MINUTES OF PLANNING AND ZONING COMMISSION MEETING
APRIL 21, 1987
The regular meeting of the Avon Planning and Zoning Commission was held
on April 21, 1987 at 7:35 PM in the Town Council Chambers of the Town
of Avon Municipal Complex, 400 Benchmark Road, Avon, Colorado. The
meeting was called to order by Chairman Mike Blair.
Members Present: Charlie Gersbach, Buzz Reynolds, Pat Cuny,
Mark Donaldson, Mike Blair, Tom Landauer, Jeff Maddox
Members Absent: None
Staff Present: Ray Wright, Engineering Technician - Maggie Lach,
Recording Secretary
Lot 36 Blk 1 BM @ BC - S.R.U. to Allow an Auto Body Repair Shop and
Storage Lot - Public Hearing
Donaldson stepped down due to a conflict of interest.
Wright stated that Tom Backhus, representing the owner of Lot 36, Block
1, has applied for a Special Review Use to allow an auto body repair
shop and storage lot on the subject property. The applicant has stated
on his application that the development will consist of a 1,600 square
foot building with parking behind. There have been no plans submitted
for review at this time. Staff feels that the lack of information
submitted wtih this application makes it virtually impossible to review
the proposed use in conjunction with the Special Review Use criteria
outlined in the Zoning Code. Staff recommends that the Commission
continue this application to the next regular meeting.
Tom Backhus, representative of lot owner stated that no plans have been
submitted because there is a partnership being put together to develop
the property. Backhus stated he was looking for comments regarding the
use at this location, and would like to see Special Review Use approved
contingent on the improved property and landscape plan fitting within
the property. The reason this lot was chosen was becuase the lot has
excellent screening from the road. He stated that the idea is to put a
small efficient improvement on the front end of the lot, with customer
parking to the front, screen off the balance of the lot on both sides
of the building, with the body work being done on the backside of the
building.
Reynolds stated he would like to see more detail before a committment
is given.
Backhus stated that he did not know what the complexion of the board
would be at the next meeting because of possible new appointments to
the Commission, which is why this application has been submitted.
Gersbach asked how many repair shops were on Metcalf Road.
Wright stated that Avon Auto Body is located on Lot 11, Vail Imports on
Lot 33, and Beaver Creek. Automotive is up the street.
Cuny stated that a Special Review Use is tied to a plan.
Discussion followed.
Blair then opened the public hearing.

Cuny stated that Commission has always been concerned about what the
auto body shop would look like on the outside, the specific business,
and the track record of the applicant.

Maddox felt that the site was appropriate for the use, but wanted to
see plans.

Louis Medeiros, owner of Avon Auto Body spoke from the audience and
stated that the screening and track record of a business of this type
is very important.
Discussion followed.
Commission concurred that use is acceptable for the site.
Cuny motioned to continue the Special Review Use application to the
next regular meeting on May 5, 1987.
Gersbach seconded.
Donaldson abstained.
Motion carried.
Lot 11, Blk. 1, BM @ BC - Avon Auto Body - Parking Lot Modification &
Color Sample Approval
Donaldson stepped down due to a conflict of interest.
Wright stated that at the October 7, 1986, meeting, the Commission
granted final design review approval for Avon Auto Body. That project
is nearing completion, and the applicant, Warner Properties, has
submitted a revised site grading and drainage plan. The revised plan
shows a realignment of the driveway to the project and additional
parking. The applicant is also requesting approval for a color change
to the building. This project was originally approved with 21 parking
spaces and 1 loading space. This new plan would increase parking to 35
spaces with 1 loading space. The driveway has been moved south to the
property line. Most of the parking is screened by a 4' to 6' berm
along the east side of the parking lot. At the northeast corner of the
lot this berm has been reduced to only 2' to 3' high. The applicant
should also be directed to construct small berms behind the filter
galleries on the south and southwest edges of the lot to direct
drainage through the filters. The applicant is also requesting
approval for a color change to the building. Samples of the exterior
siding material stained with the approved color and the alternate color
have been submitted for review.
Wright presented plans submitted for Commission review.
Louis Medeiros, owner of Avon Auto stated that in October, he and Bob
Warner negotiated for just the necessary parking. Minimum parking was
approved for the site. He stated that after studying the plans, he
realized he did not have enough parking approved for the building.
Louis then explained concept from plans submitted.
Discussion followed.
Medeiros explained that additional parking would be for additional
growth and he wanted to deal with that now.
Discussion followed on plans submitted regarding parking, setbacks,
berming and landscaping.
Landauer motioned to approve the parking lot modification as submitted
with the inclusion of filter galleries on the south and southwest edges
of the lot.

Lots 23 & 75 Blk 2 BM @ BC - Proposed Shopping Center - Wal-Mart
Design Review
Donaldson rejoined Commission discussion.
Gersbach stepped down due to a conflict of interest.
Wright stated that Palmer Development Company has applied for design
review of the proposed Wal-Mart shopping center. The project is to be
located primarily on Lots 23 and 75, with a portion of the parking and
building overlapping onto the existing City Market Froperty, which is
Lots 67 and 68. At this time we are not being asked to review the
proposed addition to the City Market store itself, but there are
parking, vehicular and pedestrian circulation issues that need to be
addressed. When the center is complete, City Market will be an
integral part of the center and the entire site should be considered at
this time. Existing development on the site consists of the City
Market store which is approximately 40,000 square feet. A 15,000
square foot addition is planned for the south end of the store.
Proposed development includes a Wal-Mart store which will initially be
approximately 52,885 square feet with room to expand by approximately
10,000 square feet. The Wal-Mart store will be located at thR south
end of the site. Approximately 19,860 square feet of retail space is
proposed for a smaller building that will be located between City
Market and Wal-Mart. There are approximately 604 parking spaces being
provided on-site. The submittal includes a site plan, landscape plan,
conceptual grading and drainage plan, building elevations and color
renderings.
Steve Szymanski of Palmer Development stated that they have submitted
the revised plans and elevations that contain comments from Commission
and Staff from last informal presentation. He stated these plans
address the architectural treatment, the covered walkways, and most of
the site problems. He stated that Mike Chreitzberg from POUW and
Associates, and Steve Casey of Schmeuser, Gordon, Meyer, Civil
Engineers, were present for additional input. He stated that they are
looking for site plan and building design approval. There are still a
number of things that have to be done such as the variance for the lot
line, a replat of Lots 23 and 75, and City Market approval.

Szymanski stated that there is a problem regarding the initial proposal
to have an integrated shopping center- from the Wal-Mart parking to City
Market. He explained that when civil work began, they tried to make
the grade work across the whole site. The City Market site and
elevations won't allow access to work. Szymanski then explained grade
separation from plans submitted. He stated that there are certain
constraints that Wal-Mart has to have and be satisfied with the grade
change, which is slight. He stated they can only have a 3 1/2% grade
change and as the site slopes away to the train tracks and the river,
there is a situation where we have to increase the elevation of the
Wal-Mart. He did not feel they would be able to work out the traffic
flow within the site. They will try to provide as much back and forth
access on Beaver Creek Place as possible, but it is not feasible to
think that there will be an optimum situation driving back and forth
because of the given grades.
Reynolds felt that something had to be worked out with the common
access.
Discussion followed on access and lot lines from plans submitted.
Szymanski stated that Safeway had done a study to see how many people
came to a shopping center, went to Safeway and then went to the shops.
Safeway found that there is a small percentage of people that go to a
grocery store, go shopping there and then go to those shops in the same
trip. Most people go to the grocery store and then see the shops and
go back to the shops because they see them in every trip to the grocery
store. It is not a necessity for City Market to have vehicular access.
Mike Chreitzberg of POUW and Associates then reviewed plans with
Commission. He stated that the main entry to Wal-Mart does have a
civil change from what was shown initially.
Review and discussion followed on plans submitted regarding access
between Wal-Mart and City Market.
Donaldson suggested that the east retail building have a grade wall
that continues the architecture out into the site and form it into
pedestrian steps to make the transition, and continue the lighting and
landscaping.
Discussion followed an loading zones and trash receptacles.
Chreitzberg then presented building plans and elevations for Commission
review. He stated that the facade of the building was extended 8' to
create a covered walkway. The roof would then drain to the rear of the
building. The lighting on the building would be indirect and in the
soffit. He stated they were also proposing neon accent lighting for
the building.
Donaldson felt that accent on the downspouts in back of the building
would be too broken up and would not be necessary.
Discussion followed on roof drainage.
Chreitzberg then presented elevations of buildings.
Discussion followed on trim and lighting.
Chreitzberg stated that the rear of the building would have equipment
such as house panels, disconnects, meters, gas meters, roof drainage
such as downspouts, and doors to each shop. The bigger equipment would
be screened with 6' to 8' evergreens.

Discussion followed on access between sites.
Cuny felt that accent colors on building were overdone. She did not
feel it was necessary to have accent on the rear of the retail spaces
and accent around the doors or on the gutters.
Discussion followed.
Donaldson motioned for preliminary design review approval for the
building, with the following conditions being met within a 30 day time
frame: 1) building materials being indicated on plans; 2) colors be
approved and indicated on plans; 3) comprehensive sign program for the
project being submitted for review and approval; and 4) site plan
requirements in conceptual approval being met.
Landauer seconded.
Gersbach abstained.
Motion carried.
In a separate motion, Donaldson motioned to grant conceptual approval
for the site with the following conditions begin met within a 30 day
timE frame: 1) begin subdivision process to vacate lot line between
Lots 23 and 75; 2) obtain setback variance; 3) submittal of a
satisfactory grading and drainage plan for review and approval, that is
compatible with the site plan and building elevations; 4) supply
documentation from City Market agreeing to improvements and changes to
Lots 67 and 68; 5) revise site plan addressing concerns at project
entrance, loading zones for retail shops; and 6) the transition between
the City Market and Wal-Mart be discussed due to the fact that mutual
access between the two properties may not be possible due to steep
grade variation's.
Maddox, seconded.
Gersbach abstained.
Motion carried.
Reading & Approval of P & Z Minutes of 4/7/87 Regular Meeting
Gersbach rejoined Commission discussion.
Cuny motioned to approve the minutes of the April 7, 1987, regular
meeting as submitted.
Gersbach seconded.
Passed unanimously.
Other Business
Blair commended Town staff on their work regarding the Homestake
hearings.
There being no further business to discuss, Donaldson motioned to
adjourn the meeting.
Landauer seconded.
Passed unanimously.
