The Town of Avon Planning and Zoning Commission held a worksession starting at 6:30
P M Topic of discussion was the matter of how the height of a building is to be determined
The applicants for Lot 3. Block 2, Wildridge were questioning the manner height was
determined The Commission informed the applicant that they would either have to meet the
35' requirement or apply for a height variance All Planning and Zoning Commission
members, except Patti Dixon and Buz Reynolds, were present Others present included,
Norm Wood, Town Engineer, Mary Holden, Town Planner, and C'harlette Pascuzzi,

The regular meeting of the Town of Avon Planning and Zoning Commission was called to
order by Chairman lack Henn at 7 40 PM, August 16. 1994 in the Council Chambers, Avon
Municipal Building, 400 Benchmark Road. Avon, Colorado All members, except Patti

Mary Holden stated that this is a request for an expansion of the Special Review Use Permit
for Rich's Auto Body Shop She stated that the final design review will be scheduled at the
next meeting She stated that Staff recommends approval or Resolution 94-I5, approving the
SRU
Mark Donaldson described the expansion
Chairman Hunn then opened the public hearing for citizen input With none forthcoming the
Chairman then closed the public hearing.
The Commission had no problems with the request
Henry Vest moved to approve Planning and "Zoning Commission Resolution 94-I5. A
Resolution Granting A Special Review Use To Allow An Auto Body Repair Shop On i r--
36, Block I, Benchmark At Beaver Creek Subdivision, citing the following findings an4i
conditions
FINDINGS:
A The proposed use otherwise complies with all requirements imposed by the
zoning code, and
B The proposed use is consistent with the objectives and purposes of the
Comprehensive Plan, and
C The proposed use is designed to be compatible with the surrounding land
uses and uses in the area

Lot 1 Riverside Subdivision Eaglebend IIf PUD Y tblic Hearing
Mary Holden staled that this is a PUD request She stated that the design criteria is listed out
in the Staff Report She stated that one of the recommendations of Sub -Area 10 that this
proposal is not meeting is providing public access to the river and they are not providing the
pedestrian pathway She stated that the applicant has done a good job r`oreaking up the
mass of these buildings, with the detail that they have done She stated that this proposal is
at Z 1 6 units per acre She stated that, based on the site plan given to staff, it shows a wall
building on the 30' setback She asked if the landscape plan mitigate the disturbance of the
vegetation The circulation for this site is limited to one access point by the State Highwav
Department She stated that landscaping is called for within the 10' setback She stated that
the Commission should focus on the 10' buffer and the landscape treatment which can help
soften the front facade of the building, which contain the garages She stated that the project
will all be built at once The applicant must provide from the respective agencies that there is
adequate service
Regarding Staff comments. the comment on the Eagle River, is preserving the 30' setback
from the mean annual high water line The placement of Building A should be looked at
The drainage plan has not been reviewed by Staff The landscape plan must meet minimum
Town standards The applicant is requesting that 10 guest parking spaces be waived The
dumpster location has been shown in the 10' landscape butler zone, but not indicated on any
site plans
Staff recommendation is for Commission to give consideration to the attached PUD proposal
which is included in the packet Should the Commission decide to approve this proposal,
Staff would recommend approving Resolution 94-16

Jay Harkins stated that this is a very difficult site which is very narrow and has a lot of
constraints to it in terms of the grade exchange between the highway and the actual site itself,
as far as an entrance goes He provided a model of where the buildings will be located
He stated that on the west end of the site they have plenty of room to provide some sort of
pedestrian area He then described how the embankment drops off further on the site They
prefer not to put a pedestrian path in that area
He stated that their understanding was that they had a thirty foot setback to stay out of with
the eaves, foundation. etc They have complied with that, however when you put a building
on a site, there is some site grading that has to happen, there is some spillage that has to
happen beyond that It is not realistic to look at it in any other form If there is concern they
will put a construction fence at the thirty foot line and maintain it and keep it in place They
are willing to provide some sort of financial warranty if required
Mary Holden stated that the stream setback provision does not allow for building grading to
go in there. She reviewed the code for the Commission.
Chairman Hunn then opened the Public Hearing. With no public input, Chairman Hunn then
closed the public hearing.
Commission concerns consisted of the possible encroachment into the 30' setback, and the
parking The applicant stated that they have 124 spaces
Sue Railton moved to approve Resolution 94-16, A Resolution Recommending to the Avon
Town Council Approval of a PUD Development Plan and Development Standards Related to
Lot 1, Riverside Subdivision, Town of Avon, Eagle County, Colorado, (Currently Zoned
Planned Unit Development, PUD), citing the findings and conditions
FINDINGS:
The PUD is consistent with the developmc patterns and locations set forth in the Town
of Avon Comprehensive Plan
2. The PUD is consistent with the Comprehensive Plan goals and objectives related to
the Town's role as a principal. year round residential center in the Vail Valley

3. The PUD is consistent with the Comprehensive Plan Goals and objectives related to
an appropriate mix of reside -tial dwelling units for permanent residents.
4. The PUD is consistent with the Comprehensive Plan goals and objectives related to
open space dedication along the Eagle River corridor
5. The PUD is consistent with the Comprehensive Plan goals and objectives related to
sensitivity to the natural riparian environment along the Eagle River corridor.
6. The PUD is consistent with the Comprehensive Plan goals and objectives related to
the River&ont District (Subarea 10) related to buildings capitalizing on the River,
setback from the River to preserve its natural character, limit building heights to
three or four stories. and, where possible, locate buildings and parking to preserve and
promote the health of existing quality trees.
CONDITIONS:
The PUD Guidelines and Standards described in the report (including allowed Uses,
density, site access, and development standards) be incorporated into and binding
upon the PUD zone district designation for the parcel.
2. No site disturbance (including grading or structures) be allowed within the 30'
mean high water setback.
A protective and erosion ccrtrol fence be installed along the 30' setback from the
mean annual high water prior to and during construction.
4. A pedestrian trail/pathway, consistent with the Town's Recreation Plan, be shown
on the PUD Plan along the Eagle River. The developer shall construct this pathway prior
to any temporary or permanent certificates of occupancy being issued
5. A drainage plan be submitted to Staff and approved by Staff prior to any application
for a building permit. The drainage plan must address all engineering concerns
6. The landscape plan be adequate to mitigate the removal of existing trees and
vegetation on site The landscape plan must be brought back before the Planning

Bill Sargis seconded Considerable discussion followed on adding the matter of the building
encroachment into the setback Sue Railton amended her motion to include the following
Condition number two was changed to add with the exception of the north west corner of
Building A. at a twelve foot radius on that corner, and the developer agrees to return the area
back to a condition acceptable to Staff Bill Sargis seconded the amendment and the motion
carried unanimously

Mary Holden stated that building materials and plant materials are listed in the staff repon
She stated that their concerns are basically the same as the ones for the PUD She stated that
the grading shows slopes exceeding 2 I, whic', is not allowed The landscape plants do not
meet Town minimum standards Snow storage is being called out in the thirty foot setback,
and snow storage may not be placed in that setback It must be relocated so as not to
discharge into the Eagle River The dumpster detail has not been shown The applicant must
provide permission from the Highway Department granting access Should the. Commission
approve this application. Staff recommends conditions 1 through 12 listed in the Staff Report
be included
The applicant responded favorably to all the conditions listed
Mary Holden stated that the alignment of the pedestrian path will have to he determined at a
later date She stated that the verbiage in Condition 6 commits the developer to doing it
Discussion followed on the matter of the pathway
Sue Railton asked about a playground The applicant stated that the area for that is between
buildings B &: C They would rather have continuous open space as opposed to having

barbecues and tables around the area Railton stated that she would like to see them in the
30' setback area Railton asked what will happen to school children waiting for a school bus
She stated that this should be investigated
Rhoda Schneiderman stated that she does not feel they have enough variety in trees The
applicant stated that the number of 15 deciduous trees would be split half between the
seedless ash and the cottonwood On the ornamental trees the aspens will be the minor
number and the balance to be split between the choke cherry and the wayfarer
Discussion followed on where the meters would be located The applicant stated that they
feel the better location is between the buildings, using the buildings themselves as park of the
screening, and planting shrubs along the edge of the buildi ,gs giving it a soft screen rather
than a structural screen
Chairman Hunn asked if there was any flexibility on the site to shift the middle building back
to create some variety and get away from the straight line The applicant stated that there is

followed Hunn stated that he is concerned about snow shedding The applicant stated it will

that they are proposing dry landscaping in there, gravel and rocks, etc They can put a
protective canopy in there Trim details were discussed and the color to be used The
shingles will be a 300# or greater Regarding the slopes exceeding the 2 1 slope. the
applicant stated that he needs staff to point out where that would be. as he was not aware of
that situation He stated that they could work it out
Bill Sargis moved to grant final design review approval, with the following conditions

6 The developer install the pedestrian path along the Eagle River as specified in the
Recreation Master Plan and the Comprehensive Plan prior to any certificates of
occupancy being issued
7 No site disturbance of any kind may take place in the 30' stream setback, except as noted
in Resolution 94-16
8 The developer provide to the Town of Avon, Colorado Department of Transportation
permission for the access off of Highway 6/24 prior to application for a building permit
9 A drainage plan be submitted to Staff and approved by Staff prior to application for
a building permit The drainage plan must address all engineering concerns
10 The landscape plan must be brought back before the Planning and Zoning Commission
for their review and approval. with the addition of a variety of species

Site stated that Staff has identified a couple of concerns The first is the applicant/developer
must provide streetscape improvements which includes a 4' detached concrete sidewalk.

that the middle entrance to the site is offset from an existing entrance across the street and
staff is recommending that the middle entrance line up with the existing entrance Also the
finished grades on the north side of the school aid south of the bike path are about 2 1
Existing slopes found in the park are about 3 1 and staff will be recommending and requiring
the slopes maintaining 3 1 in character with what is a!readv existing Another concern is the
joint parking area That lot is held in common with the Town of Avon and the School
District There is an area in the north west portion that shows a sidewalk and staff is asking
that it be removed and parking put back in there She stated that Staff has not had time to
analyze the drainage report, and any concerns must be addressed One concern is that they
are showing the drainage ('.owing onto the property south of them, but specifically on the
southwest side Also the type of treatment of the parking lot runoff
She stated that the landscape plan needs to meet the minimum size requirements They are
calling for a naturalized meadow and staff recommends that the area be replaced with sod , as
the rest of the area is Staff would like to know how the existing trees will be handled and if
removed, how they will be replaced The school system will have to provide their own
irrigation They may not tie into the Town irrigation system
Holden stated that there are retaining walls and fences indicated. but no information has been
provided The east elevation has a very large blank stucco wall facing the park Another
design concern is the roof form Not only is it a ditiirent kind of roof form. but it slopes into
a vallev and a potential snow buildup She stated that Staff would like for the Commission to
take a serious look at the design. Should the Commission approve this application. Staff
would recommend inclusion of Staff conditions I through 12, listed in the Staff report

The applicant discussed the streetscape and the curb and gutter. He stated that they would
do the sidewalk, but the curb and gutter is still a matter of discussion. Neither the applicant
nor the architect were near a microphone, therefore most of their comments are not clear
The applicant stated that the location of their entrance is dictated by the bus parking. If they
move it they will end up with buses out in the street He stated that they will be sloping the
area mentioned and the slopes will be greater than 3: I, but they will be replacing that with
The applicant stated that the shared parking is only 74 feet He stated that the parking lot is
60 feet and that extra area is not going to gain anymore parking and it is logical to have a
sidewalk in front oft lie parking Discussion followed on this matter
The applicant stated that the drainage plan has been submitted. He stated that they would
look at meeting the landscape minimum sizes He stated that the trees to be removed to form
the playground area will be moved to another area to conform with the landscaping

A property owner at Stonecreek, (name is not clear), asked about the screening of the trash
He felt that the trash shoula be covered on top too as it is adjacent to the neighbors Also,
make sure that they are large enough He also suggested a noise buffer at the playground
area

on the east elevation Discussion followed on the colors It was suggested that they use
something that does not have so much pink in it Discussion on the use of sodium lights- It
was agreed that the landscape plan needs to be beefed up and some sort of screening
landscape wise should be done at the play area from the neighboring buildings The dumpster
needs to be completely covered Discussion followed on the flat roof being river rock ballast
It was suggested that the lighting be directed toward the building instead of away from it

theme. Jack Hunn stated that it is primarily boxes connected and the roofs seem to be out of
character with the building. The applicant stated that this area is a valley between two
mountains and that is kind of what the building is saying. The lack of interest in the total
building was discussed Suggestions were made on how the building could be made more
interesting by detailing the building.
Rhoda Schneiderman moved to table this application to give the applicant time to consider
the Commission comments. Bill Sargis seconded and the motion carried unanimously.
Lot 16, Filing I. Eaglebend Subdivision, Duplex. Final Design Review
Mary Holden stated that the applicant has requested this item be tabled until the next
meeting Rhoda Schneiderman moved to table, Bill Sargis seconded and the motion carried

CONCEPTUAL DESIGN REVIEWS
Let 84. Block 1. Wildridge Subdivision. JM)3 Enterprises. Fourplex. Conceptual Design
Review
Mary Holden stated that this will contain three levels and stand approximately 27-1/2 feet in
height Building materials and colors are called out in the staff report A landscape plan has
not been presented The main concern is the grading plan indicates new contours in the
sewer easement and the building overhangs at the edge of the easement. The applicant will
need to provide permission from Upper Eagle Valley Sanitation District for this
encroachment Also all four elevations need to be submitted at final design review
Ray Story provided some site plans He stated that they will be talking to Upper Eagle
Valley Sanitation District about the grading issue Discussion followed on the property
needing a road to access it It is more than a driveway. It is in a utility easement which
allows the road to exist. they are proposing a hedgerow situation and snow storage along the
road and then focus the rest of the landscaping around the building, They do not plan to
overhang into the utility easement

It was suggested adding some skylights to break up the massing of the roof. It was also
suggested that they might add a dormer and a skylight. The Commission members
complimented the applicants on the variety shown in this fourplex. Discussion followed on
the large trim around the windows. The applicant stated that on one of the elevations it is
wood and on two it is stucco. Discussion followed on the colors. Discussion followed on
the trash pickup being individual pickup. Discussion followed on the parking. The applicant
stated that there are four spaces per unit. it was suggested that the landscaping be
considered further
Chairman Hunn stated that as a conceptual review no formal action will be taken at this time
MODIFICATIONS
Lot 12. Block 1. Benchmark at Beaver Creek Subdivision. Valley Wide, Color
Mary Holden provide samples of the existing colors Tom D'Agostino stated that it was a big
surprise when Mary Holden informed him that the building was the wrong color. He stated
that the general contractor ordered the building and he ordered the wrong colors. The
building came with the cNor already in the stucco and on the metal The canopy has been
done as originally approved. Considerable discussion followed on what had been approved
Henry Vest moved to approve the modification of colors as presented Bill Sargis seconded
and the motion carried with Rhoda Schneiderman and Jack Hunn voting nay
Lot 8. Block 4. Wildridge Subdivision. Simon Residence. Modificatia•!s.
Mary Holden stated that this application was tabled at the last meeting She stated that the
applicant is also submitting revised colors. She stated that the revised colors are a peach
piazza and paris dawn
Mr. Simon described the changes in the retaining walls. He stated that the walls have been
changed to dry stack, utilizing native rocks. They will be terraced. Discussion followed on
the handicapped bedroom being moved to the front of the house. Discussion followed on the
colors being too intense. The Commission urged they use more subtle, natural colors
Discussion followed on the snow shedding in front of the garage The applicant stated that

they would just have to manage it. He thinks that with the south facing view, there will not
be much of a problem.
Rhoda Schneiderman moved to approve the following modifications:
1. Retaining wall material change to a dry stack utilizing native rocks,
2. Landscape plan revisions.
3. Material change from half siding and half stucco to all stucco.
4. A revised color scheme to be brought back to the commission at a later date.
5. The landscape material meet the minimum Town of Avon standards, which include a
minimum height of 6' for coniferous trees, and 2" caliper minimum for deciduous trees
and the original 16 approved Bristle cone pines be added back into the landscape plan
6. The applicant address all engineering concerns prior to the application for a building
permit.
Bill Sargis seconded and the motion carried unanimously.
Lot 17. Block 2. Benchmark at Beaver Creek Avon Villas Color Chantte
Mary Holden stated that this applicant came in at the last meeting requesting color changes
and the green they had submitted was denied They have submitted another green color for
approval It is a muted color and will be used on the windows and casings around the doors
only.
Sue Railton moved to approve the green color as submitted. Henry Vest seconded and the
motion carried with Rhoda Schneiderman voting nay

Minutes
Rhoda Schneiderman moved to approve the August 2. 1994 minutes as submitted. Bill
Sargis seconded and the motion carried unanimously
OTHER BUSINESS
Mary Holden stated that next Tuesday August 23, 1994,at 2PM,at the Town Hall, Jen Wright
has invited the Planning and Zoning Commission and the Town Council to tour Mountain
Star. Let Bill lames know if you would like to attend
She stated that they are going to be presenting to the Commission a list of items that the
Commission mayor may not want to include in the Townwide ordinance A worksession µill
be scheduled
