PZC Packet 0927840 STAFF REPORT TO PLANNING E ZONING COMMISSION - 9/27/84 Lot 63, Block 2, Benchmark at Beaver Creek Peregrine Village Variance Request - Compact Car Spaces Continued from 9/13/84 Regular Meeting This variance request is continued from the September 13, 1984 meeting of the Planning and Zoning Commission. Since that time, the variance reauest has been narrowed such that it is for the allowance of a percentage of compact car spaces only. The applicants letter of September 20, 1984 indicates the project will have a total of 362 on-site parking spaces which are broken down as follows: Covered Parkinq Full Size 9 x 18 204 Spaces Compact 8 x 16 99 Spaces Handicap 12 x 19 4 Spaces TOTAL COVERED 307 Spaces SURFACE PARKING 55 Spaces TOTAL PARKING 362 Spaces The compact spaces represent 32.25" of the total covered spaces and 27.35% of the total on-site spaces indicated. Section 17.36.040 of the Municipal Code requires that the following factors be considered when reviewing a requested variance: A. The relationship of the requested variance to other existing or potential uses and structures in the vicinity; B. The degree to which relief from the strict or literal interpretation and enforcements of a specified regulation is necessary to achieve compatibility and uniformity of treatment among sites in the vicinity, or to attain the objectives of this title without grant of special privilege; C. The effect of the requested variance on light and air, distribution of population, transportation and traffic facilities, public facilities and utilities, and public safety; D. Such other factors and criteria as the board deems applicable to the proposed variance. That the granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same district; B. That the granting of the variance will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity; C. That the variance is warranted for one or more of the following reasons: 1. The strict, literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of this title; 2. There are exceptional or extraordinary circumstances or conditions applicable to the site of the variance that do not apply generally to other properties in the same zone; 3. The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same district. The following information may be pertinent to the above factors to be considered and findings to be made: A. Current parking regulations allow up to 3001: of all covered parking spaces to be compact, minimum size 8' - 16', when approved as a Special Review Use; B. A variance request was approved for Avon Center on October 7, 1982, allowing up to 28%, of the off-street parking spaces to be for compact cars with minimum size of 8' x 16'. The Commission may wish to consider the following conditions if the required findings are made for the granting of MG this variance: 1. The compact spaces allowed under the variance shall all be covered, shall not exceed 359 of the covered spaces, and shall be of ;, minimum size of 8' x 16'; 2. The actual number of on-:ite spaces should be subject to field verification with regard to both size and numbers. (An approval should not refer to a specific number of spaces as being available since the number of viable parking spaces will probably be slightly less than the 362 spaces indicated in letter of September 20, 1984); 3. Pio use shall be allowed within the project which will require more than two parking spaces per condominium unit or more than one space per 400 S.F. of commercial space, as per Ordinance 79-12, until such time as applicant can provide satisfactory evidence that minimum parking require- ments for higher uses have been met. Possible methods of providing parking for higher use requirements include, but are not necessarily limited to: a. Provision of off-site parking in accordance wit" Chapter 17.24 of the Municipal Cede; b. Conversion of commercial space to recreation amenities and common space for project residents and guests; c. Reduction of commercial space and/or condominium units to match available parking spaces; 4. Future approval of surface parking spaces shall be subject to applicant providing satisfactory evidence that open space requirements have been complied with or proper variances outained; 11pproval of this variance shall not be corutrued as an approval of any parking layout submitted to the Town by the applicant; 6. Commission act upon the variance request with action based upon the above factors and findings. If approved, attach appropriate conditions to approval as determined by Commission. Benchmark Shopping Center Applicants are proposing to install two signs for their business located in the Benchmark Shopping Center. One sign will be located on the building facia, and one hanging below for a pedestrian sign in the arcade area. The combined sign square footage is approximately 12 S.F., measuring the letters individually, which complies with our current Sign Code. Currently, the Benchmark Shopping Center has a variety of signs, which would lead me to my only recommendation, and that is that we encourage the Benchmark Shopping Center to develop a sign program.
