PZC Minutes 070594RECORD OF PROCEEDINGS PLANNING AND ZONING COMMISSION MEETING MINUTES JULY 5, 1994 The regular meeting of the Town of Avon Planning and Zoning Commission was called to order by Chairman Jack Hunn at T30 PM, July 5, 1994 in the Council Chambers, Avon Municipal Building, 400 Benchmark Road, Avon, Colorado. All members were present Members Present. Jack Hunn, Bill Sargis, Patti Dixon, Cue Railton Rhoda Schneiderman, Buz Reynolds, Henry Vest Staff Present Norman Wood, Town Engineer Mary Holden, Town Planner, Charlette Pascuzzi, Recording Secretary c ONSENT AGENDA Henry Vest moved to approve the Consent Agenda, Sue Railton seconded and the motion carried unanimously. The items on the Consent Agenda were approved as follows Lot 47, Block 3 Wildridge Subdivision, Design Review Modifications Approved with following conditions I The main chimney stack be redesigned to a battered on the east and west sides and be brought back for Staff approval 2 The spark arrestor be concealed by a terra cotta tile chimney flue 3 All meters be placed on the building. 4. Flues, flashings and vents must have a finished surface, matching the color scheme of the structure The driveway can be less than 16 feet if approved by Town Staff and the Fire Department 6 Additional shrubbery be added to the project 7 The applicant provide the Town with a satisfactory soils report, prepared by a Soils Engineer, prior to the application of a building permit r�l 1� PLANNING AND ZONING COMMISSION MEETING MINUTES July 5, 1994 Page 2 Lot 40. Block 2. Benchmark at Beaver Creek Subdivision Fence Location Approved with the condition that the applicant respect Buck Creek and it's banks when placing the fence. Lot 63, Block 2. Benchmark at Begyer Creek Subdivision. The Seasons at Avon, Modification Approved with the following conditions. I . All modifications match the approved color theme and design styles. 2, The day care playground area design receive the Mall Committee approval and if the design changes, the design be resubmitted for Staff approval. 3. Street lights be placed on both sides of the east entrance to the. building. 4. Approved landscape plan shall include curb, gutter, sidewalk and storm drainage as shown on engineering plans for review and approval FINAL DESIGN REVIEWS Lot 72. Block I. Wildridae Subdivision, Brofos Residence. Final Design Review Mary Holden stated that this will be two levels and stand approximately 25' in height. The building and plant materials are called out in the report. She stated that their main comments are the slope of the driveway, also a construction fence be placed on the south property line due to the grading that will go up to that property line She stated that this does meet the design review criteria and Staff recommends approval with the conditions outlined in the t eport. Guy Parker, representing the applicant, responded to some of the comments made by the Commission at the previous meeting, stating that the driveway slope is about 9.5%. He stated that in order to fit within the setbacks on that slope on that lot and meet the 8% criteria is quite difficult. The current slope is about as good as they are going to get without radical fill. He stated that there ?s a relatively flat area from the garage, about 25 feet from the garage. With moving the building to conform with the front setback the driveway is now about 15 feet wider at that point and should provide a lot better maneuvering. He stated that the north elevation windows placement is quite deliberate. Final Design Review, (cont) stairwell there and the central window conforms to the height off of the stairwell landing and he does not feel it is awkward. As far as the garage door goes, with the cedar siding, it will be lighter than the color sample He understands that the irrigation system is a recommended practice, but the owner are doing everything they can to save money, and if it is not an absolute requirement they would like to not install one at this time Regarding; the cut and fill situation, they are very close to a balanced cut and fill, with approximately 100 yards of fill needing to be imported He stated that he is not sure what the concern regarding the roof pitch is Chairman Hunn asked if it was a 4 12 or less The applicant stated it is a 4 12 He stated that they did add some landscaping and specified the trees by height rather than caliper Buz Reynolds asked if the fascia lines are 1 x 6 or I x 8 The applicant stated that the fascia is rough sawn 2 x 8 Reynolds stated that he did not have anv other concerns and he thinks the project will look nice Patti Dixon stated that she thinks everything has been met except for the irrigation system and the east elevation, which she thinks some interest should be added The applicant stated that that elevation will be tucked to the inside of the hill and it is close to the side of the road bank which is quite steep there, and it is a side of the house which is going to be little seen by someone driving by. There is no way to add windows because of the entryway closet They cotrid possibly add a window to the left to the garage, but the owners didn't really want a second window there Henry Fest stated that he likes the house. but the window spacing on the north elevation , he is surprised that they couldn't move the one window The applicant stated that he did make a congruent spacing and it actually appeared somewhat face like and the owners didn't like that Vest stated that the owners have lived in Wildridge and have been concerned landscapers. So he has no problem with the lack of an irrigation system Bill Sargis stated that he thinks the house is fine and he has no problems Rhoda Schneiderman asked what kind of finish would be on the stucco The applicant stated that it will be a hand trowel texture It will not be a sand texture Rhoda Schneiderman asked about the matter of only four trees She does not think that is enough The applicant stated that the owners are planning to do more in the future, but they don't wart to do more than the can afford at the moment Schneiderman asked if the owners are aware of the watering; is strictions The applicant stated they were PLANNING AND ZONING COMMISSION MEETING MINUTES July 5, 1994 Page 4 Lot 72, Block I. Brofos Residence Final Design Review. -(cont Sue Railton stated that she thinks if they are willing to do more over the .years, as they see what grows well, but it certainly needs more trees there Four spruce are not nearly enough around a building like that The applicant stated that he could commit to the addition of another six trees Jack Hunn stated that it would be better to resolve it tonight, rather than try_ to remember a year from now that they will have to come up with some more trees The applicant stated that if the main concern is to break up the building. then he would go for firm 2" caliper or six 2" caliper aspens to be added to the landscape plan Mary Holden stated that aspens don't really do much to break up a building The applicant may want to look at low maintenance, low water shrubs that would grow up to about four or five feet in height, placed in close proximity to the building Discussion followed on what could be considered Rhoda Schneiderman moved to grant final design review approval with the following conditions I The flues, !lashings and vents be painted to match the color scheme of the building '_ The building lighting be approved by Staff prior to issuance of a building permit 3 Revegetation include native bushes 4 'Meters be placed on the building 5 The first 20' of the driveway must maintain a maximum 40 o slope and Itro for the rest of the driveway 6 Prior to any site disturbance, a construction fence he placed along the south property line of the site 7 All engineering concerns be addressed prior to issuance of a building permit S A revised landscape plan he brought back at a future date with the addition of trees or tall shrubs Henry Vest seconded and the motion carried unanimously -_1 Al 004 PLANNING AND ZONING COMMISSION MEETING MINUTES July 5, 1994 Page 5 Lot 43, Block 3. Bober Residence Final Design Review Mary Holder. stated thst this will be three levels and stand 32' in height Building and plant materials are called out in the report She stated that slopes may not exceed 2 I, landscape plan must meet the Town of Avon minimum standards, and they must satisfy any engineering concerns during the building permit process She stated that this project does meet the design review criteria and staff recommends approval with the conditions listed in the report Buz Reynolds stated that, for the record. Mr Bober is his next door neighbor and he did do his soils test for him, bw did not collect any funds Mr Bober stated that the house is a little bit after the Frank Lloyd Wright style He stated it may be a little uncommon to the area, but it still has applications to the mountain area lie stated, in response to the previous Commission comments. the overhangs are three foot, primarily to shield the house, since most of the windows are facing the east, south and the west. He stated that the deck railing will be rough sawn cedar Regarding the use of flagstone and vucco, he stated that nrimarily it is to briny some of the native materials to the house He stated that the reason that the north elevation is blank is that whole east wing is the master suite..and the north side is the closets, the shower and the toilet, and they did not feel the need to put windows there Regarding the backing and turning areas for cars, The location, of the drive is underneath the house and the reason it is down there is because the design of the house, to get a three car garage at the first level created problems design wise with the roof and the house lie thinks there is plenty room ro back the car out and maneuver back up to the driveway Regarding the banding around the house, it is to create a base of the house He stated that the landscaping is something that you i% ill add to each year He has indicated four spruces, eight aspen, eight spirea and three mugho pine to start with Ile stated that he also does not want to obstruct the views, as that was the purpose of buving that particular lot Regarding the 2 1 slope, he thought he had covered that Lie stated that it is about the flattest lot in Wildridge Sue Railton stated that as long as he beefs up the landscaping it will be alright Rhoda Schneiderman stated she thinks the house will be elegant She thinks that maybe they need more shrubs She would like to see the landscape plan come back and have everything shown on it Bill Sargis stated that he thinks the house is very different for Wildridge, but he thinks it is a very spectacular home He likes the colors a lot and thinks the house is fine PLANNING AND ZONING COMMISSION MEETING MINUTES July 5, 1994 Page 6 Lot 43. Wildridge Subdivision Bober Residence Final Design Review, (cont) Henry Vest thinks it is a great house He asked about the deck railing The applicant described how it will be done Patti Dixon stated that she thinks the house will be nice far the Wildridge area, even though it is not a mountain style She thinks the north side is fine the way it is. Buz Reynolds stated that he likes th^ home He thinks the three foot overhangs will create a nice shadow effect He asked if the stones would he the snap -ins The applicant stated that they would be Reynolds stated that he thinks that the landscaping will be fine Jack Hunn stated that he thinks this will be a nice addition to Wildridge His only concern is the quality of the asphalt roofing material. The applicant stated it would be a three tab, three dimensional shingle The sample was only for the color Hunn stated that he agrees that the house would benefit from a little more detailing in the landscaping, net necessarily more trees, but more shrubs, more variety, particularly in the area between the home and the road Ile would like to seethe landscape plan and the real roofing comeback Hunn asked what the width of the driveway was The applicant stated that it is 12 and 1/2 feet of asphalt, 14- 1/2 feet overall Rhoda Schneiderman moved to grant final design review approval, with the following conditions 1 The Flues, flashings and vents be painted to match the color scheme of the building 2 The building lighting be approved by staff prior to issuance of a building pei mit 3 Revegetation include native bushes 4 Meters be placed on the building 5 Prior to any site disturbance, a construction/erosion control fence be placed on site 6. Block 3. Wildridge Subdivision Bober Residence. Final Desmon Review. (cont) Patti Dixon seconded and the motion tamed unanimously. l,ot 24. Block 2. Wildridge Subdivision, Canton/Ray Duplex, Final Design Review Mary Holden stated that the Commission has seen this before. It will be, two levels and will stand approximately 30-1/2 feet in height. The building and plant materials are in the report. and they have not changed from the last submittal. She stated that the connection has been changed or added to A construction fence should be placed on the site prior to disturbance due to the grading frow. lot line to lot line. There is still a potential for snow shedding. Holden stated that should the Commission approve this application, Staff recommends the conditions outlined in the Staff,eport Sue Humm, representing Mike Ray and Bruce Canton, stated that regarding the architectural connection, they have added a roof enclosure The roof will have the same pitch as the other ones. It will cover both entries, however there will be a separation once you get back in behind there. One has the flight of stairs going up underneath the roof and the other one enters off about two feet above the parking level. Both will be enclosed, therefore the snow would not shed right on the doorstep. They have brought the two buildings closer together .and reduced the asphalt area She stated that there will be three narrow leaf cottonwoods and eight quaking aspens and the rest is ground cover, deciduous shrubs and evergreen shrubs. She stated that they have revised some of the windows and she described what was done, however, she moved away from the microphone and her comments are not clear She also stated that they have raised the roof on one unit which will help in the linear look of the roofs they have moved the buildings closer together. By bringing one of the buildings further up on the lot, they were able to reduce the amount of grading in back of the units and also reduced some of the height of the concrete retaining walls in the back. Buz Reynolds stated that he likes what they have done Patti Dixon stated that she thinks it is. n improvement. She asked about the dotted in windows on the northeast elevation. Ms. Humm stated that it is if some buyer wanted to add a loft up there Henry Vest stated that the roof certainly helps the connection a lot Bill Sargis asked how much they raised the roof up The applicant stated just enough to squeeze the entry of Unit A on the southeast elevation underneath it Sargis stated that be agrees that it is a much better connection. S;+e Radwri asked how the stairway went She stated that she doesn't think it is pleasing architecturally in the overall design of the thing It looks like an afterthought unfortunately Jack il:::a commended the applicant on addressing all the Commission's concerns He stated that he thinks that the connection probably works from a technical standpoint. but architecturally it does look a little forced He stated that the one conzern he has is that as ,• ou view it from the southwest you will see daylight between the soffit of the main roof and the ridge and it is going to look tacked on and if they could consider integrating the two roofs so the ridge actually does pop out of the main roof d.t would be a more successful detail Further discussion followed Discussion followed on the planting around the entrances Sue Railton stated that something is needed Discussion followed on planters being added Rhoda Schneiderman moved to grant final design review approval with the following conditions I The flues, flashings and vents be painted to match the color scheme of the building 2 Meters be placed on the buildings 3 The first 20' of the driveway must maintain a maximum 4° slope 4 Prior to any site disturbance, a construction/erosion control fence be placed on site 5 The applicant address any engineering concerns prior to the issuance ofa building permit 6 A strong suggestion that a planting bed of some sort be placed around the front entry between the building and the asphalt Bill Sargis seconded and the motion carried unanimously Since no representative was present for the review of Lot 12, Block I, Benchmark at Beaver Creek, the Commission postponed review until later A PLANNING AND ZONING COMMISSION MEETING MINUTES July 5, 1994 Page 9 CONCEPTUAL DESIGN REVIEW Lot 37. Block I. Wildridue Subdivision. Shearwood Duplex Conceptual Desi¢n Re Liew Mary Holden stated that this would be two levels and stand approximately 29-1/24 in height. No landscape plan has been submitted. The Wilding materials have been called out in the staff report. The basic standard comments are in IS report and since this is a conceptual review, Staff has no recommendation Scott Shearwood stated that they do have a site plan which reflects some of the grading concerns and some of the landscaping. He has plans in excess of twenty large trees throughout the property, around the duplex itself consitning of a crabapple, three to four inch caliper, narrow leaf cottonwoods, Colorado spruce as well as blue spruce. They are looking at an average as they come off of Longspur of 4 to 5% off of the first twenty to thirty feet and then as it approaches the building it does level r•at to almost level The snow storage will beat the west end of the driveway. There will be a gas f replace The exterior building lights are mounted at the front door and at the comers of the deck and the switches are censored The roof will be a dark brown rather than the light beige showp on the rendering. It Viii be a Presidential three tab style asphalt shingle. Disturbed soits will be revegetated with a mountain mix natural grass, Sue Railton stated that she likes the way the house hugs into the hill. She stated that she would like to see some sort of landscaping island between the two sets of garages Also, there should be really good landscaping on the other side of the asphalt since that is where the living room windows face Also, landscaping nicely up those banks by the stairs. Rhoda Schneiderman stated in general it is a nice design. She asked what kind of fireplaces The applicant stated gas. Bill Sargis stated that he thinks there is a lot of character to the design He asked what the garage doors would be The applicant stated that they would be a wood grained panel door Also they are adding a bit more stucco to the structure It is more in tune with what goes on in the side elevations and the back elevation There will be approximately four foot of stucco with a built out band. The reason is that he does not like to run the siding all the way to the ground Henry Vest stated that he thinks it is a great looking house He likes the roof forms He asked if there would be a gutter over the hip that comes over the east unit The applicant stated that actually that has been eliminated He pointed out how the ridgeline continues, so 04 PLANNING AND ZONING COMMISSION MEETING MINUTES July 5, 1994 Page 10 Lot 37, Block 1. Wildridge Subdivision, Shearwood Duplex. Conceptual Design Review. Lon" that they won't have to worry about drainage His comments are not clear, as he is away from the microphone and a train is passing at the same time. Patti Dixon stated that she had no comments. Buz Reynolds stated that when this comes back for final the landscaping needs to help this project especially in between the two units, not like the last project the applicant has done where there is no landscaping in the back Jack Hunn stated that he thinks the house lits the site well and he likes the way you are transitioning the materials, He stated that he is a little bit concerned with the image of the four garage doors lined up like that He realizes that two of them are set back, but he asked the applicant to try to disguise that a bit by having one of them being one larger door, etc. He stated that the east unit seems to be a lot less exciting in terms of capturing that view The west unit has a high arched window, a lot more volume and he suggested that they pop a minor dormer out of the hip to get the living room view up a bit so that it is more comparable to the other side without going to a full gable and a mirror image. The applicant stated he originally did have one side with the two eight foot doors and one with the sixteen, but the clients have requested that they have the two separate doors, they did not want the one large one. The reasoning for the smaller doors boils down to some structural engineering. There is a bearing header in that floor system and in trying to avoid an oversized header with the height that we have in the basement it was much easier to do a post system, rather than having to engineer an oversized header to accommodate the floor load. Jack Hunn suggested, since the east unit is stepped back, to get some balcony element to project toward the south that would partially cover and put two of those doors in shadow Hunn stated that it looks like a good deal of the roof is contributing to a drip over both entry doors The applicant stated that they will probably gutt--r that area Chairman Hunn stated that it sounds like the Commission is pretty supportive of this project and they look forward to seeing it again in the near future As a conceptual review, no action is taken at this time Chairman Hunn asked is a representative from Valley Wide had shown up Mary Holden stated they had not shown up yet Hunn then called for approval of the minutes. PLANNING AND ZONING COMMISSION MEETING MINUTES July 5, 1994 Pace I 1 Reading and Approval of the June 21, 1994 Planning and Zoning Commission Meeting Minutes Sue Railton moved to approve the June 21, 1994 minutes as submitted Rhoda Schneiderman seconded and the motion carried unanimously OTHER BUSINESS Wildridge Covenants Mary Holden stated that Town Council has deferred to the Planning and Zoning Commission the Wildridge Restrictive Covenants to be approved in Ordinance form. to codify and make that the PUD Zone District's standards As it stands now Wildridge does not have any zone district standards other than what is on the Wildridge Plat Map That, hopefully, will be coming to the Commission at the next meeting They have to check posting schedules, etc and it will be a public hearing The Commission will review it and make comments and then send it back to Town Council Discussion followed on the guidelines and the restrictive covenants Rhoda Schneiderman asked what happens when the guidelines come into direct conflict with what has been approved and is being approved on a regular basis fop the Town of Avon and for Wildridge. Mary Holden stated that they would have to comply with whatever is the final form of this ordinance Buz Reynolds stated that it doesn't make sense to make people who come in in the future, saying now you have to meet this criteria Ile stated it will take some time to do this Mary Holden stated that it will be treated as a Town initiated zone change, basically It is more of a PUD development standards Discussion followed on what is contained in the covenants Hunn stated that he thinks that the Commission should get their copies in advance of the meeting and even have a worksession so that the Commission is up to speed before the public hearing Mary Holden stated that she could get copies to the Commission this week Hunn stated that what he understands from Bill James and John Dunn is that thev don't want to modify the ordinance significantly Otherwise, it constitutes changing the covenants which :akes approval of 75% of all property owners up thele Height Interpretation Discussion Mary Holden stated that Bob Kaufmann and Michael Waste and his partner would like to talk to the Commission about building height and how it is interpreted She stated that this cannot be site specific This in concept only, they cannot refer to a specific site or plan r� PLANNING AND ZONING COMMISSION MEETING MINUTES July 5, 1994 Page 12 Height Interpretation Discussion cont She described the house shown on the steep slope guidelines, showing it stepping with the, site. She pointed out how it would meet the 35' requirement frorn the side, but not from the rear elevation. Holden stated that the definition of the building height is from existing or finished, whichever is more restrictive, 'o the highest point of the ridgeline. Considerable discussion followed on how this could happen Bob Kaufmann described how he understood it should be figured. He described how Maty has been figuring the height Bob Kaufmann stated that his ioYP wrEt:.tiuii is ihat you take a vertical line from the ridge and drop ii straight down and where that crosses existing grade or proposed grade is where the height is taken He stated that what Staff is doing is that they are not going straight down, they are going out horizontally and out horizontally and measuring that distance and he does not think that it is a fair way of doing it, Norm Wood stated that they have been figuring height according to the definition in the code which is as follows: "Building height means the distance measured vertically from the existing grade or finished grade (ei:hichrver is more restrictive) at any given point to the top of a flat roof or mansard roof or to the highest ridgeline of a sloping roof " The rest of Norm Wood's comments are not clear because Rhoda Schneiderman interrupted with comments of her own at the same time. Mary Holden stated that this was they way that they have been doing it since Steve came and they have been doing it on all four elevations, so that all four elevations meet the thirty five foot height Jack Hunn stated that basically if your slope is moving at an angle you draw a parallel line 35 feet above the slope and as long as the high portions of the building are within that it used to be considered within the height limit Considerable discussion followed on this matter, rvwever, all Commission members were speaking at the same time, therefore, not one sti tement is clear Ja:k Hunn stated that it isn't that Mary and Norm are nworrect, because they are interpreting the ck.Ae... Sue Railton stated that every town has a different way of interpreting it Hunn stated that they have wrestled with this for years and in the Nylman era they drew the parallel plane and allowed things to fit within that and within Steve's era he went a different way Hunn stated that what the Commission needs to consider is whether this interpretation stimulates more creative architectural solutions or whether Mary's version would stimulate creative solutions Bob Kaufmann stated that the vertical version would work better Mary Holden stated that if that is the way they are to interpret it great, they will get a lot of high backs of buildings that are going to exi eed the thirty five foot limit Considerable discussion followed 0 A PLANNING AND ZONING COMMISSION MEETING MINUTES July 5, 1994 Page 13 Height InteMrretat:on Discussion (cont) Mary Holden asked if what she is hearing is that on steep slopes we will only measure side elevations with a 35 foot plane' Mary Holden stated that they way that she has been measuring, every house that has come through. they have met the 35 foot height limit on all four elevations Hunn asked if there had been any problems or complaints Mary Holden replied no. Bill Sargis stated that either the Commission either choose to measure it one way or the other way, and the one way on a steep slope is too restrictive and kills creative architecture, etc. Mary Holden stated that she needs direction from the Commission of how they want the height figured More discussion followed Jack Hunn stated that if they interpret it in the less restrictive point that doesn't mean that they have to approve a shear flat building wall three stories high without any interest Mary Holden stated that these people are waiting on the Commission's decision of how they want the height interpreted before they come for final design review, and ifthat is the way vau want it interpreted then that is how she will do it It does not directly coincide with the zoning code definition Several Commission members spoke at the same time saying that it does. depending on how you choose to interpret it Mary Holden staied that this interpretation is kicking back to the Commission and from now on all she will do is start marking points on the elevations She will measure it, scale it and mark it and let the Commission decide, because at any given point she is going with the most restrictive, which is exceeding the 35 foot limit Jack Hunn stated that what they need to have her do is carefully interpret the existing grade, because that is usually the most restrictive Hunn stated that if they do go with this version, essentially you draw out the existing grade line and yov parallel that and see if the building fits within that envelope on two elevations because the grade can change from one end of the building to the other He stated that he guessed he would question whether their interpretation matters here In the past Statl'has come to the Commission and said this is how we do it and this is what we recommend Ile thinks this has been a good discussion, but he questions whether the Commission is the final authority on how this will be done He feels that they need to be consistent Nunn asked how many plans Holden had checked since she has been here Holden stated probably over a hundred Hunn stated that he is impressed that, with the exception of one or two. all of them fit based upon the more restrictive interpretation r i PLANNING AND ZONING COMMISSION MEETING MINUTES July 5, 1994 Page 14 Hei. IntetTDretation Discussion cont Rhoda Schneiderman stated that during the discussion of the steep slope guidelines they discussed how to interpret the height and they came to the conclusion that they were doing the parallel lines down from the slope of the hill on the side elevations Mary Holden stated that she never got that clarification. Several Commission members decided to try to make their comments heard at the same time and therefore. nothing is clear. Discussion followed on the steep slope guidelines. Mary Holden stated that height is not addressed in the steep slope guidelines, and she will include whatever the Commission decides to do regarding the interpretation of how to figure huildinu height Mary Holden stated that if that is how they are to do it, great, that is all she needed to know She asked if it was for steep slopes or for everyone.
