PZC Minutes 090187RECORD OF PROCEEDINGS MINUTES OF PLANNING AND ZONING COMMISSION MEETING SEPTEMBER 1, 1987 The regular meeting of the Avon Planning and Zoning Commission was held on September 1, 1987, at 7:35 PM in the Town Council Chambers of the Town of Avon Municipal Complex, 400 Benchmark Road, Avon, Colorado. The meeting was called to order by Chairwoman Pat Cuny. Members Present: Mike Blair, Frank Doll, Pat Cuny, Charlie Gersbach Mark Donaldson, Buz Reynolds, Tom Landauer Members Absent: None Staff Present: Norm Wood, Director of Engineering and Community Development Jim Lamont, Planning Consultant - Ray Wright, Engineering Technician Lot 17 Blk 1 BM @ BC Colorado Mountain Express - Request to Delete Asphalt Paving for Temporary Parking Lot - Con t. from 8/18/87 Regular Meetiira Wright stated that at the August 18, 1987, meeting, the Commission continued this request because there was no one from Colorado Mountain Express present at the meeting to explain their situation. Andy Wallace, Head of Operations for Colorado Mountain Express apologized that no one was present at the last meeting. He explained that they want to delete the asphalt required on Lot 17 because they have run into financial difficulties. He explained that when they took over the facility, the property was in fore- closure and the original lender on the property was anxious to get them into the building. The bank who owns the lot told them to follow through with the improvements and they would handle the cost. They also said they would finance the improvements on the lot and amortize the cost of the lot over a 5 year period in their lease. After the improvements were begun, the bank began to have financial difficulties and they told Colorado Moutain Express that they had a $12,000.00 cap on the parking lot paving. The first bid for excavation and gravel was $11,000.00. At this point the bank dropped everything into the lap of Colorado Mountain Express and we had a commitment to the Town to finish our development on the site, but at that point we no longer had any type of financing. Wallace stated that there is approximately $22,000.00 tied up in the property on the fence, additional excavation, the filter gallery, and are already $10,000..00 over the original cost. The additional costs that aren't added in yet is the landscaping, lighting and paving, for a total of approximately $24,000.00, more or less. The reason we've been so slow in completing this project is because cash flow isn't what it is in winter months. He stated they would like to proceed with the lighting so it's in place by December or January. Discussion followed on items to be completed. Commission generally concurred that asphalt could be deleted if other items were completed. Donaldson 'stated for the record that he initially drew the plans for this project, but did not feel he had a conflict of interest because he has nothing to gain or lose on any action taken on this application. He suggested that the 3 other items be completed and then the asphalt requirement be deleted. Gersbach motioned to waive the asphalt requirement and applicant is to complete the remaining improvements within a 60 day period to Staff's satisfaction. Landauer seconded. Discussion followed. Passed unanimously. A. Avon Center @ Beaver Creek - Joyce Communications - P1 ment rightrstatedthat llLe UJoyce Communications has requested approval to place a satellite dish antenna on the Avon Center. They have submitted information on the proposed dish, along with building elevations and photographs showing the proposed location. The applicant proposes to n1ace the satellite dish on the second floor deck on the south side of Avon Center. Marty Hijmans, engineer for Joyce Communications (also known as KEYQ) explained dish and location from photos submitted. Reynolds asked if the dish could be located on the roof. Hijmans stated that when snow accumulates it has to be swept out. They're looking for proximity to station personnel. He stated they found a space for the dish in front of a blank wall, and the dish would be painted the same color as the wall. The dish is fairly large at approximately 13' in height and sticks up partially in front of the railing on the deck. He stated that a mesh antenna would not work because the network requires a large dish. Cuny had a problem with the dish not being screened. Donaldson stated that there are many dishes in Avon that are not fully screened. Clee Dober, General Manager of KEYQ stated there is safe access to the dish. He explained that they are concerned with the location of the dish and has concerns of employees going to the roof in a safe manner. He stated that the deck location for the dish sets in an alcove and is about as screened as any dish he's seen. He stated that a dish can't totally be screened because the reception is then lost. Gersbach asked if the dish location was approved by the condo association. Jim Lindsey, Project Manager of Avon Center stated th:c permission is not required from the Homeowner's Association on the commercial -revel. Discussion followed on location of dish from photos submitted. Lamont asked if there was normal access to the roof. Lindsey stated yes. Lamont felt that it would be difficult for someone to fall off of a roof with a parapet wall and a railing. Lengthy discussion followed on access to dish during snow storms, view from adij+cent properties, and how screening could be accomplished on the top of the roof or on the deck. Commission then reviewed Staff Comments regarding screening and obligation to notify residential owner above site. Blair motioned to approve the satellite dish placement with the following conditions: 1) applicant contact the owner of the unit directly above the site and give them 30 days to respond; 2) applicant devise ideas to make dish blend in with the surroundings to the general satisfaction of the Staff; and 3) that adequate fencing or barrier be constructed for security reasons. Cunt' felt that provisions should be made for wiring the dish. Blair amended motion to include that the wiring or cable be concealed to the satisfaction of the Staff. Discussion followed.
