RECORD OF PROCEEDINGS PLANNING AND ZONING COMMISSION MEETING MINUTES OCTOBER 18, 1994 A Town of Avon Planning and Zoning Commission Worksession was scheduled for 6.30 PM to discuss a Town Wide Ordinance The regular meeting of the Town of Avon Planning and Zoning Commission was called to order by Chairman Jack .Bunn at 7 30 PM, October i8, 1994 in the Council Chambers. Avon Municipal Building, 400 Benchmark Road. Avon. Colorado .All members were present except for Buz Reynolds Members Present Jack Hunn, Henry Vest Rhoda Schneiderman, Bill Sargis, Patti Dixon, Sue Railton Staff Present Norm Wood, Acting Director of Community Development Mary Holden, Town Planner, Sheila Kremski, Recording Secretary CONSENT AGENDA The following items were scheduled on the Consent .Agenda 1 Tract C, Block I. Benchmark at Bearer Creek Subdivision Propane Tank 4 Approval of October 4. 1994, Planning and Zoning Commission Meeting Minutes Mary Holden described each Consent Agenda request Jack Hunn requested that the Commission discuss in detail later in meeting Tract C. Wildridee Subdivision, Front Setback Variance Planningand Zoni�t; Commission Resolution 94-24 Public Hearin Mary Holden addressed the letter requesting a withdrawal of the application therefore, recommending approval of the Resolution 94-24 which denied the front vard setback Staff recommendation is for denial of this request Neighbors east of Lot 86, Block 4, Wildridge Subdivision, expressed concern Staff explained the two fold reason for denial first was the lack of sufficient information for staff review and second the applicant is not following through with project Chairman Hunn then belatedly opened the public hearing Without anymore public input he then closed the public hearing Henry Vest moved to approve Resolution 94-24. A Resolution Denying A Variance for a front yard setback. For Lot 86, Block 4, Wildridge, Subdivision, citing the findings as follows A That the granting of the variance will constitute a grant of special privilege inconsistent with the limitations on other properties in the vicinity B That the granting of the variance will be detrimental to the public health. safley. or welfare. or materially injurious to properties or improvements in the vicinity C That the variance is not warranted for one or more of the following reasons iii The strict of 'neral interpretation and enforcement of the specified regulation would not deprive the applicant of privileges enjoyed by the owners of other preperties in the vicinity Bill Sargis seconded and the motion carried unanimously Lot I. Public Hearing (Con 't) included is a letter from Janet Williamson protesting the SRU The staff recommends approval for a SRU a home occupation for Unit #103, Building K. Sunridge Phase 11, Lot I, Block 3, Benchmark at Beaver Creek Applicant John Putnam added that his business would have a low impact only involving contact with customers over the phone or by mail, therefore. no customers coming to the home Chairman Jack Hunn opened the pubic hearing Brad Sunkin, a member of the Board of Directors at Sunridge, attended on behalf of the Sunridge members to fully understand what the applicant was requesting John Cardinolli, also on the Board of Directors at Sunridge, requested that the Commission table item until the Sunridge Board of Directors meet to discuss and approve Chairman Hunn closed public hearing Bill Sargis clarified that condominium associations are not controlled by the Town of Avon nor does the condominium association located within the Town control the permitting process within the Town of Avon Concluding that the Town can approve the permit but it is also up to the applicant to have approval for the condominium association Jack Hunn recommended that permit approval be done by specific conditions Rhoda Schneiderman moved to approve home occupation special review for Lot I, Block 3, Benchmark at Beaver Creek. Home Occupation Special Review Use, Planning and Zonine Commission Resolution 94-23, Public Hearin Con.'t C The proposed use is designed to be compatible with the surrounding land uses and uses in the area Bill Sargis seconded motion General discussion to allow two year limit on permit. Rhoda Schneiderman amended the motion to include the home occupation code as specified in the Resolution.Bill Sargis seconded the revision with Sue Railton voting nay Motion carried Lot I. Block 2 Benchmark at Beaver Creek Subdivision, The Aspens Mobile Home Park, Special Review Use. Planning and 'Zoning Commission Resolution 94-22, Public Hearin¢ Mary Holden discussed a special review use for the creation of standards for the placement of a new mobile home going into park Presently it is an existing non -conforming use and exempt from the mobile home provisions or codes however, they are upgrading their standards but will still be non -conforming Therefore thev are required a special review use for their standards The standards and criteria are listed in staff report Staff recommends approval Mary Jo Gelser, represented management for the mobile home park She discussed the recent upgrades and improvements to the mobile home park Chairman Hunn opened public hearing No public input Public meeting closed Henry Vest moved to approve Lot I. Sindlinger Landscape Plan Mary Holden suggested the condition of approval of the applicants original design and review approval The applicant had derived at a landscape plan Plant material list is in staff report Staff recommends approval with a strong suggestion that irrigation be added Mr Sindlinger agrees and stated irrigation is needed Rhoda Schneiderman commented that the first spruce needs to be G fl and suggested an above ground drip system with a single hose as a more economical alternative Jack Hunn discussed the east side of the garage. a native area. and suggested planting sonic sage or other indigenous shrubs Sue Railton moved to approve Lot 58, Block 1. Sindlinger Landscape Plan, with the staff recommendation that irrigation be added Seconded by Patti Dixon Motion unanimously carried Tract N Block 3 Benchmark at Beaver Creek Subdivision. Roof Change Mary Holden stated that the applicant, Upper Eagle Valley, requested to change out a half cedar shake haW metal roof and replace the cedar shake portion with etched galvanized metal Staff recommends approval with the condition that the entire roof either receive an acid wast treatment or that it all be etched Applicant not present Sue Railton discussed concern over the glare on the present metal portion and the effect of the acid wash lack Hunn stated that the acid wash does not efTect the roofs durability PLANTING AND ZONING COMMISSION MEETING MINUTES October 18, 1994 Page 6 Tract N. Benchmark at Beaver Creek Subdivision, Roof Change until applicant has produced sample of the metal Seconded by Rhoda Schneiderman Motion unanimously passed Lot 8. Block 4 Wildridge Subdivision Simon Residence, Color Change Mary Holden stated that the applicants are requesting a change in the original peach colors to poetic peach and palladin peach Also changes to the elevations and optional garage from the original plans that never were approved through the design review process The applicant. M Simon, apologized for not submitting side elevations He also explained having the option of a garage where the original plans had a carport The Commission began discussion with color approval Overall members were pleased with the new choice of the muted peach colors however were concerned with the application in what proportions The white color on the columns and the garage doors need to be clarilied as to which shade of white and a sample submitted to staff and Planning and Zoning Chairman Hunn recommended the applicants add color pencil to elevations on paper to exactly where colors will be applied also submit sample colors of stucco The commission also discussed the applicants change in elevations The commission recommended height calculations be done by staff before a decision is made Jack Hunn suggested dealing architecturally with the images on the elevations of which the commission had no objections Henry Vest motioned to approve Design and Review Modification Color on Lot 8, Block 4 Wildridge Subdivision, Simon Residence with the following conditions I )present color rendering to staff to add to a consent agenda 2)provide physical samples of the shades of white stucco colors to staff so commission can view, and 3) all proposed changes architecturally are subject to staffchecking the height of the building which includes the height of the third garage PLANNING AND ZONING COMMISSION MEETING MINUTES October 18, 1994 Page 7 Lot 8, Block 4. Block 2 Benchmark at Beaver Creek Subdivision, The Seasons, Roof Top Mechanical Equipment Mary Holden stated applicants applied to replace rooftop mechanical equipment on north side of the building facing the parking lot, plaza, and the mall area The equipment is a ventilator for the kitchen and a heating unit to provide air separate from the kitchen The two units will be painted to match the surrounding colors to blend in The original mass has been reduced Staff recommends approval with the condition that the units be painted to match the surrounding background colors to blend in Applicants, Sheila Peterson and Rob Galvin, added their business will not be rrying foods so hopefully their will not be many odors Only open for breakfast and lunch Sue Railton motioned to give Final Design Approval/Modifications of Lot 63, Block 2. Benchmark at Beaver Creek Subdivision, The Seasons, Roof'Top Mechanical Equipment and the staffs recommendation of the condition that the units be painted to match the surrounding background colors to blend in Rhoda Schneiderman seconded Motion carried unanimously Lot 14/15, Block I. Benchmark at Beaver Creek Subdivision. T l Conner. Site Modification_ Mary Holden stated the applicant requested a site modification of a retaining wall surface treatment Certain retaining walls on site will just receive a painted surface and others will require a stucco surface Major discrepancies were in the application in what was approved for the building permit application and what was given to the staff presently and the preliminary condominium plat Those discrepancies are listed in the staff report The stat' recommends approval of the retaining wall surface treatment and nothing else Norm Wood will discuss the discrepancies in the site plan Norm Wood referred to the site plans in the Commissioners packets When the revised plan was submitted it had a number of revisions none of which were submitted for approval Also grade measurements changing from 8% to 40�', to 12% or more on driveways A double retaining wall had been replaced with a single 16 ft retaining wall Drainage patterns had been changed on the side significantly Trash closure locations have disappeared from previous site plan These changes promoted a revision by staff Major concerns can be addressed in later P&Z meetings with one exception for a revision for this evening to deal �� PLANNING AND ZONING COMMISSION MEETING MINUTES October 18, 1994 Page 8 Lot 14/15. Site Modification con 't with replacement of the retaining wall between the two parking lots from a double wall to a single wall Staff recommendation is to approve surface treatment for a retaining wall and deny other design changes but provide information with regard to changes in one wall between the two parking lot levels and put a strong stipulation that the plans be submitted in one week for presentation at the next P&Z meeting and if no acceptable plans are at the next meeting that all permits will be revoked until issues resolved Applicant, David Howell, is President of National Construction and represents project Regarding to the retaining wall he explained a decision was made on one of the retaining walls on back of the building without going through P&Z The retaining wall is in the back of the building and separates a higher parking lot tion, the lower parking lot The job engineers failed to submit changes and get approval He would prefer, with permission, to leave the wall and put up a guard rail Which needs to be resolved before the next meeting Please allow the retaining wall since its effecting the progress of the job Rhoda Schneiderman commented that the project be returned to its original plans and the stucco treatment be finished on the large curves on both sides of building, and there be a finished stucco treatment on the concrete walls Jack Hunn pointed out the gain of two parking spaces with the change from the original pians He suggested the following information needed I )an update on the transformer placement area. _)suggested deferring the stucco issue until staff and P&Z. has more time to review, 3)Grades of the driving lane particularly where the large vehicles are hacking in and out of the loading bays Many of these elements were carefully considered in the originally approved plans and hopefully not many more will be compromised Bill Sargis motion to approve Lot 14/15, Block I. Patti Dixon seconded Motion unanimously passed Lot 38B. Block2. Wildridge Schneiderman Residence Color ChangeDesign Review Rhoda Schneiderman requested to step down from P&Z Commission for next item Mary Holden presented Rhoda Schneiderman's late application to repaint her garage doors to match the existing house Applicant presented color sample to Commission for approval Bill Sargis motioned to approve Lot 38B. Block 2. Wildridge, Schneiderman Residence. Color Change, Design Review Sue Railton seconded. Motion unanimously approved Rhoda Schneiderman returned as a voting member of the Commission Jack Hunn expressed concern over the Columbine moving and storage sign on one of the warehouse buildings at the comer of Nottingham Road and Medcalf Road It was decided previously that the sign could not be lit -up at night but could be left on display during the day Also the dirt situation located at Block ,t 28 Staff reassured that someone was taking care of it Staff was recommended to i,.w Norm Wood announced that Charlette Pascuzzi is officially retiring on December 15, 1994 The P&Z Commission expressed their thanks to Charlette Pascuzzi for a job very well done With no further business the meeting was adjourned at 9 30 PM r.2.
