PZC Minutes 062188RECORD OF PROCEEDINGS MINUTES OF PLANNING AND ZONING MEETING JUNE 21, 1988 The regular meeting of the Planning and Zoning Commission was held on June 21, 1988, at 7:30 PM in the Town Council Chambers of the Town of Avon Municipal Complex, 400 Benchmark Road, Avon, Colorado. The meeting was called to order by Chairwoman Pat Cuny. Members Present: Pat Cuny, Tom Landauer, Frank Doll, John Perkins, Denise Hill, Clayton McRory, Buz Reynolds Staff Present: Norm Wood, Director of Engineering and Community Development, Jim Lamont, Planning Consultant, Charlette Pascuzzi, Recording Secretary Lot 6. Block 1 Bencimark at Beaver Creek, Bala% Condominiums East Color Change Request Continuation from Juns 7, 1488 Planning_and_Zonin _Meeting Chairwoman Cuny stated that since the Commission had asked Mr. Nolan of Perpetual Care to return with a choice of color for the trim on the Bal.as Condominiums East, and rather thar make him wait for the Other Business agenda item, the Commission should consider this matter at this time. Mr. Nolan stated that they had chosen two colors as possibility, either white or a federal blue. He also stated that their preference was to ler.ve the trim the same as the building, but if the Commission so directed, they would paint the trim another color. Perkins stated that he felt that it would be best ali one color. Discu-sion followed on tha detail on t -.a building. Perkins moved to allow Balas Condominiums East to maintain the building in one uniform grey color as approved at the June 7, 1988 meeting. Doll seconded. The motion carried unanimously. Amendments to the Fractionalization Provisions of the Town of Avon Zoning Code Public Hearing Wood stated that in the last few weeks there has been concern expressed regarding fractionalization and how it is being utilized. These concerns are generally about the excessive amount of small units in primarily large unit areas, not obtaining the unit mix, desired. Wood described what is being proposed as a possible solution. He discussed the Ordinance that had been presented to the Council for consideration. He stated that it limits the mix that is available by eliminating the 450 square foot unit .iossi bi 1 i ty. Another to ng that was looked at was putting a restriction on fractionalization, putting a cap on the number of units that could be built with development rights, such as 2 112 units per development right, it would not change the -fractions or unit sizes. It would reduce the maximum number of units on the site. It should encourage a mix of unit sizes in order for the developer to fully utilize the development rights and also maximize the number of units ori the site.. It does retain the full. range of unit sizes. It does not guarantee that: a project would not come through with units of P-11 one size. Discussion followed on the possible fractionalization formulas. Wood stated, regarding notification of property owners, he suggested the amendment of the Administrative Procedures for fractionalization, which would require a public hearing before the Planning and Zoning Commission on fractionalized projects and written notice to all property owner's within 300 feet of the proposed project and this would be sent at least 12 days prior to the hearing on the project. Lamont described the development rights map he had prepared, showing the duplex development rights, the single family development rights, the triplex, and five or more development rights. The map also showed the sites that are presently developed. The map shows that in the RHDC, SC, and TC areas most of the sites have been developed, so there is relatively few sites left in those zone districts that can absorb new growth. He stated, in terms of criteria that would be considered under administrative review, one critical criteria from the ooal statements deals with mixture. Lamont then reviewed the other criteria being considered. Lamont stated that goals and objectives for the Wildridge area need to be established once the fractionalization is resolved. Cuny then opened the public hearing and called for any comments. Ken Sortland stated that one of the problems is that it is the middle of the building season and any delay r_au=eri by this process is critical. He feels this is a bad time to oe malting these kinds of decisions. He feels that it is wise to keep fractionalization. With no other public input, Chairwoman Cuny closed the public hearing. Discussion followed on the 2 1/2 limit. Doll asked how the public hearing and criteria would be incorporated into the requirements. Wood stated that this would be adopted without going through the ordinance process by amending the administrative procedures, recommended by Planning i -.-id Zoning Commission and approved by Council. It is not in the code, it is a procedure to be followed administratively for fractionalization. The criteria will also be handled the same way. Doll moved to approve Resolution 88-6, A Resolution From The Planning and Zoning Commission Recommending Aeon Town Council Approval Of Certain Amendments To The Fractionalization Provisions Or The Town Of Avon Zoning Code, amending paragraph D of Section 17.22.020 of Chapter 17..22, Title 17 of the Avon Municipal Code, limiting the maximum number of units to 2 1/2 units per residential development right, except in the RHDC (Residential High Density and Commercial), SC (Shopping Center) and TC (Town Center) Zone Districts. Hill seconded. The motion carried unanimously. Perkins moved to direct the Staff to amend the Administrative Procedures for fractionalization to provide for a public hearing process, conforming w" --h Special Use, Zone Changes, Variances accordingly, and also to incorporate guidelines for the review of a fractionlized project. Landauer seconded. The motion carried unanimously. Lot 21 Block 2 Benchmark at Beaver Creek Christy Sportsi Deck Addition (Northwest Corner of Building) Design Review Wood stated that Staff had received an incomplete application and recommended denial of this item. Perkins moved to deny the application for Lot: 21, Block. 2, B hm ark at Beaver Creek, Deck Addition as an incomplete enc submittal. McRory seconded. The motion carried ur.Rnimously. Planning and Zoning Commission Meeting Minutes June 21, 1988 Page 4 of 7 Lot 2Q -_Block 2 Benchmark at Beaver Creek, Rug's Pub, Inc., Temporary Sian Variance Request i Wood stated that Rug's Pub i*; requesting permission to display a temporary sign for special event.= throughout the summer, i.e. July 4th, Vintage Car Race, Balloons and Bluegrass etc. The temporary sign is approximately 3 feet by 6 feet and would state "Now Open for Breakfast" in red and blue letters on a white background. The sign would be mounted between the two uprights on each side of the drive that goes into the Benchmark Plaza office building. Wood stated that the proposed banner does meet with the current sign code ordinance for temporary signs which are allowed for special events. The variance request is to allow for display more often than one week per month. Staff suggest that the Commission go through the variance procedure and if so inclined, make the findings required for granting a variance, and that the variance be granted for a period through September 30, 1988, at which time the Commission could review the situation. Cuny stated that the manager of the building has submitted a letter of approval for this banner. Landauer commented that, before he steps down, he feels that there is a time and a place for all banners to help increase business in town, however, ':= teels they should be put on a limited basis, so that they are not up for a 24 hour period. Landauer then stepped down as a voting member of the Commission. Doug Geschwentner, owner of Rug's Pub was present to respond to any questions the Commission might have and displayed the sign for the Commission. Cuny asked if he was requesting the sign be displayed for 24 hours a day. Geschwentner stated that there was no need to display it for that length of time each day. McRory stated that the previous variance granted was --flowed because the site was hard to see from the roa- and he feels that the Commission should take a careful look at what can happen now. Cuny reviewed the required criteria and findings. Discussion followed on the special events and the hours requested. Reynolds moved to apprave the temporary sign, limiting the displav to special events of July 4th. Avon Vintage Car Race, Balloons Bluegrass and Barbeque and Labor Day weekends, citing the findings of (a) and (b), and the hours to 6 AM to Planning and Zoning 1'ommission Meeting Minutes June 21, 19e8 Page 5 of 7 Lot 20 Block 2 Benchmark at Beaver Creek Rug's Pub Inc. Temporary Sian Varianre Request (cant.) 11 AM, through September 30, 1988. Hill seconded. The motion carried with Perkins voting nay. Lot A. Avon Center Benchmark at _Heaver Creek. Temporary Sign Variance Request. Wood stated that Jim Park, representing Avon Center, is requesting approval for a variance to display a temporary sign advertising summer rates, condo rentals, kitchen/living rooms. The purpose of the sign is to serve as the condominium/hotel exterior sign that they presently do not have. Also, to let the traveling public know that there is a hotel office and rentals in the building. The sign would not exceed 35 square feet, probably not more than 25 or 30 square feet. It would be displayeu on the second floor of the building, wired to the balcony. The proposed banner does conform with the current sign code ordinance for temporary banners, but requires a variance for the length of time requested. Wood stated that the Commission should consider the variance criteria and and if they are able to make the required finding=_ for the granting of the variance, Staff recommends that it be limited to a period through September 30, 1988, at which time they would have to come back for reconsideration. Cuny stated that a letter from the Avon Homeowners Association had been received, stating that they had no opposition to the banner. Cuny asked if the applicant was present. Janet McWilliams stated she was representing Jim Park, who is on vacation. She stated that they desperately needed the sign as Everybody thought they were central reservations. Cuny awned what the maty=rial of the sign would be. McWilliams stated that it would be on the order of a flag or on heavy paper and would be wired to the building. Discussion followed on what the Avon �-nter is allowed in the way of signage. Reynolds stated he had a problem with the request that the sign be displayed 24 hours a day. He did not feel that it could be considered a temporary sign when it is displayed 24 hours a day, seven days a week. The Commission felt they needed more informati,in regarding the type of sign and the requested time limit and Ms. Mcwilliams could not answer their questions. Doll moved to continue this application until the July 5, 1988 Planni^g and Zoning Commission meeting, to allow the applicant to provide more information regarding the type of sign and also to provide an alternative to the request for Planning and Zoning Commission Meeting Minutes .June 21, 1988 Page 6 of 7 Lot A. Avon Center Benchmark at Beaver Creek temporary Sign Variant Reguest (Cont.) display for 24 hours a day, seven days a week. McRory seconded. The motion carried unanimously. Lot 21, Block -4. -Wildridge Subdivision, Satellite Dish Antenna, Design Review Denise Hill stepped down as a voting member of the Commission due to a conflict of interest. Wood stated that Gary Hill has applied for approval of a satellite dish TV antenna on Lot 21, Block 4, Wildridge Subdivision. -the six foot diameter satellite dish has already been installed at the northwest corner of the residence. Wood reviewed the guidelines which provide far the installat:':on of satellite dish antennae. Wood stated that if the Commission feels that this application conforms with the guidelines for satellite dish antennae., Staff would recommend approval. Gary Hill, Applicant provided photographs showing where the satellite dish is positioned. Reynolds stated he was very familiar with the installation of this satellite dish and that it is very well screened. Cuny asked if the applicant had been aware that the installation had to be approved and he responded that he felt that, considering where they are and that no one else could see it he had just neglected to apply for approval. he stated that the satellite dish was their only means of having television reception in that area. Reynolds moved to approve the satellite dish antenna on Lot 21, Block 4, Wildridge Subdivision. Perkins seconded. The motion carried unanimously. Reading and Approval of Planning and Zoning Commission of 6/7%88. Doll. :roved that the minutes of 6/7/88 be approved as submitted. Hill seconded. The motion carried unanimously. Wood stated that the landscaping is supposed to be completed by July 15, 1988. Cuny also asked about the Christie Lodge painting situation. Wood stated that no response to our letter had been received and Staff will follow up on it. Doll moved to adjourn. Perkins seconded. The meeting was adjourned at 8:30 PM.
