PZC Packet 091686STAFF REPORT TO PLANNING & ZONING COMMISSION - 9/16/86 Pester Gas Station Lot 1, Block 1, Benchmark at Beaver Creek Design Review INTRODUCTION: Pester Marketing Company, which owns and operates the Pester Gas Station on Nottingham Road, has applied for design review for chanes they propose to make to the existing site. Changes include elimination of the existing five pump islands, to be replaced by three new pump islands. The existing building which houses the cashier and restrooms will be replaced by an 1,800 square foot convenience store and deli. The proposed building materials include "Dryvit" stucco to be "Pearlash" in color, with white painted cedar trim, and a "Slate Grey" metal roof. Proposed building height is 30 feet. Plans submitted include site plan, landscaping plan, building floor plans and elevations, and Sign Program. STAFF COMMENTS: A comparison of the proposed improvements with the existing site has resulted in the following information: EXISTING PROPOSED Impervious Surface: Building = 300 sq.ft. or 1% of site vs. 1,800 sq.ft. or 6% of site Pavement = 18,746 sq.ft. or 64% of site vs. 13,480 sq.ft. or 46% of site TOTAL = 19,046 sq.ft. or 65% of site vs. 15,280 sq.ft. or 52% of site Open Space = 10,120 sq.ft. or 35% of site vs. 13,600 sq.ft. or 48% of site Parking requirements for the proposed convenience store are calculated at 4 spaces per 1,000 square feet of floor area. The floor area of the convenience store (excluding storage areas, etc.) is approximately 1,380 square feet. Based on this, 6 parking spaces are required. The site plan shows 7 full-size parking spaces and 1 loading space. Staff suggests that the landscaping on the north side of the store be extended to the east, between the parking area and Nottingham Road, in order to separate the parking from the street and to define traffic flow. Another area of concern is the existing exit drive on the west end of the project. Staff recommends that the radius on the east side of the exit be increased to allow better turning movements for the eastbound traffic. A sign should also be installed at this exit stating that it is an "Exit Only, Do Not Enter". The site plan shows a 500 gallon propane tank which the applicant proposes to install within a 6' high cedar enclosure. The Commission should be aware that, according to the Planning and Zoning Commission Rules and Regulations, Section 5.10.(g)4, "No oil, gasoline, or liq:;id petroleum gas tanks will be permitted above ground. All such tanks shall be buried below ground level." Other above ground installations of LP gas tanks have been approved by the Commission in the past. That the tank location and type comply with all Fire Department regulations; 2. That the tank be screened from view of passing motorists and adjoining property owners by a fence or landscaping; 3. That the tank be removed within 30 days after natural gas is available to the site. The applicant has submitted a let Ler to the Commission, requesting this approval and is attached to this report. Under the proposed plan, site grading and drainage will be virtually unaffected. The underground gas storage tanks currently in use will remain in their present locations, only the pump locations will change. Open space on the site will increase from the current 35% of site area to approximately 47%. The landscape plan calls for an increase in new plant materials to be spread throughout the site. The applicant has applied for a variance from the Sign Code for both sign height and sign area. Staff suggests that the sign program and variance be treated separately from the site and building design review, so that the Commission may adequately address the Approval Criteria and Findings Required for the variance. STAFF RECOMMENDATIONS: Staff offers the following items to be considered as conditions to design review approval for this project: 1. Landscaping on the north side of the building be extended eastward to separate the parking area from Nottingham Road; 2. The radius on the east side of the exit drive be increased to allow better turning movements for eastbound traffic; 3. Install sign on this exit that states "Exit Only, Do Not Enter"; 4. If the above ground installation of the LP tank is acceptable, the Commission should, as a minimuo, attach the conditions discussed in the Staff Comments. The requested signs are summarized below: 1. Project Identification Sign: Height 30 feet Area 149.2 square feet Location East end of site (where existing flagpole is located) 2. Existing Price Sign: Height 11 feet Area 80.5 square feet Location Sign already exists on the east end of the site Sign allowance for the project per the Sign Code is as Follows: Total Building Frontage 122 linear feet* Sign Area Per Sign Code 62 square feet Allowable 50% Increase 31 square feet TOTAL SIGN ALLOWANCE 93 square feet Allowable sign height 30 feet** * According to Section 15.28.020 of the Sign Code, a building may have more than one building front when approved as part of a sign program. Due to the location of the site with I-70 on the south and Nottingham Road on the north, the applicant is counting three sides of the building as frontage. ** According to Section 15.28.080(Q)6 of the Sign Code, the Commission may approve a 50% increase in sign areas or heights when approved as part of a sign program. The allowable height for a free-standing sign is 20 feet. The variance being requested for the project identification sign is for sign area. The variance being requested for the price sign is to allow it to remain 5 feet from the property line, instead of the required 10 feet. Staff Report to Planning Pester Gas Station Lot 1, Block 1, Benchmark Sign Variance and Design Page 2 of 3 STAFF COMMENTS: & Zoning Commission - 9/16/86 at Beaver Creek Review The 230 square feet of total sign area being requested for the Pester site exceeds the maximum allowable area for the project by nearly 22 times. The location and type of business does require a significant amount of signage located such that it is visible to both the local and the Interstate traveler. The proposed signage does address this concern. However, it seems that these concerns can be addressed in a more attractive and acceptable manner. One available option is the use of the Interstate signage program which is administered by the Colorado Department of Highways. Another option could be combining the company logo sign and the price sign into one sign structure. The design of the mounting could be such that it would blend with other landscape features and be more in proportion with the dimensions of the logo sign, while at the same time allowing the incorporation of the price information. A properly designed mounting structure could meet the needs of the project and still address the aesthetic concerns of the Town. The additional cost of such a structure is somewhat justified by the amount of variance from allowed signage requlations that the applicant is requesting. It is suggested that a maximum of 6 square feet per side be allowed for the price sign. This would reduce the total sign area for the site to a maximum of about 161 square feet. STAFF RECOMMENDATIONS: Citing Section 15.28.060, Sign Design Guidelines, Staff recommends that the Commission continue this application, and direct the applicant to consider use of the Interstate signage program as administered by the Colorado Department of Highways in conjunction with on-site signage program conforming with Town of Avon Sign Code. If this is not an acceptable alternate, consideration should be given to design modifications to incorporate a smaller price sign into the mounting structure for the company logo sign. The sign is proposed to be located at the southeast corner of the site, where the free-standing project entrance sign will be located. The proposed sign is one face, 64 square feet in area, and is to be 11 feet in height. The Sign Code allows a maximum of 16 square feet of sign area for development signs, and a maximum height of 8 feet. The applicant has submitted a site plan showing the proposed location of the sign, construction details, and a color rendering for Commission review. STAFF COMMENTS: Although the proposed sign is much larger in area than the Sign Code allows for this type of sign, the Commission should consider the fact that construction of the project is already well underway and is scheduled for completion in December of 1986, and the proposed sign will become obsolete with the installation of the approved free-standing project entry sign. Since this is a variance request, the Commission must follow the procedures below in determining whether or not to grant this variance. Section 15.28.090 Maintenance, variances, construction code. B. Variances Purpose. The planning and zoning commission shall have authority to grant variances from this regulation to prevent or lessen such practical difficulties and unnecessary physical hardships, inconsistent with the objectives of this title, as would result from strict or literal inter- pretation and enforcement. Approval Criteria. Before acting on a variance request, the planning and zoning commission shall consider the following factors: a. The relationship of the requested variance to existing and potential uses and structures in the vicinity; b. The degree to which relief from the strict or literal interpretation and enforcement of a specified regulation is necessary to achieve compatibility and uniformity of treatment among sites in the vicinity; c. Such other factors and criteria as the commission deems applicable to the requested variance. The planning and zoning commission shall make the followina findings before granting a variance: a. That the variance is warranted for one or more of the following reasons: i. The strict or literal interpretation and enforcement of the regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of this title; ii. There are exceptional or extraordinary circumstances or conditions applicable to the site of the variance that do not apply generally to other properties in the vicinity; iii. The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the vicinity. STAFF RECOMMENDATIONS: If the Commission grants the variance request and approves the design of the proposed sign, Staff would suggest that the sign be removed from the site when the free-standing project entrance sign is installed, or by January 1, 1987, whichever comes first. They have submitted a letter • outlining the dish's specifications and they are listed below: 1. The proposed dish will be 12' in diameter; 2. It will be constructed of metal mesh; 3. It will be installed approximately 18" above the ground; 4. The color will be white, if possible it will be painted an earth tone; 5. Screening of the dish is to be accomplished either through landscaping or wood fencing; 6. The dish will be located at the northwest corner of the property. STAFF COMMENTS: The dish is proposed to be located at the northwest corner of the property. This would place the dish behind the trash enclosure, in the midst of several lodgepole pine and green ash trees proposed to be approximately 8' in height. This location would appear to be the best one on the site to locate the -dish. Although the current Planning and Zoning Commission Rules and Regulations prohibit exterior antennas, the Commission should be aware of a ruling made in March, 1985 by the Federal Communications Commission that preempts any local zoning that discriminates against satellite dish antennas in favor of cable television or other communication systems. The ruling also requires that local zoning ordinances for dish antennas have a "direct and tangible relationship to reasonable, valid, demonstrable, and clearly articulated health, safety, or aesthetic objectives and constitute the least restrictive method of accomplishing such objectives." The new Planning and Zoning Commission Rules and Regulations, which are not .vet in effect, provide for the installation of satellite dish antennas. The guidelines for design of the antennae are listed below: 1. All antennas shall be located so as to be screened from view from any public right-of-way or neighboring property. All wiring and cable related to antennae installations shall be installed underground or be incorporated entirely within the structure; 3. The use of mesh antennas is encouraged; 4. Color selection for dish antennas should be made with respect to the characteristics of the site or structure. Unpainted surfaces and dish antennas with reflective surfaces shall not be allowed.
