PZC Minutes 012684-9" owa RECORD OF PROCEEDINGS MINUTES OF PLANNING & ZONING COMMISSION MEETING JANUARY 26, 1984, 7:15 PM The regular meeting of the Avon Planning and Zoning Commission was held on January 26, 1984, at 7:15 PM in the Town Council Chambers of the Town of Avon Municipal Complex, 400 Benchmark Road, Avon, Colorado. The meeting was called to order by Chairman Bill Pierce. Members Present: Clint Watkins, Bill Pierce, Pat Cuny, Jim Meehan Members Absent: Tom Landauer, Jerry Davis, Mike Blair Staff Present: Jim Lamont, Planning Director, Maggie Loch, Recording Secretary val of P & Z Minutes of lar Meeti (;lint Watkins moved to approve the minutes of the January 12, 1984 meeting with the changes as noted. Pat Cuny seconded the motion. Motion approved and passed unanimously. Bill Pierce pointed out that page 2 of 6 regarding the housing survey should read 0' vacancy rather than occupancy. Clint Watkins stated that page 4 of 6 regarding the Coldwell Banker sign amended motion should read "... or if it is sooner terminated by applicable Ordinance or Code." Watkins motioned that procedure on the minutes from now on be that if Planning and Zoning or staff have changes in the minutes as presented, that the recording_ secretary, following the meeting, retype the minutes showing those corrected changes and go ahead and present those to the Council and that the Planning_ and Zoning Commission sign the corrected minutes at the following meeting. Pat Cuny seconded the motion. Passed unanimously. Wildridge Zoning and Rezoning Amendment, Lot 5, 52A, 52B, Blk. 1, B.S., Con't. from 1/12/84 Pierce read the letter for continuation of this matter sent by A.J. Testa, Vice President, Engineering and Construction. Pierce questioned if this item could be tabled for an indefinite period of time, and if so, would a new public notice be required. Lamont stated that there was no rule on the books that he'd comr across that said that Planning and Zoning members can't continue it. He believes that the applicant wants to keep their proposal alive, so an indefinite continuation would keep it alive, or the applicant could request that the application be continued on a meeting by meeting basis. Pierce felt that public notice should be republished. Lamont stated that this particular problem is identified in Sign Code. Example, all the decisions are to approve, deny with conditions, approve with conditions or continue. Lamont suggested adding another which would be "table". A "continuance" indicates that the process is still going, but to "table" is cessation without prejudice; since no "tabling" procedure is available, to not continue could be interpreted as a denial. Watkins felt applicant could continue item until such time that they notify sta that they want it back on the agenda and that they would have to comply with republication of public notice. Lamont suggested that it be continued for a period of time; then tabling might be requested. Norm Wood, Director of Public Works, suggested that since a public hearing was involved, set a maximum specific time that continuance would be good and after that it would be a matter of coming back through notification process again. Cuny questioned if application was made with idea that it would be continued. Lamont said no, but staff could continue issue for 90 days and then write a letter to the effect that after 90 days Planning and Zoning Commission would like to di�zuss tablina or discontinuation. Pierce suggested continuing issue for 60 days, but if applicant was not back within 60 days with application and actual hearing, that following that period, applicant would have to republish public notice. Watkins agreed, but questioned how the matter would be handled after 60 days. Meehan suggested that it would be automatically disapproved. Watkins moved that on the Wildridge Zoning and Rezoning Amendment, that the matters be continued at the applicants request; that the period of continuation not exceed 60 days; that prior to the lapse of 60 days, the applicant would have to request another "continuance". Further, that after 60 days, the matter would require republication; if the applicant took no action at the end of 60 days, the application would automatically be denied. Meehan seconded motion. Passed unanimously. Staff Work Session Cuny ase if t e bylaws would be addressed at this meeting. Lamont answered that they would be addressed next month under Zoning Ordinance Procedure according to the Master Plan schedule. Meehan made comments on the Sign Code in relation to the Roadcal sign; feels that Sign Code is case specific as it refers to development signs; by allowing for sale sign to be put on property (Lots 29-32, Block 2, Benchmark Subdivision) felt that is was too general an interpretation of the Ordinance to the point where it was an open interpretation; feels that the meaning of a development sign is a project that's been before the Planning and Zoning Commission; received approval; has gone through all approval procedures; have established their pre- sale program and are pursuing their pre -sales in order to meet their financing requirements. He does not beleive in real estate signs. Cuny agreed that a development sign is to locate and identify rather than to sell Pierce commented that the installation of a sign with phone numbers of realtors and addresses is hard to construe as anything but a for sale sign. Lengthy discussion followed on Coldwell Banker sign regarding type and presen- tation of sign on property. Cuny mentioned that this area is atypical; if someone wants to buy property, there are many realtors available; a sign such as this disturbs the aesthetic atmosphere in town and there are other alternatives for selling the property. 0 Planning and Zoning Meeting Minutes 1/26/84 Page 3 of 3 Staff Work Session, Con't. Discussion also followed on information included in the Planning and Zoning packets regarding the Augmentation Plan, letter from Housing Advisory Board and questionnaire. Lamont is rewriting the questionnaire and putting together a Residential Housing Survey to be circulated in the trailer park. Objective is to find out where people want to live; gauge their "wants" and "needs". Also included was letter from Harry Frampton of Vail Associates regarding the White annexation, mall ideas for Town of Avon, Waterford Ranch, Transportation Advisory Board regarding the county -wide transportation system and alternatives presented in memo by Beth Whittier. There was also discussion on the Sign Code that Lamont presented; is similar to the Vail Sign Code which he authored. This code assigns a Sign Administrator. Also deals with procedure rather than types of signs. Pierce suggested that a Sign Review Board, rather than Planning and Zoning, handle signs. Lamont pointed out that the Sign Administrator would work with the Planning and Zoning Commission, Town Council and applicant. The Sign Administrator would be able to approve signs of no more than 5 S.F. Lengthy discussion followed on Sign Code, proposed Sign Code and procedures and standards.
