PZC Minutes 010687M RECORD OF PROCEEDU MINUTES OF PLANNING JANUARY 6, 1987 AND ZONING COMMISSION MEETING The regular meeting of the Avon Planning and Zoning Commission was held on January 6, 1967 at 7:15 PM in the Town Council Chambers of the Town 04 Avon Municipal Complex, 400 benchmark Road, Avon, Colorado. The meeting was called to order by Chairman Mike Blair. Members Present: buzz Reynolds, Mike Blair, Tom Mark Donaldson Members Absent: None Jeff Maddox, Pat Cuny, Landauer, Charlie Gersbach, Staff Present: Norm Wood, Director of Engineering and Community Development - Jim Lamont, Planning Consultant - Maggie Lach, Recording Secretary Staff Work Session Wood reviewed agenda items of January 6, 1987 with Commission. Regular Agenda Items - 7:35 PM Wildrid a Re eater Hut - Tract J W.R. - Vail Communications Design Review Wooc' stated that Vail Communications has applied for design review for a small structure to be located on Tract J in Wildridge. Tract J is the site of the uppermost water storage tank in Wildridge•eakhe at proposed structure is approximately 6' x 8' and the very p 10'611. The antenna will be attached to the structure and will extend about 8' above the peak of the roof. The antenna is proposed to 5e an earthtone color. The proposed materials for the but are Till plywood siding and asphalt shingles or cedar shakes. This but will be used to house translators for communication systems in the area including the Town's communication system. The structure will be mounted on skids so that it can be moved around on ,.he site as necessary. Tyrone Thompson of Vail Communi_ations, the applicant, presenters antenna for Commission review. Thompson stated that the antenna could be painted any color. Discussion followed. Thompson stated that the zolor of the structure would be Olympic stain #916, and asphalt shing?es, if used, could be any color that the Commission would recommend. The cedar shingles co,ild also be stained to match the structure. Landauer motioned to approve the repeater but as submitted, with the conditions that the color is to be Olympic stain #916 and Staff is to review the proposed color for the asphalt shingles. If asphalt s.iingles are not used, applicant will use cedar shakes. Re,fnolds seconded. Discussion followed. Passed unanimously. Planning & Zoning Meeting Minutes January 6, 1987 Page 2 of 5 F_a lewood at Vail (formerly Meyers Ranch) Subdivision Sketch Plan Review Wood stated that Republic Investment Corporation has submitted a Sketch Plan for the subdivision of Parcel #2 of the Meyers Ranch Annexation. The property is located west of Sunridge and is bounded by Highway 6 on the south and the D & RGW on the north. A large portion of the Eagle River is within the parcel. The Sketch Plan shows the property being divided into two lots. Lot i encompasses the eastern portion of the property and Lot 2 the western portion of the property. The Eaglewood Condominium project which was previously presented to the Commission for conceptual review would be located on Lot 1. Access to each of the two lots is from Highway 6 and would be subject to approval by the State Highway Department. Supplemental information submitted with the Sketch Plan indicates water and sewer service will be provided by the local districts and electric service by Holy Cross Electric Association. Soils, geology and radiation reports do not indicate any particular hazards on the site or conditions which would preclude development on either Lot 1 or Lot 2. A drainage report was not included with the submital, but a letter from Contra Ltd., engineers for the project, states that they feel that off-site and on-site drainage can be adequately controlled. Wood then reviewed Section 16.16.030 of the Avon Municipal Code with the Commission. Wood explained that a determination should be made regarding the suitat.ility of the sketch plan. Guidelines and conditions for proce-�'_-^n_ tr preliminary plan should then be established or reasons provided for not proceeding to preliminary plan. Wood stated that the proposed subdivision is located in the RHDC zone district as established by Ordinance No. 81-29. This ordinance assigned 140 Residential Development Rights to the property and limited commercial development to a maximum of 5,000 square feet of which not more than 4,000 square feet would be allowed as restaurant. The area north of the Eagle River was limited to parkland or open space use with the exception of water wells or water storage by Avon Metro District. The adopted Development Goals, Policies, and Programs for the Town of Avon states as a policy for Development District 5, "Promote the creation of a riverfront park that provides for a variety of aquatic sports, passive recteational activities, public access by means of continuous paths and bikeways, the protection of streambank vegetation, adjacent floodplains,wildlife habitat, historical buildings, and residential privacy." Wood then reviewed Section 16.40.360 and Section 16.40.370 of the Avon Municipal Code. Wood stated that information submitted indicates that utilities will be available to each of the two lots and ssible and radiationereports do notach lot is appearto from Highway 6. Soils, geology, preclude the site from development. The drainage report has not been submitted but the project engineer feels that off-site and on-site drainage can be adequately controlled. The Arrowhead Preliminary Circulation Plan, Trails, and Paths dated March 3, 1983, shows a bikepath which could be connected to a bikepath through Eaglewood along tiie Eagle River. Wood stated thr.t this is important in going back to the Development Goals, Policies and Programs. Wood then presented map of Arrowhead area showing the circulation network and explained the possible connections between the projects. Glenn Palmer of Contra Engineering stated that they are working on necesary items for the subdivision process. He stated that any problems they would have would be with t!,e development rights and the 30 foot stream setback as far as dedication or how to handle the park system. Palmer stated that the owners did not have a problem with the bicycle path that would connect to Arrowhead and the Avon area, as long as that is in an easement. He did not believe that the owners would want to dedicate any property. Tim Garton, owner of the property, stated that he was not prepared to deed over 1/2 the property to the Town, reserving it for certain uses. He was amenable to the concept, but deeding it over to the Town was another notion. As far as the public using the pedestrian easement, there is no opposition. Garton explained that they originally told the Town they could utilize the other side of the river as a park, and that there would be no problem deeding that over. He suggested that those lands that fall within the Town's riverfront park concept, could be reserved for certain uses, so that it would not actually be deeded over to the Town. Discussion follor.ed. Wood stated that while the proposed roadway shows rp�anthese drawings, it should not be considered as any part of the app . Y access to those properti.s would be through a future development plan. Both of the lots meet the minimum requirements for tome 25' frontage on the public right-of-way and the access would have to be a.proved by the Colorado Department of Highways. The information should be considered as information given to the applicant to help in establishing the lot line locations and not a part of this approval. Discussion followed. Wood suggested that as an additional condition, that application, in proceeding to preliminary plan, is in conformance with all applicable rules and regulations regarding preliminary plan and final plat. Cuny asked if Riverside Center, Eaglebend and the Yacht Club had dedicated any land to the Town. Wood stated they split the land into separate tracts, but still retain ownership, along with agreements stipulating uses. Gersbach questioned public use of the riverfront as opposed to private use. Lamont stated that the riverfront park idea is that it is an amenity for the public. He felt if there were a consistent policy of having 30 foot setbacks, portions of the riverfront already public would not be over used or damaged: Garton stated that a pa;t of the reason for not deeding the land over was that there are some rights the owner should have, and he would not like to see the Town put picnic tables in front of the condos. He felt there was some right to quiet enjoyment and the value of the whole property is the frontage on the river. He stated he was not opposed tc public access to the property, but was opposed to giving it to the government, at any point in time. Discussion followed on dedication and property line setbacks. 0^011 Planning & Zoning Meeting Minutes January 6, 1987 Page 4 of S Eaglewood at Vail - Subdivision Sketch Plan Review Con't._ Cuny motioned to adopt Resolution 87-1 with the inclusion of "Conformance with all applicable rules and regulations regarding preliminary and final plat." The Commission also found that the Sketch Plan is in conformance with Chapter 16.16 of the Avon Municipal Code. Maddox seconded. Passed unanimously. Lamont stated that the principal reason the 30 foot setback is in there is to protect the watershed. Blair made comment on the sales brochure for Eaglewood at Vail, stating that there is absolutely no mention of Avon, which could be misleading. Discussion followed. Blair thanked applicant for presentation. Holy Cross Electric - S.R.U. Informal Discussion (Non -Agenda Item) Lamont presented a video tapes ,r power lines along the I-70 corridor (this being in regard to the Special Review Use being proposed by Holy Cross Electric for the 1/20/87 meeting). Blair stated that Commission reviewed the film of an area north of I -own where Holy Cross Electric proposes to locate some power lines. Proposed Zoning Code Revisions - Public Hearing - Con't. from 12/16/86 Regular Meeting Donaldson stepped down to make presentation as consultant to Com::ssion. Donaldson stated that Town Attorney John Dunn had submitted a letter of comments regarding the Zoning Code. Donaldson then reviewed comments with Commission. Points discussed included: 1) definition of "true elevation"; 2) definition of lot lines and lot setback lines; 3) provisions for publication of public notices; 4) deletion of home occupation as S.R.U. in certain zones; 5) criteria for SPA; EN petitions and appeals to Town Council and; 7) density restrictions. Discussion followed. Blair then re -opened the public hearing. There being no one in the audience, the public hearing was closed. Cuny motioned to continue the public hearing on the proposed Zoning Code revisions to the next regular meeting on January 20, 1987. Landauer seconded. Donaldson abstained. Motion carried. Reading —& Approval of P & Z Minutes of 12/16/96 Regular Meeting Donaldson rejoined Commission discussion. Maddox motioned to approve the minutes of the December 16, 1986 regular meeting as submitted. Donaldson seconded. Passed unanimously. Maddox mentioned that a ne+un sign had been placed on the Wolff Warehouse for the Polaris space. Wood stated that Staff would look into these items. Wood asked Commission to review the changes to the Planning and Zoning Commission Proc-dures, Rules and Regulations for the next meeting.
