MINUTES OF PLANNING AND ZONING COMMISSION MEETING
DECEMBER 13, 1984
The regular meeting of the Avon Pian,ning and Zoning Commission was held on
December 13, 1984 at 7:40 PM in the Town Council Chambers of the Town of Avon
Municipal Complex, 400 Benchmark Road, Avon, Colorado. The meetinc was called
to order by Chairman Ptike Blair.
Members Present: Cheryl Dingwell, Tom Landauer, Mike Blair, Larry Kumpost,
Mark Donaldson

Review - Subdivision Plat - Tract Q, Block 2, BM 0 BC - Con't. frog 11/29/84
Reqular Meeting
Wood stated teat this proposed Subdivision, Tracts 0 and r, Blockenc mark
at Beaver Creek had been referred to the Commission for review and recommendation
before Town Council action. fie explained that this is a subdivision that does
not specifically require Planning and Zonine review, but at the request of the
Commission, Council has been referring plats to the Conmission for review. In
addition, when a subdivision involves a developed tract, as part of the review
of a subdivision, it requires a review of the site plan to verify that the
subdivision does not take one of the tracts out of compliance with the zoninn
regulations, such as parking requirements, loading space requirements, building
area coverage, open space requirements, etc. It is a twofold review;; one is
for compliance with the zoninc_ renulations as well as whether the subdivision
is desireable or not. At the last meeting, a number of concerns were expressed
regarding the proposed subdivision. These dealt with the actual parking, access
to the developed lot and to the portion that is beine split off and how it could
be accessed, and how traffic would relate to existing traffic patterns. In
development of the !aster Plan, Staff is lookinn at a future roadway across this
tract in order to provide circulation to the east area of Town. Since the last
meeting, Staff has worked with the applicant and feel that a tentative, mutually
acceptable solution has been reached regarding the problems addressed at tiat
meetinn.

4Jood presented rawinns showing before and after examples for Commission review.
Wood explained from the plans submitted that open space is approximately 30% of
the lot; building area coverage is approximately 18%, both of which are within
the zoning requirements for the area. The parking layout shown on the plan shows
122 full size parking spaces, two of which are handicapped spaces, and two loading
zones are shown, which meets zoning requirements for this particular development.
Staff feels enough information has been shown and that these requirements can
be met for the subdivision for the existing zone. Staff oas also worked with
the developer on access into the parking lot on the north side of the building
and feels a solution has been worked out which will greatly improve the situation
that now exists. Wood further stated that in the event that the street should
go through the right-of-way in the easement shown, there is another drawinc that
shows how the south tract would be accessed at that time, and Staff feels it is
a workable solution.
Wood presented those sketches for Commission review and explained that the access
would go through Tract Q south, or as noted on the plat as Lot 2. What would
happen is that approximately 25-30 spaces would be lost in the event that this
access easement is developed as a street. This layout can be modified and a
few more spaces can be picked up.
Bill Pierce, representative of applicant Jim Cunningham, stated he had nothing
to add; Wood had covered all points and they were satisfied with the plan.
Wood stated Staff recommendations for approval of Cunningham Subdivision:
1) The plat being revised to conform with the site plan as submitted; 2) A
satisfactory Subdivision Agreement containing provisions for -development of
the revised parking and loading spaces on Lot 1 prior to development of Lot 2
and provisions for the possible future acquisition of the access easements, by
the Town of Avon, for a public street right-of-way; 3) Detailed Site Layout,
Grading, Drainage and Landscape Plans for the site modifications to Lot 1 be
submitted to the Planning and Zoning Commission for review and approval prior
to approval of Final Plat; 4) Plans for reconstruction of Metcalf Ditch be
submitted to Aron Metro District for approval prior to approval of Final Plat.
Discussion followed.
Kumpost motioned to recommend approval of the Cunningham Subdivision to Town
Council, a replat of Tracts Q and R, Block 2, Benchmark at Beaver Creek, per
Staff recommendations.
Donaldson seconded.
Passed unanimously.
Special Review! Use - Tract Q, Block 2, B11 @ BC - Large Lot Reduction in Parking
Benchmark Shopping Center - Con't. from 11/29/84 Regular Meeting
Fogland stated that the Special Review Use is for Benchmark Shopping Center for
a reduction in parking, in accordance with Section 17.24.020 of the Avon
Municipal Code. With the revisions in the plans, it is an improvement and will
benefit the site and the Town.

Special Review Use - Tract Q, Block 2, BM @ SC - Large Lot Reduction in Parking

Blair reopened the public hearing.
Bill Pierce, representative of applicant, Vail Avon Commercial Partners stated
that they are asking for the large lot reduction so that they have an idea as to
s the potential additions that could be made to the existinC building.
Many of the items discussed in the Plat review of Tract 0 were applicable to the
Special Review Use on parking, therefore the Commission found the Special Review
Use in compliance with Section 17.20.020-B of the Municipal Code, 1-3: 1) Whether
the proposed use otherwise complies with all requirements imposed by the zoning
code; 2) Whether the proposed use is consistent with the objectives and purposes
of this zoning code and the applicable zoning district; and 3) Whether the pro-
posed use is designed to be compatible with surrounding land uses and uses in the
area.
Dingwell motioned to approve the Special Review Use for large lot parking reduction
for Tract Q, Block 2, Benchmark at Beaver Creek, and the Commission finds that
the application is in accordance with Section 17.20.020-B, 1-3, and that 12 parking
spaces are approved.
Kumpost seconded.
Dingwell amended motion to include that the Special Review Use was approved per
Section 17.24.020-8 of the Avon Municipal Code.
Kumpost amended second.
Passed unanimously.
Phase I, Lodge at Avon Subdivision (Formerly Lots 57-50, Block 2, BM @ BC)
Minor Revisions - Con't. from 11/29/84 Reular Meetin
og aF dstate that at last meeting, severs items neede clarification, such as
parking, trash enclosure, loading space, entrance and exits, and asked that a
partial color elevation be submitted. Since that time Bill Pierce, representative
of applicant, Lodge at Avon Associates met with the Town Engineer and reviewed
the egress and exits. Fogland stated that loading space is adjacent to Benchmark
Road.
Pierce stated that parking is closer to building, access has been revised to show
one wav in at the northwest of project, and one way out to the northeast of the
property. Lighting type and locations have been submitted, as well as a color
elevation. Shingle siding has been eliminated and will now use vertical siding.
Fogland stated that at the last meeting, the design review was approved, conditioned
upon the submittal of the partial color elevation and egrees, parking, loading
space, and lighting plan.
Kumpost motioned to approve the minor revisions for Phase I, Lodge at Avon
Subdivision as submitted.
Donaldson seconded.
Passed unanimously.

Tract H, Block 3, BM @ BC - Upper Eagle Valley Sanitation Treatment Plant
Addition to Existing Building - Design Review
Fogland stated that Upper Eagle Valley Sanitation District is proposing an
addition of 50' x 35' to their existing metal building, using the same materials
and colors for a covered truck area for handling sludge. The addition would be
southwest of the Municipal Building.
Dingwell motioned to approve the addition to
Treatment Plant, Tract H, Block 3, Benchmark

Planning and Zoning Commission Meeting of December 27, 1984
Landauer motioned to cancel the scheduled Planning and Zoning Commission meeting
of December 27, 1984.
Dingwell seconded.
Passed unanimously.
Other Business
Donaldson mentioned concerns of being denied his $100 per month payment for serving
on the Commission after having been to four three hour worksessions on a sub-
committee, Planning meeting and a Special meeting held at the request of the Town
Council. As a result, he has resigned from the Zoning Committee, but will attend
regular meetings and be an active Planning and Zoning Commission member without
any extra activities until he has more time to volunteer.
Fogland clarified that in a situation where the Town Council has requested a joint
meeting with the Commission, his Opinion is that it should count toward meeting
attendance and an additional $50.
Dingwell clarified that if you did not make it to a regular Commission meeting,
but did attend a Special meeting, you should be paid.
Fogland stated that he had resubmitted his memo from the November 29, 1984 meeting
on the Sign Code, specifically for review of the Sign Program.
Discussion followed on Sign Programs, and review of sign heights and sizes.
Blair mentioned that Dinowell, Landauer and Blair were present, as well as Staff,
for the Work Session held on December 13, 1984 from 3-6 PPI regarding District 1
Planning Goals and Community Wide Goals, Policies and Programs. He stated that
these documents were reviewed and discussed at length and they were adopted as
preliminary working documents so that the Commission would have something to work
with.
