PZC Minutes 092094owk RECORD OF PROCEEDINGS PLANNING AND ZONING COMMISSION MEETING MINUTES SEPTEMBER 20, 1994 A Town of Avon Planning and Zoning Commission Worksession was scheduled for 7.00 PM to discuss a Townwide Ordinance, however only two Commission members and Town Staff were able to make the meeting, therefore the discussion was postponed The regular meeting of the Town of Avon Planning and Zoning Commission was called to order by Chairman Jack Hunn at 7 35 PM, September 20, 1994 in the Council Chambers, Avon Municipal Building, 400 Benchmark Road, Avon, Colorado. All members were present except for Sue Railton. and Bill Sargis Members Present. Jack Hunn, Henry Vest Rhoda Schneiderman, Patti Dixon. Benchmark at Beaver Creek Subdivision, Color Change 2 Lot 13, Block 1, Benchmark at Beaver Creek Subdivision, Sign 3 Approval of September 6, 1994, Planning and Zoning Commission Meeting Minutes Mary Holden described each Consent Agenda request Henry Vest moved to approve the Consent Agenda as submitted, Rhoda Schneiderman seconded and the motion carried unanimously 610 PLANNING AND ZONING COMMISSION MEETING MINUTES September 20, 1994 Page 2 PUBLIC HEARINGS Swift Gulch PUD Plan, Public Hearing Planning and Zoning Commission Resolution 94-18 Mary Holden stated that this is for re-establishment of PUD Zoning She provided pictures of the site. She stated that the criteria for the re-establishment of the PUD zone district is listed in the staff report. She stated that this proposal does comply with Goal A5 and Goal D 1 of the Comprehensive Plan. The property is in Sub -Area 16. The surrounding uses are open space, commercial and Highway 70. The Town has met with the Division of Wildlife and they have no problem with the Town's proposal. This is just for the zoning of the property There is no landscaping at this time. There is phasing proposed, but no schedule yet. The permitted uses are listed out in the report and are basically Municipal Services and related uses. The maximum building height will be 48' The minimum building setbacks are 25 feet for the front, 7-1/2 feet on the sides and 10 feet from the rear. The maximum site coverage is 501/6 and the minimum landscape area is 20%. This is in conformance with the Industrial Commercial Zone District regulations. Staffs recommendation is for approval of Resolution 94-18, approving the re-establishment of the PUD for Swift Gulch. Holden stated that Bill James and Larry Brooks were present to answer questions. Chairman Hunn then opened the public hearing for public input. With no public input, the Chairman closed the public hearing and opened it up for Commission review The Commission and applicants discussed the enclosed equipment storage area, The possibility of a partial earth structure or the berming of the site, where the buildings would be located, the underground fuel storage, the CDL area also being used as snow storage, and the gravel storage area. It was suggested that maybe a terra cotta color gravel could be used in this area Considerable discussion followed on the forty eight foot building height Buz Reynolds moved to approve Planning and Zoning Commission Resolution 94-18, A Resolution Recommending To The Avon Town Council Approval Of A PUD Development Plan And Development Standards Related To Parcels I And 2, Swift Gulch Addition, Town of Avon, Eagle County Colorado (Currently Zoned Planned Unit Development, PUD) Patti Dixon seconded and the motion carried with a four to one vote, Rhoda Schneiderman voting nay 1"1 PLANNING AND ZONING COMMISSION MEETING MINUTES September 20, 1994 Page 3 PUBLIC HEARING, (CONTI Lot 31. Block 2. Wildridge Subdivision Sideyard Setback Variance Public HearingPlannine and Zoning Commission Resolution 94-19 Mary Holden stated that this is to allow for a 1.5 foot roof overhang to extend into the sideyard setback. It is not the construction it is just the roof overhang. She stated that the applicant states that the contractor moved the pins that had bee staked by Alpine Engineering. Staff recommends approval of Resolution 94-19, approving the sideyard setback variance. Chairman Hurn then opened the public hearing. With no public input, the Chairman then closed the public hearing. Henry Vest moved to approved Planning and Zoning Commission Resolution 94-19, A Resolution Approving A Variance, From The Sideyard Setback Requirements As Stipulated In Title 17 Of The Avon Municipal Code, For Lot 31, Block 2, Wildridge Subdivision. Patti Dixon seconde.i and the motion carried unanimously Lot 14;15. Block I. Benchmark at Beaver Creek Subdivision, Above Ground Electric Service Lines a ial Review Use Public Hearing Planning and Zoning Commission Resolution 94- 20 Mary Holden stated that this request is for allowing above ground power lines to go from the power pole into the building. They are making this request Jue to the adjacent property owners denial of an easement through their property, to connect the power lines underground. The criteria is listed in the staff report. Goal 1 I of the Comprehensive plan states "Ensure that a high quality visual image of the Town is established through both public and private sector activities Object (e) states "Improve the appearance and image of the service district along Nottingham and Metcalf Roads through enhanced design, screening of activities and landscaping". Staff is recommending approval of Resolution 94-20, which basically denies the request The newer buildings that have been built along Metcalf Road have underground power lines going into their building Peter Sullivan stated that CME denied them permission to bring the lines underground. He described where the lines would be brought down from the main pole through a hollow. Chairman Hunn then opened the public hearing for public input. Public Hearing Planning and Zoning Commission Resolution 94- 20 cont David Svabik, owner of Lot 13, the lot just north of the applicant's lot stated that t.-� would be the one most impacted with the line and he stated that the way hill is they would do more damage to the vegetation in back than if they put up a pole. He stated he had no objections to this With no further public input. the Chairman closed the public hearing Considerable discussion followed on various alternatives, including the possibility of trenching in the back behind the buildings Rhoda Schneiderman moved to table this application to allow the applicant time to provide other possible alternatives Patti Dixon seconded and the motion carried unanimously Lot 3. Block 2 Wildridge Subdivision Fourplex Height Variance Public Head am, Manning and Zonine Commission ResQlutiQn 94-21 Mary Holden stated that this is a variance request for building height They are requesting a variance of 4-I!2 feet over the allowed 35 foot building height She stated that the approval criteria is in the staff report She stated that a height variance has not been granted in this area before She stated that the granting of this variance may create other proposals, thereby increasing the mass of the building and building height She stated that Staffs recommendation is for approval of Resolution 94 -21, which denies the variance request Bob Kaufmann, representing the applicant. described what they have done to bring some of the height down He described how this project would look compared to other neighboring properties. He stated that there are quite a number of examples in Wildridge that do not conform with the Curren; Staffs definition of height Chairman Hunn then opened the public hearing Terry Gamon stated that he recently bought two lots on the same street and they would not have purchased them if they had known that there would be an extreme limitation on the definition of height, because of the slope there He stated that if the restrictions are going to be that severe it will really restrict people like himself that are willing to come up here 10) PLANNING AND ZONING COMMISSION MEETING MINUTES September 20, 1994 Page 5 PUBLIC HEARINGS. Wildridge Subdivision Fourplex Height Variance Public Hearing Planning and Zoning Commission Resolution 94-21 (cont Cathy Gamon stated that the height from the street would not be objectionable. She stated that to be measuring the unit from the backside from the bottom to its top is overly restrictive, because you are dealing with a severe slope. She stated that she has no objection to this request. Chairman Hunn then closed the public hearing. Discussion followed on the matter of this lot having a double slope and the problems this causes any development. Considerable discussion followed on the location of the building on the lot and what properties would be impacted with the height variance. Discussion followed on the option of clipping the gable ends. Also discussed was the egress bedroom windows and welling them out. The applicant stated that they don't think that it would make any difference the way staff has calculated the height Commissioner Reynolds stated he thought it would help and if the height was closer to the thirty five foot height he would feel more comfortable. He stated he is just trying to give them some more options to bring the height down. Considerable discussion followed on how height of a building is figured. The Commission stated that they feel Staff is measuring each project consistently. Discussion followed on how the slope of this lot compares with the slopes of other lots in the subdivision, Rhoda Schneiderman moved to approve Resolution 94-21, denying the height variance. Patti Dixon seconded. After further discussion, Rhoda Schneiderman withdrew her motion and moved to table this item to allow the applicant to consider some of the suggested options Patti Dixon seconded and the motion carried unanimously FINAL DESIGN REVIEWS Lot 3. Block 2 Wildridge Subdivision. Fourplex. Final Design Review Since the above described height variance request for this same project was tabled, Buz Reynolds moved to table this application, Patti Dixon seconded and the motion carried unanimously PLANNING AND ZONING COMMISSION MEETING MINUTES September 20, 1994 Page 6 FINAL DESIGN REVIEWS, (CONT) Lot 30, Block 2. Wildrid@e Subdivision Single Family Residence. Final Design Review Mary Holden stated that this site is 5.76 acres with a 45% slope. The building is three levels and will stand 33' in height. She stated that the materials, colors and landscaping have been called out in the report. She stated that a revised site plan at a scale that is readable needs to be provided. She stated that the landscaping needs to meet the Town's minimum requirements. Staff would recommend approval with the conditions listed in the staff report and two additional conditions: That the site plan be resubmitted for the grading and drainage, and if substantial changes in elevations come about due to the grading plan, the elevations will come back before the Commission; and that more detail on the retaining wall that is being proposed be provided. Tom Ambrosia stated that the construction impact on the site will be very minimal Some of the engineering on the foundation work might need to be changed due to the slope of the site He stated he would like to be able to work this out with staff. Discussion followed on the garage door being the natural siding color rather than the green trim color, and the lighting on the garage needing to be a down light The applicant stated he would meet the Town requirements Discussion followed on the stone to be used, and the, color of the hand rails being a natural color Discussion followed on the siting of the building It was suggested that an automatic irrigation system be installed. Discussion followed on the windows on the south side not being more imaginative The applicant described the Floor plan of that particular area The entrance approach was discussed. Discussion followed on the landscaping addressing all sides of the house Discussion of the need for a motion detector on the outside lights followed. The applicant stated that they would be turning all lights off at night Discussion followed on the fact that the grade of the driveway not being calculated due to the lack of a proper grading plan The applicant commented on the location of the Upper Eagle Valley stub out being in a bad place and stated that he will be making some changes to the actual elevations of the driveway and where the house will sit because of this Also discussed was the maneuvering space for vehicles The amount of cut and fill was discussed Buz Reynolds moved to grant final design approval with the following conditions 1 The landscape plan be brought back to the Commission 2 The site plan be re -submitted showing grading. drainage, and utility connections, and PLANNING AND ZONING COMMISSION MEETING MINUTES September 20, 1994 Page 7 FINAL DESIGN REVIEWS. Should there be substantial changes affecting the design, the applicant must receive approval from the Planning and Zoning Commission for the changes. The retaining wall design be approved by Town Staff prior to the application for a building permit 4. Revegetation include native bushes. 5. Meters be placed on the building. 6. Prior to any site disturbance, a construction/erosion fence be placed on site Patti Dixon seconded Rhoda Schneiderman asked if Reynolds would amend his motion to include that the garage door be of a natural, cedar color Reynolds so amended his motion, Patti Dixon seconded the amendment and the motion carried unanimously. Lot 4. Wildridge Acre�bdivision, Addition of Loft. Final Design Review Mary Holden asked the Commission to table this item due to a lack of sufficient information received from the applicant. Henry Vest moved to table, Rhoda Schneiderman seconded and the motion carries: unanimously Lot 55, Block 3. Wildridge Subdivision, Single Family Residence, Final Design Review Henry Vest stepped down as a voting member of the Commission, due to a conflict of interest Mary Holden stated that this application was tabled at the last Planning and Zoning Commission meeting The lot has 25% to 40% slopes The building will contain three levels and the height varies from 31' to 37.5' The materials, colors and landscape plan are called A PLANNING AND ZONING COMMISSION MEETING MINUTES September 20, 1994 Page 8 FINAL DESIGN REVIEWS. (CONT) Lot 55, Block 3. Wildridge Subdivision Single Familv Residence Final Design Review, cont out in the staff report. the building height does not conform with the zoning code. Staff would recommend approval with the conditions outlined in the staff report and one of the conditions is that the building conform to the 35' height limit. Sam Sterling described what they had done since the last meeting to address the Commission's concerns. He stated that he thinks the height could be corrected by modifying the grade at the one corner. He stated that exterior lighting will be to code with 60 watt incandescent decorative wall sconces. The fireplace will be gas top vented sealed unit. Considerable discussion followed on the sage color and the concern that once the color is on the wood it would be more of a limey color, and also using it with the gray white stucco color. Considerable discussion followed on the matter of the applicant's statement about modifying the grade on the one corner. This still would not correct the problem as the height would be figured from the most restrictive grade. This proposal is contrary to the regulation. The applicant stated that he could lower the dormers 14 inches if necessary. .Another considerable discussion followed between Staff and the Commission members regarding the method of measuring the height of a building. The drainage of the driveway and the grade was discussed and also the maneuvering ability for vehicles. It was also suggested that a darker color be used on the base to give the perception of a heavy base and it would change the perception of the height. The applicant felt that the lower roof that covers almost the entire deck would give that shadow line. Buz Reyiolds moved to grant final design review approval with the following conditions: I The building height be lowered to conform with the maximum limit of 35' 2 The design of the boulder retaining walls be approved by Staff prior to an application for a building pennit 3. OTHER BUSINESS Mary Holden stated that the APA Conference is scheduled for next week and will be in Vail Any Commission member that would like to attend needs to let her know by tomorrow Mary Holden stated that she thinks that what they are running into more and more is not the building height, but the building massing and the Commission needs to start looking at something to start addressing the building mass. It might be some type of ratio, i e a ratio for two materials or a darker/lighter A discussion followed on what information is being handed out to an applicant. The Commission felt that the steep slope guidelines should be handed out. Norm Wood stated that hopefully within the next three months some of the forms previously used will be available again to hand out Chairman Hunn summarized the rules with regard to measuring buildings He stated that Mary is going to measure all four sides to be within a 35' height as measured parallel to the existing or proposed grade, which ever is more restrictive on lots that are less than 209/6 slope. On lots that are greater than 20% average slope she will measure only the side elevations to be within 35 feet, both sides W PLANNING AND ZONING COMMISSION MEETING MINUTES September 20, 1994 Page 10 OTHER BUSINESS, (CONT) Rhoda Schneiderman disagreed with that. Mary Holden stated that if the lot is over 200/0 it is a steep site and we will give them a break on measuring building height, but if it is less than 20% there is no reason that they cannot meet building height 3' foot limit, period. Chairman Hunn stated that they need to set this in concrete, so that it will work for every reasonable project and will give Staff direction and this problem does not come up again. on another matter, Chairman Hunn asked about the plywood siding going ;)n to the Klein project. Mary Holden stated that they are using T-111 and once that is on they are going back with the batten. Runn stated that with the plywood they will have horizontal seams that they cannot hide. The Commission has never allowed a sheet product up there, ever. It is not what was approved Chairman Hunn stated that Avon Auto Body is continuing to store old body parts, frames, etc. over the berm that is intended to hide those types of things Chairman Hunn stated that there is some new exterior lighting on an exterior sign at the condominium project immediately west of the tire store and it is a source of tremendous glare at night Chairman Hunn stated that he sees no progress on the abandoned house. Mary Holden stated that John Dunn is working on that Norm Wood stated that Terry Allen has been served with legal notices and he has so much time to respond before the next step can be taken Chairman Hunn stated he didn't think that the house that was to be repainted has been yet Rhoda Schneiderman stated that it has been repainted and it is the right color Chairman Hunn stated that there is a house on Longsun that continues to receive dirt Mary Holden stated that Steve Hodges is dealing with that.
