PZC Minutes 081793O%OPN ^k'") RECORD OF PROCEEDINGS PLANNING AND ZONING COMMISSION MEETING MINUTES August 17, 1993 The regular meeting of the Planning and Zoning Commission was held on August 17, 1993, at 7:40 P.M. in the Town Council Chambers, Avon Town Municipal Building, 400 Benchmark Road, Avon, Colorado. The meeting was called to order by Chairman John Perkins. Members Present: John Perkins, Jack Hurn, Patti Dixon, Sue Railton, Henry Vest Rhoda Schneiderman Staff Present: Steve Amsbaugh, Director of Community Development All members were present except Buz Reynolds. Lot 46A/46B. BloLk 1, Wildridge Subdivision. Setback Variance. Public Hearing Steve Amsbaugh stated that he has provided a compilation of a research of the files and the information provided by Rick Pylman. The existing Lot 46, Block 1, Wildridge Subdivision was platted into a duplex subdivision about three years ago. In order to do the duplex subdivision two building footprint lots were created, Lots 46A and 46B. Also created was a common tract which is common to both parties. The homes were then constructed on those two building envelopes and it was later discovered that the roof overhang for those buildings extended over the building envelope line. Therefore the applicants are in for a request to extend and expand the building er velope to include the entire building as built. There is also a third request and that is that on 46B a deck and hot tub addition has been constructed and that deck happens to extend a few inches into the rear yard setback of ten feet. To clean this up the applicant is requesting a side yard variance of one foot and a rear yard variance of one foot. The homes are on a steeply sloping site that slopes from the street up to the rear property fine. The deck itself is trapped between the house and the upper slope of the rear property line. (cont) from adjacent properties because it is below grade. There are no homes on the adjoining properties at this time. Nick Bellino, occupant of 46B, stated that the encroachments were discovered when a survey of the properties was done. Chairman Perkins opened the public hearing and asked if there were any comments from the audience. with no input from the public, Chairman Perkins then closed the public hearing and asked for comments from the Commission. Jack Hunn asked how close the homes were tc each other. The applicant stated that they were about eight to ten feet apart. Hunn asked if there were any building code concerns with the buildings being that close. Steve Amsbaugh stated that the files he researched did not indicate any concerns. The Commission had no other concerns regarding this request. Henry Vest moved to grant approval for the side yard setback and rear yard setback variance request for Lot 46A/46B, Block 1, Wildridge Subdivision, citing the following findings: A. That the granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same district; B. That the granting of the variance will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity; C. That the variance is warranted for the following reason: 1. The strict, literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of this title. Sue Railton seconded and the motion carried unanimously. Lot 88, Block 4. Wildridge Subdivision. Monroe Residence, Final Design Review Steve Amsbaugh stated that the applicant has submitted a final design review request for a rooftop addition. The rooftop addition is proposed to go where the existing rooftop stairwell is as well as occupy the same space that the rooftop deck now occupies. The Commission members had no problems with the proposed addition. Jack Hunn moved to grant final design approval to Lot 88, Block 4, Wildridge Subdivision, the Monroe Residence addition. Henry Vest seconded and the motion carried unanimously. Lot 69, Block 3. Wildridge Subdivision, Brethauer Residence, Final Design Review. Submittal of Requested Information Steve Amsbaugh stated that, at the last meeting, the Commission requested the applicant come back with more detail on the retaining wall at the rear of the house. The applicant has a solution that they would like to present and included in it is more detail to the landscaping plan in relationship to the rear wall. Ron Brethauer provided a copy of the plans, laying them out before the Commission members in front of the microphones. The discussions that followed regarding the landscaping are not clear due to too much noise. Jack Hunn asked if there would be an automatic irrigating system. It sounds like the response was yes. Also discussed was the stepping of the wall, but this is not clear either, due to several people speaking at the same time and the noise of the plans being rattled. Discussion followed on the Town requirements for structural engineering on a wall such as this. Steve Amsbaugh stated that if the Town Engineer felt, at time of plan review, that this wall was unstable he would require engineered plans. Rhoda Schneiderman moved to grant approval to Lot 69, Block 3, Wildridge, Brethauer single family residence, final design review with the recommendation that if the retaining walls reach a height that the Town has to require structural engineering on it, that they do so. Patti Dixon seconded and the motion carried unanimously. INI-) PLANNING AND ZONING CONMSSION MEETING NUNUTES August 17,1993 Page 4 Lot 32, Block 1, Benchmark at Beaver Creek Subdivision, Beck Commercial Building, Conceptual Design Review Steve Amsbaugh stated that because this is a conceptual design review request, he would like the applicant to present the project. He stated that the site is adjacent to an existing building and the applicant proposes to duplicate that building in terms of facade, color and basic building shape. The new building would replace existing parking that is on the property at this time for the adjacent building. A concern Staff word have is that the applicant, at least by final design review, prove that there will be adequate par king for both buildings. Dave Peel, representing Andy Beck, stated that in 1985 and 86 Mr. Phillip Barshop developed the project on Lot 33. Mr. Peel moved away from the microphone and his statement is not clear, but it sounds like he stated that he also purchased lot 32. The original building is about 8,000 square feet, with the required 13 parking spaces and two loading spaces. In 1987 Mr. Barshop had a tenant, Vail Discount Tires and the additional parking lot of 37 spaces was developed. The building proposed now matches the other one in detail is half the size of the other one. It is 4000 square feet. It requires 4 pasking spaces for its 2800 square feet of warehouse, 4 parking spaces for its 1200 square feet of office, and 2 parking spaces for its 1200 square feet of storage which is above the office area, for a total of 10 spaces required on this piece of property leaving the front of the property alone. They will revise some parking spaces and will have 19 spaces on Lot 32 instead of the required 10 spaces. There will be a reduction in asphalt, all the drainage will work the same. They will add one more trash dumpster, which will match the existing one. They would like to relocate the existing trees that are now pretty mature. Discussion followed on where these trees could be moved. Discussion followed on the retainage wall at the back of the property. The Commission felt that this was a good p. oject, but asked that Mr. Peel pass on to the owner that the west wall of the existing building should be kept cleaner since this is a very visible corner. Steve Amsbaugh stated that the applicant should also include the sign program for both buildings at the time of final design review. The applicant stated that the sign program would be the same as the program approved for the existing building. Discussion followed on the signs. Commission Meeting Minutes of August 3, 1993 Rhoda Schneiderman moved to approve the minutes of the August 3, 1993 meeting. Patti Dixon seconded and the motion carried unanimously. Other Business Jack Hunn stated that Lot 29, Block 1, Wildridge is a duplex that is nearing completion and from what he has observed, the final grading does not match the approved plans. They have a lot of extra dirt and he was concerned that it is causing problems on the adjacent properties. Rhoda Schneiderman slated that there are several projects that have TCO's and have gone for over a year without putting their drives and landscaping, etc., and these need to be checked ont. Steve Amsbaugh stated he is working on some of these at this time and will be working on some others in the near future. John Perkins stated that he would like to discuss the site visits. He is concerned with the attendance at the site visits and maybe they ought to be discontinued. The majority felt that they were important. Chairman Perkins suggested the members make an effort to attend them. Jack Hunn moved to adjourn, Patti Dixon seconded. The meeting adjourned at 8:30 P.M.
