NW/je Sincerely, Norm Wood Engineering and Community Development - 2 - STAFF REPORT TO PLANNING & ZONING COMMISSION - 5/16/85 Lot A, Block 2, Benchmark at Beaver Creek Avon Center Penalty Box Restaurant Information: The applicant has submitted a request for design review of an outdoor patio/dining area to be used in conjunction with the Penalty Box Restaurant. The patio would be located in the Town Center Mall adjacent to Avon Center. The patio would consist of a section of the existing walkway plus an additional concreted area. The area would be enclosed with a wrought iron fence and redwood planters. This use is consistent with proposed uses in the Mall and Town Center zone district. However, proposed design must be approved by Avon Town Center Mall Committee as well as the Planning and Zoning Commission. The Town Center Mall Committee has approved concept for patio/dining area, but has not approved design. Staff Concerns: 1. The existing walkway adjacent to Avon Center will be blocked by the wrought iron fence Proposed walkway width and alignment is inconsistent with other walkways in the area. It seems the project design could be modified to provide consistent walkway width and alignment and still meet liquor law requirements; 2. If this is to be a permanent modification to the Town Center Mall, it may be desireable to limit amount of wrought iron fence and to construct planters from more permanent appearing material such as the brick facing on that area of Avon Center; 3. Plans are incomplete with respect to required grading and how existing landscaping and irrigation system will be modified. Recommended Actions: 1. Introduce proposed project; 2.. Conceptual review of project for proposed use and design compatibility; 3. Provide guidance to applicant regarding Planning and Zoning Commission concerns; 4. Continue review for submittal of complete plans addressing any expressed concerns. NW/mml W W a STAFF REPORT TO PLANNING & ZONING COMMISSION - 5/16/85 Lot A, Block 2, Benchmark at Beaver Creek Avon Center Penalty Box Restaurant - Signs Introduct This is a request for design approval for an exterior sign and a neon window sign for the Penalty Box Restaurant. Neither of the signs are in accordance ;with the approved sign program for Avon Center. Non -complying signs renuire approval of both Avon Center and the Planning and Zoning Commission. To date, we have not received any indication of Avon Center's approval for the two siqns. The neon window sign is existing, the other is proposed. The following criteria is taken from the approved Avon Center sign code and is felt to be pertinent to this application: 1. No signs shall be placed inside the window within 24 inches of the glass except as noted: a. Painted or etched lettering affixed to storefront glass not exceeding 10% of the glass area. Maximuri letter height 6"; b. Individual white "Letra sign" die cut vinyl letters affixed to the storefront glass not exceeding 6" in height and 10" of glass area. Window signs may not be used in conjunction with wall signs; 2. Exterior signs shall consist of groups of individual cast metal bronze letters or wood letters with laminated bronze faces and matching edges; 3. No exposed lamps, flat wood signs or internally lit cabinet type signs shall be permitted in any District; 4. Height shall not exceed 12"; 5. Letters shall be mounted to the wall adjacent to storefront or directly above the entry door; 6. Illumination of individual signs shall be by recessed incandescent light only; 7. The sign area shall not exceed 12 SF. Sign area is calculated by enclosing the perimeter of the area around the entire word grouping. A copy of the Avon Center Sign Criteria is included for your information. 'AWN 110 Staff Report to Planning & Zoning Commission - 5/16/85 Lot A, Block 2, Benchmark at Beaver Creek Avon Center Penalty Box Restaurant - Signs Page 2 of 3 Staff Concerns: Avon Center has not responded to these or previous signs which were not in conformance with their sign program. Numerous phone calls have not been returned in addition to no response to the attached letters regarding this matter. If Avon Center does not respond to a request for a non -conforming sign, it seems the Planning and Zoning Commission has no option but to deny the request. If Avon Center approves a non -conforming sign, the Planning and Zoning Commission may approve or deny the request; 2. The proposed exterior sign seems to generally comply with the approved sign program with the exception of construction materials. The submittal is not totally clear, but it appears that exposed lighting fixtures may be proposed. This should be clarified and if to be included, additional information is needed; 3. The existing neon window sign seems to be a totally non -conforming sign including both type and size. It appears that the window sign exceeds both 12 SF and 10% of the window area; 4. The approved sign program allows only a window sign or a wall sign, not both; In previous action, the Planning and Zoning Commission gave a 30 day temporary approval for an existirg non -conforming sign at Avon Center to allow additional time for a response. In order to be consistent, it may be adviseable to do the same for this existing non -conforming sign. Recommended Actions: 1. Introduce proposed signs; 2. Review proposed signs for compliance with sign program for Avon Center; 3. Give 30 day temporary approval for existing non-confroming neon window sign to allow applicant additional time to obtain approval for sign from Avon Center. If approval for sign is received from Avon Center within a 30 day period, applicant is to resubmit application for Planning Zoning Commission approval at the next regular meeting following the 30 day period.
