PZC Minutes 070787RECORD OF PROCEEDINGS MINUTES OF PLANNING AND ZONING COMMISSION MEETING JULY 7, 1987 The regular meeting of the Avon Planning and Zoning Commission was held on July 7, 1987, at 7:10 PM in the Town Council Chambers of the Town of Avon Municipal Complex, 400 Benchmark Road, Avon, Colorado. The meeting was called to order by Chairwoman Pat Cuny. Members Present: Charlie Gersbach, Mike Blair, Pat Cuny, Frank Doll, Buz Reynolds, Tom Landauer - Members Absent: Mark Donaldson Staff Present: Norm Wood, Director of Engineering and Community Development - Jim Lamont, Planning Consultant Ray Wright, Engineering Technician - Maggie Lach, Recording Secretary Staff Work Session Wood reviewed agenda items of July 7, 1987, with Commission members. 7:30 PM - Regular Agenda Items Lots 23 & 75 Blk. 2, BM C BC - Wal-Mart Shopping Center -- Design Review Gersbach stepped down due to a conflict of interest. Wright stated that at the Commission meeting of April 21, 1987, Palmer Development was granted conceptual site plan approval and preliminary design review approval for the buildings for the Wal-Mart Shopping Center. Since that time, the developer has redesigned the project to stay within Lots 23 and 75. With the exception of a pedestrian walkway and a retaining wall, no improvements are planned for the City Market property. Wright presented plans for Commission review and comment. Steve Sizymanski of Palmer Development stated tie would Explain the changes to the site plan. The major change is that the shops and entrance drive have been Nulled 50 feet from the City Market property because City Market said they would riot allow them to use their property or to build there. City Market's explanation was that they didn't feel there was enough land there and they wanted to protect all of the parking that they could. Szymanski explained changes from plans submitted. He stated that atrother change was to push the shops back. This would maximize the site, and they are trying to maintain as much square footage as possible. By pushing the shops back, that gave us the drive area in back, and we have eliminated the head -in parking which takes away any conflicting backing movement into the main drive. Szymanski then continued review of plans. He explained that landscaping remains in front of Wal-Mart and the shops, with a planta: in the middle of the shops. There is screening for the trash and between the buildings and the entrance ways all along the wall. Ther is also a walkway in the back of the shops. Blair had concerns that the delivery trucks would use the front of the building rather than the back. Szymanski stated that the rear of the Wal-Mart building has 2 -way traffic and is 25' wide. Can t. Szymanski stated that Wal-Mart requires 6/1000 spaces and they are 2 spaces over. He stated they meet the open space requirement, but do not meet on-site snow storage requirements. Discussion followed on access for delivery trucks and pedestrian aides from plans submitted. Lamont commented on pedestrian access and deliveries. He stated this site plan has some benefits over some previous ones and also offers some opportunities. The scale of this project is big and will require some monitoring and there is growth potential on either- side. The delivery issue does have some options. One is that the setup of the parking lot can't be manuevered any other way. it does provide the opportunity on the northeast to stack delivery vehicles if it becomes necessary. The covered walkway in front of all of the shops also offers some opportunities. The width of that pedestrian arcade is such that hand truck deliveries can be made relatively easy and service the entire project from the front, particularly if you've got a 6-8' wide wheelchair ramp. The rear of the building has sufficient lard, given 1 or 2 feet, which is something that can be determined on-site. Commission then reviewed Staff recommendations. Szymanski stated that the subdivision replat would be ready for Council next Tuesday. The grading and drainage plan has been submitted and needs to be reviewed. There will be a letter of agreement from City Market regarding the wall to be constructed on a portion of their property. The building colors for the split cinder blocks on the retail shops and Wal-Mart will be white for Wal-Mart with a bright peach accent color and a soft green. The retail shops are the opposite color. This is Wal -Mart's first white building and they have never used peach and green on any other buildings ofetstathe ed that moving tz snow off-site is no problem for the Blair asked if the Fire Department was satisfied with the access to the rear of the retail space. Wood stated the Fire Department had riot reviewed or commented on the plans yet. Lamont stated that this project does meet all of the Goals and Objectives substantially. Szymanksi stated they are very close to breaking ground. They need final approval to satisfy the requirements of the Town, and are finishing the plans and specifications, which should be dove by Friday to be sent out to bid with the general contractor. Thearcfinancing is ready to go contingent upon final drawing_ from Reynolds motioned for approval of the resubmitted plans as submitted, conditioned upon: 1) complete subdivision process to vacate lot line between Lots 23 and 75, Block 2,; 2) submittal of a satisfactory grading and drainage plan for review and approval, that is compatible with the site plan and building elevations; 3) supply documentation from City Market agreeing to improvements and changes to Lots 67 and 68; 4) that specific building materials and colors be indicated on plans; 5) that letter be submitted stating that the developer- agrees to r -:move snow from the site and transport to an appropriate site when on-site snow storage proves to be inadequate; and 6) that the Fire Planning & Zoning Meeting Minutes July 7, 1987 Page 3 of 8 Lots 2 & 75 B1H BM @ BC - Wal-Mart Shopping Center - Design Review Con't. Department approve the access to the rear of the retail shops. Landauer seconded. Gersbach abstained. Motion carried. Ordinance 87-12 Series of 1987 -_Motor Fuel Dis ensin in the SC Zone District Resolution 87-12 - Public Hearing Gersbach rejoined Commission discussion. Wood stated that the Town Council has requested that Staff prepare an ordinance amending the Zoning Code to allow motor fuel dispensing as a Special Review Use in the SC Zone District. This provision was previously included in the proposed Zoning Code revisions as presented to the Planning and Zoning Commission and forwarded to the Town Council. If adopted, the ordinance would define "Motor Fuel Dispensing" and allow this activity in the SC Zone District when approved as a Special Review Use. When considering this proposal, the Commission should consider the intentions outlined for the SC Zone District and the compatability of the proposed use with other allowed and Special Review Uses in the SC Zone District. Staff has prepared Resolution 87-12, which recommends approval of Ordinance 8 Cuny then opened the public hearing. Wood stated that the current SC Zone District includes eNerything on the east side of Avon Road, north of the railroad tracks., with the exception of the Christie Lodge site. There being no one wishing to be heard, the public hearing was closed. Discussion followed. Blair motioned to adopt Resolution 87-12, recommending Council adopt Ordinance 87-12, an ordinance amending the Zoning Code of the Town of Avon to allow motor fuel dispensing as a Special Review Use in the SC Zone District. Doll seconded. Passed unanimously. Tract Q Blk 2 BM @ BC - Hardee's Restaurant_- Design Review Landauer stepped down due to a potential conflict of interest Wright stated that Silver Eagle Enterprises has applied for design review of a proposed Hardee's Restaurant to be located on Tract Q, Block 2. A similar use and site layout was approved on this parcel about 2 years ago. The proposed building materials include a stucco exterior with a mansard roof finished with cedar shakes. The submittal consists of a site plan, floor plans and elevations, landscape plan, grading and drainage plan, and color rendering. Wright presented plans for Commission review and comment. Bill Pierce, architect and representative of Silver Eagle Enterprises stated that they do want to put in a Hardee's Restaurant. He explained they are following the site plan used and approved for Wendy's, which had been approved for this site. He felt that the building was mare attractive than the Wendy's. It relies more on the quality of architecture rather than garish colors. Pierce presented cjl:?r' rendering for Commission review. He felt that the architecture of 11. He stated they are proposing to revise some of the materials. There will be a metal roof and stucco has been added. Pierce then presented the material color board, explaining finishes on the building. He stated the building has an atrium on the south with a dining patio. There is a drive-through window with a canopy. There is adequate parking and snow storage. The mansard roof is high enough to screen all of the equipment that goes on the top of the building. The orange tile is used as an accent. He explained that following Staff c<imments, the roof has been changed to a standing seam metal, of a brown color. We have extended the screening along the north side of t(e building to enclose the gas meter area and roof ladder. We have added more landscaping to the south and east. Pierce explained from plans submitted. He stated that the only Staff comment that they do not agree with is the use of stucco for the screening wall, because there are u opening doors that are 10' wide for access to the trash behind. It could conceivably get bumped and banged into, which is difficult to replace and we may need future access to the walk-in coolers and freezers that are enclosed by the screen fence. It is impractical to build a fence out of stucco. He stated they would like to continue to use a wood screen fence which is 9' high, with a Olympic stain 726, brown. He stated the fence would be 1 x 8 rough sawn channel rustic. The deliveries will be made on the north side of the building. Discussion followed on access for deliveries and plans submitted. Blair felt that there was too little landscaping on the plan. Pierce stated there was quite a bit of snow storage. There are removable concrete planters for the winter. Lamont felt that on -grade planting areas would be preferable to removable planters. It might soften the building somewhat. Blair asked if the architecture could be improved on the building. Bill Sargent of Silver Eagle Enterprise stated that this plan is the parent company's design, which is different from the Hardee's in Glenwood Springs. He stated that this is a new design that has not been built anywhere yet. Lamont asked if the roof had to be a mansard design. Pierce stated that it does have a function providing a flat roof, and all of the equipment is being screened by it. Lamont stated that the reason they suggested the stucco wall was to bring the modern look into town. Pierce stated that if the roof were higher or the pitch changed, it would take a big bite out of the canopy area that covers the equipment He felt it was very similar to the First Bank of Avon in detail. Discussion followed on roof design. Gersbach asked how many seats were in the restaurant. Pierce stated about 90. Cuny stated she would prefer to see more landscaping. Review, Con"t. Pierce did not feel that would be a problem. Lamont asked if there could be a safety buffer between traffic flow and the pedestrian seating area on the south side. He felt there were advantages of moving the planter next to the building out to a railing to contain the pedestrian flow next to the driveway. Pierce stated there is a 12" curb. Discussion followed an curb and landscaping from plans submitted. Pierce then explained the sign program. He stated that they are proposing 126 square feet of signage. There are signs at the north and south end of the building of 37 square feet each and signage on the east and west side of the building of 9 square feet each, and we're proposing a freestanding sign that has a second sign under it. The freestanding sign is 18 square feet. The sign under says "Breakfast - Drive -Through" and is 15 square feet, for a total of 126 square feet. Doll felt that since they were allowed 64 square feet of signage plus a 50% increase, 96 square feet was adequate. Reynolds did not see the purpose of 4 signs with a freestanding sign. If there were 2 building signs he felt that would be adequate. Discussion followed on plans submitted. Pierce stated they would like to have the sign that says "Breakfast" and "Drive -Through". The freestanding sign is 16' tall. Lamont suggested that as much of the signage, as possible, be incorporated on the building. He felt that the signage on the building adds another accent color and design theme. He felt that the location of this building, the signage as such, should be retained on the building rather than having a freestanding sign. Cuny felt that no matter how much signage was in place, people would see the building because of its location. Discussion followed on plans submitted regarding the freestanding sigi. Cuny and Commission felt that "Breakfast" and "Drive -Through" sign should be located on the building. Discussion followed. Doll felt that signs would probably be needed on the west and south side of the building, but not all the way around the building. Discussion followed on sign program. Cuny had an objection to the U.S. flag being flown because she felt that it was merchandising and marketing the flag in a way that was noi: meant to be. Discussion followed on Staff recommendations. Wood commented on site lighting and stated that the lights that are proposed are the same type of lighting at Pizza Hut, which are flood lights, not the down lights like the Design Procedures recommend. Staff would recommend that the lighting be straight down lighting as used in Nottingham Park. Discussion followed. Blair motioned for final design review approval with conditions of: 1) Town Council approval and the recording of final plat resubdividing Tract Q it accordance with previous applications for this site; 2) approval of a variance for setback encroachment as required for the proposed design; 3) approval for the change in access use if required by the Colorado Department of Highways; 4) the inclusion of additional Planning & Zoning Meeting Minutes July 7, 1987 Page 6 of 8 Tract Q Blk. 2 BM @ BC - Hardee's Restaurant - Design Review. Can't_. information such as building material colors by manufacturer's stock number, exterior lighting information and parking lot runoff treatment facility details; 5) that lan:dscapini plan include 5-9 tall growing trees planted in the State Highway right-of-way to the west of the building to include a combination of aspen, Austrian pine and lodgepole pine; 6> a 30" high patio curb planter be placed around the outside patio and drive primarily for the purpose of safety; 77 that minor detail be added to the north and east elevation; and 8) that the sign program, outside lighting, and fence design be considered as separate design review items. Gersbach seconded. Discussion followed. Dave Irwin spoke from the audience and stated that there are so many concerns with certain aspects of the design review that he could not understand how final approval could be given. It seems that these concerns could easily be worked out, but there are many little things that could have an overall effect on the project. Preliminary approval would seem to make more sense. Cuny agreed. Blair felt that with all of the discussion and with the conditions that were made, that those concerns were covered. Blair then read back the motion. Wood stated he had concerns of final approval since the subdivision process had not yet been completed nor the variance request. These revised plans were submitted on July 6, 1987, and have not yet been fully reviewed by Staff. Pierce stated they would prefer approval on a preliminary basis. Blair and Gersbach voted aye. Landauer abstained. Reynolds, Doll and Cuny voted nay. Motion did not carry and Cuny asked for another motion. Gersbach motioned for preliminary approval with the same conditiuna previously mentioned. Doll seconded. Landauer abstained. Motion carried. Tract Q Blk. 2 BM @ BC - Variance Request - Front Lot Setback Resolution 87-13 - Public Hearing Landauer stepped down due to a potential conflict of interest. Wright stated that the applicant has requested a variance from the 25 foot setback for the proposed Hardee'=_ Restaurant. The requested variance is for O setback for drive through canopy and 12 foot setback: for building. The front lot line is along Avon Road which has a very wide right-of-way in that area of approximately 260 feet. The site i5 approximately 80 feet from the edge of the existing roadway with the area between being well landscaped. Bill Pierce, representative of Silver Eagle Enterprise stated that this is the same type of variance as was previously approved for Wendy's - He felt that due to the size of the lot, this would prove to be a hardship if the variance were not granted. Cuny then opened the public hearing. There being no one wishing to be heard, the public hearing was closed. Reynolds motioned to adopt Resolution 87-13, approving a variance request to allow O setback for a drive through canopy, and a 12 foot setback for the building, from the Avon Road right-of-way for the proposed Hardee's Restaurant on Tract D, Black 2, as shown in design review application 87-31. The variance complies with Section 17.36.040 Approval Criteria, and Section 17.36.050 Findings Required. Doll seconded. Landauer abstained. Motion carried. Lot 33, Blk. 2 BM @ BC - Greenhouse Addition - Design Review Landauer rejoined Commission discussion. Wright stated that David Irwin, representing the owners of the duplex residence located on Lot 33, has applied for design review of a greenhouse type addition to each side of the duplex. =ach addition is approximately 250 square feet in area with a small decn ttached. Building materials are proposed to match existing finishes. A portion of each of the new roofs will be glass, with the remainder being wood shakes. David Irwin, represent=ng the owners stated that he originally designed and built this duplex. He stated this is a nice addition that blinds into the original concept of the building. The greenhouse has the same roof pitch as the original roof, There is a greenhouse for each side of the duplex and has been designed to make it look like a single structure. There are 2 glass panels that are triangle shaped, and the rest of the roof is shaped to match the existing. The deck area will be increased slightly in size to blend in with the new roof area. There are no setback infringements with the revised plans. Irwin explained addition from plans submitted. Doll motioned to approve the greenhouse addition as submitted. Landauer scconded. Passed unanimously. Reading & Approval of P & Z Minutes of 6/16/87 Regular Meeting, and Continued to June 24, 1987 Doll motioned to approve the minutes of the June 16, 1987, regular meeting and continued to mune 24, 1987, as submitted. Landauer seconded. Passed unanimously. Other Business Wright stated that Vail Imports in the Barshop Pusildiog would be coming back in to request a larger ousiness sign and asked that t:ie Commission look at his present sign when in the area. The sign. is 24 square feet. Reynolds had concerns of the Colorado Mountain Express parking lot. Wright stated that Staff has requested that they complete the entire project by the end of July. Planning & Zoning Meeting Minutes July 7, 1987 Page 8 of 8 Other Business Con t. Reynolds mentioned the possibility of going to Council with the idea an alternate for the Commission. Cuny stated that unless someone sits in on the Commission meetings, they would have to be here for every meeting. Discussion followed. Cuny stated that there are times when Commission members have to be gone or step down. The reason the Commission is here is to act on behalf of the Town. She felt that the reasons for stepping down had be closely looked at. Perhaps some of the people are stepping down when they don't have to or they're stepping dot -in more often than they're serving on the Commission. She felt that should be evaluatec before looking into alternates. Gersbach felt alternates were cumbersome. Cuny suggested that if Commission members would be in conflict, that Staff be notified before the meeting. Discussion followed. Slair recommended that another member be added, or ask the Commissior to consider his position on the Commission, or have the Commission consider well ahead of time whether they will have a conflict and advise the Staff.
