PLANNING AND ZONING COMMISSION MEETING MINUTES
• October 5, 1993
Tahe regular meeting of the Planning and Zoning Commission was held on October 5, 1993, at 7:30
P.M. in the Town Council Chambers, Avon Town Municipal Building, 400 Benchmark Road, Avon,

All members were present except Jack Hunn and Buz Reynolds. Jack Hunn arrived at 7:33 and Buz
Reynolds arrived at 7:37.

Mary Holden stated that this was a submittal of the conditions of approval, which includes lighting,
roofing material, siding material and a roof over the trash enclosure. Michael Thompson, representing
the applicant, will make the presentation.
Michael Thompson stated that they were going to put a little shed roof on the trash enclosure. He
pointed out on the plans where this would be located. He stated that they had changed all their
drawings to show the tongue and groove cedar siding, which was specifically requested at the last
meeting this project was discussed. He provided samples of the siding. They also provided a sample
of the board and batten so the Commission could see the difference. They also provided block
samples. Rhoda Schneiderman asked if the applicant would put doors on the trash enclosure, since it
faced the street. The applicant agreed. Thompson stated that the siding will be on the mansard that

wraps around the service bays, as well as on the employee apartment. Thompson stated that they feel
that the board and batten would give more shadow lines. Jack Hurn stated that his fear with this
product is that you have an eight & -it sheet of plywood and you are putting battens on the height of
the seams, and when you get into a condition where you have a horizontal seam it cannot be hidden,
so you will read it as a plywood product. Discussion followed on how this product is applied.
Discussion followed on the roofing material to be used. The applicant provided a sample of the
product to be used. It is a textured material. The color will be an Estate Gray. It is an Oakridge 11,
heavy duty product. He was not sure of the exact weight per square.
Mr. Thompson then showed a sample of the color to be used on the man doors. The lighter color will
be used on the overhead doors.
Mr. Thompson provided sets of drawings for the Commission to refer to for the lighting. He stated
that there will be two lights up front and one more at the rear. He then provided cut sheets for the
lights to be used. Discussion followed on the various types of exterior lights and as examples, Mr.
Thompson mentioned the lights used around the Town. The lights will be about 4 feet tall and will be
providing fight ontr the landscaping, as well as a sign. There will be lights in the soffit around the
building. He provided a cut sheet for these lights. The lights will be recessed. Discussion followed on
the wattage to be used. Thompson stated that if they cut down on wattage they might want to add
one snore in the other corner.
Jack Hunn moved to grant approval to the T & G siding as presented, approve the lighting plan as
presented with the following conditions:
1. The type of lamp be high pressure sodium in all exterior fixtures.
2. The type C fixtures attached to the building have no more than 50 watts.and the type K
fixtures, bollard fixtures, have a 70 watt maximum.
3. Some type of wood clad door be applied to the trash enclosure.
Rhoda Schneiderman seconded and the motion carried unanimously.
Lot 98, Block 1. Wildridge Subdivision Sterling Duplex Design Revisions. Design Review
Mary Holden stated that Sam Sterling is requesting various changes to the elevations. She stated that
she has included in the packet the original elevations and also the elevations for the proposed changes.

e stated that on the west elevation a window will be changed from a window with a twin pane to a
single pane glass. On the east elevation both decks have been shifted and extended. On the south
elevation there were a couple window changes from a twin pane to a single pane. A window was
increased in size. Windows changed to doors under the deck and on the second level. Holden stated
that the main concern with this application deals with the various window styles and the elimination of
the mullions on several windows. She stated that the guidelines state that mullions add character and
are encouraged. She stated that the Staff recommends approval with the condition that all revised
windows retain the previously approved trim and mullion detail.
Sam Sterling stated that these are owner requested changes, with respect to extending the decks so
that they go all the way to the master bedroom. That window is changed to a door, and also,
underneath that deck there was a window that is also changed to a sliding glass door to access the
basement directly to the outside. Sterling stated that in addition to these changes, the owner has also
requested an additional change, and that is that she wants the garage to be an art studio and he stated
that he has come to an agreement whereby they would frame in two separate two separate single
garage door openings and then install sliding glass doors that could be removed later upon resale and
the walls tom out and separate single garage doors be later installed. Also, she has requested a color
change on the stucco. The approved color was an Omega Chenille, and the requested color change is
to a LaHabra Dove Gray.
Sterling stated that due to the small size of the proposed windows, the owner requested the mullions
be removed. The other window that has been enlarged and the mullion has been removed is a stairwell
window and the owner wanted the way it is shown.
John Perkins asked which garage door is being discussed. Sterling stated it is the east elevation garage
door. Schneiderman asked if it was shown on the elevations. Sterling stated it was not. Mary Holden
stated that these are changes that Staff has not reviewed. Sterling described how the glass doors
would be installed.
Patti Dixon asked what the existing trim color is. Sterling stated that it is an Olympic 707 Cedartone.
Sue Railton asked where they would park if they did away with the garage. Sterling stated that it
would be underneath the deck that is over that portion of the driveway. Schneiderman asked if it
would be perpendicular to the building or parallel. Sterling stated it would be perpendicular.
Schneiderman stated that this means the cars will be sticking out from the deck.

Jack Hunn stated that he is concerned with losing a garage, because what ,you will see is two cars
parked in front of this duplex forever and if they have a third car like a lot of people do, then you have
three, and all the stuff and such that usually goes in a garage doesn't go in the garage anymore. It
invites clutter outside the building. He feels that this request would be detrimental to the other person
who is going to buy the other half of the duplex as well as any neighbors in the area. Hunn asked if
the requirements state if the parking has to be covered. Holden replied that 2 parking spaces were
required up to 2500 square feet and if over 2500 square feet 3 are required.
Hunn stated that he was also concerned with the color change and the fact that they are going from a
warm palette to a cold color without changing the trim and roof color. Sterling stated that he thinks it
would look sharp. Hunn stated that he has a hard time visualizing it. Maybe if all the samples had
been provided he could respond to it.
Hunn stated that, with regard to the window changes, some of the make sense and some of them look
a little out of place on the building. One thing he is concerned about is deleting the roof over the
entrance to this unit. He asked if there will be a waterproof deck over the entrance, or will there be
water dripping through to the entrance? Sterling stated that there will not be a waterproof deck. He
stated that this is not a huge concern in the summer time. Hunn's concern was in the winter. Sterling
stated that they could certainly waterproof an area over the entrance, for about 3 Or 4 feet to provide a
drip free standing zone, or walk zone.
Henry Vest was concerned with the water dripping through and turning to ice in front of the door. He
stated that he feels it should be waterproofed in that area. He also stated that he had no problems with
the window changes.
Sue Railton stated that she has experienced the same situation which was a big problem. She feels that
the applicant has to really look into this matter. She thinks that if they are going to turn the garage
into a studio, there has to be provisions for storage, lawn mowers, etc. They can't be outside under
the deck. A section of the garage should be made into a store room.
Rhoda Schneiderman stated that she does not agree with not having a garage. If there is not going to
be a garage, the applicant should revise the site plan and find alternative parking. It will be an
unattractive solution to have these two cars parked perpendicular to the building with half sticking out
from under the deck. She also thinks that the roof color would no longer be appropriate, with the
dove gray. It would be a much too stark of contrast, as well as totally diverse color fields. She stated
that she does not have a problem with the windows.

Buz Reynolds stated that he does not have a problem with the windows, but he does with the east
elevation of bringing the deck over. He feels that there wil be an ice problem there. Regarding the
garage, Reynolds asked if there was any way that they can :lave at least a single car garage and a door
off the side. He feels that covered parking is very important. Even if they didn't use it for parking the
car, there would be a place for storage. Sterling stated that anything is possible. He is dealing with an
owner that wants these changes and he either has to tell her "no, I'm not going to do any of them,
except for the windows" or what he can do. Sterling stated that he is sure that the Commission is
aware of the problems of an already approved project and the preselling of that project. It is kind of
like being between a rock and a hard place, whether they go ahead and complete the deal or back out
of the deal.
John Perkins asked if there is a possibility of doing a single garage door on the south elevation? After
checking the site plan it was apparent that this would not work. Sterling stated that it might be that
they could put in the single car garage and only one 6 foot sliding door.
Mary Holden stated that this is the first that she has heard about an art studio in the garage. If it is to
be a home occupation it requires a Special Review Use, which is approval from the Commission.
Part of the criteria for the approval is that it does not alter the exterior of the property or effect the
residential character of the neighborhood. She stated that she has not been able to see elevations and
she does not know how the Commission would feel about approving this without finding out if this is
a home occupation.
Chairman Perkins stated that he thinks that the Commission should not act on the doors tonight, and if
the applicant wants to pursue that further, they can work with Staff, since Staff has not see it and there
is no documentation for it.
Chairman Perkins stated that the Commission will act on the window changes, color change, and deck
change only.
Jack Hunn stated he would like to go through these elevations and make some suggestions. He stated
that on the west elevation, proposed, there is one very small window still subdivided on the right hand
side that is really out of character with the other two and his recommendation is to make that one
piece of glass so it starts to work with the other larger pieces, or just make it bigger. The other
Commissioners agreed He stated that personally, he would prefer the new taller window, subdivided
once. The other Commissioners did not agree. Hunn stated that the deck is no longer centered under
the dormer. It is connected to the bedroom wing and eliminating the roof. His concern is that right

now there is a very sloppy entrance. Aesthetically, he thinks it looks fine, but it is a water
management challenge. On the proposed south elevation there are two windows that are split by the
post supporting the deck and previously they were contained under the deck. When they were
contained under the deck they were stacking with other windows above them and they had a nice
relationship and now that they are interrupted by this column it looks awkward in pure elevation. He
would prefer those get back under the deck. His concern about the sliders into what is described as a
basement space, begins to look like the entry door. Also, a certain amount of security is given up. He
sees this as a strange location for a slider, right next to the entry. He would prefer to see those remain
windows and be grouped as they were originally proposed. Discussion followed on the windows not
being well organized. Discussion followed on the dormer and arch window being centered and it used
to stack on a window below and had a pretty strong relationship and now it has no relationship.
Rhoda Schneiderman asked why, on the south elevation, did he increase the width of the windows on
the second story with the arch over it and not meet the arch. Sterling stated that they changed that to
a sliding glass door and you can't get a window arch because you are going up beyond the truss
bearing point.
Rhoda Schneiderman asked if the Commission thinks the redwood roof would look good with the
dove gray. The general consensus was that it would be difficult to make a color change when you just
bring in one color. He stated that he thinks the applicant was remiss in not bringing in all the colors.
Rhoda Schneiderman moved to approve the following changes to Lot 98, Block 1, Wildridge:
1. The window changes as submitted.
2. The deck changes as submitted.
3. The applicant be required to bring back at a future date, for approval, all three
proposed color samples, roof, trim and body, and revised plans for the art studio
and a strong recommendation that at least one garage space, indcMi s, be submitted
with those changes.
Chairman Perkins stated that the motion is for approval for all of the window changes as submitted,
for approval of the deck changes as submitted, and the motion does not include approval for colors.
the colors need to be resubmitted in their entirety, and attached to this, but he doesn't think it needs to
be part of this motion, is that the applicant needs to return with any other changes, through the Staff,
relating to garage changes.

Chairman Perkins called for a second. Henry Vest stated that he would second, but some of the things
discussed were not included in the motion. The matter of the west elevation. Rhoda Schneiderman
stated that she would like to revise her motion to include that on the proposed west elevation that the
kitchen window be a single pane window. Discussion followed on what other changes were to be
made on the doors and windows. Schneiderman stated that her motion is just to include that the patio
door on the south elevation will be a single patio door. The Commission members did not agree with
this aspect. Rhoda Schneiderman stated that she did not know why there were no plans for all this.
Chairman Perkins stated that the motion is amended for approval of all the windows as submitted,
with the exception that the small kitchen window on the north elevation would become one single
pane window.
Sue Railton seconded.
Sam Sterling stated that this would mean it would be non-operable in the kitchen. Perkins stated that
it could be a single casement. Sterling stated that there isn't a single casement in this line of windows.
Sterling stated that he could go with Jack's suggestion of increasing the size of the window and keep it
with the mullion. Perkins suggested making it the same as either one of the windows on either side of
it. Sterling agreed. Perkins asked if Rhoda would amend her motion to allow the kitchen window to
be the same as the mid-sized double casement window. Schneiderman replied absolutely.
Railton seconded the amendment.
Perkins called for a vote. The motion failed with a four to three vote.
Jack Hunn moved to approve the window changes on the west elevation, with the stipulation that the
kitchen window becomes a medium sized double casement. Approve the deck changes on the east
elevation with the obligation of the builder/developer to solve the waterproofing challenge over the
entry door, and that the proposed window changes on the south elevation be denied, specifically the
sliding glass door, the larger window out of alignment with the window above and the wider window
with a lesser radius arch over the top. These need to be restudied and brought back at a later date.
Perkins reviewed the motion as follows:
1. The west elevation, including a mid sized double casement kitchen window is approved.
2. The deck changes would be approved with the obligation that the developer come up with a
waterproofing solution over the entry way.
3. The south elevation window changes are denied., not included in this motion.

Buz Reynolds seconded and the motion carred unanimously.
Lot 4. Block 1, Wildridge Subdivision, Ridgeline Condos site Plan Modifications Design Review
Mary Holden stated that this is a landscaping plan modification. Basically, the applicant would like to
take all the sod area out and have it replaced with native grass seed. She stated that their only concern
with this application is that in this area there are sodded lawns and they recommend approval with the
condition that there be sodded yard area in the backs of the building.
Richard Wahl stated that he did not understand what Mary Holden was asking. She replied that she is
asking that a condition that some sodded area be kept in the rear. Wahl stated that the main reason
they want to go to seeded is the water usage. You can use about half the amount of water on the
native grass as compared to the sod. Everything is sprinkled. They would like to have one continuous
type of grass.
Buz Reynolds stated that he likes the plan the way it is. He prefers the sod.
Jack Hunn stated that for these units, the sodded area is appropriate.
Patti Dixon agreed.
Henry Vest asked if he was talking about the grass that looks the same as sod. Wahl stated that he
was. Vest stated that he didn't really have a problem with this request.
Rhoda Schneiderman asked if this would be mowed like a regular lawn. Wahl stated yes. She stated
that she had no problem.
Sue Railton stated that she did not either if that is what it is, but on the application it is talking about
native grasses. Wahl stated that he is not talking about wild grass. It is a combination of seed that
ends up looking like a lawn.
Schneiderman stated that they need to know what type of seed will be used.
Hunn stated that, in the Planning and Zoning Rules and Regs, page 11 states that all lots to be covered
with grass lawn shall utilize sod material for complete coverage. Hunn stated that there are some
seeded lawns up there that have come along over several years with an awful lot of work, but there are
a lot of them that have failed.

John Perkins stated that he thinks he could support this if it were a single family owner who was going
to be there working at it, but he tends to side with the sod, because it is a multi -family project.
Richard Wahl stated that he feels the Board is making a mistake. One of the problems to be
considered is water consumption. That is the biggest problem this whole state has.
Hunn stated that there are sod mixes that are more inclined to use less water. He feels the seed would
take just as much water. Reynolds stated that there is a company in Grand Junction that sells sod in
the type of grass the applicant is looking for.
Jack Hun moved for denial of the request for modification to the site plan.
Patti Dixon seconded. The motion carried with Sue Railton and Henry Vest voting nay.
Buz Reynolds asked if he finds the sod that has the grass mixes that he wants, can he use it. The
Commission agreed that he could.
Other Business
Mark Donaldson stated that he wanted to talk about the roofing for the Peregrine building. The metal
roofing idea does not work on the roofs. They are back to the black, the fully adhered flat black
membrane roofing over the larger areas. the are attempting to come up with some colored metal
roofing touches on some of the smaller towers. There are a lot of colors being considered. He stated
that the project has been cleaned inside and out, broken windows are being replaced, etc. He asked if
the commission had any comments.
Buz Reynolds stated that he had two names for the building; one was the Coliseum and the other was
the American Eagle. Rhoda Schneiderman suggested the Stratford in Avon.
John Perkins stated that he understands the applicant is saying that the black roof is what they need to
do. and that they have not found any type of membrane type roof in any color. Donaldson stated no
they have been ruled out for one reason or another. They will be coming back with different cap
flashing. So they can start setting off the roof color with different colors. One idea they have been
toying with is the addition of a series of skylights along those loft units, so that might add to a little bit
to the roof design. The chimney masses will all be painted out, the fireplaces will be converted to gas.

Donaldson stated that they are trying to bring some discipline to the use of the horizontal and the
vertical masses with color. It is difficult. More importantly, in advance of it actually happening, they
are trying to develop a retail theme. they are starting with 60,000 feet of office space and that is not
going to have a lot of glamour and a lot of life and color and colorful signs, so on the north side they
are starting to develop a retail theme.
Discussion followed on the P R for the building.

Since the applicant was not present it was decided to table this item.
Patti Dixon so moved, Henry Vest seconded and the motion carried unanimously.

Commission meeting.
