The applicant has requested a zero setback on the eastern property line of
the project for its underground parking structure.
The applicant has been requested to provide for a future inter -connection of
its parking structure with development on adjacent property.
The subterranean inter -connection of parking structure is currently being
considered in the Master Planning program. Such inter -connection would permit
a more efficient flow of traffic between sites which are permitted commercial
uses.
The Commission should give particular attention to the aesthectic treatment of
the exposed portion of the foundation walls.
Prior to making its decision, the Commission shall consider the following factors:
17.36.040 Approval Criteria
Before acting on a variance application, the Planning and Zoning Commission
shall consider the following factors with respect to the requested variance:
A. The relationship of the requested variance to othL; existing or potential
uses and structures in the vicinity;
B. The degree to which relief from the strict or literal interpretation
and enforcements of specified regulation is necessary to achieve compatibility
and unifongity of treatment among sites in the vicinity, or to attain the
objectives of this title without grant of special privilege;
C. The effect of the requested variance on light and air, distribution of
population, transportation and traffic facilities, public facilities and utilities,
and public safety;
D. Such other factors and criteria as the Commission deems applicable to the
proposed variance. (Ord. 81-9 SI(d)).
Further:
17.36.050 Findings Required
The Planning and Zoning Commission shall make the following written findings
before granting a variance:
A. That the granting of the variance will not constitute a grant of
special privilege inconsistent with the limitations on other properties classified
in the same district;
B. That the granting of the v6riance will not be detrimental to the public
health, safety, or welfare, or materially injurious to properties or improvements
in the vicinity;

C. That the variance is warranted for one or more of the following
reasons:
1) The strict, literal interpretation and enforcement of the specified
regulation would result in practical difficulty or unnecessary physical hardship
inconsistent with the objectives of this title,
2) There are exceptional or extraordinary circumstances or conditions
applicable to the site of the variance that do not apply generally to other
properties in the same zone,
3) The strict or literal interpretation and enforcement of the specified
requlation would deprive the applicant of privileges enjoed by the owners of
other properties in the same district. (Ord. 81-9 S1 (e)�.
The granting of a variance may be conditioned on action by the applicant.

Avon Metropolitan District
Tract K, Block 1, Wildwood Subdivision
Avon Metropolitan District has requested a Special Review Use to construct a
potable water storage tank and pump station within the Wildwood SPA Zone. The
combination water tank/pump station would be located at least 10 feet from the
right-of-way line of West Wildwood Road and on Tract K.
The proposed use appears to be consistent with the land use of parkland,
pedestrian access and drainage as designated on the plat and original SPA
plan. One of the uses allowed on tracts with this land use designation is
Municipal and utility facilities, when permitted by the owner and the Town.
A letter from Section 36, Inc., representing itself as owner of the property
and granting approval for the requested use, was included with the Special
Review Use application.
In considering a decision on this project, the Commission must consider the
following Zoning Ordinance criteria:
17.20.020 Granting of Special Review Use
1) Whether the proposed use otherwise complies with all requirements
imposed by the zoning code;
2) Whether the proposed use is consistent with the objectives and purposes
of this zonino code and the applicable zoning district; and
3) Whether the proposed use is designed to be compatible with surrounding
land uses and uses in the area.
Further:
Section 17.20.040 Special Review Criteria
The Commission shall approve or deny the development after considering
certain factors, including but not limited to:
A) The adequacy of access to the site with respect to the width of the
adjacent streets, their grades, intersection safety, visibility and entrance
into the lot to be developed;
B) Whether there exists safe access and sufficient water pressure to
provide fire protection;
C) The existent water pressure in the area and the ability of the water
system to supply domestic needs;
D) Whether there will be provided sufficient off-street parking as
determined by (1) the intended use of the property, (2) walking distance to
the downtown area, and (3) the availability of public transportation;

E) The impact of the development, considering the potential for stream
and air pollution, the availability of public trarsportation and other public
or private services, and any other factors affecting the overall development
and the surrounding areas, including but not limited to building height,
view plane, drainage and other physical and aesthetical features. (Ord. 79-12 S3.5).

At the January 26, 1984 Planning and Zoning Regular Meeting, a mo{;ion was
made regarding the minutes as follows:
Clint Watkins motioned that procedure on the minutes from now on be that if
Planning and Zoning staff have changes in the minutes as presented, that the
recording secretary, following the meeting, retype the minutes showing those
changes and go ahead and present these to the Council and that staff sign the
corrected minutes at the following meeting.
Pat Cuny seconded the motion.
