r The proposed project appears to comply with Section 17 (Zoning) of the Town of
Avon Municipal Code with the granting of a variance for encroachment into the
easterly sidelot setback at the March 8, 1984 Planning and Zoning Commission
meeting.
In accordance with Section 5.00 of the Design Review Board Procedures, Rules
and Regulations, "The Board shall consider the following items in reviewing
the design:"
a) The suitability of the improvement, including materials of which it
is to be constructed and the site upon which it is to be located;
b) The nature of adjacent and neighboring improvements;
c) The quality of the materials to be utilized in any proposed improve-
ment;
d) The visual appearance of any proposed improvement as viewed from any
adjacent or neighboring property;
e) The objective that no improvement will be so similar or dissimilar to
others in the vicinity that values, monetary or aesthetic, will be
impaired.
The following items should be given special consideration during the review:
Section 5.10 (g) (1) (c) materials shall be wooden shingles or shakes of
weather resistant qualities, built-up roofs with gravel or sod. Metal roofs
or other roofing materials may be submitted for consideration and possible
approval by the Board.

Variance Request - Sidelot Setback Requirement
• Lot 70-A, Block 1, Benchmark Subdivision
Lot 70-A, Block 1, Benchmark Subdivision is zoned RMD. Setback requirements
• for the RMD zone is 25 feet front, 7.5 feet side and 10 feet rear. This variance
request is for the elimination of the 7.5 foot sidelot setback reallirement from
the easterly lot line.
�`im Special Conditions Related to Request:
1. Easterly lot line borders Tract B which is zoned OLD;
2. The 50 foot wide area of Tract B, adjacent to the easterly line of Lot 70-A,
is designated as drainage and utility easement;
3. The easterly side of Lot 70-A does not contain the 7.F foot drainage and
utility easement as provided on most lots in the Town of Avon.
Prior to making its decision, the Commission shall consider the following factors:
17.36.040 Approval Criteria
Before acting on a variance application, the Planning and Zoning Commission
shall consider the following factors with respect to the requested variance:
A. The relationship of the requested variance to other existing or potential
uses and structures in the vicinity;
B. The degree to which relief from the strict or literal interpretation and
enforcements of specified regulation is necessary to achieve compatibility
and uniformity of treatment among sites in the vicinity, or to attain the
objectives of this title without grant of special privilege;
C. The effect of the requested variance on light and air, distribution of
population, transportation and traffic facilities, public facilities and
utilities, and public safety;
D. Such other factors and criteria as the Commission deems applicable to the
proposed variance. (Ord. 81-9 S1(d)).
Further:
17.36.050 Findings Required
The Planning and Zoning Commission "shall make the following written findings
before granting a variance:
A. That the granting of the variance will not constitute a grant of special
privilege inconsistent with the limita`ions on other properties classified
in the same district;

B. That the granting of the variance will not be detrimental to the public
health, safety, or welfare, or materially injurious to properties or improve-
ments in the vicinity;
C. That the variance is warranted for one or more of the following reasons:
1. The strict, literal interpretation and enforcement of the specified
regulation would result in practical difficilty or unnecessary physical
hardship inconsistent with the objectives of this title,
2. There are exceptional or extraordinary circumstances or conditions
applicable to the site of the variance that do not apply generally to
other properties in the same zone,
3. The strict or literal interpretation and enforcement of the specified
regulation would deprive the apriicant of privileges enjoyed by the
owners of other, properties in the same district. (Ord. 81-9 S1 (e)).
A motion granting or denying a vari-.nce should contain the specific criteria and
findings upon which the action is based.
The granting of a variance may be conditioned on action by tie applicant.
