PZC Minutes 040787RECORD OF PROCEEDINGS MINUTES OF PLANNING AND ZONING COMMISSION MEETING APRIL 7, 1987 The regular meeting of the Avon Planning and Zoning Commission was held on April 7, 1987 at 7:40 PM in the Town Council Chambers of the Town of Avon Municipal Complex, 400 benchmark Road, Avon, Colorado. The meeting was called to order by Chairman Mike Blair. Members Present: Buzz Reynolds, Mark Donaldson, Pat Cuny, Mike Blair, Tom Landauer, Jeff Maddox, Charlie Gersbach Members Absent: None Staff Present: Norm Wood, Director of Engineering & Community Development - Jim Lamont, Planning Consultant Ray Wright, Engineering Technician - Maggie Lach, Recording Secretary Lots 23—& 75 Blk 7 BM @ BC - Proposed Shopping Center - Informal Discussion Wood stated that Steve Simanski, proposed developer for the shopping center would be presenting a conceptual site plan and schematics showing proposed building elevations. Gersbach stated for the record that he had been involved with the owners of the property on which the development would go, and the contract has been finalized. He stated he had no financial interest in the shopping center as it develops, and stated he would like to continue to sit in on the discussions. Commission members had no objections to Gersbach's request. Steve Simanski of Palmer Development stated he had been working on this project for 3 months. He stated he had been involved with 5 different Wal -Marts in his career. He stated they hoped to begin this project in June or July of this year. Simanski then explained concept of design from plans submitted. He stated his goal was to make City Market, the shops and Wal-Mart an integrated shopping center. He explained that Wal-Mart is an auto -oriented retailer and Wal-Mart wants high visibility. He also stated that there is an area for expansion: there is a 52,000 square foot store, with 10,000 square feet of expansion, 20,000 square feet of shops, and 15,000 square feet of City Market expansion. Discussion followed on plans submitted regarding access, snow storage, landscaping, building colors, architectural design and site plan in general. Discussion followed. Lamont commented on project and stated that the project compares well and follows the Development Goals, Policies and Programs. He stated that his main interest was the of: -site interconnections and that the views from the back of the building were as important as the views from the front. He felt that more attention should be paid to the pedestrian circulation loops. Discussion followed. Simanski stated they are working as fast as they can to get financing in place for the construction loan and hope to have a full design review by April 21, 1987. Blair thanked Simanski for presentation. Lots 23 & 75 Blk. 2 BM @ BC - Wal-Mart Develo ment Sign Design Review Wright stated that Wal-Mart Stores, Inc. has applied for design review of a development sign that they propose to erect on the shopping center site. The proposed sign measures 4' x 8'. The applicant has submitted a copy of the graphics for the sign along with color information. The sign is generally comprised of a brown background with 2 diagonal orange stripes. The lettering stating "Future Home of Wal-Mart" is proposed to be white, and the remaining lettering is proposed to be yellow. This sign is approximately 32 square feet in area. The Sign Code allows 16 square feet for development signs without a variance. Wright explained that there was no one present from Wal-Mart to make the presentation, and that a letter had been submitted to Bill James, with the request that some sort of approval be obtained so that Wal-Mart could erect their sign. Wright explained that there currently is a sign on the parcel that will have to go if this sign is approved. The Sign Code states there is only 1 development sign allowed per lot or parr -al. Discussion followed. Donaldson stated that he had no problem with the size of the sign for this project. Cuny did not feel there was an exceptional or extraordinary circumstance to have a sign that big. She felt that the size was too big and the colors too bright. Reynolds felt that Wal-Mart is just trying to inform the public of their future location. Cuny felt that, based on the criteria, the sign will be bigger than what is currently in the neighborhood. Wright stated that the sign would be allowed to stay on the lot until the building was completed, or when the project ID signs go up, or when a Certificate of occupancy is obtained. Landauer felt that the size and importance of the project warranted a sign that size. 6ersbach agreed with Landauer. Donaldson motioned to approve the variance based upon the size and impact of the project (Section 17.36.040, Approval Criteria) and Section 17.36.050, Findings Required. The existing development sign on the lot is to be removed prior to placement of the new Wal-Mart sign. Landauer seconded. Cuny opposed. Motion carried. Planning & Zoning Meeting Minutes April 7, 1987 Page 3 of 6 Lot 56W Blk. 2 W.R.-Beartra Duplex - Variance Request to Allow Parking Within 10' of Beartrap Road Right -of -Waw Public Hearing Wright stated that Philip Koski of Vail Valley Builders, owner of Lot 56W, has requested a variance to allow parking within 10' of the Beartrap Road right-of-way. Section 17.24.020 of the Zoning Code states that no off-street parking spaces may be located in the front 10' of the required front yard of any lot. The applicant has submitted a site plan for a duple: residence which he proposes to constr.!ct an the lot, and the building footprint and parking spaces are shown. This variance request does not appear to pose any particular problems for the Town. The applicant has been able to meet the required 25' building setback, but due to the steep slope on this lot, he cannot practically move the house farther back to meet the parking setback. The duplex on Lot 56E currently has the same situation with parking spaces being only 5 feet from the front property line. Phil Koski, owner of Vail Valley Builders stated that he is proposing to build a duplex on this property and will own half of the project. He stated that he applied for the variance due to the site restriction of a 40 degree slope to adequately arrange parking 10' from the front of the property line. The site restriction would create unnecessary added cost of excavation and would create a larger cut in the existing grade. Blair then opened the public hearing. There being no wishing to be heard, the public hearing was closed. Discussion followed. Cuny motioned to approve Resolution 87-9 as submitted, and found the variance to comply with Section 17.36.040, Approval Criteria, and Section 17.36.050, Findings Required. Donaldson seconded. Passed unanimously. Lot 56W Blk 2 W R - Beartrap Duplex - Design Review Wright stated that Philip Koski has submitted an application fordesign review of a duplex residence to be located on Lot 56W, Blk. 2. proposed building is approximately 4,770 square feet. Building materials include 1 x 8 channel lap redwood siding with a grey finish (Benjamin Moore #080-72) and a 3 coat stucco system colored to match the siding. The exterior trim is proposed to be finished with Benjamin Moore #080052 (blue). The roof is proposed to be a slate grey, metal roof. Plans submitted include a site plan, floor plans, building elevations, landscaping plan, and a color rendering of the project. Commission reviewed plans submitted. Koski stated that he was aware that he would have to get approval for the metal roof from the Wildridge Covenants Committee. He explained that the roof is non -glare and resembles a clay tile roof. If the Covenants Committee does not approve the roof, he stated he would use a cedar shake roof. Commission continued review of plans submitted. Applicant will substitute the proposed "Stile" metal roof with cedar shakes in the event the Wildrdige Covenants Committee does not approve the metal roof. At such time as the applicant applies for a building permit, a fully dimensioned site plan, along with grading and drainage information must be submitted for plan check. Landauer seconded. Passed unanimously. Lots 67 & 68 Blk 2 BM @ BC - City Market Garden Center - Design Review Wright stated that at the April 14, 1983, meeting, the Commission approved the City Market Garden Center. That structure consisted of a redwood frame with an 8 mil. plastic covering. That approval was for 5 years as long as the design was not changed. Mike DeOnier, manager of the Avon City Market has submitted plans for a new Garden Center greenhouse. This new structure is a Quonset but type with a tubular frame and a plastic covering. The two ends of the structure are proposed to be 3/4" plywood to accommodate entry doors and air vents. The size of the structure is 22' x 48' compared with the currently approved structure of 36' x 72'. The new greenhouse is proposed to be located in the same area as the previously approved greenhouse. Wright explained that there was no one present from City Market for this presentation. Discussion followed. Cuny motioned to approve the design review of the greenhouse. A cedar fence of no higher than 6' is to surround the greenhouse, exterior covering is to be 8 mil. plastic, the structure is to be located at least 4' from the existing building, and another entrance is to be ar'::za an the east side of the greenhouse. Construction of the greenhc.,.se is to start no earlier than May 1, and the structure is to be removed no later than October 31. Approval is for the 1987 season. Landauer seconded. Passed unanimously. Lot 1 BlN 1 BM @ BC - Pester Gas Station - Color Sample Approval Wright stated that at the February 3, 1987, meeting, the Commission granted final design review approval for the Pester Gas Station renovation. At that time the Commission requested that actual samples of the proposed building colors be submitted for approval prior to issuance of a building permit. Those approved colors include a matte black finish for the metal roofing, red insulated store front panels, and a light grey finish for the stucco exterior. Actual samples of these colors have been submitted for review and approval. The proposed color for the metal roof is a "Matte Black", Kynar 500 finish. The stucco finish is proposed to be ,Stocolor" #11406 light grey. Discussion followed. Landauer motioned to approve the color samples as submitted. Maddox seconded. Reynolds abstained due to a conflict of interest. Motion carried. Wright stated that on a separate item related to Pester, the heating vent/air conditioning unit was shown on the ground. During plan check review, that unit was moved to the roof. Discussion followed. Commission concluded that Pester return for design review of the roof unit due to the fact that the roof profile was not acceptable. Reading and Approval of P & Z Minutes of 3/17/87 Regular Meeting Donaldson motioned to approve the minutes of the March 17, 1987, regular meeting as submitted. Maddox, seconded. Passed unanimously. Other Business Keith Rader, representing his client who is interested in purchasing Lot 66, Block 2, (adjacent to proposed shopping center) stated that through his research, found no strict zoning ordinance pertaining to clients proposal to put in a car wash/jiffy lube. Wright then read what allowed uses are in the SC Zone District. Discussion followed on allowed uses and proposed use. No formal action was taken.
