PLANNING AND ZONING COMMISSION MEETING MINUTES
January 4, 1994
A Planniag and Zoning Commission Worksession was held at 6:00 P.M. Primary discussion was
focused on steep slope lots in Wildridge and the need to set some guidelines for considering
development on these lots. After considerable discussion, Steve Amsbaugh stated he would take the
Commission's suggestions and work up more detailed guidelines and he would have that ready by the
next worksession meeting of January 18th.
The regular meeting of the Planning and Zoning Commission was held on January 4, 1994, at 7:30
P.M. in the Town Council Chambers, Avon Town Municipal isuilding, 400 Benchmark Road, Avon,
Colorado. The meeting was called to order by Chairman John Perkins.

All members were present at the worksession except Henry Vest and Sue Railton. Henry Vest arrived
at 7:30 PM, in time for the regular meeting.
Nottingham Station, PUD Conceptual Zoning Review
Mary Holden stated that this property was annexed in 1981 and was designated with a SPA zoning.
The zoning was never completed as no development plan was brought forth. The applicants are
requesting conceptual review for completion of the PUD zoning. She stated that the plan that you

have in your packet has been revised since you received it. Basically, they have e5minated all the
commercial and added additional residential units. She stated that Staff has not bean able to review
the plan. She stated that she will touch on the planning issues that Staff has identified. The first one
deals with traffic/circulation. Hurd Lane is the first issue. In the Transportation iv;asier Plan it does
show that Hurd Lane connects all the way through to Eaglebend. Also, for Hurd Lane, the fight -of -
way should be dedicated. Other issues are the bus service for this development, the intersections
within the development, and the length of the cul-de-sac. Holden also commend=d the applicant for
the dedication of a bike path along the entire length.
She stated that another area that they have identified are ea;-,nPn!s She stated that they would like
the applicant to show the existing easement, those that are recorded and may not be reflected, on the
plat, and all proposed easements. Also the applicant needs to provide permission from Oje railroad
and from the Avon Metropolitan District. They are showing parking in the railroad right-of-way and
they will be relocating Metcalf Ditch.
Another area is the flood plain. A detailed definition and description of the flood plain is needed.
Also, a wetland report and delineation is needed. Also, they need to provide, within that wetland,
species and location of all vegetation.
Another issue is how the utilities will be brought to the buildings. This needs to be indicated on the
plans.
Miscellaneous issues are: Show all existing structures. There may be historic structures on this site
and Staff is asking the applicant to verify what is historic or is not. Staff would also like all vegetation
shown for the entire lot and the species. Also, the Town will be requesting open space dedication
along the Eagle River.
Steve Amsbaugh stated that this will be coming back to the Commission as a PUD Zoning application.
What the applicants wants is comments from the Commission to help them more adequately submit a
real application. They have not submitted a formal application at this time. When it come to the
Commission it will be a public hearing process to complete the PUD Zoning for this property.
Mark Donaldson, representing Southwest Limited, stated that he would like to thank Mary and Steve
for all their pre -application time, and research and information that they have provided.

Donaldson stated that they are dealing with Lot 3 of Nottingham Station. What they are proposing is
purely a residential development. They are presenting a great diversity of housing types. The
challenges began with the length and the shallowness of the development area of the site. The
adjacent difficulties consists of the railroad track, the back of Wal-Mart, the back of the Slifer building,
and the back of City Market, etc. They have intentionally buffered the north side of the property with
condominium buildings which will have parking concealed around the backs of the buildings, a large
portion of it in car port style and the rest open parking. What they are presenting to the Hurd Lane
streetscape, the south elevation of the condominium buildings which will be a mixture of ones, twos,
and threes, with square footages ranging from 600/700 square feet to around 1500 square feet. They
are presenting a completed streetscape of architectural treatments that will be compatible with the
townhome design on the south side of the extension of Hurd Lane. The idea is that they are sheltering
the parking, and providing the type of housing for rental and sale, that has a nice mix to it, and those
buildings, being three story in nature will knock down a lot of the noise for the townhome
development, which will provide a much more quiet site environment for the townhomes along the
riverside. There are a few interior townhome units which will be accessed along a common interior
private road. Hurd Lane will be a dedicated right-of-way for the Town street to connect to the
Eaglebend property and all the way back to Avon Road. It will be designed and built to Town
Standards per Title 16 and the Town Engineer as fa: ,.s all intersections, bus stops, curb and gutter
design, etc. The townhome units will range from two to four bedroom units in size from 1200 to
around 2000 square feet. They are studying different floor plan types and architectural treatments.
Generally speaking, the architectural character is evolving into a western Colorado style. More detail
will be provided at the next meeting.
What they are proposing is the zoning statistics. In a PUD they usually work with the Town to write
the rules and to create the zone district requirements. In doing so they have reflected off of similar
zone districts, such as Town Center, High Density Residential, etc., to make sure that they are not
exceeding any of the normal development standards for this type of product. the site area is in excess
of twelve acres, but when you subtract the flood plain area, up to the 30 foot setback from the high
water mark, they are left with 9.2 acres. They will be focusing on that smaller reduced figure for the
calculations. The open space on this proposal is one third of that acreage, which is greater than the
normal 20% requirement. The building footprints constitute 27% and the asphalt is about 39%. The
have a total parking requirement of 436 cars with this mixture oftownhomes and condominium units.
They have taken each individual building, standing alone, to accumulate the aggregate requirement of
guest parking spaces. They are not taking any large lot reductions, etc. Out of 436 spaces they have
183, covered with either garages or car ports. The remainder are open parking spaces. They are
proposing no wood burning devices, they will all be gas fireplaces. They are making accommodations
throughout the site for access to the river. They are providing a mass transportation link that will

allow the Town's type two access to be completed along Hurd Lane to access the Stonebridge and
Eaglebend development. The easterly flag shown on the plan was platted previously and is designated
to be an emergency vehicle access and mass transit access. They do not intend for it to be daily traffic.
They are not proposing that they connect to other developments. That allows them to continue the
linear design without destroying the site with large cul-de-sac turnarounds for fire trucks, etc. The
size, length and height of the individual residential structures allow for easy staging of fire fighting
equipment. They are planning an open space dedication of the 4.698 acres along the Eagle River,
which takes them right up to the 30 foot setback. They have studied the bike path and they are going
to propose is that the bike path be constructed to Town standards, along the Hurd Lane right-of-way
with access points down to the river. There is a topography issue from the building plain up high
down to the river, as far as being able to maneuver and access on a bicycle. They feel that at this time
a logical bike path development could be more safely handled to connect and go through their
property in a continuous fashion on the Hurd Lane right -of --way dedication. They are open to
suggestions on that.
Regarding the Staff comments, Some good questions have been raised. They feel that there is nothing
that is visible to tham that would prevent this development from going forward. They have density
proposal of 13.6 units per acre. If you take out the dedicated open space, it becomes 20.63 units per
acre. Regarding the traffic and circulation, they do intend to dedicate the Hurd Lane improvements
and 50 foot right-of-way, which includes 24 feet of asphalt, curb and gutter sections on both sides,
four foot of green between the back of Hurd and the edge of sidewalk and bike path on each side of
the Hurd Lane right-of-way and all the in between spaces would be green and landscaped. They
would be providing the site lighting, signage, street furniture, such as benches and trash receptacles.
They have a bus stop planned in the center of the site. They would like for the bus to be able to stop
in either direction around the center of their own density. They will coordinate: the specific
engineering requirements for that with the Town Engineer. Jeff Spanel has been retained to provide
civil engineering work, phase I environmental analysis, as well as site assessment, utilities, flood plain
analysis, and delineation of wetland areas, etc.
Regarding the easements mentioned, the title reports, existing surveys, plat notes, etc. give them the
information they need. They have identified all the issues with the railroad, and are obtaining
permission for that odd out parcel. There are no buildings in it, just paving and parking. They have a
signed agreement from the ,Avon Metropolitan District for the relocation of Metcalf Ditch, to the
District's engineering standards. Most of it will be buried. The surface drainage will not be able to get
into it.
The updated survey information will clearly delineate and describe the 100 year flood plain,

the wetland delineation report, and all vegetation on the site will be identified. They will be showing
the utility distribution plan to each and every building. There are existing water and sewer lines on the
site and they are evaluating the size and capacity of them. There are two empty foundations on the
site, and they do not know what was on them, but they will research shat out. There are two small
structures nestled into the cottonwoods. One is an old coal shelter used by the railroad years ago. It
is on skids and is movable. The other building is some kind of vehicle shelter of some sort that has
been propped up over the years and is just about to blow over and they feel there is no historical
nature in that building. The most interesting structure lies down in the river area. They have learned
that it was the generator house for some of the first electricity provided to the valf :y. There is a
waterwheel that is stored in another area down there. That land area would be part of the open space
dedication to the Town of Avon. How that restoration takes place and what becomes of it, remains to
be seen and he would like to have the Commission's input on it.
Patti Dixon asked where it is located. Donaldson pointed it out on the plans and also where the
generator station is located.
Steve Amsbaugh asked what the total units would be. Donaldson replied 190, no office or retail,
purely residential for rental or for sale, short term or long term.
Buz Reynolds stated that he thought in the Master Plan Hurd Lane was supposed to go through and
be able to be used by all, but it sounds like just emergency vehicles and mass transit is what they are
proposing. Jeff Spanel stated that the Master Transportation Plan does call for that link long term.
He stated that they will be doing a traffic study to analyze that and determine if it will be necessary.
He stated that there is a link that is missing. The road right-of-way goes to Doll's property and there is
a gap from there and Eaglebend. Donaldson stated that the nature of their development, purely
residential, that they want to contain and be able to understand and design and understand their own
internal traffic flows and be able to retain the character of their site.
John Perkins stated that he thinks it would be beneficial to the Town and everyone involved.
Donaldson stated that the adjacent project to the east was planned and approved as a stand alone
project in terms of it's own access and internal circulation. He would agree that there could possibly
be some overall Town benefits, but what they have to protect is the integrity of this particular
development site. They definitely want to provide the access for the emergency services and they
certainly want the linkage to the mass transportation. Beyond that the issues become smaller.
Reynolds asked if the right-of-way is big enough for bicycle footprint and traffic. Donaldson stated
that it is thirty feet as it narrows to the east, which does not meet Town standards for a city road

development. Actually it narrows to twenty feet, the easement is thirty. They could not meet Town
standards, so what they are doing to make this community connection is providing an in adequate
conduit.
Perkins stated he was thinking of their development capacity getting of there and going to the east.
That is where the benefit is. The intersection at Avon Road and Hurd Lane is an increasingly difficult
intersection. The traffic is backing up from the light at Highway 6, sometimes all the way past the left
hand turn to come into your property. Donaldson stated that they still need information from Jeff
Spanel regarding their own impacts of traffic. They just don't have that information yet. Perkins
stated that the backup of traffic was one of the concerns when the Commission denied the filling
station. Perkins stated that the point he is making is that it would be beneficial if every effort can be
pursued to make that connection as soon as possible.
Buz Reynold:; asked about the drainage from the site in relation to the river. Are they going to have
some kind of filtering system? Spanel stated that they are in the process of preparing a new master
drainage plan for the Town and some of those standards may include a filtering system. There will be
some pollution control. Their research is indicating that sedimentation is more effective.
Reynolds stated that he does not see any kind of playground. He would like to see some kind of
recreational area incorporated in this project. Donaldson stated that they probably have in their
development plan, by default, on of the best recreational amenities in Colorado, and that is the Eagle
River. Reynolds stated that in the springtime, his nine year old is not allowed to play there.
Donaldson stated that they have discussed this with three of the largest brokerages in town and the
construction and operation of freestanding amenities buildings and recreational facilities is very
unpopular these days, because of maintenance, liability and on-going costs. He stated that he is not
trying to deflect the concern ',y saying that the realtors don't want it, so they are not going to design it.
What he would say is that they will go to great extremes to provide the river front connection.
Between buildings they will have bike paths, roadways, pedestrian ways through the site. Reynolds
stated he was not particularly speaking about a building. He wants something like a small picnic area
within the site. Donaldson stated that a controlled children's play area would certainly be in order.
He stated that when they come in ;md create proper drainage and create their green and open spaces
they will be more readily be able to identify the areas that can be used like that.
Jack Hunn asked if Hurd Lane would be constructed as part of the development and dedicated to the
Town or would it remain as a private road. Donaldson stated it would be constructed to Town
Standards and dedicated as a filly foot right-of-way to the Town. Hunn asked if they have flexibility

in the alignment of the road as it crosses this parcel Donaldson stated to the degree that they have a
defined entrance and exit point at either end they have some flexibility. They have intentionally placed
the interior townhome buildings in such a fashion that they a:e not meeting you square on as you enter
the site, you do not have the opportunity, when you come on to the site, to look down this 1500 foot
stretch of road.
Hunn stated that he thinks the site is laid out very well and strategically to segregate the different
product mix and preserve certain views, but the straight line of these three groups of buildings doesn't
have a lot of interest. T'iis concerns him just for the visual image. Donaldson stated that the challenge
moves up to architecture. They have very limited ability to really offset the buildings. They can have
indentations from unit to unit. They can pronounce the stairwell areas, etc. They have not given up
on that. One of the pluses is that for emergency vehicles and buses that is probably a safer road
design. they will try to find ways to get some offset or shift, etc. Hunn stated that one of his
tendencies would be to flip one building and bring the parking on road and that is detrimental to both
the building and streetscape image. He suggested sacrificing maybe one unit in favor of a pretty
intense planting pocket, that might help to create some relief. Donaldson stated that some of the
restraints they are working with are the cross street intersections being designed to Town standards
and that includes line of site. Donaldson stated that maybe one way it can be done is to keep the
roadway, but undulate the sidewalks, etc.
Rhoda Schneiderman stated that she is also concerned about the straight line image, but she is more
concerned about the way it looks from the highways and from Beaver Creek. She thinks what will be
seen from I-70 is a close proximity to Eaglebend Apartments, which she feels is a big mistake as far as
it looks from the highway. She !hinks it will be very visible from Beaver Creek . Donaldson stated
that the westerly third is about all that is really visible from Beaver Creek. Schneiderman stated that
they have left no room for any landscaping on the back side, it is basically all asphalt.
Chairman Perkins stated that they should finish with Jack Hunn's comments and he suggested that the
Commission not get too fixated on one point, since this is not even a full application.
Donaldson stated that they are working with the railroad, as far as being abit to work within their
right-of-way. They want to try to use some of their space as well, because it gives them the ability to
have undulating berms and larger berms. The berms will knock out some of the railroad noise. Also,
this site has more protection than Eaglebend, with the Slifer building, Wal-Mart building, etc.
Jack Hunn suggested that they should be very sensitive to site lighting strategy. Also, he stated that he
would hope that there is some flexibility in the number of units in order to deal with some of the issues

that may come up during the review process. Donaldson stated that they want 190 units, but they will
work with it. Donaldson asked Hunn how the density, in general, strikes him. Hunn stated that 20
units per acre doesn't seem too much.
Patti Dixon stated that she likes the effect of the sidewalk and the tree line next to Hurd Lane. Unit
identification will be very important. Dixon had some concerns regarding the small parking lot.
Donaldson stated that this parking area is for off-site users can nark and get down to the river and also
as an overflow parking for condominiums, eta. She stated that they could be more creative with it.
Henry Vest stated that jogging the sidewalks were a good idea. Will they do that with the buildings?
Donaldson stated they have very little ability to shift the buildings. What they can do is provide minor
architectural offsets. There are no garages, car ports or parking facing Hurd Lane. Vest had some
concerns with the balconies on the interior townhomes. Donaldson stated that taey are reversing the
units on the interior townhomes. They want everyone focusing south toward the river.
Rhoda Schneiderman asked if they have delineated all areas that they consider can be landscaped.
Donaldson stated that what is shown on these plans is not the complete landscaping. Everything that
is available, thirty-three percent of the buildable area, will be landscaped.
Schneiderman stated that she does not think that they will have enough parking for the apartments.
The two and three bedrooms will probably mean four to five cars per apartment. She ask --d if they are
going to prohibit un -related people living in a household. The applicant stated that they feel that they
have provided enough excess parking. Jeff Spanel stated that Eaglebend is more than half two and
three bedroom apartments, and they have just less than two parking spaces per unit as the overall ratio
and the outside management has limited the number cars per apartment to a maximum of two.
Schneiderman stated that she would like to scc as much staggering as they can come up with. Other
than that, she thinks it will be a great project.
Reynolds stated that he sees a situation where a traffic light might have to go in at Hurd Lane. Jeff
Spanel stated that would be up to the State Highway Department. There is sufficient need for a traffic
light at Benchmark Road and Avon Road, but even that is not in the 5 year plan at this time.
John Perkins stated that he agrees with all the comments made by the rest of the Board about the
linear nature of the rental product on the back. His favorite part of the plan is the lower eastern
portion where there is a substantial offset at the end of the second building. He suggested that they
see if they cannot use that treatment to some extent on the west end.

He pointed out on the plans what he was suggesting. Donaldson stated that they would work on some
of the suggestions.
Perkins stated that those are the Commission comments for the applicant to consider.
Lot 25, Block 2. Benchmark at Beaver Creek Subdivision, Christie Lodge Satellite Dish Location
Final Design Review
Chairman Perkins stepped down due to a conflict of interest. Vice Chairman Hunn presided.
Mary Holden stated that Christie Lodge is requesting approval of a three foot diameter satellite dish to
be placed on top of the east porte cochere. They received approval back in November to place a six
foot diameter dish on the north side of the property facing the highway. This is not feasible and will
not be used. There is a facade on the east porte cochere that will pretty well screen this. Staff
recommends approval with the condition that the dish be screened from the right-of-way.
Phyllis Lilischkies, operations manager of the Christie Lodge, stated that the other dish will not
operate from the location it was approved for. She stated that this proposed dish is just under four
feet and the mount is one foot. It is a solid dish that is white in color. All wiring and cable will go
down through the porte cochere. The porte cochere is hollow and the dish will sit down in back,
ahaost up against the building at she farthest back corner of the porte cochere. She provided pictures
showing, by way of black tape, how far above the porte cochere the dish would show, approximately
twelve inches.
The Commission suggested that the dish be painted to match the building. Ms. Lilischkies stated that
this part:cular dish cannot be painted due to it being a sending and receiving dish.
Buz Reynolds moved to approve the location for the satellite dish, with the recommendation that the
dish be painted to match the building if at all possible.
Patti Dixon seconded and the motion carried unanimously.

Mary Holden stated that the applicants could not make it to the meeting.
Steve Amsbaugh stated that Reynolds could sit in the audience and take notes for the applicant, but he
cannot represent them.
Rhoda Schneiderman moved to table this item.
Jack Hunn seconded and the motion carried unanimously.
Other Business
Patti Dixon stated that she has noticed a metal storage building in Avon. She did not think that they
were allowed. Wry Holden asked if it was the one on West Beaver Creek Blvd., which she had just
noticed. Dixon said it was. Steve Amsbaugh stated that Staff would look into it.
Dixon stated that the Slifer Building was supposed to take care of those metal ducts on the exterior
and it has not been done. Steve Amsbaugh stated that he had gone by there today and they look like
they have been painted. He will double check it.
