AMENDMENTS TO THE FRACTIONALIZATION
PROVISIONS OF THE TOWN OF AVON ZONING CODE
PUBLIC HEARING
INTRODUCTION
This Public Hearing is being held to determine possible amendments
to paragraph D of Section 17.22.020 of Chapter 17.22, Title 17,
of the Avon Municipal Code.
TAFF COMMENTS
The Public Hearing should be opened to receive all opinions and
information relating to fractionalization of residential development
rights from the attending public. All information presented should be
considered in determining amendments to paragraph D of Section
17.22.020, Chapter 17.22, Title 17.
STAFF RECOMMENDATIONS
Should the Planning and Zoning Commission determine that amendments
to Section 17.22.020 should be made, Staff recommends approval of
Resolution No. 88-6 - A Resolution From the Planning
Commission Recommending Avon Town Council Approval of
Amendment to the Fractionalization Provisions of the
Zoning Code.

The Commission approved Resolution 88-6, A Resolution From The Planning And Zoning
Commission Recommending Avon Town Council Approval Of Certain Amendments To The
Fractionalization Provisions Of The Town Of Avon Zoning Code amending paragraph
D of Section 17.22.020 of Chapter 17.22, Title 17 of the Avon Municipal Code,
limiting the maximum number of units to 2 1/2 units per residential development
right except in the RHDC (Residential High Density and Commercial), SC (Shopping
Center) and TC (Town Center) Zone Districts
Commission also directed the Staff to amend the Administrative Procedures for
fractionalization to provide for a public hearing process, conforming with Special
Review Use Zone Changes, Variances accordingly, and also to incorporate guidelines
for the review of a fractionalized project.

Design Review
INTRODUCTION
Christy Sports is requesting approval for the addition of a
small deck to the front of their building.. The addition
will project out from the building eight feet and
approximately sixteen feeL" in length. The deck will be
framed of wood and have a me`Al handrail to match existing
railing.
STAFF COMMENTS.
The deck, as proposed, will not effect egress and will not
project into the front setback or reduce parking.
STAFF RECOMMENDATION
Approve proposed deck as submitted.

Temporary Sign Variance Request
INTRODUCTION
Rug's Pub, Inc. is requesting permission to display a
temporary sign to be used on special event occasions, such
as, but not limited to, July 4th, Avon Vintage Car Race, etc.
The temporary sign is approximately 3 feet by 6 feet. It
will state "Now Open for Breakfast" in red and blue lettering
on a white background. The sign will be mounted between the
two sign uprights on the south side of Benchmark Plaza Office
and Retail Condominiums.
STAFF COMMENTS
The proposed banner meets the new sign code ordinance size)
requirements of Section 15.28.080, M.-1.
However, a variance from Section 15.2B.O80, M.-2. allowing
the banner- to be displayed for only one event in any
thirty -day period would be required.
At this time, the request is for special event occasion=_ such
as the July 4th weekend, Avon Vintage Car Race and Balloon_.,
Bluegrass and Barbeque, etc.
The following variance procedure is required: Section
15.28.090, B.
2. Approval Criteria: Before acting on a variance request,
the planning and zoning commission shall consider the
following factors:
a. The relationship of the requested variance to
existing and potential uses and structures in the vicinity;
b. The degree to which relief from the strict or
literal interpretation and enforcement of a specified
regulation is necessary to achieve compatibility and
uniformity of treatment among sites in the vicinity;
C. Such other factors and criteria as the
commission deems applicable to the requested variance.

constitute a grant of special privilege inconsistent with the
limitations on other properties in the vicinity;
b. That the variance is warranted for one or more
of the follcwing reasons:
i. The strict or literal
interpretation and enforcement of the regulation would result
in practi=al difficulty or unnecessary physical hardship
inconsistent with the objectives of this title;
ii. There are exceptional or
e�:traordinary circumstances or conditions applicable to the
site of the variance that do not apply 'to other properties in
the vicinity;
iii. The strict of literal
inter-pretation and enforcement of the speci.fied regulation
would deprive the applicant of privileges enjoyed by the
owners of other properties in the vicinity.
STAFF RECOMMENDATION
Should the Commission decide to grant a •variance for the
banner, it is recommended that approval be limited to special
event occasions through September 30, 1988. This would allow
the use through Labor Day and allow the Commission to
re-evaluate the banner at that time.

Temporary Sign Variance Request
INTRODUCTION
Jim Park, representing Avon Center, is requesting approval
for a variance to display a temporary sign advertising summer
rates, condo rentals, kitchen/living room. The purpose of
the sign is to serve as the condominium/hotel exterior sign
they presently do not have. Also, to let the traveling
public know there is a hotel office and rentals in the
building and that there is a condominium alternative to a
hotel room.
The sign would not exceed '05 square feet, probably not more
than 25 or 30 square feet. It would be displayed an the
second floor, neatly wired to the building.
Applicant is requesting approval to display this sign all
day, every day, through September 30, 1988.
STAFF COMMENTS
The proposed banner meets the new sign code ordinance size
requirements of Section 15.28.080, M.-1.1 but requires a
variance for the length of time requested to be displayed.
The following variance procedure is required: Section

Satellite Dish Antenna
Design Review
INTRODUCTION:
Gary R. Hill has applied for approval of a satellite dish TV antenna on Lot 21,
Block 4, Wildridge Subdivision. The six (6) foot diameter satellite dish has
already been installed at the northwest corner of the residence.
STAFF COMMENTS:
The Planning and Zoning Rules and Regulations provide for the installation of
satellite dish antennae. Those guidelines and responses from Staff concerning
this application are listed below:
1. All antennas shall be located so as to be screened from view from any public
right-of-way or neighboring property. Screening may be accomplished by in-
corporating the antenna into building design, or through the use of landscaping
materials, fencing, existing structures, subgrade placements, or other means
that both screen the antenna and appear natural to the site:
The applicant has stated that the placement of the satellite dish at the
corner of the house serves as screening.
2. All wiring and cable related to antenna installation shall be installed
underground or be incorporated entirely within the structure:
No information has been received on the installation of this satellite dish.
3. The use of mesh antennas is encouraged.
No information has been received regarding the type of satellite dish.
4. Color selection for dish antennas should be made with respect to the
characteristics of the site or structure. Unpainted surfaces and dish antennas
with reflective surfaces shall not be allowed. No advertising, logos, or
identification shall be allowed on any dish antenna.
No details have been provided on dish color.
STAFF RECOMMENDATION:
If the Commission feels that this application conforms with the guidelines for
satellite dish antennae outlined in the Planning and Zoning Commission Rules and
Regulations, the approval as submitted, or with minor modifications is appropriate.

At the June 7, 1988 Planning and Zoning
Mr. William Nolan to return on June 21,
trim on the building.
Commission Meeting the Commission asked
1998 with a color selection for the
Mr. Nolan provided the Commission with two color choices. One was white and
the other a federal blue. He stated that their preference was to leave the
trim the same as the building, but that if the Commission so directed, they
would in fact paint the trim a contrasting color.
After discussion, the Commission granted permission to leave the trim the
same color as the building.
