporary
parking areas. Consequently, the Planning and Zoning Commission has used the
following guidelines to evaluate previous requests for similar use approvals:
1. Existing or proposed access to site from existing streets;
7.. Number of parking spaces proposed and impact upon traffic flow;
3. Drainage from the site and possible impact on potable water supply;
4. Site surfacing and possibility of excess debris and mud being tracked
onto streets and highways;
5. Compatibility of use and visual impact on adjacent properties;
6. Length of time for proposed use and restoration of site a': end of
use period; and
7. Written approval from landowners allowing the proposed use.
STAFF RECOMMENDATION:
If the Commission concurs with the application, Staff recommends the following
conditions to an approval:

1. Length of approval be concurrent with length approved by property
owner.
2. Approval contingent upon receipt of written approval from property
owner.
3. Adequate safeguards be provided to control the tracking of mud and
fugitive dust from the site.
4. Access to the Sunroad site be installed in accordance with all
applicable Rules and Regulations of the Town of Avon.
RECOMMENDED ACTION:

The Commission approved the application with the conditions as written by the
Staff, specifically number one that the length of the approval for both the
current lot at the Lodge at Avon and Sunroad be for a period of three years or
the length of time approved by the property owner, whichever is shorter and that
