INTRODUCTION:

At the meeting of April 21, 1987, the Commission granted preliminary approval
for the building design of the proposed Wal-Mart and the associated retail shops.
Conceptual approval was granted for the site plan. At that meeting the developer,
Palmer Development, told the Commission of the difficulty they were having with
grading between the City Market and Wal-Mart sites. The developer has been
working on some alternate site plans and we would anticipate seeing some of
those options presented at this meeting.

Wal- Mart Shopping Center - Sign Program - Design Review
INTRODUCTION:
Palmer Development has requested design review of a sign program that, they are
proposing for the new Wal-Mart shopping center. This program would apply to the
Wal-Mart itself, and the "Retail Shops" associated with it. The program outlines
sign t%pes, sizes and materials.
STAFF COMMENTS:
For the purpose of this review, only signs relative to the Wal-Mart and the
"Retail Shops" will be considered. All signs on the City Market site will be
reviewed with the City Market addition.
The sign program for the proiect consists of the following sign types and sign
areas:
Project Identification Sign 32 sq.ft.
Retail Shops (maximum area for each shop) 30 sq.ft.
Wal-Mart (front of building) 300 sq.ft.
(rear of building) 120 sq.ft.
The project I.D. sign is proposed to be a single -faced, internally lit sign of
approximately 32 square feet. This sign fits within the allowable limits of the
Sign Code for this type of sign.
Signs for the "Retail Shops" are proposed to be calculated at 1 square foot of
sign area for each linear foot of shop frontage up to a maximum sign area of
30 square feet per shop. Signs are proposed to be individual, internally lit,
metal pan channel letters. The maximum sign area of 30 square feet per business
is approximately 2.5 times the allowable sign area per the Sign Code. The
Commission should consider the size of the signs in relation to the building,
and the distance that the building is set back from the street. As the Town's
Sign Code does not specifically address shopping centers of this size, the
Commission should determine what is appropriate.
Wal-Me.rt is proposing signs on both the front and the rear of the building. The
main sign on the front of the building is proposed to consist of 5' high,
internally lit, metal pan channel letters totalling approximately 300 square feet.
The sign proposed for the rear of the building is the same type of sign, only
approximately 120 square feet in area.
The Commission will need to consider variances for sign areas if this program
is approved.

The Commission should also request sign colors be presented `or approval.
Section 17.36.040 Approval Criteria, states:
Before acting on a variance application, the design review board shall consider
the following factors with respect to the requested variance:
A. The relationship of the requested variance to other existing or potential
uses and structures in the vicinity;
B. The degree to +which relief from the strict or literal interpretation and
enforcements of a specified regulation is necessary to achieve compati-
bility and uniformity of treatment among sites in the vicinity, or to
attain the objectives of this title without grant of special privilege;
L. The effect of the requested variance on light and air, distribution of
population, transportation and traffic facilities, and public facilities
and utilities, and public safety;
D. Such other factors and criteria as the board deems applicable to the
proposed variance. (Ord. 81-9 S1(d)).
Section 17.36.050 Findings Required, states:
The Planning and Zoning Commission shall make the following written findings
before granting a variance:
A. That the granting of the variance will not constitute a grant of special
privilege inconsistent with the limitations on other properties classified
in the same district;
B. That the granting of the variance will not be detrimental to the public
health, safety, or welfare, or materially injurious to properties or
improvements in the vicinity;
C. That the variance is warranted for one or more of the following reasons:
1. The strict, literal interpretation and enforcement of the specified
regulation would result in practical difficulty or unnecessary physical
hardship inconsistent with the objectives of this title;
2. There are exceptional or extraordinary circumstances or conditions
applicable to the site of the variance that do not apply generally
to other properties in the same zone;
3. The strict of literal interpretation and enforcement of the specified
regulation would deprive the applicant of privileges enjoyed by the
owners of other properties in the same district. (Ord. 81-9 S1(e)).

INTRODUCTION:
At the April 21, 1987, meeting, the Commission continued this application due to
lack of information. The applicant was directed to submit a specific plan for
review. The applicant has submitted a set of plans for the project. They include
a site plan, building plans, landscape plan, and a site grading and drainage plan.
The project generally consists of 1,584 square feet, single story structure, with
a flat roof. A stucco exterior is proposed with a wood accent band around the
top. There is a paved parking lot for 5 cars in front of the building, and a
partially fenced, gravel storage lot for 14 cars behind the building.
STAFF COMMENTS:
The parking being proposed in front of the building satisfies the minimum
parking requirement for a project of this size. The Commission should consider
if the landscaping and fencing shown on the plan provides adequate screening
for the storage lot.
In accordance with Section 17.20.020 of the Avon Municipal Code, the Commission
shall determine the following in considering the suitability of a special review
use:
1. Whether the proposed use otherwise complies with all requirements imposed
by the zoning code;
2. Whether the proposed use is con<J stent with the objectives and purposes
of the zoning code and the applicable zoning district; and
3. Whether the proposed use is designed to be compatible with surrounding
land uses and uses in the area.
In addition, the Commission shall consider:
A. The adequacy of access to the site with respect to the width of adjacent
streets, their grades, intersection safety, visibility and entrance into
the lot to be developed;
B. Whether there exists safe access and sufficient water ^ressure to provide
fire protection;
C. The existant water pressure in the area and the ability of the water
system to supply domestic needs;

Rich's Auto Body - Design Review
INTRODUCTION:
Thomas Backhus and Mark Donaldson have applied for design review of an auto body
shop to be located on Lot 36, Block 1, Benchmark at Beaver Creek. The project
consists of a 1,584 square foot, single story repair shop, paved parking for 5
cars, and a partially fenced, gravel storage yard for approximately 14 cars.
The building is proposed to have a stucco exterior with a wood accent band
around the roof. Colors are to be presented by the applicant at this meeting.
STAFF COMMENTS:
This project appears to conform with applicable setback, parking, and building
height restrictions. The Commission should consider the building design,
materials and colors, and determine if the landscaping and fencing provide
adequate screening for the use.
The plan also indicates signage on the building that is proposed to be
approximately 28 square feet. Since this is the only sign proposed for the
project, and its size is in good proportion with the building, Staff feels that
it is appropriate.
STAFF RECOMMENDATIONS:
If the Commission concurs, Staff recommends approval of this application with
the following additions being made to the plans prior to suL:mittal for a building
permit:
1. Stucco, wood siding, and flue colors be indicated on plans;
2. Indicate minimum 18" culvert for driveway;
3. Indicate type of landscape irrigation system on plans.

occupying was used as an archery range for Blue Steel Gun Shop. It is between
the gun shop and Benchmark Cleaners. There are no plans with this application
because the Wolff Warehouse is a completed project.

There are currently 24 parking spaces provided on-site. The parking requirement
for the auto repair being requested would be calculated at 3/1000 and would not
increase the total parking required on the site.
The Commission should limit the automotive repairs to the inside of the building,
and not allow disabled vehicles to be parked outside the builk'ing. The space being
used for the auto repair should also meet all building and fire department codes.
In accordance with Section 17.20.020 of the Avon Municipal Code, the Commission

Mountain Center - Design Review
INTRODUCTION:
At the March 18, 1986, meeting, the Commission granted final design review
approval, with conditions, for the Mountain Center located on Lots 26-28,
Block 1, Benchmark at Beaver Creek. The project generally consists of a three
story building containing approximately 82,400 square feet. The first level,
which is below grade, is proposed to house a mini -warehouse operation. The main
level and the upper level will consist of warehouse space. Les Shapiro, owner
of Lots 26-28, Block 1, is proposing to construct the first phase of the
Mountain Center, and is here to present a revised site plan showing phase one
of the project.
STAFF COMMENTS:
The following is the list of conditions that were attached to the previous
approval: 1
1. GENERAL
a. Any approval will have to be contingent on the recording of a
Subdivision Plat for Lots 26-28, Block 1, Benchmark at Beaver
Creek, vacating the existirn interior lot lines and easements;
b. Approval is valid only for those uses which are specifically allowed
in the IC Zone District. Any application for a Special Review Use
in this project would be subject to available on-site parking.
2. SITE PLAN
a. The 12:1 slope on the north side of the property be retained with
jute -mesh, or equivalent, and at least temporary irrigation be
provided in this area to assure revegetation effort;
b. Additional screening be considered along Nottingham Road by the use
of evergreen trees in conjunction with proposed decidious trees;
c. Specify type of irrigation system to be used in various landscaped
areas;
d. A complete grading and drainage plan be submitted detailing facilities
for the treatment of parking lot runoff, as well as an engineered
design for the existing drainage swale on the west end of the project
to provide for protection from runoff and debris flows;
e. Consideration should be given to alternate locations for roof drain
discharge.

3. BUILDING
a. Building materials and colors be more specifically described on
the plans;
b. Lighting details including fixture types, pole heights, etc., be
submitted and approved;
c. A Comprehensive Sign Program be submitted specifying the maximum
sign size for each business, the materials and colors for signs,
the number and sizes of any project entry signs and directories;
d. Details for the trash enclosures be submitted.
The site plan has been revised for Phase I of the project to allow vehicular
access to the basement which is the mini -warehouse portion of the project.
The revised site plan provides parking for 54 cars. Considering the floor area
of this first phase being approximately 34,700 square feet, with parking
required at 1 space/800 square feet, 44 spaces are required.
Some landscaping has been added along Nottingham Road as requested by the
Commission. Building elevations have not changed from what was previously
approved.
STAFF RECOMMENDATIONS:
Staff feels that the following items must be addressed prior to issuance of any
permits for Phase I of the project:
1. A c e grading and drainage plan be submitted detailing facilities `or
the treatment of parking lot runoff;
2. A completely dimensioned site plan be submitted showing all planned
improvements, building ties, parking and drive dimensions, parking lot
lighting, etc.;
3. A complete landscaping plan showing all landscaping and specifying the
type of irrigation system to be used;
4. Building elevations be submitted indicating building materials and colors;
5. Final i'iat for Lots 26 and 27, Block 1, Benchmark at Beaver Creek,
vacating the existing lot line and utility easement, be recorded;
6. A Comprehensive Sign Program be submitted specifying the maximum sign
size for each bL'siness, t6he materials and colors for signs, and the
locations and sizes of any project entry signs and directories;
7. Details for the trash enclosures be submitted.

Christie Lodge - Avon Pharmacy
Sign Design Review
INTRODUCTION:
Mr. Jack Mowder of the Avon Pharmacy, in the Christie Lodge, has requested
approval for an addition to his business sign. The existing sign says
"Country Store" and Mr. Mowder would like to add the word "Pharmacy" to the
sign using the same 12" high metal can channel lettering. We have received
a letter from the Christie Lodge Homeowners Association approving this request.
STAFF COMMENTS:
Mr. Mowder has indicated to Staff that his goal concerning this sign is to have
it read "Avon Pharmacy". He has stated that, if approval were granted, he would
put up the "Pharmacy" portion of the sign alongside the "Country Store" sign.
Then, in 3 to 4 months, remove the "Country Store" sign and replace it with
"Avon". This would help the applicant's customers to adjust to the name change.
The complete "Avon Pharmacy" sign would be approximately 12 square feet in area.
STAFF RECOMMENDATION:
If the Commission approves this application, it may wish to specify a time limit,
i.e., 6 months, for the changeover to take place.

Sign Design Review
INTRODUCTION:
Jim Verhey of Vail Discount Tire and Imports Garage has requested design review
approval for a business sign that he proposes to place on the Barshop Building.
The applicant is asking for approval for an 18 square foot sign which will be
a backlit, injection molded sign. No colors for the proposed sign have been
submitted as yet.
STAFF COMMENTS:
According to a letter submitted by the applicant, the proposed sign will be
approximately 1z' x 12'. There is no drawing showing the layout of the sign,
or its location on the building. Colors for the lettering and background have
not been submitted. This type of interior lit plastic box sign is listed in
the code as a type of sign that should be discouraged. The Commission could
approve this type of sign if all the necessary information were submitted,
but Staff feels that the submittal is inadequate.
STAFF RECOMMENDATIONS:
Staff would recommend that the Commission continue this application to its next
regularly scheduled meeting and direct the applicant to submit the following
information:
1. Scale drawing of the proposed sign;
2. Proposed colors;
3. Building elevation showing the sign location;
4. Letter from building owner granting approval of the proposed sign.
