PZC Minutes 010389RECORD OF PROCEEDINGS MINUTES OF PLANNING AND ZONING MEETING JANUARY 3, 1989 The regular meeting of the Planning and Zoning Commission was held on January 3, 1989, at 7:30 PM in the Town Council Chambers of the Town of Avon Municipal Complex, 400 Benchmark Road, Avon, Colorado. The meeting was called to order by Chairwoman Pat Cuny. Members Present: Frank Doll, Pat Cuny, Denise Hill, John Perkins, Buz Reynolds, Clayton McRory, Tom Landauer Staff Present: Lynn Fritzlen, Department of Community Development; Charlette Pascuzzi, Recording Secretary; Buz Reynolds asked Lynn Fritzlen about her memo regarding the Holy Cross Electric request to amend a previously approved Special Review Use for the installation of an uograded distribution line to replace an existing one initiating from Lot 10, Block 1, Benchmark at Beaver Creek. Fritzlen stated that the amendment would allow the line to be located further north than the previously approved route. She described the two routes on the i.sp provided. Concern was voiced regarding being able to see more of the line. Fritzlen stated that the same conditions would apply regarding relandscaping the area that will be effected. Cuny asked if they were going to come in with this request. Fritzlen stated that Staff would like to approve it as an amendment. The same poles, same conditions and samz requirements would stand, it is just a relocation. Discussion followed on the asthetics of the project. Fritzlen stated that the construction would not begin until 1990 and that the Forest Service had approved the relocation. The Commission directed the Staff to handle the amendment to the Special Review Use. Temporary_ Parking for Vail Associates Employees Fritzlen stated that Jim Funk, on behalf of Vail Associates, Inc., has applied for approval to allow temporary parking for employees of Vail Associates in anticipation of the World Championships on Lot 61, Block 2, Benchmark at Beaver Creek. The Lot consists of 1.06 acres and is zoned Town Center. She stated that the applicant has provided a letter of explanation and a lease signed by the owner allowing uhe use of the property for parking until April 15, 1989. She described the location of the lot in question on the map provided. Fritzlen stated that there are a number of concerns to be considered which have been used in the past for this type of application. She stated that if the Commission concurs with the application, Staff recommends the following conditions to an approval: 1. Length of approval be concurrent with length approved by property owner, which is April 15, 1989; 2. Adequate safeguards be provided to control the tracking of mud and fugitive dust from the site; and 3. Access to the site be installed in accordance with all applicable Rules and Regulations of the Town of Avon. Fritzlen stated that the access to the site was installed and has been inspected by Larry Brooks of the Public Works Department and he feels that it meets the Town of Avon regulations for a road cut permit. Discussion followed on the use of the Lodge at Avon lot also. Hill asked how many cars can be parked in this lot. Fritzlen stated that she would estimate about 100. Discussion followed on the safeguard of tracking mud etc. Reynolds stated that he thought they would take every effort to take care of the problem. Discussion followed on the dust problems with such lots. Concerns were voiced regarding the use of the lots in the summer by tot!rists once an access to the lot has been installed. It Was suggested that some sort of barrier should be installed at the end of the lease. Discussion followed on the guidelines provided. Reynolds moved to approve the request to use Lot 61, Block 2, as a parking lot, with the stipulation that excess debris and mud will be removed from the Town roads. This approval will be concurrent with the length of the Contract, to the 15th of April, 1989. Landauer seconded. The motion carried unanimously. Planning and Zoning Commission Meeting Minutes January 3, 1989 Page 3 of 5 Reading and Approval of the Planning and Zoning Minutes of the 12/20/88 Regular Meeting Doll moved to approve the minutes of the December 20, 1988 regular meeting as presented. Perkins seconded. The motion carried unanimously. Other Business Fritzlen stated that Pat Barron, of Otia Company had scheduled a worksession with the Council last week and they discussed the access situatio�j. The conclusion was that the Council would allow the Otis; Company to pursue design review without verifying the access. Similar to what the Commission's response was. Fritzlen stated that the State Highway Access Code does regulate the reconstruction and the use of any access off of a road that is under the Highway jurisdiction, which Avon Road still is. A change of use on a property, even though there may be an existing access, does require a new access permit and possibly upgrading the access. The Access Code is indiscriminate whether it is a private developer or a local jurisdiction, they require the application process. It is fairly involved and fairly costly. The applicant has asked that they not be burdened with this in order to pursue their projecc, but that they would continue to cooperate with the Town. Discussion followed on the possible amendment to the sign program for 51 Beaver Creek Place. Reynolds asked if there can be anything done regarding the foundation in Wildridge. Fritzlen stated that she had checked it again to see if it had caved in. She stated that Greg Kraft had met all the requested corrections asked for by the past building official. Reynolds stated that it is a public nuisance, an eyesore to the community and is an unusable foundation at this point. It will have to be done over. He would like to see it built on or taken down. Right now it is a dump site. Cuny asked if Fritzlen would see iF anything can be done to get the foundation removed. Cuny asked about any update on North American Van Lines. Fritzlen stated that they have corrected the pallet situation. The problem with the parking within the Planning and Zoning Commission Meeting Minutes Planning and Zoning January 3, 1989 Page 4 of 5 Commission Meeting Minutes right-of-way seems to have been worked out with the police department in terms of taking the cabs off the trailers and parking them in the parking lot. North American has also taken over the other portion of the warehouse, so that should relieve the pallet storage problem. Cuny asked about the parking of trailers �,the lower parking lot. Cuny asked about Wal-Mart buildirg their trash container. Fritzlen stated that she had written a lettEr to Bruce Wasco last week regarding this matter and asking him to come into compliance within thirty days. Further discussion followed on the recourse the Town might have regarding the abandoned foundation. It was suggested that Reynolds, as a homeowner in Wildridge, check the covenants for Wildridge regarding this tyoe of situation. Doll moved to adjourn. Perkins seconded.
