PZC Minutes 120694111 RECORD OF PROCEEDINGS PLANNING AND ZONING COMMISSION MEETING MINUTES December 06, 1994 The regular meeting of the Town of Avon Planning and Zoning Commission was called to order by Chairman Jack Hunn at 7:30 PM, December 06, 1994 in the Council Chambers, Avon Municipal Building, 400 Benchmark Road, Avon, Colorado. All members present except for Patti Dixon. Members Present: Jack Hunn, Henry Vest, Rhoda Schneiderman, Bill Sargis, Sue Railton, Buzz Reynolds. Staff Present: Norm Wood, Acting Director of Community Development, Mary Holden, Town Planner, Sheila Kremski, Recording Secretary CONSENT AGENDA The following items were scheduled on the Consent Agenda: 1. Lot 63, Block 2, Benchmark at Beaver Creek Subdivision, Season Modification. 2. Lot 7, Block 1, Benchmark at Beaver Creek Subdivision, ReRoof and Berm Addition. 3. Lot 86, Block 1, Wildridge Subdivision, Draw Spur Association Sign. 4. Lot 73/74, Block 2, Benchmark at Beaver Creek Subdivision, Ski Shop. 5. Approval of November 15, 1994, Planning and Zoning Commission Meeting Minutes. Mary Holden described the Consent Agenda and requested to remove item #4, Lot 73/74, Block 2, Benchmark at Beaver Creek Subdivision, Ski Shop, to discuss in more detail under Other Business. Sue Railton moved to approve the December 06, 1994 Consent Agenda with staff recommendation to place item #4 placed under Other Business. Rhoda Schneiderman seconded, and the motion carried unanimously. PLANNING AND ZONING COMMISSION MEETING MINUTES December 06, 1994 PUBLIC HEARINGS Lot 12, Block 1. Benchmark at Beaver Creek Subdivision. SRU for Residential Unit, Resolution 94-32, Public Hearing, Mary Holden stated the applicant is requesting approval of a residential unit, at Valley Wide, for his building. The zoning allows for this type of use, however, the condition of the area does not meet the Zoning Code nor does it meet the Uniform Building Code. Staff recommends staff adopt Resolution 94-32 with the conditions stated in the resolution. No applicant present. Chairman Hunn opened the public hearing. No comment. Public hearing closed. Henry Vest motioned to approve Lot 12, Block 1, Benchmark at Beaver Creek Subdivision, SRU for Residential Unit, Resolution 94-32, Public Hearing, with the following findings and conditions: FINDINGS: A. The proposed use must comply with all requirements imposed by the Zoning or Uniform Building Code; B. The proposed use is consistent with the objectives and purposes of the comprehensive plan, and C. The proposed use is designed to be compatible with the surrounding land uses and uses in the area. CONDITIONS: No person may occupy the basement area until it complies with all applicable codes. The a;^nlicant must submit construction plans for converting the storage area into a residential unit for Town review, approval and issuance of a building permit. These plans must be submitted to the Town of Avon within 30 days of the Special Review Use approval. Construction plans for the addition of the bathroom must be submitted to the Town within seven working days from the date of this approval for review, approval and issuance of a building permit Seconded by Bill Sargis. Motion unanimously passed. PLANNING ARID ZONING COMMISSION MEETINTES December 06, 1994 I_ot 14/15, Block 1. Benchmark at Beaver Creek Subdivision. Height Variance, Vesolution 94-30, Public Hearing. Mary Holden addressed the letters for and against the project. A building height variance was granted for this project on July 6, 1993, to exceed the maximum height of 48' for the IC Zone District by 4'. The plans submitted for the Commission's review did not reflect the ridge line of the building, which makes the building 54' high. The applicant has submitted an application requesting approval of a variance to exceed the established building height of 52' by two feet for total building height of 54'. Staff recommendation is for adoption of Resolution 94-30 that approves the requested variance to the existing building height variance. Mark Donaldson was present representing the applicant. Mark explained the difficulties of the project from the start including discrepancies in the architectural drawings. He wanted to clarify that the added height was not for another story on the building. Chairman Hunn opened the public hearing and also addressed the letters commenting on the variance. No comments. Public hearing closed. Bill Sargis moved to approve Lot 14/15, Block 1, Benchmark at Beaver Creek Subdivision, Height Variance, Resolution 94-30, P, blic Hearing with the following findings' FINDINGS: A. That the granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties in the vicinity. B That the granting of the variance will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity C That the variance is warranted for the following reason i. The strict or literal interpretation and enforcement of the regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of this title, Seconded by Henry Vest, the motion unanimously passes Lot 14/15, Block I. Benchmark at Beaver Creek Subdivision, Parking Variance, Resolution 94-31. Public Hearing Mary Holden stated a parking variance was granted for this project on July 6, 1993, to reduce the required number of parking spaces by fourteen creating a requirement of 58 spaces. The fourteen space reduction was applied to the mini -storage and not the industrial use. Approval of the variance was based on 28,800 square feet of mini -storage J PLANNING AND ZONING COMMISSION MEETIN(r MINUTES December 06, 1994 14/15, Block. The applicant has requested approval of a variance to the parking requirements. Additional industrial use square footage is being proposed through the addition of mezzanine levels. The mezzanine levels will be added in the first and second floors. The applicant is proposing to increase the square footage of the industrial use, decrease the square footage of the mini -warehouse and reduce the number of required parking spaces Staff recommendation is for adoption of Resolution 94-31 that denies the requested parking variance. Mark Donaldson was present on behalf of the applicant. Mark expressed the importance of this project to move ahead. He understands the difficulties and the projects past complications and this is why he is presently involved. Since the spaces are for mini - storage and warehouse use the parking will be minimal. Chairman Hunn opened the public hearing Robert Barr is representing a prospective tenant for the warehouse He stated that the use of this building will not constitute a parking problem if parking spaces are allocated No more comments, public hearing closed Letters regarding the parking variance were addressed Rhoda Schneiderman moved to approved Lot 14/15, Block 1, Benchmark at Beaver Creek Subdivision, Parking Variance, Resolution 31-94, Public Hearing, which denies the requested parking variance Buzz Reynolds seconded A tie vote 3 in favor of motion Rhoda Schneiderman, Buzz Reynolds, and Jack Hunn 3 in opposition Sue Railton, I ienry Vt st, and Bill Sargis Since a tie occurred, no action was taken and the motion was lost Bill Sargis moved to approve the Parking Variance tequest for Lot 14/15, Block I. Benchmark at Beaver Creek Subdi3i5ion. Recycle Shed. Mary Holden stated the applicant is requesting approval of a shed to replace the existing recycle containers on the southwest corner of the City Market parking lot. Staff recommends the Commission approve the application with the conditions the shed be • painted to match the main structure and the site be kept clean and free of trash and debris. The applicant agreed with Mary Holden's presentation. Rhoda Schneiderman motioned to approve Lot 67, Block 2, Benchmark at Beaver Creek Subdivision, Recycle Shed with a strong suggestion that an alternative site on the southeast corner of the City Market Parking lot be found and with the following conditions 1 The shed be painted to match the main structure 2 The site be kept clean and free of trash and debris. Seconded by Bill Sargis, motion unanimously carries. Buzz Reynolds steps down from the Commission due to a personal interest in the following item Lot 43. Block 3 Wildridgg Subdivision Fuel jank Storage Mary Holden stated the applicant, Buz Reynolds, Jr. has submitted an application requesting approval for placement of a 300 gallon diesel fuel tank for 6 months on the lot Staff recommends approval with the conditions listed in the staff report No applicant present Rhoda Schneiderman moved to approve Lot 43, Block 3, Wildridge Subdivision, Fuel Tank Storage, with the following conditions The applicant address Fire Department concerns which is that the tank be level The fuel storage tank be fully screened The fuel storage tank be removed within six months from the date of approval Location for the temporary fuel tank is screened naturally from view and future applications be screened with the same criteria 10 PLANNING AND ZONING COMMISSION MEETING, MINUTES December 06, 1994 Lot 43, Block 3 Wildridge Subdivision, Fuel Tank Storage (Coni) Seconded by Sue Railton, motion unanimously carries. Buzz Reynolds rejoins the Commission. Lot 3, Block 3_ Benchmark at Beaver Creek Subdivision, Exhaust Fans. Mary Holden stated the applicant, The Landing Restaurant, requested approval for the placement of two exhaust fans on the roof of the Westgate building. The applicant had presented two options for the placement. The first location was on the northeast portion of the roof. In this location, the fans are only visible from the north side of the building, which is Sunridge. The second option was to place the fans in the domed area of the roof. This location would make the fans visible from all points since they would be raised about 1 foot above the domed area. In either location, the fans will be painted to match the roof color. Staff recommends approval citing the option one location. Applicants present. Applicants prefer the location at the northeast portion of the roof. Members of Sunridge were present for comment. The concem was with the smell the vents might give off. The applicant assured them that the vents will force the air up and will not leave the area with an order. Sue Railton motioned to approve Lot 3, Block 3, Benchmark at Beaver Creek Subdivision, Exhaust Fans located on the northeast portion of the roof. Seconded by Rhoda Schneiderman. Motion unanimously carries. Lot 3 Block 3. Benchmark at Beaver Creek Subdivision, Sienaee. Mary Holden stated the Westgate received approval of their Master Sign Program on October 4, 1994. The Master Sign Program specified approximately 183 square feet of sign area for the entire building, including the freestanding sign. Unit 105 was assigned 30 square feet placed on the eastern end of the building, The Landing restaurant is requesting to modify the Master Sign Program by adding one, 30 square foot sign, to be placed in the same area. Staff recommends approval with the condition the added sign comply with all provisions of the existing Master Sign Program. Applicant present Larry Ast explained the necessity for a sign on each end of the building, that being someone driving by the building can see the signage coming from either direction PLANNING AND ZONING COMMISSION MEETINu MINUTES December 06, 1994 Lot 3, Block 3. Benchmark at Beaver Creek Subdivision, Signaee.(Con.'t) Bill Sargis moved to approve Lot 3, Block 3, Benchmark at Beaver Creek Subdivision, Signage with the following conditions: 1. The added sign comply with all provisions of the existing Master Sign Program, 2. The illumination from the signs lights are not a nuisance to the surrounding residences and will come to staff for review if a nuisance. Seconded by Henry Vest. Motion carnes. All approve motion except for Rhoda Schneiderman voted nay. OTHER BUSINESS Lot 73/74, Block 2. Benchmark at Beaver Creek Subdivision, Ski Shoo. This item was pulled from ,he consent agenda to better discuss. Mary Holden stated the applicant is requesting approval to allow the operation of a ski shop at the Comfort Inn for the use of Comfort Inn guests. Comfort Inn has given their approval for this use. There is adequate parking for the use to occur on site. Staff recommends the commission approve with the condition that no sign be allowed for this use since it is for guests of Comfort Inn. Applicant Bill Young was present. He expressed the shop was necessary for the Comfort Inn so the guest have an area to place their ski equipment while not in use. Bill Sargis moved to approve Lot 73/74, Block 2, Benchmark at Beaver Creek Subdivision, Ski Shop with the following condition: 1. The sign be on from the hours of 8 AM and 1 I PM. Seconded by Rhoda Schneiderman. Motion unanimously carries. With no further business the meeting was adjourned at 10:30 P.M.
